Level 4 — Daat HaRav (Alter Rebbe) — Siman

The Alter Rebbe’s way on דִּין בִּרְכַּת הַיַּיִן בַּסְּעוּדָה : wine at the meal — hagafen ; water and other liquids ; wine discharges liquids ; wine before the meal ; the cup of kiddush ; and savri maranan — in the Habad sensibility.

Why a Level 4 devoted to the Alter Rebbe ? The Alter Rebbe’s Shulchan Aruch is not a commentary on the Mehaber (מחבר) — it is a complete, self-standing Shulchan Aruch, written by the Alter Rebbe (Rabbi Schneur Zalman of Liadi, founder of Habad, disciple of the Maggid (מגיד) of Mezeritch). Its singularity : it combines halakha (הלכה) + טעמי המצוות + inner dimension in one work, and rules with a unique Talmudic rigor.

For Habad, the Alter Rebbe is הפוסק האחרון — his psak is the deciding authority. This page gathers the Rav’s way on siman קע״ד — דִּין בִּרְכַּת הַיַּיִן בַּסְּעוּדָה, which unfolds in the Rav over י״א סְעִיפִים (eleven seifim) : from the blessing “borei peri hagafen” over wine within the meal, to water and other liquids that require no blessing, to brandy (yayin saraf), to wine that discharges all kinds of liquids, to wine before the meal, to the last blessing, to the cup of kiddush and havdalah, up to the hamlakhat safek and “savri maranan.”

The Alter Rebbe’s own text (Sefaria source Shulchan_Arukh_HaRav,_Orach_Chayim.174), followed by our English translation. The siman comprises eleven seifim (י״א סְעִיפִים ; seif k → .174.k).

Wine, although it comes to be drunk during the meal, one blesses over it “borei peri hagafen,” and it is not discharged by the bread’s blessing, even though one drinks to soak the food that is in the innards. And behold it is like the things that come on account of the meal within the meal, which are discharged by the bread’s blessing, as has been explained; nevertheless, since wine is important, to the point that it occasions its own blessing in several places — such as at kiddush, havdalah, and the betrothal blessing (birkat erusin), where one blesses over the wine “borei peri hagafen” even though it need not be drunk — therefore it is not deemed subordinate to the bread so as to be discharged by its blessing regarding the first blessing, which is “borei peri hagafen,” even though it is subordinate to it so as to be discharged by birkat hamazon regarding the last blessing, because it does not occasion for itself a last blessing but only a first blessing (by itself, for it is on account of it that the bringing of the cup is essential in every matter that requires a cup).

But over water or other liquids — one does not bless during the meal, even if one drinks for thirst, because they come on account of the meal, since eating is impossible without drinking. And even if one eats something to sweeten the drink — it is subordinate to the liquid, and the liquid to the bread, and they are discharged by the bread’s blessing. And even if one was thirsty before the meal, since one did not wish to drink then so that the water would not harm — it turns out that the drinking of the water is because of the bread, and the bread’s blessing discharges them.
(And although the bread is a remote cause for them, and they are unlike the fruits eaten at the end of the meal to digest the food, for which the bread is a close cause and which nonetheless require a blessing before them, as will be explained in siman קע״ז — for fruits are things that come not on account of the meal, since one is wont to eat them all day, and therefore if one eats them during the meal they are not deemed subordinate to the bread, unless they came for the need of further eating, such as to accompany the bread or to arouse the appetite, and not to digest what one has already eaten, for what was was; but water and other liquids, whose drinking all day is on account of the meal, for most thirst comes from eating. And even liquids one drinks without thirst, such as beer and mead — one is not wont to drink them before eating but after; it turns out that they come on account of eating, and therefore when they come during the meal, even through a remote cause — they are subordinate to the meal, and the bread’s blessing, which is the essence of the meal, discharges them).
And this is when one fixes a meal on bread; but if one eats a little bread only so that the water will not harm — one blesses over the bread “shehakol,” as will be explained.

And brandy (yayin saraf) during the meal: if one drinks it to arouse the appetite — it is subordinate to the meal and one need not bless over it. And if one drinks it to warm the stomach in order to digest the food — one must bless over it (just as one must bless over fruits that come to digest), because brandy too is never drunk on account of eating like other liquids, and because most people’s intention is not to arouse the appetite by it, since they are wont to drink it every morning, even without a meal; therefore it is deemed subordinate only when it comes for the need of further eating.
And if one soaks bread in it — it will be explained further on.
And on Shabbat one need not bless over it in any case, for it is discharged by the blessing of the cup of kiddush, even if one made kiddush over the wine, as will be explained (unless one made kiddush at night over bread).
And there are those who say that water too and other liquids require a blessing during the meal like wine, and that the reason given for the wine’s blessing — that it occasions its own blessing — was given only because wine draws a person to appetite and is thus a need of the meal; but other liquids, which do not arouse the appetite — one must bless over them, though they are not important like wine.
And there are those who further require blessing over water each and every time, for by default one reconsiders (nimlakh) each time, since one is wont to drink water only for thirst and did not know one would be thirsty again. And the main ruling is like the first view.
And one who wishes to remove himself from doubt — let him give to another, who is not eating, to bless with intention to discharge him, or let him sit before washing the hands at the place of his meal and bless over a little water or other liquids with intention to drink all his fill during his meal (and even if he reconsiders and drinks again before the meal — he need not bless, for this is not called reconsidering, since he had in mind to drink afterward at the meal relying on this blessing). And let him not drink the measure of a revi’it, so as not to be required to recite a last blessing, in the manner that will be explained, and he will not discharge thereby what he will drink during his meal. And let him also take care not to go outside before the meal, for when one changes one’s place one must repeat and bless upon returning to one’s place, as will be explained further on. But the custom is like the first view.

If one blessed over wine — one need not bless over the other liquids, according to all, for wine discharges all kinds of liquids, whether at the time of the meal or at other times, because wine is the chief liquid and the head of all kinds of liquids; it is therefore the essential one regarding the blessing, and all are subordinate to it. And this provided the liquids were before him at the time he blessed over the wine (or he had them in mind).
And even if he does not fix himself to drink wine, but drinks a little wine for the need of a mitzvah, such as kiddush and havdalah, and afterward drinks many liquids — they are discharged by the blessing of the wine (if he had them in mind, and as will be explained).

If one drank wine before the meal, even before fixing oneself to the meal — one need not bless over the wine during the meal, for it is discharged by the blessing of the wine before the meal, unless one did not have in mind at first to drink wine during the meal and afterward reconsidered. But by default one is not called “nimlakh,” for it is customary to drink wine at the meal, even on a weekday, to soak the food in the innards. Therefore one who makes havdalah at his table — that is, close to his meal and at the place of the meal — need not bless over the wine during the meal.
And there are those who say that havdalah wine, since it does not come to be drunk but for the mitzvah — does not discharge the wine of the meal, unless he made havdalah at his very table, that is, after fixing himself to the meal at the table, or after washing his hands, for the washing of the hands is the beginning of the fixing of the meal, even if he has not yet sat at the table, and even if he washed his hands and made havdalah in another room (and in the manner that will be explained).
And one should take their words into account a priori: when one makes havdalah before fixing oneself to the meal — let one intend not to discharge by this blessing the wine that will be during the meal. And after the fact, if one did not so intend — one need not bless over the wine during the meal, for a doubt regarding blessings of rabbinic origin is treated leniently.
In what does this apply? To havdalah wine, which has no connection to the meal; but kiddush wine, since it has a connection to the meal — for there is no kiddush except at the place of the meal — discharges the wine during the meal according to all, even if he made kiddush before fixing himself to the meal, although this wine is not for drinking but for the mitzvah. And all the more so the wine before the meal on a weekday, which is for drinking and discharges the wine of the meal, even if he blessed over it before fixing himself to the meal.
(And this provided he blessed at the place of the meal, that is, in the same room where he eats; but from room to room — he must repeat and bless, unless he drank the measure that obligates a single blessing “me’ein shalosh” and did not bless, for then there are those who say he need not repeat and bless, and one may rely on their words after the fact, as will be explained in siman קע״ח. And even in the same room, if he left it in the meantime and returned — his status is as from room to room, as will be explained there).
In what does this apply? By default; but if he had explicitly in mind, when he blessed over the wine in this room, to discharge by this blessing the wine that will be during the meal that he will eat in another room — he discharges even a priori, if the two rooms are in one house, as will be explained there.

And wherever the wine before the meal discharges the wine during the meal — one need not at all bless after it a last blessing, even if he drank before the meal the measure, because it is discharged by birkat hamazon like the wine during the meal, the two being one drinking, since they were discharged by one first blessing. But one who makes havdalah before the meal intending not to discharge the wine of the meal, or who has no intention at all to drink wine during the meal — must bless after it a last blessing before the meal if he drank the measure (and if he forgot and did not bless before the meal and remembered before birkat hamazon — he must bless immediately “me’ein shalosh”). And if he did not remember until after birkat hamazon — he need not bless, for birkat hamazon discharges “me’ein shalosh” over the wine after the fact, as will be explained.
In what does this apply? To havdalah wine, which is only for the mitzvah; but one who drinks wine before the meal on a weekday — need not bless after it, even if he has no intention at all to drink wine during the meal, because the wine before the meal comes to open the innards to draw a person to appetite, and it is part of the meal; it is therefore discharged by birkat hamazon like the other things that come on account of the meal. And the same applies to brandy.
But one who drinks other liquids before the meal on a weekday — must bless after them, and even if he intends to drink also during the meal, since he does not discharge, by the blessing of the liquids before the meal, the liquids during the meal regarding the first blessing, for the other liquids during the meal require no blessing at all (and if he forgot and did not bless and remembered even after birkat hamazon — he must bless, for birkat hamazon does not discharge “borei nefashot rabbot” even after the fact).

Nevertheless, let him drink less than a revi’it before the meal, and thereby he will remove himself from doubt. And if he drank a revi’it — let him have a cup for birkat hamazon so as to bless after it a last blessing discharging the liquids he drank before the meal, if he wishes to remove himself from the doubt of the view of those who require a blessing for liquids, as has been explained, for according to their words one need not bless after the liquids before the meal, since they discharge the liquids of the meal regarding the first blessing.

And this is unlike the things that come on account of the meal after the meal, before birkat hamazon — as they were wont in their days, after finishing the meal, to withdraw their hands from the bread and fix themselves to eating fruits and to drinking; and everything brought before them then, even things that come on account of the meal, such as kinds of relish and kinds of vegetables eaten for nourishment and satiety and not for dessert and delight, nonetheless require also a last blessing and are not discharged by birkat hamazon, since they did not come within the core of the meal, as will be explained in siman קע״ז — for everything that comes after one has already withdrawn the hands from the bread is not deemed subordinate to the bread so as to be discharged with it by its blessings, which are “hamotzi” and birkat hamazon; but things that come on account of the meal at the time the mind is on the bread and the hands are not withdrawn from it, even if one has not yet begun — they are subordinate to it so as to be discharged by its blessing regarding the last blessing.
But not regarding the first blessing, so as not to derive benefit from this world without a blessing beforehand, as will be explained there.

And even wine that comes before them after they have already withdrawn their hands from the bread — one need not bless after it, for it is discharged by birkat hamazon, although it is not deemed part of the meal; because, since wine sustains the heart, it would have been fitting to institute blessing after it three complete blessings like after bread, except that, since people are not wont to fix a meal upon it, “me’ein shalosh” suffices for it. But when one drinks it in a fixed meal, inasmuch as it is a fixing for eating — it is also a fixing for drinking, and it is discharged by birkat hamazon even a priori.
But the other liquids after the end of the meal, after they have withdrawn their hands from the bread — require a blessing after them.
And further on, in siman קע״ז, it will be explained whether this law concerning the after-meal applies in our country.
(And even in their days) one did not need to bless a first blessing over the wine after the meal before birkat hamazon, because it is discharged by the blessing of the wine before the meal, if one had in mind then to drink also after the meal, or even by default, if it is Shabbat, Yom Tov, a day of bloodletting, or a day one entered the bathhouse, for by default every person is wont to fix his meal upon wine on these days, even in places where wine is not so available; therefore he is not called “nimlakh” by default, unless he knows of himself that he reconsiders.
But if he did not bless over wine before the meal but only during the meal — he does not by default discharge the wine after the meal, unless he explicitly intended to discharge it, because the wine during the meal is of inferior drinking, being drunk only to soak the food in the innards, for they were wont to drink during the meal only a little, to soak alone; and the wine after the meal comes for drinking, and it is not right that the inferior discharge the important without intention.
And nowadays, when we are not wont to withdraw our hands from the bread until birkat hamazon — behold the wine after the end of the meal too comes to soak, and it is discharged by the blessing of the wine during the meal.
(Except, in large meals where they are wont to withdraw the hands from the bread and to set the table with kinds of delicacies and to fix themselves to drinking before birkat hamazon — the wine is not discharged by the blessing of the wine he blessed during the meal, unless he had in mind to discharge it.
But over the other liquids one need not bless, just as one need not bless over the other things that come on account of the meal and are brought after the end of the meal, because they are discharged by the blessing “hamotzi,” for the reason that has been explained.
But in places where they are not wont to fix themselves to drinking after the meal before birkat hamazon in large meals, although they drink wine at the end of the meal while eating delicacies, since they do not fix themselves for drinking — one need not repeat and bless, for this drinking too is a need of the meal, and from the outset he had in mind also this, to discharge it by the blessing of the wine he blessed during the meal).
And all this for the wine after the meal; but everything he drinks during the meal, one blessing suffices for it in any case, even by default, unless he knows that he reconsiders.

And even reconsidering upon a doubt (hamlakhat safek) is called reconsidering: for example, one who enters his fellow’s house where there is a company reclining to drink, and they hand him a cup and he blesses over it, and afterward they hand him another cup — he must repeat and bless over the second, for when he blessed over the first he did not know whether they would give him more, since he is not fixed with them for drinking. Even if he has not yet drunk the whole cup that was given him at first, and they hand him another cup while he still has wine from the first cup — he must bless over the other cup they handed him.
This is unlike one who was fixed with the diners and to whom they brought a cup while he still had before him from the first cup: although he did not know that more wine would be brought at this meal after they had already begun to drink (and they did not know whether they would bring more, as will be explained in siman ר״ו), nonetheless, since he was fixed with the diners, and there is a fixing for the drinking of wine — for sometimes a person fixes himself upon wine and is drawn from drink to drink and drinks more than he first prepared — behold he had in mind from the outset that if they brought him more he would drink of it, and this is not reconsidering, since he knows that if they bring more they will give him too.
But if he does not know at all whether they will give him — behold he reconsiders by doubt. And likewise, in large meals where the diners are many, and among them are people who are in doubt whether the cup will reach them — those in doubt must bless over each cup.

But if he had explicitly in mind, at the time he blessed over the first cup, to be discharged by his blessing for all that they would give him more, even if it was doubtful to him whether they would give him at all, but he had in mind that if they gave him more he would fulfill his obligation by this blessing — he need not bless over the other cup they hand him.
And likewise, if one blessed for all, in the manner that will be explained in siman רי״ג, and the one in doubt intended that if they gave him he would be discharged by the blessing of the one blessing — he need not bless over the cup they hand him.
Nevertheless, a priori one should not act thus, that one bless for all during the meal, because the gullet (bet habli’a) is not free, and their mind is not set to hear the blessing from the mouth of the one blessing, and they will also not be able to answer “amen” after him so as to be discharged by his blessing, for one does not speak during the meal, lest the windpipe precede the esophagus and one come to danger.
Therefore, if he says to them: “savri maranan,” that is, direct your attention to the blessing to fulfill your obligation, so that they clear the gullet, set down their food, direct their attention to hearing the blessing, and answer “amen” — one blesses for all. And so is the custom.
And for this reason the custom has spread everywhere that they bless over wine, such as at kiddush and havdalah, that if one blesses for all so that they be discharged by his blessing — he says “savri maranan” and not “birshut maranan,” so as not to make a distinction in the blessing of the wine between whether they bless outside the time of the meal or over wine that comes to them during the meal.
Editor’s note: Simanim קע״ה and קע״ו are missing in the copy. But one who wishes to grasp the essence of the matters will find in the Siddur [further on, in the Seder Birkat HaNehenin at the end of the volume], where everything is written and detailed without any lack: that which pertains to siman קע״ה is found in chapter י״ב, from seif י״ג until seif [כ״א], and that which pertains to siman קע״ו is found in chapter ד׳, from seif י״א until the end of the chapter.

The Habad practical conduct

Points of conduct flowing directly from siman קע״ד in the Alter Rebbe’s and Habad sensibility — presented at the level of the principle, referring to the Rav for the detail of the cases.

For the Habad Hassid — Siman

  • Seif א. Wine drunk during the meal keeps its own blessing “borei peri hagafen”; it is not discharged by the bread, for wine is important and occasions its own blessing in several places (kiddush, havdalah, erusin).
  • Seif ב. Water and other liquids taken during the meal require no blessing — they are subordinate to the bread. One who eats a little bread only so it will not harm blesses “shehakol.”
  • Seif ג. Brandy: to arouse appetite — subordinate; to digest — requires a blessing. On Shabbat discharged by kiddush. Differing views on water; the custom follows the first view.
  • Seif ד. Wine discharges all kinds of liquids — within the meal and outside it — provided they were before him or in his mind; even the wine of a mitzvah (kiddush, havdalah).
  • Seif ה. Wine drunk before the meal discharges the wine of the meal (no “nimlakh” by default). Havdalah wine — to distinguish; kiddush wine discharges according to all, for it belongs to the meal.
  • Seif ו. Where the pre-meal wine discharges the meal’s wine — no last blessing, for birkat hamazon discharges. Havdalah with contrary intent, or other liquids on a weekday — a last blessing is required.
  • Seif ז. One who will recite birkat hamazon over a cup need not bless after the pre-meal liquids (discharged by the blessing after the cup). To remove doubt: drink less than a revi’it.
  • Seif ח. The kiddush cup on Shabbat/Yom Tov is discharged by birkat hamazon, even of other liquids, for “there is no kiddush except at the place of the meal.” To be distinguished from foods taken after the bread is withdrawn.
  • Seif ט. Wine brought after the bread is withdrawn is discharged by birkat hamazon (“me’ein shalosh” suffices for it); other liquids require a last blessing. Nowadays one does not withdraw the hands from the bread until birkat hamazon.
  • Seif י. Reconsidering upon a doubt (“hamlakhat safek”) is indeed reconsidering: a guest not fixed with the group re-blesses over each cup; one fixed with the diners need not re-bless.
  • Seif יא. Explicit intent to discharge in advance every additional cup — no new blessing. A priori one does not bless for all during the meal (the gullet is occupied); hence “savri maranan” (and not “birshut”) wherever one blesses over wine.

⚠ This section presents the Habad conduct based on the Alter Rebbe’s Shulchan Aruch, siman קע״ד (the real text is reproduced in §1). It does not replace a rabbinic decision for a particular case.
