What this page covers

  1. The siman’s two rules, and the limit that bounds them
  2. When the part carries the whole — and when it does not
  3. The vow uttered twice: how many releases, and how to ask for them
  4. The order of releases: one criterion for seifim 4 and 9
  5. A community ḥerem, and the two distant men
  6. “אינו יהודי” — and the Radbaz’s warning
  7. Four situations, and the question to ask in each
This level sets out the halakha as the Shakh, the Taz, the Ba’er Hetev, the Pitḥei Teshuva and the Nekudot HaKesef give it on this siman. It does not replace a Rav. A note on the compartment: the Admur HaZaken wrote no Shulḥan Arukh on Yoreh De’ah. This level is therefore a level of psak, not a “Daat HaRav”; not one of its lines rests on a text that does not exist.

1. The two rules, and the limit

Two rules, and they do not intersect: the first concerns a vow covering several things, the second a vow repeated about one thing. Never apply one in place of the other.
And the limit, which holds for both:
The first question to ask, always. Is there someone else with a right? A lender, an employer, a partner. If so, this siman does not apply: the partial remission he grants releases only what it covers, and the rest remains owed.

2. When the part carries the whole

The criterion, given by the Shakh and the Taz in the same terms: the undoing must uproot from the origin.
The two opinions on פתח and חרטה, and they matter, since our releases today are by חרטה:
The real case, reported by the Pitḥei Teshuva in the name of the Ḥavot Yair — a man who had vowed to fast and had one day released:
The practical line, as the Pitḥei Teshuva reports it from the Ḥavot Yair. The merit of the past is not lost, and he may continue. But going forward, it is the Ḥavot Yair who concludes, at the end of his siman 129, that one should be strict and take the undertaking on again — and it is to that conclusion that the Pitḥei Teshuva refers. And to know whether the vow did fall entire, one must know what was said before the three — which the person concerned generally no longer does. One more reason to bring the question to a Rav.

3. The vow uttered twice

The Shakh attaches a condition not in the text, and he rests it on siman 228:46:
Yet the seif he invokes says the opposite for this very case — and since the whole question turns on it, here it is in full:
The Taz upholds that ruling of the Shulḥan Arukh and expressly rejects the Maharlbaḥ’s release of them all at once:
And here is the reason he gives, and he gives none firmer:
On the other leniency — releasing the second oath before the first — the Taz is guarded in the same way:
And the Shakh himself, at the place the Nekudot HaKesef point to, calls for stringency a priori:
And the Nekudot HaKesef conclude, having in fact defended the Maharlbaḥ:
The practical line is the stringent one, and it is not the convenient one. A vow uttered twice over the same thing requires two separate releases: first the first vow; once it has fallen, the second takes effect and is released in its turn. That is what the Shulḥan Arukh says at siman 228:46, what the Taz upholds, what the Shakh requires a priori, and what the Nekudot HaKesef close the debate on. Release of them all at once — a single request covering every vow together — is the contested path, not the safe one: the Shakh holds it valid but says to refrain from it a priori so long as the other way is open, and the Taz refuses it on a reason of substance. Tell the Rav that the vow was repeated, and how many times. Whether there is ground to rely on the leniency is his to decide: this page does not settle what the Shulḥan Arukh leaves to him.

4. The order of releases

The siman gives two opposite orders, and that is what confuses. At seif 4: the clause first, the vow after. At seif 9: the vow first, the clause after. Here they are in the order of the Shulḥan Arukh — seif 4, then seif 9, in which the criterion governing both is written:
The rule, in one sentence: one releases what has already taken effect, in the order in which it took effect. At seif 4 the clause “I shall not ask” took effect at once; at seif 9 the second oath has not yet taken effect, since it depends on a future event. So this is not a rule to memorise but a question to ask of each case: what has already taken effect?

5. A community ḥerem, and the two distant men

A practical consequence, and it is a matter of counting. If the resolution carried “no release” and “no release of the release”, three releases are needed: the second clause, the first clause, then the ḥerem. The number depends entirely on the formula that was voted. So the exact text of the resolution is required — and it is a matter for a beit din, not for an assembly.
And the same demand for precision. Two names: proceed as at seif 6. Three names: the vow becomes על דעת רבים, and the regime is that of siman 228:21 — far heavier. Count the names before concluding.

And the Pitḥei Teshuva brings on this the Radbaz, on a neighbouring formula that had spread in his day:
What to retain in practice. These formulas are not a manner of speaking: the Rama says that whoever used them needs atonement, and the Radbaz asks that whoever utters them be reproved. If someone has said something of this kind, the question goes to a Rav without delay — and it concerns two things at once: the vow, and the formula.

7. Four situations

“I vowed not to eat meat for a year, and the Rav released me for a wedding meal.” Everything depends on what was said at the release, and on the two opinions of seif 1. Do not conclude on your own that the vow fell entire. Go back to the Rav who released you, with the question put in these terms.
“I promised money to someone, and he remitted me half.” This is not the siman. The end of seif 1 is explicit: the other half remains owed.
“I think I made the same vow twice, but I am not sure.” Tell the Rav, and tell him how many times. The safe course is two separate releases, in order; whether to ask for the release of them all together is his to decide.
“Our community passed a solemn resolution, swearing never to go back on it.” Seif 4 and the Taz at ס״ק י״ב apply, and the number of releases depends on the exact formula that was voted. Bring the minutes.
What this level does not say. It does not say how a release is performed — siman 228. It does not say whether it should be asked for — siman 230. It does not say who is qualified to release — siman 231. And it does not say what becomes of a vow made on a mistaken belief — siman 232.
