What this page covers

  1. What the siman settles, and what it leaves open
  2. The self-annulment clause: what it produces
  3. A third party’s refusal: what it produces, and on what condition
  4. The vow for a term
  5. A third party’s confirmation, and what can no longer be undone
  6. Four situations, and the question to ask in each
This level sets out the halakha as the Shakh, the Taz and the Ba’er Hetev give it on this siman. It does not replace a Rav. A note on the compartment: the Admur HaZaken wrote no Shulḥan Arukh on Yoreh De’ah. This level is therefore a level of psak, not a “Daat HaRav”; not one of its lines rests on a text that does not exist.

1. What the siman settles, and what it leaves open

Settled: there are only two ways of release, and no clause creates a third. Also settled: a vow for a term needs nothing. Left to judgement: whether, in a given case, the third party reacted “immediately”, and whether he had the power to do so at all.

2. The self-annulment clause

The foundation, which the Rambam gives in six words:
A practical consequence, and an everyday one. Someone who wishes to take on a practice for a time must not say “and I shall be able to release myself whenever I wish”: that clause produces nothing, and he will be left with the whole vow on his hands. He should say for such a time — the limit inside the vow works, the limit upon the vow does not. And better still: let him take it on בלי נדר.

3. A third party’s refusal

The Shakh specifies the reach of the power and, what matters most, the form it may take:
The Taz sets the time condition, and it is strict:
And the Taz also sets a substantive condition, which siman 228:37 confirms:
But the Shakh answers the same תמיה differently, and his answer requires no declaration of intent: two mechanisms, in which the vow has simply not yet taken effect.
What to retain in practice. A vow made “on the consent of” someone is not automatically revocable by that person, and in any case the third party must exercise it immediately — that is the Taz’s condition of time at ס״ק ג, and no one contests it. The condition of substance, however, is open: for the Taz at ס״ק ב the vower must have said that such was his intention from the outset; for the Shakh at ס״ק ב it is enough that the vow has not yet taken effect — either because it is annulled in that very instant, or because it was framed so as to take effect only once heard. On the other hand, the form of words does not matter: the Shakh says expressly “בכל לשון”. Which of the two readings applies to a real case is not an act of reading: it is a judgement, and it belongs to a Rav. This page does not settle between the Taz and the Shakh.

4. The vow for a term

Nothing to do at the term. No three men, no formula, no procedure. This clause opens no question — and that is why it is the right advice to give. One caution, however: the term must actually have been uttered at the moment of the vow. A term one recalls having had “in mind” is not an uttered term, and there the question returns to the Rav.

5. A third party’s confirmation, and what can no longer be undone

The case is commoner than it looks. Two people agree that one’s undertaking will hold if the other approves it. The other approves. Then, later, he changes his mind and has his approval released. The seif says that avails nothing: what he released was his own act, and the vow took effect at the moment of approval. To undo it, a proper release of the vow itself is required.

6. Four situations

“I took a practice upon myself, reserving the right to end it whenever I wish.” The reservation produced nothing. If the undertaking was framed as a vow, a proper release is required. Ask a Rav whether what you said constitutes a vow: that is the first question, and not the easiest.
“I vowed on condition that my spouse agreed, and he refused on the spot.” Very probably the vow never took effect, and his words hardly matter. But “on the spot” is counted in moments, not in days. A question of fact, to be brought to a Rav.
“I vowed for thirty days.” At the term there is nothing to do. This is the simple case, and the one to learn to produce.
“My wife and I undertook to one another by a תקיעת כף.” The Taz treats exactly this case in the second paragraph of his ס״ק ג, and his conclusion is twofold: he proves that nothing took effect, and he nevertheless says to perform a release — “ ומעתה גם נדרה אינוחל כי לא נדרה אלא על דעת אם הוא יקיים נדרו ותקיעת כף יש לו התרה ולרווחא דמילתא יתירו לה ” (ט״ז יו״ד רל״א ס״ק ג). An undertaking between spouses is never dismantled by reasoning alone. Bring it to a Rav, with the exact words that were spoken.
What this level does not say. It does not say how the release is performed — that is at siman 228, especially at seifim 37 and 38, which are the counterpart of ours. It does not say whether one should ask for a release — that is at siman 230. And it does not say what becomes of a vow released in part — that is at siman 229.
