  7. Recapitulation

1. The three formulas

עליך — “upon you”: my property is closed to you, you are the one bound. עלי — “upon me”: your property is closed to me, I am the one bound. Both — each is closed to the other. The preposition, and it alone, designates the נאסר.

2. Shared property

The two men have forbidden each other
▼
A thing jointly owned by all Israel (Temple Mount, courtyards) → permitted
▼
A thing jointly owned by the townspeople (synagogue, ark, books) → forbidden
▼
Remedy: convey to a third party the share they hold in it
▼
יש אומרים: where there is no דין חלוקה, nothing was forbidden
The criterion is not “public / private” but “do I have a share of my own in it?”. In the Temple Mount, no; in my town’s synagogue, yes.

3. What the apparatus adds

Shakh ס״ק א: מדינא yes, but by the Ra’avad’s takana one cannot forbid one’s share of the synagogue or of the books. Shakh ס״ק ב: the יש אומרים is the main view in the Shas. Taz ס״ק א–ב: four thousand characters to save the first opinion, and the יש אומרים reduced to the Ramban and the Ran alone. Ba’er Hetev ס״ק ב: sets the two face to face. Pitḥei Teshuva: see both, and the Mishkenot Yaakov.

4. The seif, clause by clause

Ten clauses — nine of the Meḥaber, one of the Rama.

SeifTextMeaning
א« ראובן שאמר לשמעון הריני עליך חרם או הרי אתה אסור בהנאתי » (שו״ע יו״ד רכ״ד:א)Reuven who said to Shimon: “behold I am חרם upon you”, or: “behold you are forbidden my benefit” —
א« ראובן מותר בהנאת שמעון ושמעון אסור בהנאת ראובן » (שו״ע יו״ד רכ״ד:א)Reuven is permitted the benefit of Shimon, and Shimon is forbidden the benefit of Reuven.
א« ואם אמר לשמעון הרי אתה עלי חרם » (שו״ע יו״ד רכ״ד:א)And if he said to Shimon: “behold you are חרם upon me” —
א« ראובן אסור בהנאת שמעון ושמעון מותר בהנאת ראובן » (שו״ע יו״ד רכ״ד:א)Reuven is forbidden the benefit of Shimon, and Shimon is permitted the benefit of Reuven.
א« הריני עליך חרם ואתה עלי שניהם אסורין ליהנות זה מזה » (שו״ע יו״ד רכ״ד:א)“Behold I am חרם upon you, and you upon me” — both are forbidden to benefit from each other.
א« ומותרים בדברים שהם בשותפות לכל ישראל כמו הר הבית והעזרות » (שו״ע יו״ד רכ״ד:א)And they are permitted in things that are in the joint ownership of all Israel, like the Temple Mount and the courtyards.
א« ואסורין בדברים שהם בשותפות לבני אותה העיר כמו בית הכנסת והתיבה והספרים » (שו״ע יו״ד רכ״ד:א)And they are forbidden in things that are in the joint ownership of the people of that city, like the synagogue, the ark and the books.
א« ומה תקנתם שיקנו חלקם שיש להם בו לאחר ונמצא שאין אחד מהם נהנה משל חבירו » (שו״ע יו״ד רכ״ד:א)And what is their remedy? That they convey to another the share they have in it, and it then turns out that neither of them benefits from his fellow’s property.
א« וי״א שהם מותרים בכל דבר שאין בו דין חלוקה: » (שו״ע יו״ד רכ״ד:א)And some say they are permitted in anything that has no דין חלוקה.
א« הגה ומי שהשאיל ביתו לבית הכנסת יש בתקנת ר׳ גרשון שאינו רשאי לאסרה על א׳ מבני הקהל אא״כ יאסרנה על כולם: » (רמ״א יו״ד רכ״ד:א)Gloss (Rama): and one who lent his house to serve as a synagogue — there is, in the takana of Rabbenu Gershom, that he may not forbid it to one member of the congregation unless he forbids it to all of them.

5. The open disputes

Three disagreements run through this siman, and none is closed by the Shulḥan Arukh itself.

The synagogue: forbidden or not? The Meḥaber’s first opinion, upheld by the Taz: forbidden. The יש אומרים, upheld by the Shakh and the Maharshal: permitted, for want of דין חלוקה. The Ba’er Hetev lays out both, the Pitḥei Teshuva refers to both and adds the Mishkenot Yaakov siman 48.
The lashes. The Rambam, reported by the Tur, distinguishes according to who spoke. The Beit Yosef warns that the Ran differs on this — see what he wrote at the end of siman 220.
The Rambam’s contradiction. The Ramban and the Ran leave it open (אסקוה בקושיא). The Ba’ḥ answers it, the Taz refutes him and proposes his own reading in three degrees.

6. Vocabulary

TermMeaning
חרם“set apart” — a vow formula that withdraws a thing from use
הנאהbenefit, in the widest sense: any advantage drawn from a thing or a man
הנודר / המודרthe one who utters the vow / the one about whom it is uttered — the mishna’s terms, which the Shulḥan Arukh replaces by Reuven and Shimon
דבר של עולי בבלwhat belongs to all Israel: Temple Mount, courtyards, the cistern on the road
דין חלוקהthe right to demand partition of jointly held property — the pivot of the whole debate
התיבהthe desk on which the scroll is laid for reading — listed by the mishna alongside the books
תקנת רבנו גרשוםthe ordinances of Rabbenu Gershom; the Rama invokes one for a house lent to a synagogue

7. Recapitulation

ע for עלי / עליך: the preposition designates the נאסר. — ח for חלק: do I have a share in this thing? — ק for קנין: the remedy is an act of acquisition, not a formula.
Golden rules. (1) Always establish the exact formula before anything else. (2) For shared property, ask: do I have a share of my own in it? (3) The seif’s remedy is a real transfer of the share, not a declaration. (4) For the synagogue and the books, the takana reported by the Shakh overrides the debate: the power to forbid does not exist.
Pitfalls. (1) Thinking the vow is reciprocal: it is so only if both formulas were uttered. (2) Confusing “public” with “no share of one’s own” — the synagogue is public and yet each has a share in it. (3) Taking the Taz’s position for the Shakh’s: they are opposed, and the Ba’er Hetev says so. (4) Forgetting that the Shakh’s ס״ק א changes plane and moves from the law to the takana. (5) Looking for the lashes in the Shulḥan Arukh: it does not mention them here; it is the Tur who reports them from the Rambam.

The line of ruling

Establish the formula: עליך binds the addressee, עלי binds the speaker, both together bind both. Property of all Israel stays open. For the town’s property the Shakh–Taz dispute remains open, and the seif’s remedy — transferring one’s share to a third party — works in every case. But for the synagogue and the books in particular, the takana reported by the Shakh in the Ra’avad’s name, and adopted by the Shulḥan Arukh in או״ח קנ״ג:ט״ו, removes outright the power to forbid. Any real situation goes to a Rav.
