  4. The vocabulary to hold
  5. The classic pitfalls

1. The rule, and what it is not

רואין דברים שבגללן נשבע או נדר ולומדים מהם לאיזה נתכוין — one looks at the circumstances and learns the intention from them. Intention is not a declaration collected after the fact: it is an inference from the visible.
a pain or an awkwardness→a broad vow, thrown out on the spot→the vow is reread through the pain→the prohibition shrinks to what it aimed at
The boundary is in seif 1 itself. All the foregoing holds only of a vow a man makes alone. Once a third party has a right in what was said, the language governs, barring an אומדנא דמוכח.

2. The six seifim, in the order of the book

SeifThe clause of the Shulchan ArukhWhat it says
א« כיצד הולכין אחר כוונת הנודר. ובו ו׳ סעיפים » (שו״ע יו״ד רי״ח:א)How the intention of the one who vows is followed — and it contains six seifim
א« כל הנודר או נשבע רואין דברים שבגללן נשבע או נדר ולומדים מהם לאיזה נתכוין » (שו״ע יו״ד רי״ח:א)Whoever vows or swears — one looks at the things on account of which he swore or vowed, and learns from them what he aimed at
א« והולכין אחר הענין ולא אחר משמעות הדיבור » (שו״ע יו״ד רי״ח:א)and one follows the matter, not the meaning of the utterance
א« כיצד היה טעון משא של צמר או פשתים והזיע והיה ריחו קשה » (שו״ע יו״ד רי״ח:א)How so? He was carrying a load of wool or flax, he sweated, and his smell became offensive
א« ונשבע או נדר שלא יעלה עליו צמר או פשתים לעולם » (שו״ע יו״ד רי״ח:א)and he swore or vowed that wool or flax should never come upon him
א« הרי זה מותר ללבוש בגדי צמר או פשתים ולהתכסות » (שו״ע יו״ד רי״ח:א)he is permitted to wear woollen or linen garments and to cover himself with them
א« ואינו אסור אלא להפשילן לאחוריו » (שו״ע יו״ד רי״ח:א)and he is forbidden only to sling them over his back
א« היה לבוש בגדי צמר ונצטער בלבישתו » (שו״ע יו״ד רי״ח:א)If he was wearing woollen garments and was pained by wearing them
א« ונשבע או נדר שלא יעלה עליו צמר לעולם אסור ללבוש ומותר לטעון עליו » (שו״ע יו״ד רי״ח:א)and he swore or vowed that wool should never come upon him — he is forbidden to wear it and permitted to load it upon himself
א« ומותר להתכסות בגיזי צמר » (שו״ע יו״ד רי״ח:א)and he is permitted to cover himself with fleeces of wool
א« שלא נתכוין זה אלא לבגד צמר וכן כל כיוצא בזה » (שו״ע יו״ד רי״ח:א)for he aimed only at the woollen garment — and likewise in every similar case
א« הגה וכל זה דוקא בנודר בינו לבין עצמו » (רמ״א יו״ד רי״ח:א)Gloss: and all this holds only for one who vows between himself and himself
א« אבל בנודר לחבירו כל שלשון הנדר כולל הולכין אחריו » (רמ״א יו״ד רי״ח:א)but for one who vows to his fellow — whatever the language of the vow encompasses, one follows it
א« אם לא באומדנא דמוכח (כך משמע בריב״ש ובהרמב״ן » (רמ״א יו״ד רי״ח:א)unless there is a manifest presumption (so it appears from the Rivash and the Ramban)
ב« מי שהעלילו עליו מפני שמכר יין לישמעאלים » (שו״ע יו״ד רי״ח:ב)One against whom a charge was brought because he had sold wine to Ishmaelites
ב« ומפני כך נשבע שלא יעשה יין למכור » (שו״ע יו״ד רי״ח:ב)and because of this he swore that he would not make wine to sell
ב« והיה לו יין עשוי מקודם אסור למכרו » (שו״ע יו״ד רי״ח:ב)and he had wine already made beforehand — it is forbidden for him to sell it
ב« הגה דאף על פי שקאמר שלא יעשה אזלינן בתר כוונתו (ב״י בשם רשב״ץ » (רמ״א יו״ד רי״ח:ב)Gloss: for although he said “that he would not make”, we follow his intention (Beit Yosef in the name of the Rashbatz)
ב« וכל שכן קהל שעשו תקנה כיוצא בזה שאסורין למכור אפילו מה שהיה להם קודם לכן » (רמ״א יו״ד רי״ח:ב)and all the more a community that made such an ordinance: they are forbidden to sell even what they had before
ב« סברת הרב ממשמעות רשב״ץ ולא כת״ה סימן רפ״א » (רמ״א יו״ד רי״ח:ב)(the Rav’s reasoning from the implication of the Rashbatz, and not like the Terumat HaDeshen siman 281)
ג« היו מפצירין בו לישא בת אחותו ואמר קונם שהיא נהנית לי לעולם » (שו״ע יו״ד רי״ח:ג)They were pressing him to marry his sister’s daughter, and he said: קונם — let her never benefit from me
ג« וכן המגרש את אשתו ואמר קונם שהיא נהנית לי לעולם » (שו״ע יו״ד רי״ח:ג)and likewise one who divorces his wife and says: קונם — let her never benefit from me
ג« הרי אלו מותרות ליהנות לו » (שו״ע יו״ד רי״ח:ג)these are permitted to benefit from him
ג« שלא נתכוון אלא לשום אישות » (שו״ע יו״ד רי״ח:ג)for he aimed only at marriage
ד« היה מפציר בחבירו שיאכל אצלו ומיאן » (שו״ע יו״ד רי״ח:ד)He was pressing his fellow to eat at his house, and the other refused
ד« ואמר קונם לביתך שאיני נכנס וטיפת צונן שאיני טועם » (שו״ע יו״ד רי״ח:ד)and he said: קונם — your house, that I shall not enter, and a drop of cold water, that I shall not taste
ד« מותר ליכנס לביתו ולשתות לו צונן » (שו״ע יו״ד רי״ח:ד)he is permitted to enter his house and to drink cold water there
ד« שלא נתכוון אלא שלא יאכל וישתה עמו בסעודה זו וכן כל כיוצא בזה » (שו״ע יו״ד רי״ח:ד)for he aimed only at not eating and drinking with him at this meal — and likewise in every similar case
ד« מי שנדר צדקה או שאר נדר מחמת חולה ומת עיין לקמן סימן ר״כ » (שו״ע יו״ד רי״ח:ד)(one who vowed tzedaka or another vow on account of a sick person, and [the sick person] died — see below, siman 220)

ה« אמר קונם שאיני חורש בה לעולם » (שו״ע יו״ד רי״ח:ה)he said: קונם — that I shall never plough with it
ה« אם היה דרכו לחרוש שדהו בעצמו הוא אסור לחרוש באותו פרה » (שו״ע יו״ד רי״ח:ה)if it was his habit to plough his field himself, he is forbidden to plough with that cow
ה« אבל אחרים מותרין לחרוש לו בה » (שו״ע יו״ד רי״ח:ה)but others are permitted to plough for him with it
ה« ואם אין דרכו לחרוש בעצמו אלא אריסין חורשין לו הוא וכל אדם אסורין » (שו״ע יו״ד רי״ח:ה)and if it is not his habit to plough himself but sharecroppers plough for him — he and all men are forbidden
ו« הסכמה שצוה לבטל השר מקצתה » (שו״ע יו״ד רי״ח:ו)A haskama of which the lord ordered part to be annulled
ו« אין ההסכמה בטילה מפני צוויו » (שו״ע יו״ד רי״ח:ו)the haskama is not annulled because of his order
ו« הגה קהל שהחרימו על א׳ שלא ידור עמהם ואח״כ רוצה לישב שם בחנות » (רמ״א יו״ד רי״ח:ו)Gloss: a community that placed a ḥerem on someone that he not dwell among them, and who then wishes to sit there in a shop

ו« אם לא כוונו רק על דירת קבע עם אשתו ובניו חנות שרי » (רמ״א יו״ד רי״ח:ו)if they aimed only at a permanent dwelling with his wife and children, the shop is permitted
ו« ואם לאו הכל אסור. (רמב״ן סימן רנ״ז » (רמ״א יו״ד רי״ח:ו)and if not, everything is forbidden (Ramban, responsum 257)

3. The positions in play

Is a הוכחה needed to narrow the vow? (seif 1)

WhoWhat he holdsWhere
The Rambamyes, in both directions: the braita mentions the pain because it is requiredTaz ס״ק א
The Rosh, the Turnot for the garment: a plain vow means only the garmentBeit Yosef, cited in Taz ס״ק א
The Ranthe braita diverges from the mishna, and one rules like the mishnaBeit Yosef
The Taznothing is required; the Tur mentioned the garment לרבותאTaz ס״ק א
The Shakhno pain, no proof — and all is forbidden, carrying and covering includedShakh ס״ק א · Ba’er Hetev ס״ק א

Intention against the letter (seif 2)

WhoWhat he holdsWhere
The Rashbatz, the Mehaber, the Ramaforbidden: intention is followed even against the verb usedשו״ע יו״ד רי״ח:ב
The Taz, the Mahari’tno: Shmuel requires פיו ולבו שוין, and “making” does not include what is madeTaz ס״ק ג · Pit’hei Teshuva ס״ק ג
The Nekudot HaKesefdefend the Mehaber: the word למכור shows the real concern — but close with צ״עNekudot HaKesef · Ba’er Hetev ס״ק ג

The communal takana and what one already had (seif 2, gloss)

WhoWhat he holdsWhere
The Ramaall the more forbidden, even what they had beforeרמ״א יו״ד רי״ח:ב
The Terumat HaDeshen, the Maharshal, the Shakh, the Taza takana without a ḥerem is rabbinic: an unresolved doubt, hence leniencyShakh ס״ק ג · Taz ס״ק ד · Ba’er Hetev ס״ק ד
The same, on a takana with a ḥeremtreated as a Torah obligation: the doubt is decided stringentlyShakh ס״ק ג · Taz ס״ק ד

4. The vocabulary to hold

TermWhat it denotes
כוונת הנודרthe intention of the man who vows — the siman’s title and the third term after לשון תורה and לשון בני אדם
רואין דברים שבגללןthe phrase of seif 1: intention is inferred from circumstances, not declared
העניןthe context — what one follows, as against משמעות הדיבור; taken up by the Rama in seif 6
הוכחהcircumstantial proof; without it, per the Shakh at ס״ק א, nothing is permitted
אומדנא דמוכחthe manifest presumption: the only exception admitted in an undertaking toward another
פיו ולבו שויןthat mouth and heart agree — a requirement peculiar to a personal vow, and the key to the Rama’s gloss per the Taz
להפשיל לאחוריוto sling across the back: the only act forbidden to one pained by carrying
לשום אישותfor the sake of marriage — what the vow of seif 3 aimed at, and nothing else
הסכמה · תקנה · חרםthe communal ordinance, with or without a ḥerem: the whole discussion of Shakh ס״ק ג and Taz ס״ק ד turns on this difference

5. The classic pitfalls

Do not think intention is declared. The Shakh at ס״ק ז says expressly that the man is not believed when he claims afterwards that he meant only one place. Intention is read in facts, not in memories.
Do not forget the Rama’s gloss when reading seif 1. The seif alone seems to give a general principle; the gloss halves it. An undertaking made toward someone is read by its words.
Do not take the Rama’s כל שכן as settled. On this point the Shakh, the Taz and the Ba’er Hetev all go the other way, and the Rama himself noted that he was contradicting the Terumat HaDeshen.
Do not read seif 5 as a question of psychology. The criterion is the habit of ploughing, a verifiable fact — and it produces two prohibitions of opposite width.
Do not confuse narrowing with abolishing. The siman reduces a vow’s extent; it never annuls it: what remains within the field of intention stays forbidden, and is lifted only by a התרה.
