A first approach to Siman 222, which holds a single seif — yet thirteen commentary entries attach to it. Siman 221 set out the whole regime of the מודר הנאה; this one takes its most human case: a father wishes to give to his daughter, and his son-in-law may receive nothing from him. Now a husband eats the fruits of his wife’s property — the gift to the daughter is a benefit to the son-in-law. The seif gives the formula that unties this, and examines what happens when a piece of it is missing. These are rules למעשה: every real case goes to a Rav.

8. Comprehension questions

1. What is this siman about?

The previous siman, 221, set out the whole regime of the מודר הנאה — one to whom another’s benefit is forbidden by vow. This one takes a single case from it and gives it one seif: the father-in-law who wishes to provide for his daughter while his son-in-law may receive nothing from him.

The knot is not moral but legal. In matrimonial law the husband eats the fruits of his wife’s property. To give money to the daughter is therefore to give to the son-in-law — not by stratagem but by the mechanical operation of the law. What is at stake is not the father-in-law’s intention: it is the nature of the gift.

Hence the seif’s solution, which is a formula. If the father designates the coins for a set use, he has not transferred them absolutely, and nothing remains for the husband’s right to fasten on. The seif states that formula, then examines what happens when one of its parts is missing — and there the Gemara, the Rishonim and the A’haronim part ways.

The siman in one line. One seif, thirteen commentary entries: the density is in the formula, not the length. Three ways of speaking, three outcomes — and two of the three are openly disputed.

2. The seifim, clause by clause

Here is the single seif, first in full — as the source gives it, heading and misprints included — and then broken down clause by clause.

Seif 1 — the words that must be said, and the order in which they hold

The siman is a single case and nothing else. A man has been barred by a vow from benefiting from his father-in-law — or, which comes to the same here, the father-in-law forbade his benefit to the son-in-law. The father-in-law now wishes to give money to his daughter. The difficulty is that what enters a wife’s hand, the husband eats its fruits: the gift to the daughter is therefore a benefit to the son-in-law. The whole seif is the formula that unties this, and the three places where it may fail.

One whose son-in-law is מודר הנאה from him, and who wishes to give money to his daughter — and it contains one seif
⚠️ The heading as the source gives it carries two plain misprints, and we copy it untouched: התנו for חתנו — “his son-in-law” — and טעות for מעות — “money”. The Tur, the source of the title, writes
One who is מודר from his son-in-law and wishes to give money to his daughter
The Taz pauses at ס״ק א on the word מעות, and rightly: it is money precisely, not food. For over מזונות he need say nothing at all — the husband has no vested right in them, as the mishna וזן את אשתו teaches, at siman 221.
so that she may enjoy them and spend them on her own needs
The clause is the Rambam’s word for word, and it explains why money raises a problem food does not: money at her disposal is capital, and a husband eats the fruits of his wife’s capital.
he gives her and says to her: behold, these coins are given to you as a gift
The first of the formula’s two members, and it does not suffice alone. It is rather the reverse: an outright gift is exactly what makes the husband acquire. The Rosh notes this in his commentary on the mishna — without the second clause it would be forbidden.
provided only that your husband have no right in them
The second member, the clause the mishna in נדרים פ״ח ע״א requires. The Pit’hei Teshuva at ס״ק א will report from the Sha’ar HaMelekh that several Rishonim hold it dispensable — a question on which the Shakh had written פשיטא.
but let them be for what you put into your mouth, or for what you will wear, or the like
The designation, and it is what makes the formula work: by naming the use, the father has not transferred the coins to her for everything, so the husband has nothing to fasten on. The mishna knew only “what you put into your mouth”; the Ran reports in the Beit Yosef a view extending it to any designation, and it is that view the Mehaber follows in adding
and even if he said: on condition that your husband have no right in them, but do with them what you wish
The pivot of the siman. מה שתרצי עשי designates nothing: it is a gift for everything. Rav, in the Gemara, says the husband acquires there; Shmuel says he does not. The Mehaber writes Shmuel’s position here, which is the Rambam’s.
the husband has not acquired, and she will do with them what she wishes
The Taz explains at ס״ק ב the Rambam’s logic: by saying “whatever you wish to do”, he revealed his mind — even to her he did not give absolutely, but for the use she will wish at the moment she wishes it. The Pit’hei Teshuva at ס״ק ב adds the Sha’ar HaMelekh’s question: and if the wife dies, does the husband inherit them?
but if he gave her a gift and said to her: on condition that your husband have no right in them
The third case, and the failing one: the second clause alone, with no designation at all. It is precisely here that the Nekudot HaKesef open their one entry on the siman — to uphold the Raavad against the Rambam.
and did not specify that this gift should be for this and that, or for what she would wish to do with them
Note that the Mehaber ranks the precise designation and מה שתרצה together: for him both suffice, and it is total silence that fails. The יש אומרים at the end of the seif will contest exactly that equation.
then the husband will acquire it to eat its fruits — and that is forbidden
The mechanism is that of matrimonial law: the husband eats the fruits of his wife’s property. This is no detour: money given to the daughter is, in law, a benefit to the son-in-law.
for he is forbidden to benefit from his father-in-law
The Taz raises here, at ס״ק ג, the question that gives the siman its full weight: if the son-in-law is forbidden, why not simply give to the daughter — he surely will not transgress! His answer reverses the perspective, and he draws from it a case the Perisha had missed.
and some say that even where he says to her: on condition that your husband have no right in them, and do with them what you wish
The second view, and it is the Tur’s in the Rosh’s name — that is, Rav against Shmuel. The Taz identifies it explicitly at ס״ק ב. The Shakh at ס״ק ג gives the reason: with no designation it is a gift for everything, the husband has already acquired, and the condition comes too late.
the husband has acquired, and they are forbidden to him
The Shakh closes the siman with a cross-reference that changes practice: at Even HaEzer 85:11 the Mehaber writes the first position without mentioning the יש אומרים. And he reports the Ba’h’s rule for arbitration — stringency in matters of vows, and for money
The seif in a word. Three formulations, three outcomes. (1) “These coins are given to you, your husband has no right in them, they are for your food or your clothing” — permitted, all agree. (2) The same with “do with them what you wish” — permitted for the Mehaber, forbidden for the יש אומרים. (3) “Your husband has no right in them”, and nothing else — forbidden, and both the Shakh and the Taz set aside the Perisha who doubted it.

3. The key concepts of this siman

One to whom another’s benefit is forbidden by a vow. All of siman 221 is devoted to him; our siman takes just one case — and one where the prohibition passes through a third party.
אכילת פירות — The husband’s right to enjoy the fruits of his wife’s property. That right, and it alone, makes the gift to the daughter a benefit to the son-in-law. The Taz recalls it at ס״ק א, and the Pit’hei Teshuva attaches the question of inheritance to it at ס״ק ב.
יד אשה כיד בעלה — A wife’s hand is as her husband’s hand. Rabbi Meir’s position, to which the Gemara at נדרים פ״ח ע״ב ties Rav’s view. The Nekudot HaKesef use it to show that Shmuel follows the Sages — and draw the Raavad’s argument from it.
על מנת שאין לבעליך רשות בהן — “On condition that your husband have no right in them.” The clause the mishna requires. The Shakh holds it indispensable; the Sha’ar HaMelekh, reported at Pit’hei Teshuva ס״ק א, gathers the Rishonim who dispense with it.
מה שאת נושאת ונותנת בפיך — “What you carry and put into your mouth.” The mishna’s formula, the only one it knows. The seif adds clothing and “the like”, following the view the Ran reports in the Beit Yosef.
Do with them what you wish.” The pivot: a formula that designates nothing. Shmuel and the Rambam still see in it a sufficient reservation; Rav and the Tur see an outright gift.
מי שמוחזק המע״ה — The holder prevails: the claimant must bring proof. A rule the Shakh reports from the Ba’h at ס״ק ג to arbitrate, on the monetary side, a divergence that the votal side decided stringently.

4. Where these seifim come from

The mishna —

This is the source, and two things must be noted at once: the mishna says המדיר — the one who imposes the vow — where the Shulchan Arukh writes המודר; and it knows only one designation, the mouth.

The Gemara — Rav against Shmuel

The whole divergence of the seif lies in these two lines, and the Shulchan Arukh sets them end to end: Shmuel’s position as his own, Rav’s as the ויש אומרים.

The Rambam — הלכות נדרים chapter 7, halakha 17

The Shulchan Arukh’s seif is this halakha, almost word for word, down to the ויש אומרים the Mehaber adds after it. That is why the Raavad’s critique, reported by the Nekudot HaKesef, reaches the Shulchan Arukh as well.

The Tur — and the opposite position

The Tur gives the position the Mehaber will file as ויש אומרים, and gives it as his own: it is the Rosh’s. He then names the Rambam as the dissenter.

The Beit Yosef — the Ran, and why money

The Beit Yosef reports the Rosh and then the Ran, and from the Ran comes the decisive widening: the mishna said “money” only because food requires nothing, and the designation works for any named use.

5. The commentaries of the siman, entry by entry

A single seif, and yet thirteen entries: three ס״ק of the Shakh, three of the Taz, three of the Ba’er Hetev, three of the Pit’hei Teshuva, one of the Nekudot HaKesef — and that last is among the longest in the tractate. We cite them all, in order, summarising none. The Arukh HaShulchan is not cited: it is not accessible to us for this siman. Neither are the Pri Ḥadash, the Biur HaGra and the Be’er HaGolah.

Three entries, and they cover exactly the three questions of the siman: what requires no formula, what has not enough of one, and the arbitration between the two views.

ס״ק א — מזונות need no formula at all

ס״ק ב — against the Perisha: without the condition the husband acquires — it is obvious

ס״ק ג — the reason of the יש אומרים, Even HaEzer 85, and the Ba’h’s rule

Three entries, long and reasoned. ס״ק ב identifies the two views with Shmuel and Rav; ס״ק ג raises the finest question of the siman and draws a consequence from it against the Perisha.

ס״ק א — מעות and not מזונות: the Ran, and Rashi on the mishna

ס״ק ב — the Rambam against the Tur, Shmuel against Rav — and the ק״ו against the Derisha

ס״ק ג — why not give plainly? and the son-in-law’s counter-vow that does not help

The Ba’er Hetev

Three entries, and here they are exactly what the Ba’er Hetev is meant to be: the Shakh, the Taz and Rashi brought back to their substance, in the order of the seif.

ס״ק א — the Shakh abridged, and Rashi on the husband’s benefit

ס״ק ב — the Taz abridged: the question, the answer, and the counter-vow

ס״ק ג — the Shakh on the יש אומרים, down to מי שמוחזק המע״ה

The Pit’hei Teshuva

Three entries, and the first is decisive: it gathers, in the Sha’ar HaMelekh’s name, the Rishonim who contradict the Shakh’s

ס״ק א — the Sha’ar HaMelekh against the Shakh: the Ran, the Rashba, the Tosafot Yom Tov

ס״ק ב — if the wife dies, does the husband inherit?

ס״ק ג — the Mishkenot Yaakov on the second view

The Nekudot HaKesef (נקודות הכסף) — א׳ entry

A single entry, but a full dissertation: in it the Shakh upholds the Raavad against the Rambam, from the sugya in Kiddushin, the Yerushalmi at the end of Nedarim, and against the Kesef Mishneh.

Entry א — the Raavad against the Rambam, and the Yerushalmi at the end of Nedarim

6. The table of seifim

The whole seif in a grid: the clause, and what it says.

SeifThe clause of the Shulchan ArukhWhat it says
ובו סעיף אחד » (שו״ע יו״ד רכ״ב:א) One whose son-in-law is מודר הנאה from him, and who wishes to give money to his daughter — and it contains one seif
א « המודר מחתנו והוא רוצה לתת לבתו מעות » (שו״ע יו״ד רכ״ב:א) One who is מודר from his son-in-law and wishes to give money to his daughter
א « כדי שתהא נהנית בהם ומוציאה אותם בחפציה » (שו״ע יו״ד רכ״ב:א) so that she may enjoy them and spend them on her own needs
א « הרי זה נותן לה ואומר לה הרי המעות הללו נתונים לך במתנה » (שו״ע יו״ד רכ״ב:א) he gives her and says to her: behold, these coins are given to you as a gift
א « ובלבד שלא יהא לבעליך רשות בהן » (שו״ע יו״ד רכ״ב:א) provided only that your husband have no right in them
א « אלא יהיו למה שאת נותנת לתוך פיך או למה שתלבשי וכיוצא בזה » (שו״ע יו״ד רכ״ב:א) but let them be for what you put into your mouth, or for what you will wear, or the like
א « ואפי׳ אמר על מנת שאין לבעליך רשות בהם אלא מה שתרצי עשי בהם » (שו״ע יו״ד רכ״ב:א) and even if he said: on condition that your husband have no right in them, but do with them what you wish
א « לא קנה הבעל ומה שתרצה תעשה בהם » (שו״ע יו״ד רכ״ב:א) the husband has not acquired, and she will do with them what she wishes
א « אבל אם נתן לה מתנה ואמר לה על מנת שאין לבעליך רשות בהם » (שו״ע יו״ד רכ״ב:א) but if he gave her a gift and said to her: on condition that your husband have no right in them
א « ולא פירש שתהא המתנה הזאת לכך ולכך או למה שתרצה תעשה בהם » (שו״ע יו״ד רכ״ב:א) and did not specify that this gift should be for this and that, or for what she would wish to do with them
א « הרי זה יקנה אותה הבעל לאכול פירותיה ודבר זה אסור » (שו״ע יו״ד רכ״ב:א) then the husband will acquire it to eat its fruits — and that is forbidden
א « שהרי הוא אסור בהניית חותנו » (שו״ע יו״ד רכ״ב:א) for he is forbidden to benefit from his father-in-law
א « ויש אומרים דאפי׳ באומר לה על מנת שאין לבעליך רשות בהם ומה שתרצי תעשי בהם » (שו״ע יו״ד רכ״ב:א) and some say that even where he says to her: on condition that your husband have no right in them, and do with them what you wish
א « קנה הבעל ואסור בהם » (שו״ע יו״ד רכ״ב:א) the husband has acquired, and they are forbidden to him

7. Practical cases

Five situations, taken in the order of the seif. Each closes on the same referral: actual conduct belongs to the Rav.

Case 1 — the wedding gift and the everyday gift

The seif speaks of מעות — money. The Taz at ס״ק א and the Shakh at ס״ק א both say that for מזונות nothing need be said: the husband has no vested right there, since the mishna of siman 221 expressly permits it. Where does the line run between feeding and endowing? The question goes to a Rav.

Case 2 — the formula one supposes sufficient

Saying only “your husband has no right in this money” does not suffice, per the Shakh at ס״ק ב and the Taz at ס״ק ב, the latter adding that the matter admits no doubt at all. But the Pit’hei Teshuva at ס״ק א reports from the Sha’ar HaMelekh that several Rishonim hold the reverse. This is a point of divergence: ask your Rav.

Case 3 — “do with it what you like”

This is the most natural formulation, and precisely the disputed one: permitted for the Mehaber following the Rambam, forbidden for the יש אומרים following the Tur. The Shakh at ס״ק ג notes that at Even HaEzer 85:11 the Mehaber writes the first position without the second view, and reports the Ba’h’s rule of arbitration. Ask your Rav.

Case 4 — “my son-in-law has himself vowed off benefiting”

The Perisha thought this would untie everything. The Taz at ס״ק ג rejects the device in two steps: the object remains forbidden to the son-in-law in any case, and above all his own vow can be released — after which he will want to benefit. The Ba’er Hetev at ס״ק ב takes up the argument and concludes ודלא כפרישה. Do not build such an arrangement without a Rav.

Case 5 — the daughter dies before her husband

The question is the Sha’ar HaMelekh’s, reported by the Pit’hei Teshuva at ס״ק ב: the money reserved to the wife, from which the husband could draw nothing in her lifetime — does he inherit it? The Pit’hei Teshuva refers without deciding. A question of inheritance as much as of vows: it goes to a Rav.

8. Comprehension questions

  1. Why is giving money to the daughter, in law, a benefit to the son-in-law?
  2. Why does the seif speak of מעות and not מזונות? Give the Ran’s answer as the Taz reports it at ס״ק א.
  3. What are the two members of the formula, and why does neither suffice alone?
  4. The mishna knows only one designation. Which, and who widened the rule to any designation?
  5. What did Rav and Shmuel say, and which of the two does the Mehaber write first?
  6. What is the Taz’s explanation, at ס״ק ב, for the Rambam’s position on מה שתרצי עשי?
  7. The Taz draws a קל וחומר against the Derisha. Set it out.
  8. The Shakh writes פשיטא at ס״ק ב. About what, and who contests it, and where?
  9. The Shakh refers, at ס״ק ג, to Even HaEzer 85:11. What is found there, and what weight has it?
  10. What rule of arbitration does the Ba’h give, and why does he give two?
  11. The Taz at ס״ק ג asks why not simply give to the daughter. What does he answer?
  12. Why does a vow the son-in-law might take on himself solve nothing?
  13. What is the Raavad’s objection about, and with whom do the Nekudot HaKesef side?
  14. What proof do the Nekudot HaKesef draw from the Yerushalmi at the end of Nedarim?
