A first approach to Siman 218, six seifim, and it is the siman of intention. After 216, which settled the reach of words in the language of the Torah, and 217, which settled it in the language of men, this one posits the third term: what the man who vowed meant. And seif 1 says it plainly — כל הנודר או נשבע רואין דברים שבגללן נשבע או נדר. He is not asked: one looks at what made him vow. These are rules למעשה: every real case goes to a Rav.

📑 Study plan

1. What is this siman about?
2. The seifim, one after another, clause by clause
3. The key concepts
4. Where these seifim come from: the Mishna, the Gemara, the Rambam, the Tur, the Beit Yosef
5. The commentaries, cited entry by entry
6. The table of seifim
7. Practical cases
8. Comprehension questions

1. What is this siman about?

Three consecutive simanim ask the same question and answer it with three different terms. 216 asked what the word conveys of itself — לשון תורה. 217 asked how people speak in a given place and time — לשון בני אדם. This one leaves words behind: it asks what that man meant.

And it asks in a way worth noticing. Seif 1 does not write that one questions the man about his intention: it writes that one looks at the things on account of which he vowed. Intention is therefore not a declaration collected after the fact — that would open the door to every retraction — but an inference drawn from visible circumstances. That is the sense of the decisive phrase:

The six seifim unfold this, and the siman has a counterweight: the Rama, already in seif 1, restricts the whole rule to a vow a man makes between himself and himself. Once a third party has a right in what was said, the language takes over again, barring a manifest presumption.

The siman in three blocks. Seif 1: the rule, its demonstration on wool, and the Rama’s boundary. Seifim 2 to 5: four applications — the wine already made, the refused marriage, the refused invitation, the borrowed cow. Seif 6: the passage from an individual vow to a communal undertaking.

2. The seifim, clause by clause

Here are the six seifim, each first in full — as the source gives it, source parentheses and the Rama’s glosses included — and then broken down clause by clause.

Seif 1 — the rule, and the wool that proves it

The siman opens with its rule and states it plainly: one looks at the things on account of which the man vowed. It then proves it on a case where the same word — צמר, wool — receives two opposite senses according to the discomfort that produced it. The Rama’s gloss comes at once to bound its reach.

How the intention of the one who vows is followed — and it contains six seifim
The heading, and it names exactly the third term of the series. Siman 216 settled the reach of words in לשון תורה; 217 in לשון בני אדם; this one passes from the words to the man.
Whoever vows or swears — one looks at the things on account of which he swore or vowed, and learns from them what he aimed at
The rule, and it is the Rambam’s almost word for word. Note what it does not say: one does not question the man about his intention, one looks at the circumstances. Intention is not a declaration but an inference.
and one follows the matter, not the meaning of the utterance
The strongest phrase in the siman, and it is a reversal: the word says one thing, the context another, and the context prevails. The Pit’hei Teshuva hangs on the word הענין, at ס״ק ב, two later responsa on the reach of an undertaking.
How so? He was carrying a load of wool or flax, he sweated, and his smell became offensive
The case is the mishna of נדרים נ״ה ע״ב, in Rabbi Yehuda’s name: הכל לפי הנודר. The detail is the whole spring of it: it was the carrying that pained him, not the garment.
and he swore or vowed that wool or flax should never come upon him
The formula is entirely general — שלא יעלה עליו, “let it not come upon him” — and it covers the garment as much as the load. That is precisely what the seif will refuse to follow.
he is permitted to wear woollen or linen garments and to cover himself with them
Here is the reversal at work: the formula covered the garment, and the garment remains permitted. Nothing in the pain that produced the vow bears on getting dressed.
and he is forbidden only to sling them over his back
להפשיל לאחוריו: to carry slung across the shoulder, porter-fashion. That act, and it alone, is what the man meant never to do again.
If he was wearing woollen garments and was pained by wearing them
The symmetrical case, and it is the one on which the whole apparatus converges. The Shakh opens his ס״ק א here, the Taz his ס״ק א, the Ba’er Hetev his ס״ק א — all three on the same clause.
and he swore or vowed that wool should never come upon him — he is forbidden to wear it and permitted to load it upon himself
Exactly the reverse of the first case, with the same formula. The Shakh specifies at ס״ק א the condition on which all depends: without the pain there is no הוכחה — no proof — and everything becomes forbidden again.
and he is permitted to cover himself with fleeces of wool
The raw fleece is not a garment: it is not included, though it is certainly wool. The distinction is therefore not of material but of form — and that is the decisive step toward the next seif.
for he aimed only at the woollen garment — and likewise in every similar case
The phrase וכן כל כיוצא בזה is what turns a particular case into a method. It is on it that the A’haronim will lean to treat the ship, the shared house, the making of wine.
Gloss: and all this holds only for one who vows between himself and himself
The boundary, and it is capital. The whole seif spoke only of a man alone with his word. The Taz explains at ס״ק ב why: it is there that one requires פיו ולבו שוין, that mouth and heart agree.
but for one who vows to his fellow — whatever the language of the vow encompasses, one follows it
The reversal of the reversal: once a third party has a right, it is the word that governs again, and intention ceases to be an argument. The Taz gives the underlying reason at ס״ק ב, from a responsum case of the Rivash.
unless there is a manifest presumption (so it appears from the Rivash and the Ramban)
אומדנא דמוכח: circumstantial evidence so strong it counts as a written clause. The Shakh at ס״ק ב reports a restriction from the Mabit — that it applies only in monetary matters — and writes ואין זה מוכרח.
Seif 1 in a word. One reads the vow from what provoked it, not from what it says: the same sentence forbids carrying to one pained by carrying, and wearing to one pained by wearing. But that reading holds only for a man alone with his word; the moment another has a right in it, the language takes over again.

Seif 2 — the wine already made: intention against the letter

A responsum case of the Rashbatz, and the most contested of the siman. A man was denounced for selling wine; he swears not to make any more for sale. But he already has some. The letter of his oath does not touch it — “making” does not include what is made. The seif forbids it all the same.

One against whom a charge was brought because he had sold wine to Ishmaelites
The word העלילו denotes a slanderous accusation, with the danger it carries. It is that danger which caused the oath, and from it intention will be inferred.
and because of this he swore that he would not make wine to sell
Two words carry the whole debate: יעשה, to make, and למכור, to sell. The Taz at ס״ק ג will say the first excludes what is already made; the Nekudot HaKesef will answer that the second shows it was the selling that troubled him.
and he had wine already made beforehand — it is forbidden for him to sell it
The ruling, and it runs against the letter. The Ba’er Hetev at ס״ק ג warns the reader in one line: the Taz disputes this ruling, and the Nekudot HaKesef refute the Taz.
Gloss: for although he said “that he would not make”, we follow his intention (Beit Yosef in the name of the Rashbatz)
The Rama states the reason and puts it as a principle: These are the three words the Taz will attack head on, and the Nekudot HaKesef will defend.
and all the more a community that made such an ordinance: they are forbidden to sell even what they had before
⚠️ The Rama’s כל שכן is the most disputed point in the siman. The Shakh devotes the siman’s longest note, ס״ק ג, to contesting it; the Taz at ס״ק ד arrives there by another road; the Ba’er Hetev at ס״ק ד records both.
(the Rav’s reasoning from the implication of the Rashbatz, and not like the Terumat HaDeshen siman 281)
The parenthesis is unusually candid: the Rama acknowledges that this is his reasoning, drawn from an implication, and that it runs against a named authority. The Shakh will start precisely there.
Seif 2 in a word. The Mehaber and the Rama rule that intention prevails even against the natural sense of the verb used. Two of the siman’s four A’haronim oppose this, and a third defends the seif. This is the siman’s open divergence.

Seif 3 — “let her never benefit from me”: the vow and marriage

Two situations in which a man fends off a marriage with a vow which, read literally, would ruin an entire life. The mishna at נדרים ס״ג ע״ב refuses so to read it: what he meant to fend off was the marriage, not benevolence.

They were pressing him to marry his sister’s daughter, and he said: קונם — let her never benefit from me
The verb מפצירין — they were pressing him — is what does everything: the vow is a parry thrown up under pressure, not a considered decision about this woman’s fate.
and likewise one who divorces his wife and says: קונם — let her never benefit from me
The second case is graver than the first, and permanently topical: a word spoken at the worst moment of a divorce. The mishna reads it as aimed at resuming the marriage.
these are permitted to benefit from him
Note the direction: they benefit from him. So it is he who remains free to give them — maintenance, help, support. The vow does not prevent him.
for he aimed only at marriage
לשום אישות: “for the sake of marriage”. The Tur adds, on the next seif, an observation that holds here too: he did not utter it — it is we who infer it from the circumstances.
Seif 3 in a word. A vow thrown out to refuse a marriage forbids only the marriage. It does not make the woman a stranger to whom nothing may be given — which is nevertheless exactly what the vow’s letter said.

Seif 4 — the refused invitation: one meal, and no more

The companion of seif 3, from the same mishna. A man insists that his fellow eat at his house, the other refuses and vows. The vow covers entering the house and even a sip of cold water; the seif reduces it to that meal.

He was pressing his fellow to eat at his house, and the other refused
The same verb מפציר as in seif 3 — and the same consequence: the vow is born of social awkwardness, not of a rupture.
and he said: קונם — your house, that I shall not enter, and a drop of cold water, that I shall not taste
The formula is extravagant, and deliberately so: it is made to end the discussion, not to be carried out. טיפת צונן — a drop of cold water — says plainly enough that this is the rhetoric of refusal.
he is permitted to enter his house and to drink cold water there
The Beit Yosef notes here a divergence the seif does not display: per the Rosh he would even be permitted to eat and drink, since he did not utter it; per the Tosefta and the Rambam eating and drinking remain forbidden — but for that meal only.
for he aimed only at not eating and drinking with him at this meal — and likewise in every similar case
The Shakh sums up the seif in five words at All the rest of the vow, though it was said, counts for nothing.
(one who vowed tzedaka or another vow on account of a sick person, and [the sick person] died — see below, siman 220)
A parenthesis in small type, doing no more than referring — but the reference is well chosen: it is exactly the same mechanism, a vow hanging on a circumstance that has vanished. The Shakh at ס״ק ה and the Ba’er Hetev at ס״ק ה merely repeat it.
Seif 4 in a word. A vow of refusal holds for what it refused, and not a step further. What was said in excess — the house, the cold water — was never meant, and so was never forbidden.

Seif 5 — the borrowed cow: intention is read from habit

The mishna of נדרים מ״ג ע״א. A man was refused a cow and swore never to plough with it. The seif does not ask what he was thinking: it asks whether he ploughs himself. The answer to that question of fact decides the vow’s reach.

He said to his fellow: lend me your cow. He replied: it is not free
The Beit Yosef explains the refusal: the cow is at work. And he adds what the mishna implies — the borrower took offence, and it is from that pique that the vow is born.
he said: קונם — that I shall never plough with it
⚠️ The mishna and the Rambam read here קונם שדי שאני חורש בה — “my field, that I plough with it”. The Shulchan Arukh omits שדי, and the Tur writes it differently again. The Beit Yosef expressly discusses these versions.
if it was his habit to plough his field himself, he is forbidden to plough with that cow
The criterion is factual: what is his habit? The Beit Yosef gives the reason — one who ploughs himself vowed אדעתא דנפשיה, with only himself in mind.
but others are permitted to plough for him with it
A decisive clause, and the Pit’hei Teshuva draws from it at ס״ק ה a striking consequence in the name of the Mayim Amukim: one who swore not to reveal his secret to Shimon may tell Levi, and Levi will tell Shimon.
and if it is not his habit to plough himself but sharecroppers plough for him — he and all men are forbidden
⚠️ The Beit Yosef notes that the Tur reads here the reverse — he permitted and others forbidden — and that this is the Rosh’s version; but the version of the books, the Rambam and the Ran is the seif’s, וכן עיקר.
Seif 5 in a word. Intention is not guessed but established: one who ploughs himself meant only himself, one who has others plough meant the cow’s service. The same vow therefore produces two prohibitions of different width according to the man’s manner of life.

Seif 6 — the communal ordinance, the authorities, and the word “dwell”

The siman closes in a different register: no longer one man’s vow but a community’s undertaking. Two questions arise — can an order from the civil power undo a הסכמה? and how is a word used by a community read?

A haskama of which the lord ordered part to be annulled
A הסכמה is the ordinance a community gives itself, held as a collective vow. The Shakh at ס״ק ו refers for the whole matter to siman 228, seif 15.
the haskama is not annulled because of his order
The answer is clean, and worth weighing: an outside power may prevent part of it from being carried out; it does not undo the undertaking. What remains, remains whole.
Gloss: a community that placed a ḥerem on someone that he not dwell among them, and who then wishes to sit there in a shop
The case is the Ramban’s, responsum 257, and the Beit Yosef reports it in full. The whole question turns on the word דירה: to dwell. The Ramban begins by showing that it has several senses.
one judges according to the matter concerning which they vowed against him
This is the rule of seif 1 applied to a collective vow, and the Rama uses the Mehaber’s own word: הענין. The principle therefore holds also when the one who vows is an assembly.
if they aimed only at a permanent dwelling with his wife and children, the shop is permitted
דירת קבע: settled residence, as opposed to a business presence. The Ba’er Hetev at ס״ק ו will leave this case for two others, both from the Knesset HaGedola, and both disquietingly topical.
and if not, everything is forbidden (Ramban, responsum 257)
The siman thus ends on an alternative left open: the word “dwell” has no fixed sense, only the intention of those who used it. It is the whole siman, folded into one line.
Seif 6 in a word. A haskama does not fall because a power forbids part of it. And the reach of a communal ḥerem is read like that of an individual vow: by the matter that gave rise to it, not by the general sense of the words used.

3. The key concepts of this siman

כוונת הנודר — The intention of the one who vows. The siman’s title, and the third term after לשון תורה and לשון בני אדם. It is not collected from the man’s mouth but inferred from what made him vow.
One looks at the things on account of which…” The exact phrase of seif 1, taken from the Rambam. It anchors intention in observable fact, not in declaration.
הענין — The context, the matter at hand. The Mehaber’s word in seif 1, taken up by the Rama in seif 6 for a communal ḥerem. It is what one follows, not משמעות הדיבור.
הוכחה — Circumstantial proof. The Shakh’s word at ס״ק א: without it — without visible pain — no restriction of the vow is possible and everything remains forbidden.
אומדנא דמוכח — A manifest presumption. It is the one exception the Rama leaves in a vow made toward another. The Taz illustrates it at ס״ק ב by the case of Bava Batra 146b; the Shakh at ס״ק ב reports from the Mabit that it is confined to money matters, and is not persuaded.
פיו ולבו שוין — That mouth and heart agree. A requirement peculiar to a vow a man makes alone: it is what licenses correcting the words by the intention. The Taz sets it out at ס״ק ב as the spring of the Rama’s entire gloss.
נודר בינו לבין עצמו · נודר לחבירו — A vow made alone, and a vow made toward another. The Rama’s division in seif 1, and the hinge of the whole siman: in the first case intention corrects the words, in the second the words govern.
To sling across the back, porter-fashion. The precise act the vow of seif 1 forbids — and the only one — when the pain came from carrying.
For the sake of marriage.” The phrase of seif 3: what the man fended off was not the person but the union. Hence the leave to give to her and to help her.
תקנת הקהל · חרם — The communal ordinance, and the ḥerem attached to it. The whole discussion of the Shakh at ס״ק ג and the Taz at ס״ק ד turns on this difference: without a ḥerem the ordinance is rabbinic and a doubt in it is resolved leniently; with a ḥerem it is treated as a Torah obligation.

4. Where these seifim come from

The Tur — the siman in two cases

The Tur opens with the very words of the title and gives both faces of the wool case. Note a difference from the Mehaber: in the second case the Tur also forbids covering oneself, and he omits the mention of pain — two points the Taz will discuss at length at ס״ק א.

The mishna and the braita —

The mishna gives the first half of seif 1, in Rabbi Yehuda’s name; the braita, cited just after in the Gemara, gives the second. The Ran will maintain that they diverge, and from there the whole discussion of the Taz at ס״ק א is born.

The mishna — נדרים ס״ג ע״ב: seifim 3 and 4

These two seifim are the mishna, almost word for word, and it closes the chapter קונם יין. Note that for seif 4 the mishna gives the reason in a different form from the Mehaber: לשום אכילה ושתייה where the seif writes בסעודה זו.

The mishna — נדרים מ״ג ע״א: the cow

The source of seif 5. The mishna says קונם שדי שאני חורש בה — “my field, that I plough with it” — while the Shulchan Arukh omits the word שדי. It is a variant the Beit Yosef expressly discusses.

The Rambam — הלכות נדרים chapter 8

This whole siman is the Rambam’s chapter 8, from halakha 8 to halakha 12, in order. And the chapter opens earlier on a neighbouring but distinct matter, a vow suspended on a circumstance that did not come about.

The Beit Yosef — the Rashbatz and the Ramban

Seifim 2 and 6 come neither from the mishna nor from the Tur but from two responsa the Beit Yosef reports. The first is the wine case, which the Taz will attack; the second the communal ḥerem, which yields the gloss of seif 6.

5. The commentaries of the siman, entry by entry

The commentaries on this siman number twenty-three entries: seven ס״ק of the Shakh (two of which, ס״ק א and ס״ק ז, each carry two paragraphs), four of the Taz, six of the Ba’er Hetev, five of the Pit’hei Teshuva, one of the Nekudot HaKesef. We cite them all, in order, summarising none. The Arukh HaShulchan is not cited: it is not accessible to us for this siman. Neither are the Pri Ḥadash, the Biur HaGra and the Be’er HaGolah.

Seven entries, one of them immense: ס״ק ג, which by itself occupies nearly the whole of the Shakh’s commentary on this siman and contests the Rama on the communal takana. ס״ק א and ס״ק ז each carry two paragraphs, and we cite them under the same reference.

ס״ק א — no pain, no proof; and two responsa of the Mabit

ס״ק ב — does the אומדנא hold outside money matters? — the Mabit, and ואין זה מוכרח

ס״ק ג — the great note: the Terumat HaDeshen, the Maharshal, and the Rama contested

ס״ק ד — that meal, and nothing more

ס״ק ה — a vow on account of a sick person: referral to siman 220

ס״ק ו — the haskama: referral to siman 228

ס״ק ז — referral to siman 217; then the limit of כוונה, per the Mabit

Four entries, all long and all reasoned. ס״ק ב is the key to the Rama’s gloss, which the Taz himself calls סתומה, obscure; ס״ק ג is a frontal attack on the ruling of seif 2.

ס״ק א — the Rambam, the Rosh, the Ran — and the Taz’s own view

ס״ק ב — the Rivash 195, and why a gift follows the language

ס״ק ג — the attack on the Rashbatz: Shmuel, the verse, and siman 208

ס״ק ד — a takana with ḥerem and one without: two regimes

The Ba’er Hetev

Six entries, roughly one per seif. The Ba’er Hetev abridges the Shakh and the Taz here with useful precision, and adds at ס״ק ו two responsa no one else reports.

ס״ק א — the Shakh abridged: the pain, the ship, the two brothers

The Pit’hei Teshuva

Five entries, nearly all from later responsa — the Ḥavot Yair, the Shevut Yaakov, the Ḥut HaShani, the Noda BiYehuda, the Beit Efraim, the Mayim Amukim. It is there that the siman meets the cases of the eighteenth century.

ס״ק א — the Ḥavot Yair: the parsa, the halt, the round trip, and half a shiur

ס״ק ב — the Ḥut HaShani and the Shevut Yaakov: the tithe and the jewellery

The Nekudot HaKesef (נקודות הכסף) — א׳ entry

One entry, aimed at the Taz’s ס״ק ג: in it the Nekudot HaKesef defend the Rashbatz and the Mehaber against the harshest attack of the siman.

Entry א — the defence of the Rashbatz against the Taz

7. Practical cases

Five situations, taken in the order of the siman. Each closes on the same referral: actual conduct belongs to the Rav.

Case 1 — a word thrown out in anger

This is the heart of the siman, and seifim 3 and 4 are two examples. A broad formula thrown out to end a discussion is not construed as a considered legal act: it is brought back to what it refused. But the Shakh at ס״ק ז sets the exact limit, and it is severe: the man is not believed when he claims after the fact to have meant only a place or a time. Ask your Rav.

Case 2 — an undertaking made toward someone else

The Rama’s gloss in seif 1 changes everything: once a third party has a right in what was said, intention ceases to correct the words. The Taz explains at ס״ק ב that the reason is structural — in a gift or an undertaking toward another one does not require פיו ולבו שוין, and the beneficiary acquires through the language used. Classifying the case belongs to a Rav.

Case 3 — a communal decision, and what one already had

The Rama’s כל שכן in seif 2 extends the prohibition to what members owned before the decision. The Shakh devotes the siman’s longest note, ס״ק ג, to contesting it, and the Taz at ס״ק ד reaches the same restriction: without a ḥerem the ordinance is rabbinic, the Gemara’s doubt is unresolved, and one is lenient. This is a point of open divergence: ask your Rav.

Case 4 — having another do what one forbade oneself

Seif 5 permits others to plough with the cow for the man who vowed — if his habit was to plough himself. The Pit’hei Teshuva at ס״ק ה draws from it, in the name of the Mayim Amukim, a bold consequence about a secret entrusted to a third party. The reasoning is real, but it rests on identifying one case with another. Transpose nothing without a Rav.

Case 5 — the professional who forbade himself his own trade

The Ba’er Hetev adds at ס״ק ו, in the name of the Knesset HaGedola and the Ranaḥ, a case that has not aged: a shochet swore not to slaughter for others — may he at least check their knife so that they slaughter themselves? The answer is no. And he adds a second, on a price capped by the community, where the buyer too is penalised. Ask your Rav.

8. Comprehension questions

  1. What is the difference between siman 216, siman 217 and this one?
  2. Why does seif 1 write רואין דברים שבגללן rather than “one asks him what he meant”?
  3. The same vow produces two opposite prohibitions in seif 1. Explain which, and why.
  4. What is a הוכחה, and what happens if it is missing? Give the Shakh’s answer at ס״ק א.
  5. What boundary does the Rama set at the end of seif 1, and what is its reason per the Taz at ס״ק ב?
  6. What is an אומדנא דמוכח? The Shakh reports a restriction at ס״ק ב: which, and what does he think of it?
  7. The Taz at ס״ק ג attacks the ruling of seif 2 with three arguments. What are they?
  8. How do the Nekudot HaKesef answer the first of them?
  9. The Rama draws a כל שכן for the community. How do the Shakh at ס״ק ג and the Taz at ס״ק ד restrict it?
  10. What distinction does the Maharshal draw between a takana with a ḥerem and one without?
  11. In seif 3, what does לשום אישות mean, and what remains permitted?
  12. The Shakh sums up seif 4 in five words. Which, and what do they discard?
  13. In seif 5, what criterion decides the width of the prohibition, and why is it not psychological?
  14. The Pit’hei Teshuva at ס״ק ה draws a consequence from seif 5 about a secret. Set it out.
  15. In seif 6, why does the lord’s order not annul the haskama?
  16. The Shakh at ס״ק ז sets the limit of כוונה. What is it, and what exception does he allow?
