Three seifim: when nothing obliges at once, and when nothing ever ends

A first approach to Siman 219, only three seifim, and two contrary movements. Siman 218 laid down that one follows the intention of the man who vows; this one draws the consequence on the point a vow almost always omits: time. A man undertook to marry, to buy, to pay a teacher — he is not pressed, one waits for what fits him. A man forbade himself a thing — and nothing bounding the prohibition, it lasts forever. These are rules למעשה: every real case goes to a Rav.

📑 Study plan

1. What is this siman about?
2. The seifim, one after another, clause by clause
3. The key concepts
4. Where these seifim come from: the Mishna, the Gemara, the Rambam, the Tur, the Beit Yosef
5. The commentaries, cited entry by entry
6. The table of seifim
7. Practical cases
8. Comprehension questions

1. What is this siman about?

This siman holds one question, and it is asked in both directions. A man vowed, and said nothing of time. What is made of that silence?

The answer depends entirely on what the vow does. If it binds him to an action — to marry, to buy, to pay a teacher — the silence works in his favour: he is not obliged at once, and one waits for what is fitting for him, because no one bound himself to take just anything. But if the vow forbids a thing, the same silence works against him: nothing bounds the prohibition, so it never ends.

This is no contradiction: it is one principle applied twice. In both cases one reads what the man meant — and a man undertaking to act did not mean to bind himself beyond the reasonable, while a man forbidding set no limit at all.

The siman in two movements. Seifim 1 and 2: a vow to act, with no term — one waits for the fitting, and the only immediate duty is to create no break. Seif 3: a vow to forbid, with no term — forever, and the oath with it.

2. The seifim, clause by clause

Here are the three seifim, each first in full — as the source gives it, source parentheses and glosses included — and then broken down clause by clause.

Seif 1 — he vowed to marry, to buy: he is not pressed

The siman opens on a positive vow — not forbidding a thing but undertaking to do one — and on what that vow did not say: when. Its source is a braita in Bava Kamma, closing on a real case: a woman driven to it by her son swore to turn no suitor away. The Sages said she had meant only one fit for her.

The law of one who vows without setting a term — and it contains three seifim
The printed heading, and it announces exactly what the siman does: קביעות זמן, the fixing of a term. Three seifim and two opposite directions — a vow to do, which does not oblige at once; a vow to forbid, which never ends.
One who vowed or swore to marry a woman, or to buy a house, or the like
Two examples, and not at random: they are those of the braita in בבא קמא פ׳ ע״א. The Shakh at ס״ק א raises at once the formal question: a vow forbids an object; undertaking to act is the province of an oath. He answers, in the Perisha’s name, that this is a התפסה — he made something forbidden to himself should he not marry.
and he did not set a term — he is not obliged to marry or to buy
The heart of the seif. The vow holds — there is no question of voiding it — but it is not executed on demand. The Ba’er Hetev at ס״ק א reports from the Mabit that the rule is not confined to the absence of a term, and at once notes that the Rashdam and the Knesset HaGedola say that it is.
until he finds what is fitting for him
The measure, and it is a measure of intent. No one vowed to marry anyone at all or to buy anything at all: that is what the Sages said of the woman in the braita. The Pit’hei Teshuva at ס״ק א reports from the Ḥatam Sofer in the Mahari’t’s name the distinction that governs everything: a matter of mitzva — marrying a woman — compels as soon as a fitting one appears; a matter of option may be deferred.
Seif 1 in a word. A vow to act, with no term, is not a vow to act at once nor to act in any manner whatever. One waits for what is fitting. This is no indulgence: it is the exact reading of what the man meant.

Seif 2 — the teacher: “up to ten litrin”

A responsum case, from the Rashba, applying the same principle to a sum rather than to a delay. A father swore to pay a teacher up to ten litrin — must he then spend all ten and hire the most learned man available? No: he swore להגון, to a fitting one, like the woman of the braita.

One who swore to hire a teacher for his son up to ten litrin
The לטרא is a weight that became a unit of account: “up to ten” sets a ceiling of expenditure, not a target. The seif will show the formula does not say what one would suppose.
so long as he hires a fitting teacher, he is quit
The same word as in seif 1: הגון. The Shakh at ס״ק ג gives the Rashba’s reason, and it is the link between this siman and the last: all vows follow nothing but the intention of the heart — he did not swear to hire the most learned man he could afford.
and let him take care not to dismiss the first teacher before the second arrives
The proviso, and a practical one. The Beit Yosef gives the reason: the obligation is immediate, like tzedaka, because there is a child before him — and time lost to study is פסידא דלא הדר, a loss that does not come back.
for he must hire the first fitting teacher, unless another teacher comes to him
The explanatory parenthesis, set in small type in the edition: it bounds the preceding proviso. The reference that follows, תשובת הרשב״א, gives the source of the whole seif.
Seif 2 in a word. A ceiling is not a quotation. One who bound himself “up to ten” bound himself to the fitting, and once he has it he is quit. But the rule of the fitting does not excuse a break: one does not dismiss the teacher in place before the next arrives.

Seif 3 — he forbade without saying until when: it is forever

The siman turns about. The first two seifim dealt with a vow to act, where silence about the term worked in the man’s favour. This one deals with a vow to forbid, and the same silence works against him. One line, and behind it the whole discussion of the commentaries.

One who forbade a thing upon himself without a term
The wording is the Tur’s, almost word for word. The Beit Yosef gives the source: the Rosh at the end of the chapter שבועות שתים, and the reasoning too — what term would you give him? It is not reasonable that he be forbidden for a moment only.
it is forbidden to him forever
Three words that open the siman’s real question, the question of the commentaries: and an oath? The Taz at ס״ק א gives the Ran’s reason — a vow embraces vows of consecration, and a consecrated beast is consecrated forever — then the Hagahot Mordechai who distinguish, then the Darkei Moshe’s doubt, and concludes all the same that an oath is the same.
Seif 3 in a word. What one forbids without saying until when, one has forbidden forever — and both the Shakh and the Taz extend the rule to an oath, against the model of nezirut where silence means thirty days. The Ba’er Hetev draws two very concrete cases from it, and the Pit’hei Teshuva a third.

3. The key concepts of this siman

קביעות זמן — The setting of a term. The word of the heading and the axis of the siman: what the man did not bound in time. Its absence does not act the same way in a vow that obliges and in a vow that forbids.
הראוי לו · הגון — What is fitting for him. The criterion of seifim 1 and 2, and the very word of the Sages in the braita of Bava Kamma:
דבר מצוה · דבר הרשות — A matter of mitzva, a matter of option. A distinction the Pit’hei Teshuva reports at ס״ק א in the Mahari’t’s name: in a matter of mitzva he is deemed to have undertaken at once, as soon as the fitting appears; in a matter of option, deferral is free.
התפסה — Making a thing forbidden by “attaching” it to another already forbidden. The Shakh invokes it at ס״ק א to explain how an undertaking to act can nonetheless be a vow and not an oath.
An unbounded nezirut lasts thirty days. It is the reverse model of our seif 3, and the one the Taz and the Shakh must set aside in order to extend the “forever” rule to an oath.
A loss that does not return. The reason the Beit Yosef gives for the immediacy of seif 2: the child’s lost study time cannot be recovered.

4. Where these seifim come from

The Tur — the siman’s two ends, in two lines

The Tur gives only seifim 1 and 3: seif 2 will come from the Beit Yosef, who took it from a responsum of the Rashba. Note that the Tur writes מיד — “at once” — where the Shulchan Arukh omits it.

The braita — בבא קמא פ׳ ע״א, and the woman’s case

This is the source of seif 1, and it carries a phrase the Shulchan Arukh did not reproduce: בארץ ישראל. The Pit’hei Teshuva at ס״ק א notes the omission and writes ויש לעיין.

The Rambam — הלכות נדרים chapter 8

The Rambam places this case at the end of the chapter he devotes to the intention of the one who vows — that is, siman 218. He adds two examples our seif does not keep, the caravan and the sea crossing, and reports the woman’s case.

The Beit Yosef — the Rashba’s responsum, source of seif 2

The Beit Yosef reports the responsum in full, and from him the Shulchan Arukh took the seif — including the closing proviso on dismissing the first teacher, for which he gives the reason.

The Rosh — the reason for “forever”

The Beit Yosef gives the source of seif 3 and reports its argument in a line: what term would one assign him?

5. The commentaries of the siman, entry by entry

The commentaries on this siman number ten entries: four ס״ק of the Shakh, one of the Taz, two of the Ba’er Hetev, two of the Pit’hei Teshuva, one of the Nekudot HaKesef. We cite them all, in order, summarising none. The Arukh HaShulchan is not cited: it is not accessible to us for this siman. Neither are the Pri Ḥadash, the Biur HaGra and the Be’er HaGolah.

Four entries, each opening a distinct question: the form of the vow, its reach when a term is set, the Rashba’s reason, and finally the extension to an oath — the siman’s main discussion.

ס״ק א — a vow, or an oath in disguise? the Perisha’s answer

ס״ק ב — the Mabit: even with a term set, only a fitting match is required

ס״ק ג — the Rashba’s reason: vows follow the heart’s intention

ס״ק ד — an oath too is forever — and why the Ba’h had no objection to raise

A single entry, but it carries the debate: the Ran, the Hagahot Mordechai, the Darkei Moshe’s doubt, and a proof from the braita of the differences between vow and oath.

ס״ק א — nezirut, consecration, and the Hagahot Mordechai

The Ba’er Hetev

Two entries, and the Ba’er Hetev does here what he does best: abridges the A’haronim, then adds in parentheses responsa no one else reported.

ס״ק א — “not specifically”: the Mabit, and the Rashdam’s reservation

ס״ק ב — an oath too; the synagogue and the term-less haskama

The Pit’hei Teshuva

Two entries, both long and both from later responsa — the Ḥatam Sofer on the first seif, the Tiferet Tzvi on the third.

ס״ק א — the Ḥatam Sofer and the Mahari’t: a matter of mitzva, a matter of option

ס״ק ב — the Tiferet Tzvi: the shochet removed, then taken back

The Nekudot HaKesef (נקודות הכסף) — א׳ entry

One entry, very brief and purely critical: the Shakh faults the Taz for citing the Darkei Moshe by halves.

Entry א — the Taz did not copy the Darkei Moshe in full

6. The table of seifim

The whole siman in a grid: the seif, the clause, and what it says.

SeifThe clause of the Shulchan ArukhWhat it says
The law of one who vows without setting a term — and it contains three seifim
One who vowed or swore to marry a woman, or to buy a house, or the like
א « ולא קבע זמן אין מחייבין אותו לישא או לקנות » (שו״ע יו״ד רי״ט:א) and he did not set a term — he is not obliged to marry or to buy
א « עד שימצא הראוי לו » (שו״ע יו״ד רי״ט:א) until he finds what is fitting for him
One who swore to hire a teacher for his son up to ten litrin
ב « כל זמן שישכור מלמד הגון הוא פטור » (שו״ע יו״ד רי״ט:ב) so long as he hires a fitting teacher, he is quit
ב « ויזהר שלא ישלח המלמד הראשון עד שיבא השני » (שו״ע יו״ד רי״ט:ב) and let him take care not to dismiss the first teacher before the second arrives
ב « כי צריך לשכור המלמד הראשון ההגון לו אם לא שבא לו מלמד אחר » (שו״ע יו״ד רי״ט:ב) for he must hire the first fitting teacher, unless another teacher comes to him
One who forbade a thing upon himself without a term
ג « אסור בו לעולם » (שו״ע יו״ד רי״ט:ג) it is forbidden to him forever

7. Practical cases

Five situations, taken in the order of the siman. Each closes on the same referral: actual conduct belongs to the Rav.

Case 1 — “I swore to marry this year”

Seif 1 addresses one who did not set a term. But the Shakh at ס״ק ב reports from the Mabit that the rule holds even where a term was set: only the fitting is ever required. The Ba’er Hetev at ס״ק א at once notes that the Rashdam and the Knesset HaGedola restrict the rule to the term-less case. Two opposite readings of one line: ask your Rav.

Case 2 — an undertaking to give, and nothing about the date

The Pit’hei Teshuva at ס״ק א reports from the Ḥatam Sofer a long analysis in the Mahari’t’s name: in a matter of option one may defer from term to term; in a matter of mitzva the undertaking is deemed taken for מיד ולאלתר as soon as the fitting appears. The Pit’hei Teshuva adds that this first half seems to him צ״ע. The classification of the undertaking decides everything: ask your Rav.

Case 3 — replacing one’s child’s teacher

Seif 2 says two things, and the second is the more practical: though quit by hiring a fitting teacher, the man must still take care to create no gap. The Beit Yosef’s reason is that the obligation is immediate like tzedaka, and lost study time is not recovered. A Rav will say whether the case is one of the ceiling or of continuity.

Case 4 — “I will no longer pray in that synagogue”

This is exactly the case the Ba’er Hetev adds at ס״ק ב in the Rashach’s name: one who forbade himself to pray in so-and-so’s synagogue without setting a term has forbidden himself forever. And he reports a second, communal one: a haskama with no term set holds indefinitely. A perpetual vow is lifted only by a התרה: ask your Rav.

Case 5 — a communal decision one wishes to undo

The Pit’hei Teshuva at ס״ק ב reports from the Tiferet Tzvi an exemplary case: a community agreed to remove its shochet, and did so; may it take him back? Yes — for they did not accept that he be forbidden to be their shochet, which would have been perpetual, but only to remove him, and remove him they did. Everything turns on the exact wording of the decision: ask your Rav.

8. Comprehension questions

  1. Why does silence about the term work for the one who vows in seifim 1 and 2, and against him in seif 3?
  2. The Shakh at ס״ק א asks how an undertaking to act can be a vow. What answer does he give in the Perisha’s name, and what does he add?
