1. אכילת פירות — why the gift to the daughter reaches the son-in-law

The siman has a difficulty only through a rule external to it: the husband eats the fruits of his wife’s property. Without it, giving to the daughter would be an act between two people, with which a third has nothing to do. With it, the property the daughter receives yields for the husband — and the son-in-law benefits, in the strict sense, from his father-in-law.

Hence the first observation of the commentaries, and the Shakh and the Taz both make it at the same place, the seif’s first word: it is money that is at issue. For מזונות there would be nothing to say.

The difference is not of degree but of kind: over food the husband has no right to assert, since he is himself the debtor. A father who feeds his daughter merely stands in the husband’s place, and one does not benefit from a debt of which one is relieved.

The Taz adds at the same ס״ק a remark of Rashi which lights up the whole siman from behind: where it is permitted to give to the daughter, the husband may also benefit — for he then benefits from his wife’s property, not his father-in-law’s.

2. רב ושמואל — the sugya, and who follows whom

The mishna knows only one formula: “what you carry and put into your mouth”. Everything that follows is born of the question: and if the father says more broadly “do with them what you wish”?

Rav: “do with them what you wish” is a gift for everything, and the husband acquires. Shmuel: even then he does not. The Gemara then ties Rav’s view to Rabbi Meir — for it holds only if a wife’s hand is her husband’s hand.

The Taz identifies the two views of the seif

The seif carries an anonymous position, then a ויש אומרים. The Taz says which is which, and his ס״ק ב is the most useful passage in the siman: the first is the Rambam’s, following Shmuel; the second the Tur’s, following Rav.

The Rambam’s foundation, as the Taz puts it: in saying “whatever you wish to do”, the father revealed his mind — he did not give absolutely, even to her, but for what she will wish at the moment she wishes it. Something therefore always remains that has not left the giver, and the husband acquires nothing.

The Shakh gives, at ס״ק ג, the opposite reason — that of the יש אומרים: with no designation the gift is complete, the husband has already acquired, and the condition arrives upon property no longer available.

3. פשיטא — what the Shakh holds obvious, and what the Sha’ar HaMelekh sets against it

The Perisha raises a formal question and leaves it in צריך עיון: what if the father says the designation — “that you eat and clothe yourself” — but omits the clause “your husband has no right in them”?

The Shakh does not share the doubt, and his answer is categorical: without the clause the husband acquires, and that is פשיטא — it follows from the mishna, from the poskim, and expressly from the Rosh’s commentary on Nedarim 88a.

The Taz goes further still: he draws a קל וחומר from the Mehaber’s own position, and concludes that the Derisha’s question is no question.

Yet the Pit’hei Teshuva at ס״ק א reports from the Sha’ar HaMelekh an astonishment aimed at the Shakh himself — and it is no lone voice. The Ran in the first chapter of Kiddushin, the Kitzur Piskei HaRosh, the Rashba in his novellae, and the Tosafot Yom Tov reading the Rambam: all suggest that the designation suffices without the clause.

And the Sha’ar HaMelekh defuses the argument from the mishna: if it gives both formulas, it may be teaching the reverse — that the clause alone does not suffice until he has said “what you put into your mouth”.

4. ולמה לא ייתן סתם — the Taz’s question, and the counter-vow that does not help

The Taz raises at ס״ק ג the question any attentive reader must ask: since the son-in-law is forbidden to benefit, he will not benefit — he is honest. Why then not simply give to the daughter?
The answer shifts the prohibition from benefit to acquisition: the moment the wife receives, the husband has acquired — and it is as if he had received from his father-in-law and then given to his wife. The prohibition is complete at the moment of the gift, before the question of benefit arises.

What the Taz draws from it against the Perisha

The Perisha had proposed a device: let the son-in-law vow himself off those fruits, and the father-in-law may give. The Taz says this is איסור גמור, and gives two reasons.

The second reason is the finer and the more contemporary: a vow one takes on oneself can be released. A device resting on one party’s enduring goodwill is no device. The Ba’er Hetev takes it up and concludes ודלא כפרישה.

5. הראב״ד — the Nekudot HaKesef against the Rambam, and so against the Mehaber

The single entry of the Nekudot HaKesef on this siman is a dissertation, and it targets the last member of the seif: where the father says the clause without the designation, and where the Mehaber writes that the husband acquires.

The Raavad’s argument is tightly reasoned. If Shmuel says the husband does not acquire even with “do with them what you wish” — that is, even when the gift is complete — then he does not hold that a wife’s hand is her husband’s. But then why should he acquire when nothing is specified?

The Nekudot HaKesef first set aside the Kesef Mishneh’s defence, which invoked the Ran: the Ran explains the Rambam’s position, he does not answer the Raavad.

Then they bring a proof from the Yerushalmi at the end of Nedarim, where the mishna is attributed to Rabbi Meir precisely because it requires “and not to you” — showing that without that requirement the wife acquires and the husband acquires with her.

And they close on a brief remark worth its weight: the Migdal Oz writes that the Rambam ruled like Rav — which, to the Shakh, is תמוהין.

The weight of this entry must be measured. The Shulchan Arukh’s seif is the Rambam’s halakha, almost word for word. The Shakh, siding with the Raavad, is therefore not criticising a commentator: he is calling into question the Mehaber’s own last clause.

Even HaEzer 85, and the Ba’h’s two rules

The Shakh closes his ס״ק ג with a weighty cross-reference: the same author, at Even HaEzer 85:11, writes the first position without reporting the second view. An author who rules twice on one question and hesitates only once shows which way he leans.

A decision remains. But the case is double: it is a question of vows, where in a dispute of Rishonim one goes stringently; and a question of money, where the holder prevails. The two rules do not give the same result.

The Ba’er Hetev takes this entry up to its last word, and it is in that abridged form that it circulated.

Concretely: the question “has the husband acquired?” is not asked in the abstract but between two hands. If the money is still with the wife, the husband who claims it is the plaintiff and has no proof; if he has already taken it, she must prove. And above all the vow’s prohibition remains — which is why one does not rest on the monetary rule alone.
