The Shakh opens the siman on this question and answers it in the Perisha’s name: this is not a vow to marry but a vow that attaches a thing to the absence of marriage — “such a thing is forbidden to me if I do not marry”. That is התפסה, and the vow recovers its normal shape: it forbids an object.
But the Shakh does not stop there, and his continuation is more interesting than the answer itself: nowadays, he says, it is a vow in any case — referring to the end of siman 206. He then adds that some hold it works by way of ידות, the “handles” of a vow: an incomplete formula, or one borrowed from another register, still binds.
The source of seif 1 is a braita in בבא קמא פ׳ ע״א, and it is instructive twice over. It stands within a series about what is not demanded immediately — a repentant shepherd need not sell his flock at once, nor a convert who inherits dogs and swine. And it carries a geographical clause.
The question is not ours. The Pit’hei Teshuva raises it expressly, in parentheses, at the end of his long entry on this seif — and does not decide it.
The Rambam decided otherwise: he does not keep the Land of Israel but adds two examples the braita lacks — setting out with a caravan, putting to sea — which shows he read the rule as general.
The Shakh at ס״ק ב decides for the second reading in the Mabit’s name: it is not said specifically, and the same rule holds of one who vowed to marry within the year.
The Ba’er Hetev repeats the Mabit at ס״ק א — and at once adds, in parentheses, that the Rashdam and the Knesset HaGedola wrote the opposite. The parenthesis is short, but it reopens the debate rather than closing it.
The seif says he is not compelled — but until when? The Pit’hei Teshuva reports from the Ḥatam Sofer, in the Mahari’t’s name, a distinction that restates the whole seif: deferral is not the same thing according to the nature of what was promised.
The Pit’hei Teshuva is not satisfied all the same, and his reservation is aimed precisely at the first half: freedom of deferral in a matter of option seems to him צ״ע from several places. It is in that same parenthesis that he notes the omission of the Land of Israel.
Seif 2 is a responsum of the Rashba, and the Shakh reports its argument. It must be read attentively: he does not say ten litrin are too much, he says the man did not swear that.
The phrase כל הנדרים אינם הולכים אלא אחר כוונת הלב is the rule of the previous siman, applied here to a sum. And the Rashba draws the surprising conclusion: a teacher who has not reached the rank of the great rabbis will do, for it was the fitting one he had in mind.
The Taz gives the Ran’s reason, and it is structural: the word נדר covers both vows of consecration and vows of prohibition. Now to consecrate a beast to the altar is to consecrate it permanently. The regime of the prohibitive vow therefore follows its brother’s.
Another reason, and it reaches further: in nezirut the man binds himself — and it is presumed he subjected himself only to the least he could. In a vow he forbids an object, and the object is no more forbidden for thirty days than for a year.
That is exactly what the Darkei Moshe formulates, and the Taz reports it as a doubt left open — adding that the Rama’s doubt would hold even on the Ran’s reason, since consecration is not included in an oath.
The Taz nonetheless decides, and his proof is fine. The braita enumerates the points on which a vow is weightier than an oath — it takes effect on a matter of mitzva as on a matter of option. Had duration been one of them, it would have been listed.
The Shakh reaches the same result by another road, and adds what the Taz left aside: the Darkei Moshe himself concludes, in the Rosh’s name, that an oath too is forever. The Shakh uses this to dispel the Ba’h’s astonishment, who faulted the Rosh for ruling from reasoning where the matter is explicit in the first chapter of Nedarim — no, answers the Shakh: the Gemara speaks only of a vow, the Rosh was speaking of an oath.
The single entry of the Nekudot HaKesef on this siman is not on the substance: it faults the Taz for citing the Darkei Moshe by halves — giving his doubt without giving his conclusion.
