What we shall ask of the text

  1. Why this siman runs to one line where the Tur runs to a column
  2. What “אי עביד לא מהני” is doing in a siman of nedarim
  3. The Noda BiYehuda’s distinction: the transgression in the act, or beside it
  4. Why the brake sits with the Rama and not with the Meḥaber

1. One line here, a column in the Tur

The first thing to see is a disproportion. The Shulḥan Arukh settles this siman in seven words; the Tur devotes to it a discussion in which the Rif, Rav Hai Gaon and the Rosh follow one another. The disproportion is not an accident of drafting: it measures a closed controversy.

The Rif, first, does not refuse release but rations it:

Rav Hai Gaon goes much further. Not only does he hold that an oath sworn on a sacred book has no release, he states a general thesis about the generations:

The difficulty is head-on. If “in the last generations no man has the power to release an oath”, then the whole of siman 228 — פתח, חרטה, מומחה, three הדיוטות — becomes a dead letter. This is not a restriction of detail: it is the abolition of the institution.
The Rosh’s answer comes on two levels, and they are worth separating. The first is legal: release is from the Torah, and what was done in the days of the Geonim is not a rule but a ḥerem, a measure of circumstance.
The second is factual, and it is what decides the matter: the Rosh saw what the measure produced. Forbidding release did not make people more careful in their oaths; it only left them with oaths they could not keep. He then concludes with a sentence in the first person, rare in his pen:
Nafka mina for reading the Shulḥan Arukh. His parenthesis “ כן נהגו על פי ש״ס ופוסקים עיין בית יוסף ” (שו״ע יו״ד ר״ל:א) is not a bibliographical reference: it is the verdict of that controversy, delivered in the name of practice. A short siman is not a siman without stakes; it is a siman whose stakes were settled elsewhere.

2. “אי עביד לא מהני” in a siman of nedarim

The Rama’s closing clause shifts the question. Until now we asked: does the oath hold? From here on: does the act done against the oath hold? These are two distinct questions, and one may perfectly well answer “he transgressed” to the first and “the sale is valid” to the second. The whole of this section rests on that division.

The Taz gives the reason for this opinion, then refuses it:

The maḥloket is not where one expects it. The Taz does not say the principle is false; he says it was not adopted — neither in Ḥoshen Mishpat 208, nor at siman 228:35. It is an argument from where the law stands. The Shakh answers on the same ground, but his survey of positions is different:
Three authorities, three verdicts: the Rama of Ḥoshen Mishpat upholds the sale; the Sma voids it, as here; the Baḥ refuses to decide and refers the matter to the law of proof. And the Shakh, who is the Taz’s great opponent, concludes with the Baḥ — that is, with neither the Rama here nor the Rama there.
The yesod the Shakh contributes, and it is his own. He does not merely count votes: he brings from the Rosh a distinction that explains why the two Ramas do not contradict one another.
On this reading the principle אי עביד לא מהני applies only to commandments that cannot be undone — the Rosh names the man compelled to marry the woman he violated who then divorces her, and one who separates terumah from the poor produce for the good. There the Torah can enforce its word only by depriving the act of effect. But a takana, a ḥerem — and, in our case, a personal oath — can be undone another way: by release. So the Torah has no need to void the act, and Rava himself grants it.

3. The Noda BiYehuda: the transgression in the act, or beside it

The Pitḥei Teshuva brings a distinction found in neither the Taz nor the Shakh, and it moves the debate up a level. It no longer asks which authority prevails, but which oath we are speaking of.
The ḥakira, stated plainly. When an oath forbids a sale, does the prohibition fall on the fact of selling or on the legal act of sale? If the oath says “I shall not sell this thing”, the legal act itself is what the oath forbids: the body of the transaction is made in transgression. If the oath says “I shall not sell without consulting so-and-so”, the legal act was permitted; what is faulty is having performed it in a certain setting.
The comparison with the one who slaughters on Shabbat is exact and lights up everything: his sheḥita is valid — the animal may be eaten — and yet he has desecrated Shabbat. The act and its moral quality come apart. The Noda BiYehuda says the second kind of oath is of that species, and the first is not.
The nafka mina is immediate. The wording of the oath, at the moment it was uttered, decides the validity of an act performed years later. A clause that looked like mere phrasing — “without my brother’s agreement” — changes the answer. One more reason to settle nothing without the exact text of what was sworn.

4. Why the brake sits with the Rama and not with the Meḥaber

Read the structure of the seif again. The Meḥaber writes no restriction at all: one releases, and one releases even the oath sworn on the Name. Every limit comes from the Rama. This is not a disagreement of substance — the Meḥaber surely does not think one releases lightly — it is a difference of burden.
The Meḥaber writes the din: what the extent of the sage’s power is. The Rama writes what, in Ashkenaz, had begun to go wrong: people swearing because they knew they could get released. The Shakh says so without circumlocution, reporting the Maharam Mintz:
There the problem is named: not a doubt about the halakha, but a use of the halakha as an exit planned in advance. And the Maharam Mintz’s solution is not to close the door — he releases — but to make it costly:
And the Shakh limits the brake the other way. The Rama had written מדוחק alone, which could have been read as “only in distress”. The Shakh adds the second opening, in the name of the Rivash in the name of the Ramban:
What remains open, and should be left open. Neither the Rama nor the Shakh defines what a דוחק is, nor what counts as צורך מצוה. That silence is no gap: both notions are by nature relative to a man and to a vow — “לפי האדם ולפי הנדר”, as the Maharam Mintz says of the measure he imposes. They are weighed before a Rav, case by case.
