Our Sages taught (מגילה כ״ו:) the principle that governs this siman: תשמישי קדושה — נגנזין — an object that serves the sacred directly carries its own sanctity, and when worn out it is not discarded but buried (גניזה), whereas a mere accessory of an accessory (תשמיש דתשמיש) has no such sanctity. Hence the care of the cloths and cases, the conduct when they age, what may be transformed, and the régime of the lights. We study here at the level of principle; for personal conduct, one refers to the custom and to the ruling of the Rav.

A. The sacred objects and lights — the ט״ו seifim

תַּשְׁמִישׁ קְדֻשָּׁה — an accessory of sanctity — an object made to hold or carry the sacred directly (séfer torah, téfilines, mezouza) itself takes on sanctity: worn out, it requires גניזה (burial). But what merely protects the accessory — a תשמיש דתשמיש (an accessory's accessory) — has no such sanctity. Two principles govern the whole siman: מעלין בקודש ואין מורידין (one raises in sanctity, one does not lower) and לב בית דין מתנה עליהם (the court stipulates in advance), which permits certain uses.

Séif 1 — רחבה של עיר: the town square and the aron

רַחֲבָה שֶׁל עִיר, אף על פי שמתפללין בה בתעניות, אין בה משום קדושה, מפני שהיא עראי; וכן בתים וחצרות שמתקבצים בהם להתפלל באקראי, אין בהם שום קדושה. הגה: ויש אומרים דלא מקרי ארון הקודש אלא אם הוא כמין ארגז שאינו עשוי רק לכבוד התורה, אבל ארון הבנוי בחומה שנעשה לשמירה לא מקרי תשמישי קדושה, וכל שכן אם הספרים מתקלקלים בו דמותר ליטלו משם.
Séif 1: the town square, although one prays there on fast days, has no sanctity, since its use is occasional (עראי); likewise houses and courtyards where people gather to pray by chance have no sanctity. Rama: some say that a fixture is called « aron haqodesh » only if it is a kind of chest made solely for the honour of the Torah; but a niche built into the wall, made for storage, is not a תשמיש קדושה — and all the more so, if the books are being damaged in it, one may remove them.
The sanctity of a place or object depends on its fixed designation for the sacred. An occasional use (עראי) does not sanctify; and a chest built merely for storage is not a true aron.

Séif 2 — השוכרים בית: the rented house

הַשּׂוֹכְרִים בית ומתפללים בו, אין לו דין בית הכנסת.
Séif 2: those who rent a house and pray in it — it does not have the status of a synagogue.
A rented space for prayer does not acquire the sanctity of a בית הכנסת, lacking a fixed and dedicated consecration.

Séif 3 — תשמישי קדושה: the heart of the siman

תַּשְׁמִישֵׁי קְדֻשָּׁה, כגון תיק של ספרים ומזוזות ורצועות תפילין, וארגז שנותנין בו ספר תורה או חומש, וכסא שנותנין עליו ספר תורה, ווילון שתולין לפני ההיכל, יש בהן קדושה וצריך לגנזן. הגה: ודוקא הדבר שמניחין בו דבר הקדושה בעצמו לפעמים, או שנעשה לכבוד, כגון המכסה שעל הקרשים של הספרים; אבל אותו מכסה שהוא לשמור אותו מכסה שעל הקרשים, לא מיקרי תשמיש, דהוי תשמיש דתשמיש, וכל כיוצא בזה. ואסור לכבס מטפחת של ספר תורה במי רגלים מפני הכבוד.
Séif 3: the תשמישי קדושה — the case (תיק) of séfarim, mezouzot and téfilines' straps, the chest (ארגז) in which a séfer torah or a houmach is placed, the seat (כסא) on which a séfer torah is set, the curtain (וילון) hung before the heikhal — carry sanctity and must be buried (גניזה). Rama: and this applies to that in which the sacred object itself is at times placed, or which is made for its honour, such as the cover over the boards of the books; but a cover made to protect that cover is not an accessory (תשמיש), for it is a תשמיש דתשמיש, and likewise for all that resembles it. And it is forbidden to wash a séfer torah's cloth with urine (מי רגלים), out of respect.
An object is a תשמיש קדושה if it directly touches or carries the sacred, or is made for its honour; it then requires גניזה. What merely protects the accessory is a תשמיש דתשמיש and has no such sanctity.

Séif 4 — מטפחות שבלו: the worn cloths

מִטְפְּחוֹת ספר תורה שבלו, יכולים לעשות מהן תכריכין למת מצוה, וזו היא גניזתן.
Séif 4: the cloths (מטפחות) of a séfer torah that are worn out — one may make of them shrouds (תכריכין) for a met mitsva, and that is their גניזה.
גניזה is not only in the earth: giving a worn sacred object an equally honourable use — the shroud of a met mitsva (a deceased whom none tends to) — counts as burial.

Séif 5 — ספר תורה שבלה: the worn séfer

סֵפֶר תּוֹרָה שבלה, מניחין אותו בכלי חרס וגונזין אותו בקבר תלמיד חכם, אפילו אינו אלא שונה הלכות ולא שימש תלמידי חכמים.
Séif 5: a worn séfer torah — one places it in an earthen vessel (כלי חרס) and buries it in the grave of a talmid chakham, even if he was only a repeater of halakhot and did not serve the Sages.
The worn séfer is buried in an earthen jar, beside a תלמיד חכם — the Torah rests near one who bore it. Even a modest scholar is fitting.

Séif 6 — מעלין בקודש: transforming an object

אֵין עוֹשִׂין מתיבה כסא לספר תורה, אבל מותר לעשות מתיבה גדולה קטנה; וכן מותר לעשות מכסא גדול כסא קטן, אבל אסור לעשות ממנו שרפרף לכסא. וכן מותר לעשות מוילון גדול וילון קטן, או לעשות ממנו כיס לספר תורה, אבל לעשות ממנו כיס לחומש אסור. הגה: ופרוכת שאנו תולין לפני הארון אין לו קדושת ארון רק קדושת בית הכנסת, וכן הכלונסות שבו תולין הפרוכת; ומכל מקום אסור לעשות מהם העצים שמסמנים בו הקריאה לחובת היום, שאינן קדושים כמו הם.
Séif 6: one does not make a seat for the séfer torah out of a chest (תיבה), but it is permitted to make a small chest from a large one; likewise one may make a small seat from a large one, but it is forbidden to make of it a footstool (שרפרף) for the seat. Likewise one may make a small curtain from a large one, or make of it a cover (כיס) for a séfer torah, but making of it a cover for a houmach is forbidden. Rama: the parokhèt we hang before the aron does not have the sanctity of the aron, only the sanctity of the synagogue, as do the poles from which the parokhèt is hung; nevertheless it is forbidden to make of them the rods that mark the day's reading, for they are not as holy as they are.
מעלין בקודש ואין מורידין: one may make of a sacred object something of equal or higher rank (a small one from a large one), but never lower it — a chest (which holds the séfer) into a mere seat, or a curtain into a houmach's cover (a lower degree).

Séif 7 — הבימה: the platform

הַבִּימָה, כגון בימה שהיו עושים למלך, אין בה קדושת ארון אלא קדושת בית הכנסת.
Séif 7: the platform (בימה), like the platform that was made for the king, does not have the sanctity of the aron, only the sanctity of the synagogue.
The bima serves the congregation, not to hold the séfer: it has the (lesser) sanctity of the place, not of the aron.

Séif 8 — תנאי: the stipulation

הָאָרוֹן וכל מה שעושים לספר תורה, מועיל בו תנאי להשתמש בו שאר תשמיש אפילו דחול. הגה: ונהגו ליהנות בכמה הנאות מדברי קדושה, כגון מטפחות של ספרים ושלחן שבבית הכנסת ומעילים של ספר תורה; וכתבו הטעם, משום דכיון שנהגו כן ואי אפשר ליזהר, לב בית דין מתנה עליהם מעיקרא, כדי שלא יבואו בני אדם לידי תקלה; ואף על גב דלא התנו, כאילו התנו דמי.
Séif 8: the aron and everything made for the séfer torah — a תנאי (a prior stipulation) permits using it for another use, even a mundane one. Rama: it is customary to derive various benefits from sacred items, such as the cloths of séfarim, the synagogue's table and the mantles of the séfer torah; and they wrote the reason: since people act thus and it is impossible to be scrupulous, the court (לב בית דין) stipulates about them from the outset, so that people do not stumble; and even though they did not stipulate, it is as though they had (כאילו התנו דמי).
A תנאי set in advance lowers the level of setting-apart and permits a mundane use. The Rama generalizes: לב בית דין מתנה עליהם — the court has stipulated in advance, so that even without an explicit stipulation the custom has a basis.

Séif 9 — מטפחות שהוקדשו: for which séfer?

הַמִּתְנַדְּבִים ספר תורה ומניחים מטפחות בבית הכנסת, מותר להשתמש בהן כל ספר וספר, שלדעת כן הוקדשו; אבל המניחים בביתם ואחר כך מקדישין, כיון שעל דעת אותו ספר נעשה ונשתמש בו אותו ספר, אסור להניחו בספר תורה אחר; ויש מתירין.
Séif 9: those who donate a séfer torah and deposit cloths (מטפחות) in the synagogue — it is permitted to use them for any séfer, for it was with that intent that they were consecrated; but those who keep them at home and then consecrate them, since the cloth was made and used for that particular séfer, it is forbidden to place it on another séfer torah; and some permit.
The intent of the consecration fixes the scope of use: a cloth given to the synagogue serves every séfer; a cloth tied to a particular séfer remains, per the first view, reserved for it — but יש מתירין.

Séif 10 — עטרות ספר תורה: the crowns

הַנּוֹהֲגִים להניח עטרות ספר תורה בראש הקורא בסיום התורה, אין מוחין בידם; אבל המניחים אותם בראשי חתנים דעלמא, מוחין בידם.
Séif 10: those who have the custom of placing the séfer torah's crowns on the head of the one who completes the Torah (the chatan Torah) — one does not stop them; but those who place them on the heads of ordinary bridegrooms — one stops them.
A use bound to the honour of the Torah (the siyum) is tolerated; diverting the séfer's ornaments to a mundane use (ordinary bridegrooms) is forbidden — that is a lowering of sanctity.

Séif 11 — נרות של עכו״ם: an idolater's candles

נֵרוֹת של שעוה שנתנום עובדי כוכבים לעבודת אלילים, וכיבן שמשן ונתנן או מכרן לישראל, אסור להדליקם בבית הכנסת. הגה: אף על פי שמותרים להדיוט. מומר או עובד כוכבים שנתן שעוה או נר לבית הכנסת, אסור להדליקו.
Séif 11: wax candles that idolaters had given for an idolatrous rite, which their attendant extinguished and then gave or sold to a Jew — it is forbidden to light them in the synagogue. Rama: even though they are permitted for a mundane use (הדיוט). A renegade or an idolater who gives wax or a candle to the synagogue — it is forbidden to light it.
What has served an idolatrous rite, or the gift of a renegade, is kept from the synagogue's service — even though its ordinary use is permitted, it does not befit the sacred (distancing out of honour).

Séif 12 — עכבר בשמן: the mouse in the oil

עַכְבָּר שנמצא בשמן של בית הכנסת, אם הוא מאוס, אסור להדליקו בבית הכנסת.
Séif 12: a mouse found in the synagogue's oil — if it has become repugnant (מאוס), it is forbidden to light it in the synagogue.
What has become repugnant (מאוס) has no place in the service: out of respect, one does not light befouled oil in the synagogue.

Séif 13 — נר של בית הכנסת: reading by its light

נֵר של בית הכנסת, מותר לקרות לאורו.
Séif 13: the synagogue's lamp — it is permitted to read by its light.
The lamp is kindled to give light; benefiting from it to read is no diversion, for that is precisely its purpose.

Séif 14 — נר הדיוט: kindling a mundane light

אֵין מַדְלִיקִין נר של הדיוט מנר של בית הכנסת. ויש מי שאומר דהני מילי בעוד שדולקין למצותן, אבל כשצריך לכבותן, מותר. הגה: מיהו לא נהגו ליזהר בכך, ומדליקין בהן נר שהוא לצורך גדול; ואפשר גם כן שדעת בית דין מתנה בכך, וכן בכל הדברים שנהגו להקל בדברים כאלו אולי הוא מהאי טעמא.
Séif 14: one does not light a mundane lamp from the synagogue's lamp. And some say that this applies only while they burn for their mitsva, but when one needs to extinguish them, it is permitted. Rama: however, one does not have the custom to be careful in this, and one lights from them a lamp for a great need; and it may also be that the court's intent stipulates thus, as with all things where one is customarily lenient in such cases — perhaps it is for this reason.
Diverting the consecrated light for a mundane use is in principle avoided (מעלין ואין מורידין); but the custom allows leniency, resting on the principle already seen: דעת בית דין מתנה.

Séif 15 — בני כרך: the town's partners

בְּנֵי כְרַךְ שקנו ספר תורה והתנו שאם יצא אחד מן הכרך שהנשארים יתנו לו חלקו, והוקרו הספרים, אם יצא אחד מהם, אין נותנין לו אלא מה שנתן בלבד.
Séif 15: the inhabitants of a town who bought a séfer torah together and stipulated that if one of them leaves the town, the remaining ones will give him his share — and the books have risen in value: if one of them leaves, they give him only what he gave, nothing more.
One interprets the stipulation according to its original intent: to return the original outlay, not to profit from the rise — one does not trade in a sacred object.
The siman in one sentence: the תשמישי קדושה carry sanctity and require גניזה (a מטפחת → a shroud for a met mitsva, a worn séfer → an earthen jar at a talmid chakham's grave), but a תשמיש דתשמיש has no such sanctity; one raises in sanctity and does not lower (מעלין בקודש); a תנאי — and failing that לב בית דין מתנה עליהם — permits certain uses; and the synagogue נרות have their own régime.

Practical cases

Case 1 — A worn séfer cloth (מטפחת)

Situation: the cloth wrapping the séfer torah is worn out and no longer of use. May one discard it?
Conduct: no — it is a תשמיש קדושה requiring גניזה (seif 3-4). One may make of it a shroud for a met mitsva, and that counts as its burial; otherwise it goes to the geniza. For the practical application, one follows one's Rav.

Case 2 — Transforming a sacred object

Situation: one has a large curtain (וילון) of the heikhal; may one recut it?
Conduct: מעלין בקודש ואין מורידין (seif 6). One may make of it a small curtain or a cover for a séfer torah (equal rank), but not a cover for a houmach (a lower degree), nor make a seat out of a chest. For the details, one follows one's Rav.

Case 3 — Benefiting from synagogue objects

Situation: may one use the synagogue's table or the séfarim's cloths for an ordinary need?
Conduct: the ideal is an explicit תנאי (seif 8). Failing that, the custom tolerates certain benefits, for לב בית דין מתנה עליהם — the court stipulated in advance (כאילו התנו דמי). As to how far, one follows one's Rav.
