1. הדין העולה — the siman’s line of psak
This level sets out the line of psak as it emerges from the Shulḥan Arukh and its apparatus. It replaces neither a Rav nor a question asked: this siman touches another man’s estate, and almost every rule in it depends on facts — which words were said, in which direction, and what local practice pays for. Any real situation goes to a Rav.
The line, in four propositions. (1) In principle the vow reaches every benefit, including the kind no one bills for. (2) Three benefits escape it, and all agree on them: benefit merely avoided, benefit that comes of itself, benefit that is only the mitzva. (3) Everywhere else the measure is the customary fee. (4) And on three points the apparatus does not conclude — slaughtering, blowing by the bound man himself, and one word in seif 4.
2. שני כיווני הנדר — the first thing to establish
Seif 1 opens on two arrangements, and the siman does not treat them alike: did I forbid my property to another, or forbid myself his? In seif 4 this difference alone decides whether one may enter a sick man’s house; in seif 7 it decides who may forbid what.
In practice: never apply a rule of this siman before establishing the direction of the vow. The Shakh, at ס״ק כ״ה, draws the most delicate consequence — where it is the sick man who forbade his property, we presume he did not mean to forbid what his life depends on; but if the visitor forbade himself the sick man’s property, he does not enter at all.
3. ויתור — the principled severity, and what it actually forbids
The starting rule is not intuitive: the vow forbids even what is not billed for. Crossing an open field in the dry season, where no one minds, is forbidden. The Shakh, the Taz and the Nekudot HaKesef maintain it against the Ba’h, and the Ba’er Hetev records it in plain words.
The practical reach is wider than one supposes: seif 5 draws from it the prohibition of selling and buying, lending and borrowing — and not only because benefit is involved, but by decree, lest one come to the forbidden case. The Taz adds the analysis of price: if the bargain is even, both benefit; if there is a discount, one benefits.
4. פריעת חוב — the permission, and the Shakh’s two conditions
The Meḥaber permits without reservation. The apparatus adds two conditions the text does not write, and this is the point in the siman where sticking to the letter most easily misleads.
First condition (Shakh ס״ק ו, in the Ran’s name): without the debtor’s knowledge. Second (the Ba’h, cited there): not where the debt is evidenced by a deed or secured by a pledge. This second is not unanimous — the Meḥaber does not state it, and the Nekudot HaKesef note that the author elsewhere, on Ḥoshen Mishpat, objected to the Sma’s position supporting it.
Two views, two courses: such a question is not decided alone, the more so as the Ba’er Hetev adds the Radbaz on outright remission of a debt, a neighbouring but not identical case.
5. בני הבית ובהמתו — what may be fed, and what may not
Permitted: the wife, the children, the servants. Forbidden: the beast, clean or unclean. The division is not one of amount but of what the recipient is for. And the prohibition on the beast holds, per the Ran, even where over-feeding harms it.
6. במקום שנותנין שכר — the measure of the fee, local and dated
This is the most used measure in the siman. Three applications, all practical. Visiting the sick: standing where a seated companion is paid — but the Shakh specifies that sitting for a fee is permitted, and the Ba’er Hetev records it against the Levush. Healing: free where no physician’s fee is customary, for a fee elsewhere — and never the beast. Teaching: the rule changed with practice, and the siman says so itself.
A practical consequence, and an unusual one: the state of the market for services is part of the question. Conduct permitted where the service is free becomes forbidden where it is billed. That is a fact to establish, not a rule to recite — and one more reason to ask.
7. נכסים מושכרים — what “my property” covers, and what a קונם can no longer reach
Two rules, and they are not one. Seif 6 decides what a general word covers: a leased asset leaves it where the owner keeps no תפיסת יד — but an express designation brings it back. Seif 7 decides something else: even designated, the asset remains charged with the tenant’s right, and a קונם lacks the force to displace it.
And the apparatus narrows further. The Shakh, at ס״ק מ״ד, limits consecration to the portion exceeding rent or debt; at ס״ק מ״ה he cites Rabbenu Yeruḥam in the name of the Rashba and Rabbenu Yona, for whom not even the surplus may be consecrated. And the Pitḥei Teshuva, at ס״ק ב, adds that an express formula is needed in any case — “I consecrate the right I hold”, not “I consecrate it”.
This seif is one of property law before it is one of vows, and the question it raises — what becomes of a third party’s right? — is settled before a beit din, not on a page. Ask your Rav.
8. על ידי אחר — the boundary of agency
The device of seif 8 is permitted, and commonly used: to declare one’s distress to a shopkeeper or to labourers, and let them act. The condition lies in the Meḥaber’s parenthesis — he is not obliged to pay. The Taz makes it the operative criterion of the whole seif.
Permitted: “so-and-so is bound by a vow and I do not know what to do”; “whoever feeds him will not lose” — and per the Ba’h, cited by the Shakh, this second formula stays permitted even said to one man, since it is not in the singular. Forbidden: “let whoever hears my voice feed him” — that is a command; “if you feed him, you will not lose” — that is a singular.
And seif 9 adds the route of the property itself, with its reservation: a conditional gift, or one belied by circumstances, conveys nothing. The Shakh, at ס״ק נ״ב, moreover confines that permission to the case where the man has nothing to eat — unlike the one in seif 8.
9. מצוה בחפץ אסור — the shofar, the lulav, the spring, the book
The rule permits: performing a mitzva with the forbidden object is not benefiting from it. It holds for the shofar, for the lulav from the second day, and for immersion in the rainy season.
Three limits, and firm ones. (1) The book remains forbidden: for the Shakh because a book can be rented, for the Taz because one is not obliged to lend it and it is worn, and again because the Torah gladdens the heart. (2) The spring in summer remains forbidden, because one is refreshed. (3) The lulav on the first day does not discharge, and the bar is not benefit but ownership: ולקחתם לכם.
And a point the apparatus leaves open: seif 13 implies the bound man may blow it himself, whereas Oraḥ Ḥayyim 586:5 writes that another blows for him. The Shakh ends וצ״ע; the Ba’h permits in pressing need, and that is what the Ba’er Hetev retains.
10. שחיטה — the divergence the apparatus does not settle
The Rama permits slaughtering a healthy beast for him, not one at the point of death. The reason, which the Shakh gives in a line: slaughtering a healthy beast damages it, whereas it saves a dying one.
The Taz opposes it formally, and his ס״ק מ״ב is the siman’s most vehement note: one should not rely on this ruling, for making a beast fit to eat is a considerable benefit — every day we hire a slaughterer. He concludes that had the Rama seen his proofs he would not have ruled so.
The Nekudot HaKesef refute him — the Taz misread the Tosafot, and the comparison with ויתור fails, since there a benefit exists and here there is none. The Pitḥei Teshuva, at ס״ק ו, brings from the Peni Aryeh a view following the Rama but hedged: only where slaughtering is not paid for, or where he is given his fee; and only if the bound man did not ask that it be slaughtered for him.
This question is not settled, and a page cannot settle it. It arises exactly where it is most often met: rendering free a service that is normally paid for. It belongs to the Rav.
11. Contemporary cases — and the limit of this page
A quarrel sealed by a formula. This is the commonest case: two people fall out and one utters an undertaking of prohibition. Before any application one must establish which formula was used and which way it runs. The rest of the siman depends entirely on that — down to the right to cross a plot of land. This goes to a Rav.
A debt one wishes to settle for another. Seif 2 permits; the Shakh adds two conditions; and one of them — the deed or the pledge — is not unanimous. Today almost every debt is written down somewhere. This question is not decided alone.
Help routed through a third party. The device of seif 8 is permitted, and the most useful in the siman. But the boundary is narrow, and it turns on words: declaring a distress, yes; promising to the crowd, yes; commanding, no; addressing one man, no. And the real question is not the words but the obligation: shall I be bound to repay?Ask your Rav.
A leased asset, and an undertaking made after the lease. Seifim 6 and 7 belong to property law as much as to the law of vows, and their apparatus holds four distinct positions, from the Taz to the Pitḥei Teshuva. A lease, a pledge and a loan for use are not treated alike. This is a beit din question.
A service that is normally paid for. Slaughtering, healing, teaching, repairing. The siman answers everywhere by the same measure — is this service billed here and now? — but on slaughtering the apparatus divides, and the Peni Aryeh adds three conditions. Do not decide from memory.
The limit of this page. A vow can be annulled; that is precisely why, in other simanim, one does not seek to circumvent a vow-based prohibition but to have it released. Nothing above indicates the course to take in a given case, and this siman in particular engages another’s property. Actual conduct belongs to the Rav.
