Yoreh De'ah · Nedarim

Siman 232 — The four vows that do not bind

The neighbouring simanim say what binds and how one dissolves. This one says that there are utterances that never bound — and that it is nevertheless forbidden to speak them.

There are vows that need no dissolution: vows of urging, of exaggeration, of error, of duress. The siman’s first sentence does not say how one dissolves — it says there are vows with nothing to dissolve.

Choulhan Aroukh, Yoreh De'ah 232:1

Frequently asked questions — Siman 232

What is a “vow of urging” (נדר זרוזין)?

A vow uttered not to forbid oneself something, but to make one’s interlocutor yield — typically in bargaining. The Choulhan Aroukh gives its reason at seif 2:

The Taz, at ס״ק ב, makes it precise: they wanted three dinars from the outset, so the vow lacks the agreement of mouth and heart. But three things bring it back — a sale that fails, a declaration of having meant to vow, a gap too wide to be bargaining — and the Rama forbids at seif 3 extending the rule to a neighbouring case.

May one use this siman to declare oneself released from an undertaking?

No, and the siman itself says so in two places. The Rama closes off analogy at seif 3, and the Mehaber forbids at seif 13 vowing in this way:

The Taz, at ס״ק כ״ב, observes that this prohibition can bear only on three of the four families, since a man does not know in advance that duress will come. A permission is therefore never a licence, and a real question goes before a Rav.

What is the difference between a vow of exaggeration and a vain vow?

Exaggeration is a figure of speech no one takes literally (seif 4). The vain vow has an object genuinely impossible to keep — and the Choulhan Aroukh writes so at seif 5:

The distinction is not theoretical: the Taz teaches at ס״ק כ״ה that a vain vow leaves a prohibition standing, which is why seif 14 still requires an inner reservation. The Chakh, at ס״ק ט, adds that one who says he had a day or two in mind is believed — but he goes straight on: one who forbade himself only part of the fruits is not believed, except under the duress of seif 14.

Does the siman permit swearing falsely before an authority?

Seif 14 permits it in a narrow case and at once hedges it. Its first condition is that the authority act outside its right:

The Taz explains it at ס״ק כ״ד: without this there is no theft, for the law of the kingdom is law. And the Rama makes the permission fall as soon as the truth will be known, because of the profanation of the Name. The Pit’hei Techouva, at ס״ק י״ב, says expressly that a teacher was wrong to use it to cover a true fact.

Does financial ruin release one from an undertaking?

Seif 16 answers for the case of the promised dowry, and its phrase is famous:

But the threshold is precise: no debts, no land, no goods remaining — only the dwelling house and household utensils being out of account, as the Chakh details at ס״ק מ״ב. And the Pit’hei Techouva reports at ס״ק י״ד that, per the Hatam Sofer, the Rosh exempts here on the ground of a self-evident condition. Such a threshold is not for a man to assess himself.

What is a vow “hung upon a thing”?

It is the fifth case, announced at seif 1 and treated at seif 19: the vow was true, and its reason has since ceased.

The Taz distinguishes it at ס״ק ל״ב from the vow of error at seif 6: there the stated reason was false from the outset; here it was true and came undone. The Chakh, at ס״ק מ״ה, gives the test: a man is liable to die or to repent, which an ugly woman becoming beautiful is not.
