1. The rule, in one sentence

Release a vow on one of its parts, and the whole vow falls — because release does not take away the prohibition, it establishes that it should never have existed. And if the same thing was forbidden twice, two releases are needed.
The limit never to forget. All this holds only for a vow one makes for oneself. Once a third party has a right — a debt, a promised piece of work — a partial remission releases only what it covers.

2. The mechanism

A man vows, and the vow covers several things or several people
▼
One part is released — by פתח, or on the second view by חרטה
▼
The release uproots from the origin: the vow’s implicit condition falls
▼
So the whole falls — unless the undoing does not uproot (חרם, הפרת בעל: seif 2)
▼
And unless a third party had a right — then each part stays what it is

3. Where it comes from

The rule — Rabbi Akiva, נדרים ס״ו ע״א and נדרים כ״ה ע״ב. The cases of seif 1 — the Rambam, הלכות נדרים פרק ד׳ הלכה י״א, almost word for word. The chains of seif 3 — הלכות נדרים פרק ג׳ הלכה ג׳ and פרק ד׳ הלכה י׳. The order of seif 4 — הלכות שבועות פרק ו׳ הלכה י״ג, another book of the Rambam. The example of seif 1 — it is the פתח the Rambam puts at the head of his list, at הלכות שבועות פרק ו׳ הלכה י״א.

4. The fifty-nine entries, by work

WorkEntriesWhat it contributes of its own
ש״ךי״טEight ס״ק on seif 1 alone. He carries the siman: the distinction from siman 232 (ס״ק ד), the reason for the exception at seif 2 (ס״ק ט), the difference between attachment and “ואני” (ס״ק י״א), the hidden condition of the repeated vow (ס״ק י״ג) and its retroactive mechanism (ס״ק י״ד).
ט״זי״זThe reason for the rule (ס״ק א), the maḥloket over שיחליף דבריו (ס״ק ה), the immense ס״ק י on releasing the second oath, the two releases of the last ḥerem (ס״ק י״ב), the limit of two releasers (ס״ק ט״ו) and the question on seif 7 (ס״ק ט״ז).
באר היטבי״גAlmost everything is taken from the Shakh or the Taz — and that is its value: ס״ק ג and ס״ק ז set the siman’s two splits side by side, which neither of the other two does.
פתחי תשובהו׳The responsa: the Maharshdam and the Shaar HaMelekh (ס״ק א), the Ḥavot Yair on the interrupted fast (ס״ק ב), the Ḥatam Sofer (ס״ק ג and ד), the Radbaz on a widespread oath formula (ס״ק ה).
נקודות הכסףד׳Four answers to the Taz, on his ס״ק ה, י, ט״ז and י״ז. They are what arbitrate the siman’s two maḥlokot.

5. The nine seifim

SeifTextWhat it settles
א« נדר שהותר מקצתו הותר כולו » (שו״ע יו״ד רכ״ט:א)a vow released in part is released entire, and the cases that follow
ב« אם החרימו או נידו עשרה בני אדם והתירו אחד מהם הוא מותר וכולם אסורים » (שו״ע יו״ד רכ״ט:ב)the ḥerem of ten men, and the husband’s הפרה
ג« נדר מאחד ואמר על אחר יהא כפלוני כולם אסורים אפי׳ עד מאה » (שו״ע יו״ד רכ״ט:ג)the chains: attachment, the “ואני”, and the vow uttered twice
ד« נשבע על דבר אחד ונשבע שלא ישאל על שבועתו נשאל תחילה על האחרונה שנשבע שלא יתירו לו ואחר כך ישאל על הראשונה » (שו״ע יו״ד רכ״ט:ד)the order of releases when one has sworn not to be released
ו« אם נשבע על דבר אחד והתנה שלא יוכלו להתיר לו אלא פלוני ופלוני שהם בארץ מרחקים » (שו״ע יו״ד רכ״ט:ו)the two distant men named as sole releasers
ז« אם התנה בשעת שבועתו שלא תהא ניתרת לעולם אין תנאו כלום דדברים בעלמא הם » (שו״ע יו״ד רכ״ט:ז)the clause “never to be released”, which is worth nothing

6. What remains open

פתח or חרטה? Seif 1 gives two opinions, and the question is practical since our releases are by חרטה. The Pitḥei Teshuva at ס״ק ב reports the Ḥavot Yair on an interrupted fast and, for practice, refers to what the latter concludes at the end of his siman 129: “ ובסוף סי׳ קכ״ט דלמעשה יש להחמיר לחזור ולקבל להבא ” (פתחי תשובה יו״ד רכ״ט ס״ק ב).
Must he change his words? The Taz at ס״ק ה requires it, following siman 232:8; the Shakh at ס״ק ד distinguishes and does not; the Nekudot HaKesef find against the Taz. The Ba’er Hetev at ס״ק ג reports both.
May the second oath be released before the first? The Taz at ס״ק י says no, and further refuses the Maharlbaḥ’s grouped release; the Shakh at ס״ק י״ג allows it if the request covers all the vows at once; and the Nekudot HaKesef defend the Maharlbaḥ before concluding “ ומכל מקום יש להחמיר בדבר וכמ״ש בש״ך סימן רכ״ח ס״ק ק״י ” (נקודות הכסף יו״ד רכ״ט).

7. Vocabulary

פתח — the opening: the sage shows a fact the vower had not considered. · חרטה — present regret. · התפסה — attaching a thing to one already forbidden; no time limit. · תוך כדי דיבור — the window of the “ואני”. · על דעת רבים — the regime triggered by naming three releasers (Taz ס״ק ט״ו). · נעקר מעיקרו — “uprooted from the origin”: the criterion that governs the whole siman.

8. Recapitulation

ע for עוקר מעיקרו: this is the criterion to remember, and it explains seif 1 and the exception of seif 2. — ל for לעצמו: and all this holds only for a vow one makes for oneself. — ח for חל: one releases what has taken effect, in the order in which it took effect.
Golden rules. (1) Always ask first: is there a third party with a right? If so, the siman does not apply. (2) Never move from “the vow is released” to “everything is released” without knowing how it was released. (3) Faced with a repeated vow, count the vows and plan for two separate releases: that is what the Shulḥan Arukh requires at siman 228:46, and releasing them all together is the contested path, not the safe one.
And the Shulḥan Arukh has already settled this case elsewhere: “ אבל מי שנשבע על דבר אחד פעמים ושלש צריך התרה לכל אחד ואחד ” (שו״ע יו״ד רכ״ח:מו). In practice: two separate releases, in order — the first vow, then the second once it has taken effect. Releasing them all together is the contested path, and it is asked for only on the Rav’s decision.

The line of psak

A vow released on one part falls entire, provided it is a vow made for oneself and the release uprooted from the origin. A vow uttered twice requires two separate releases, in order — first the first vow, then the second once it has taken effect — as the Shulḥan Arukh rules at siman 228:46; releasing them all together, which the Shakh allows and the Taz refuses, is asked for only on the Rav’s decision. The order is not fixed: one releases what has taken effect, in the order in which it took effect. A community ḥerem accompanied by a clause of irrevocability requires two or three releases depending on the formula used. And none of these questions is settled without a Rav: the exact wording that was uttered decides everything, and it is rarely the wording one remembers.
