1. The criterion that governs everything:

Before any question of vows, a question of property: is the courtyard divisible? Divisible → the vow takes hold, no one enters. Indivisible → the vow does not take hold, each enters his own.
Two partners · joint property · reciprocal vow
▼
Is the property divisible? (a criterion of civil law)
▼
YES → the vow takes hold · entry forbidden until division
▼
NO → the vow does not take hold · each enters “his own” (ברירה)
▼
But either way: oven, stove, mill and chickens stay forbidden

2. ברירה, and where it stops

The permission in the indivisible courtyard is no leniency: the vow seized nothing. Each step is deemed taken on ground that was his from the outset — because the courtyard was acquired on that very condition.
The limit. ברירה presupposes a share to bring out. In the wife’s נכסי מלוג the third party has none: seif 1’s permission does not transpose there. That is the whole of seif 3.

3. The use that fills the courtyard

Four named installations — oven, stove, mill, chickens — and one general rule behind them: any use that occupies the whole courtyard. They stay forbidden even where entry is permitted.

4. The compulsion to sell, and the condition of wording

The court does not punish: it prevents. The Taz gives the reason — lest the fellow stumble over a vow he never uttered. And the measure makes sense only if the sale releases: hence only for the wording חצרי.

5. The Rama’s gloss: the synagogue seat and the movable object

Two lessons. One: the word לך turns a consecration into a prohibition, for one does not consecrate “to” a person. Two: the criterion of דין חלוקה leaves the courtyard and holds for any jointly owned property — this is not a law of land but a law of co-ownership.

6. Every clause, in the order of the book

Three seifim, twenty-one clauses. The table restores the exact order of the Shulḥan Arukh, the Rama’s gloss included.

SeifTextSense
Two men who are partners in a courtyard and who vowed benefit from one another.
If it is subject to the law of division, the vow takes effect and they may not enter it.
א« עד שיחלקו ויכנס כל אחד בשלו » (שו״ע יו״ד רכ״ו:א)until they divide it, and each enters into what is his.
And all the more so, if one of them forbade his property by vow to a man of the street, that man may not enter it.
And if it is not subject to the law of division, the vow does not take effect and they may enter it.
א« בין אם הדירו זה את זה או שהדיר אחד מהם לאחד מן השוק מנכסיו » (שו״ע יו״ד רכ״ו:א)whether they forbade one another, or one of them forbade his property to a man of the street.
And that precisely when the outsider, the one to whom it is forbidden, enters for the partner’s need.
א« בין שהוא צריך לשותף בין שהשותף צריך לו » (שו״ע יו״ד רכ״ו:א)whether he needs the partner or the partner needs him.
א« אבל ליכנס בו שלא לצורך השותף אסור: » (שו״ע יו״ד רכ״ו:א)but to enter it not for the partner’s need is forbidden.
And the same law for two men who together had a seat in the synagogue, one of whom said to the other: “my share shall be hekdesh to you”.
א« דמאחר דקאמר לך הקדש ודאי כוונתו לאסרו עליו » (רמ״א יו״ד רכ״ו:א)for since he said “to you hekdesh”, his intent was certainly to forbid it to him.
א« אבל אם אמר יהא הקדש ולא אמר לך לא כוון אלא שיהיה הקדש לעניים ומותר חבירו ליהנות ולישב עליה » (רמ״א יו״ד רכ״ו:א)but if he said “let it be hekdesh” without saying “to you”, he intended only a hekdesh for the poor, and his fellow may benefit from it and sit on it.
א« והוא הדין בכל כיוצא בזה » (רמ״א יו״ד רכ״ו:א)and the same holds in every like case.
א« וכן אם היו שותפין בדבר המטלטל אם יש בו דין חלוקה אסורין בו ואם אין בו דין חלוקה מותרין בו » (רמ״א יו״ד רכ״ו:א)And likewise if they were partners in a movable object: if it is subject to the law of division they are forbidden in it, and if it is not, they are permitted in it.
When they forbade one another, they may not set up there an oven, a stove, a mill and chickens.
ב« היה אחד מהם מודר הנאה מחבירו הוא אסור בהעמדת תנור וכירים וריחים ותרנגולים » (שו״ע יו״ד רכ״ו:ב)If one of them was bound not to benefit from his fellow, he is the one forbidden to set up oven, stove, mill and chickens.
ב« ואסור ליכנס בו אם יש בו דין חלוקה וחבירו מותר בכל » (שו״ע יו״ד רכ״ו:ב)and he may not enter it if it is subject to the law of division; his fellow is permitted in everything.
And they would compel the one who made the vow to sell his share.
ב« אם נאסר בלשון חצרי שמותר בו לאחר שימכר: » (שו״ע יו״ד רכ״ו:ב)if the prohibition was worded “my courtyard”, which becomes permitted once it is sold.
ג« בעל שאוסר הנאתו על אחרים אסורין ליכנס בנכסי מלוג של אשתו » (שו״ע יו״ד רכ״ו:ג)A husband who forbids others from benefiting from him — they may not enter his wife’s מלוג property.
ג« ואינו דומה לשותף שהדיר את אחד מן השוק » (שו״ע יו״ד רכ״ו:ג)and this is not like the partner who forbade his property to a man of the street.

7. The open disputes

Four points remain disputed, and none is settled on this page. Each is a question to bring to a Rav.

1. The man of the street in a divisible courtyard. May he enter for a partner’s need? The Beit Yosef says no, the Shakh follows him in the firmest terms, the Ba’ḥ and the Taz say yes, and the Nekudot HaKesef refute the Taz. The Ba’er Hetev leaves both positions standing.
2. Does one compel where both vowed? The Ran says no, there being no envy to fear; the Rosh and the Tur say yes, and compel whichever of the two passes most often — twice sufficing to make a רגיל.
3. Whom does one compel, the vower or the one bound? The Ramban and the Rambam say exactly the opposite of each other, according to the stumbling one fears. The Meḥaber writes “the vower” without distinguishing, and the Shakh reads there that one compels either way.
4. To whom shall he sell? The Ba’ḥ refuses a sale to the partner; the Shakh finds this תמוה; then the Shakh himself, in the Nekudot HaKesef, vindicates him. To read only the Shakh is to come away with the position he abandoned.

8. Vocabulary of the siman

TermSense
דין חלוקהlaw of division: the property is large enough that dividing it leaves each a usable share — four cubits by four for a courtyard
ברירהretroactive clarification: the act performed reveals the share was already determined
שותפיןpartners, co-owners of one property
אחד מן השוקa man of the street: neither of the partners
חצרי“my courtyard” — a relation of ownership, dissolved by the sale
חצר זו“this courtyard” — the thing itself, unchanged by the sale
כופיןone compels: a measure of the court, here the duty to sell one’s share
גוד או אגוד“take or I take”: a procedure for ending co-ownership
רגילthe one who habitually passes — twice suffices, per the Yerushalmi
נכסי מלוגthe wife’s property whose fruits the husband enjoys without owning it
הקדשconsecration to the Temple; the Rama shows that “to you hekdesh” is not a consecration but a prohibition

9. Recap — to remember

The siman in four words: חלוקה decides · ברירה permits · תנור forbids anyway · חצרי makes the sale worth ordering.
Golden rules. (1) Ask the property question first — is division possible? — before any question of vows. (2) “The vow does not take effect” is not “it is permitted”: nothing was seized, so the other ordinary uses follow. (3) Entry and installation are two distinct regimes. (4) Establish the exact wording — “my courtyard” or “this courtyard” — before speaking of compulsion.
Classic pitfalls. (a) Thinking “one compels the vower” always means the one who uttered the vow: the Ramban and the Rambam contradict each other, and the Shakh reads both senses in the Meḥaber’s silence. (b) Thinking that permission to enter carries permission to install. (c) Relying on the Shakh sק 13 without reading the Nekudot HaKesef, where he retracts. (d) Transposing to a movable object or to מלוג property what holds for the courtyard — the Rama makes the first transposition, the Meḥaber refuses the second.
In practice. This page is a study tool, not a ruling. Siman 226 involves a real vow, real property and, often, a real quarrel: three reasons not to decide for oneself. Record the exact words spoken, the nature of the property and whether it can be divided, then bring it all to your Rav.
