1. The line of ruling, in five propositions

This level sets out the line of ruling as the decisors laid it down. It does not replace a Rav’s decision: every real case goes to a Rav, and a perpetual vow is lifted only by a התרה.
1. A vow to perform an action, with no term, holds — but is not executed on demand: one waits for what fits.
2. The measure is the Sages’ in the braita:
3. For the Mabit the same measure holds even where a term was set; the Rashdam and the Knesset HaGedola say the opposite.
4. For the Mahari’t, a matter of mitzva is deemed promised at once as soon as the fitting appears.
5. A prohibition set with no term is perpetual, vow and oath alike — and that is the point on which the Taz, the Shakh and the Ba’er Hetev agree.

2. What remains open, and how it is decided

A vow with a fixed term — two positions, neither set aside

The Shakh reports the Mabit without reservation; the Ba’er Hetev reports him and sets the Rashdam and the Knesset HaGedola beside him. Neither decides between them. This is therefore a case where conduct depends on the Rav consulted and on the circumstances.

Deferral in a matter of option — the Pit’hei Teshuva’s reservation

The Mahari’t permits deferring indefinitely in a matter of option. The Pit’hei Teshuva, though he reports the whole analysis, writes in his own name that this half seems to him צ״ע from several places. It is therefore not a permission to be taken as it stands.

3. The cases the commentaries report — and all are of today

Praying elsewhere — the Rashach, in the Ba’er Hetev

A burning case in any community: one forbids oneself a synagogue in the course of a quarrel, and thinks of it no more. Seif 3 says the prohibition has no end of itself.

A haskama with no duration — the Rashach, same entry

The shochet removed, then taken back — the Tiferet Tzvi, at Pit’hei Teshuva

This is the exact counterweight to the previous case, and it shows where the line runs. A community agrees to remove its shochet — it removes him, and its undertaking is fulfilled. It had not undertaken that he be forbidden to be their shochet; that undertaking would have been perpetual.

The practical lesson of these three cases is a lesson in drafting: a communal decision that says “we remove” ends with its execution; one that says “it is forbidden” does not end. Have the wording read by a Rav before it is voted.
