A zimun does not merely ask for three mouths: it asks for three people who count. This siman draws up the list, and draws it in two columns — those with whom a zimun is made and those with whom it is not. Eleven seifim run through the attendant, the Kuti, the am haaretz, the convert, the onen, women, slaves and minors, the androginos, the tumtum, the child, and one placed under a ban. Hebrew text, translation and explanation of the י״א seifim, with a section of practical cases.

The preceding simanim asked how many must be present, where they are seated, and what was eaten. Here the question changes in kind: it bears on the person — is he one of those we count? The mishna had already given both columns: on one side אכל דמאי ומעשר ראשון שנטלה תרומתו מעשר שני והקדש שנפדו והשמש שאכל כזית והכותי מזמנין עליו (ברכות מ״ה ע״א), on the other אכל טבל ומעשר ראשון שלא נטלה תרומתו ומעשר שני והקדש שלא נפדו והשמש שאכל פחות מכזית והנכרי אין מזמנין עליו (ברכות מ״ה ע״א), and finally a category of its own: נשים ועבדים וקטנים אין מזמנין עליהן (ברכות מ״ה ע״א). Our siman is those three lines set down as halakha, together with what later generations had to decide after them. We study here at the level of principle; for personal practice, one follows the ruling of one's Rav.

A. השמש, הכותי ועם הארץ — the one who serves, the one who changed, the one who does not know

שַׁמָּשׁ — the table attendant. Not a guest, but the one who comes and goes, brings and clears, and eats standing between two courses. One might have thought he is not settled at the meal and therefore does not count; the Gemara raises exactly that objection before removing it: פשיטא מהו דתימא שמש לא קבע קמ״ל (ברכות מ״ז ע״ב). summary: what makes a diner is not the posture of the body but the reality of being settled at the meal — and a kazayit is enough to establish it.

Seif 1 — השמש שאכל כזית מזמנין עליו

השמש שאכל כזית מזמנין עליו:
Seif 1: the attendant who ate a kazayit — a zimun is made on him.
The rule: השמש שאכל כזית מזמנין עליו (שו״ע או״ח קצ״ט:א). The mishna already said so, placing him in the column of those we count: והשמש שאכל כזית והכותי מזמנין עליו (ברכות מ״ה ע״א) — and, in the other column, והשמש שאכל פחות מכזית והנכרי אין מזמנין עליו (ברכות מ״ה ע״א). summary: it is therefore not his standing as an attendant that decides, but the measure of what he ate.

Seif 2 — כותי בזמן הזה

כותי בזמן הזה הרי הוא כעובד עבודת אלילים ואין מזמנין עליו:
Seif 2: a Kuti (a Samaritan) nowadays is as one who serves idols, and no zimun is made on him.
A reversal: the mishna did count the Kuti — והכותי מזמנין עליו (ברכות מ״ה ע״א) — and the Gemara specified the case: אביי אמר בכותי חבר (ברכות מ״ז ע״ב), even praising their exactitude: כל מצוה שהחזיקו בה כותים הרבה מדקדקין בה יותר מישראל (ברכות מ״ז ע״ב). But here the Mechaber writes כותי בזמן הזה (שו״ע או״ח קצ״ט:ב), and that changes everything: the Talmud itself records the day the Sages ruled — ולא זזו משם עד שעשאום עובדי כוכבים גמורין (חולין ו׳ ע״א).
summary: this seif teaches something easily forgotten — a halakha can reverse without any rule having moved. It is not the law of the zimun that changed, but the person it spoke of. The Tur puts it in the same terms: ורב אלפס כתב והאידנא הם עכו״ם גמורין ואין מזמנין עליהן (טור או״ח קצ״ט).

Seif 3 — עם הארץ גמור מזמנין עליו בזמן הזה

עם הארץ גמור מזמנין עליו בזמן הזה:
Seif 3: on an am haaretz, even a complete one, a zimun is made nowadays.
A second reversal, in the opposite direction: the baraita taught ותניא אין מזמנין על ע״ה (ברכות מ״ז ע״ב), and yet the Mechaber writes עם הארץ גמור מזמנין עליו בזמן הזה (שו״ע או״ח קצ״ט:ג). The Tur gives the reason in the name of the Ri: והאידנא אמר ר״י שמזמנין עם עם הארץ כדי שלא יהא כל אחד בונה במה לעצמו (טור או״ח קצ״ט), and explains it: פי׳ אם היו פורשין מהם היו גם הם פורשין מן הציבור לגמרי (טור או״ח קצ״ט). Rabbeinu Chananel said the same: האידנא רגילין לזמן אפי׳ עם עם הארץ גמור (טור או״ח קצ״ט).
summary: the two seifim are read together. They do not contradict each other: both say that the halakha looks at reality. The Kuti ceased to be one of ours and leaves the count; the am haaretz is one of ours, and shutting him out of the zimun would push him out of the community — better to keep him in.

B. עכו״ם, גר ואונן — belonging and obligation

Seif 4 — עכו״ם וגר

עכו״ם אין מזמנין עליו ואפי׳ גר שמל ולא טבל אין מזמנין עליו אבל גר גמור מזמנין עליו ויכול לברך בהמ״ז ולומר על שהנחלת לאבותינו:
Seif 4: on a gentile no zimun is made; and even on a convert who was circumcised but did not immerse, no zimun is made. But on a full convert a zimun is made, and he may recite Birkat haMazon and say "for having given our fathers as an inheritance".
The unfinished convert: ואפי׳ גר שמל ולא טבל אין מזמנין עליו (שו״ע או״ח קצ״ט:ד). The Gemara supplies the principle, on the word והנכרי of the mishna: הכא במאי עסקינן בגר שמל ולא טבל (ברכות מ״ז ע״ב), and דאמר רבי זירא א״ר יוחנן לעולם אינו גר עד שימול ויטבול וכמה דלא טבל נכרי הוא (ברכות מ״ז ע״ב). summary: conversion is reckoned not by what has been begun but by what has been completed.
The full convert, and the words of Birkat haMazon: אבל גר גמור מזמנין עליו ויכול לברך בהמ״ז ולומר על שהנחלת לאבותינו (שו״ע או״ח קצ״ט:ד). This was not obvious: the Tur reports that Rabbeinu Tam objected — ור״ת לא היה מניח אפי׳ לגר גמור (בא״י) לברך ברה״מ שאינו יכול לומר שהנחלת לאבותינו (טור או״ח קצ״ט) — while the Ri permitted it: ור״י כתב שיכול לברך שיכול לומר לאבותינו דכתיב אב המון גוים נתתיך (טור או״ח קצ״ט). The Beit Yossef concludes like the Ri: והכי נקטינן (בית יוסף או״ח קצ״ט).
summary: the convert does not borrow another man's fathers — Avraham was made father of a multitude of nations, and the convert therefore has fathers of his own to name. It is one of the finest rulings of the siman: the halakha refuses to make the convert a perpetual guest at his own table.

Seif 5 — אונן בחול

אונן בחול שהוא פטור מלברך אין מזמנין עליו:
Seif 5: an onen (a mourner whose dead is not yet buried) on a weekday, who is exempt from blessing — no zimun is made on him.
The reason is written into the seif itself: אונן בחול שהוא פטור מלברך אין מזמנין עליו (שו״ע או״ח קצ״ט:ה). This is not an exclusion but a consequence: the zimun is an invitation to bless, and one cannot be invited to what one is exempt from. The mishna says of the mourner before burial: מי שמתו מוטל לפניו פטור מק״ש ומן התפלה ומן התפילין ומכל מצות האמורות בתורה (ברכות י״ז ע״ב). The Tur states it in our seif's own words: וכן האונן בחול שהוא פטור מלברך אין מזמנין עליו (טור או״ח קצ״ט).
summary: note the precision בחול — on a weekday. Mourning in its first hours suspends the obligations; Shabbat does not suspend them in the same way, and the seif is careful to speak only of an ordinary day. In practice, such cases are settled with a Rav.

C. נשים ועבדים וקטנים — the zimun that is their own

פְּרִיצוּתָא — literally looseness, licence. It is the word by which the Gemara explains why women, slaves and minors do not form a zimun company together: שאני התם משום פריצותא (ברכות מ״ה ע״ב). It says nothing of their capacity to bless — the same Gemara states that each group makes a zimun of its own — but everything about the mixture the halakha declines to institute.

Seif 6 — נשים ועבדים וקטנים

נשים ועבדים וקטנים אין מזמנין עליהם אבל מזמנין לעצמן ולא תהא חבורה של נשים ועבדים וקטנים מזמנין יחד משום פריצותא דעבדים אלא נשים לעצמן ועבדים לעצמן ובלבד שלא יזמנו בשם:
Seif 6: women, slaves and minors — no zimun is made on them, but they make a zimun among themselves. And there shall be no company of women, slaves and minors making a zimun together, because of the licentiousness of slaves; rather women by themselves and slaves by themselves — provided they do not make the zimun with the Name.
Three statements in one sentence. First: נשים ועבדים וקטנים אין מזמנין עליהם (שו״ע או״ח קצ״ט:ו) — they do not join the men's zimun; this is already the mishna: נשים ועבדים וקטנים אין מזמנין עליהן (ברכות מ״ה ע״א). Then: אבל מזמנין לעצמן (שו״ע או״ח קצ״ט:ו) — but they have one of their own, and that is the baraita: נשים מזמנות לעצמן ועבדים מזמנים לעצמן נשים ועבדים וקטנים אם רצו לזמן אין מזמנין (ברכות מ״ה ע״ב). Finally the condition: ובלבד שלא יזמנו בשם (שו״ע או״ח קצ״ט:ו).
Why not mixed? The seif says it plainly: משום פריצותא דעבדים (שו״ע או״ח קצ״ט:ו), and the Gemara had posed exactly that question — why not, since there are minds enough present? אמאי לא והא איכא דעות (ברכות מ״ה ע״ב) — and answered: שאני התם משום פריצותא (ברכות מ״ה ע״ב). The Rambam codified it: נשים ועבדים וקטנים אין מזמנין עליהן אבל מזמנין לעצמן (רמב״ם הלכות ברכות פרק ה׳ הלכה ז׳).
summary: ובלבד שלא יזמנו בשם — a zimun of ten adds the Name (נברך לאלהינו); it is that degree, and only that one, which the seif withholds from them, because it belongs to דבר שבקדושה. The ordinary zimun remains theirs in full.

Seif 7 — נשים מזמנות לעצמן רשות

נשים מזמנות לעצמן רשות אבל כשאוכלות עם האנשי׳ חייבות ויוצאות בזימון שלנו:
הגה אע״פ שאינן מבינות (הרא״ש ומרדכי ריש פרק שלשה שאכלו בשם רש״י):
Seif 7: women making a zimun among themselves — it is optional; but when they eat with men they are obligated and are discharged by our zimun. Gloss (Rama): even though they do not understand (the Rosh and the Mordechai, at the beginning of the chapter "Three who ate", in the name of Rashi).
Two regimes, not one: נשים מזמנות לעצמן רשות (שו״ע או״ח קצ״ט:ז) — among themselves it is permitted and not imposed; אבל כשאוכלות עם האנשי׳ חייבות ויוצאות בזימון שלנו (שו״ע או״ח קצ״ט:ז) — at the shared table the obligation arises and is discharged of itself. The Beit Yossef gives the Ri's formulation: ואומר ר״י דלעצמן דוקא רשות אבל כשאוכלות עם האנשים חייבות ויוצאות בזימון שלנו ואינן מברכות לעצמן (בית יוסף או״ח קצ״ט).
The Rama's gloss removes the most natural objection: אע״פ שאינן מבינות (רמ״א או״ח קצ״ט:ז). One might have thought that a text one does not understand cannot discharge an obligation; the Rama says that for the zimun, hearing suffices.
summary: seif 7 must be read against seif 6, and it then appears that אין מזמנין עליהם does not mean "they do not count" but "we do not count them to make up the three". Once the three are made up by men, the woman at the table is obligated and is discharged. The Tur indeed reports that the Rosh derived the obligation from the baraita in Arakhin: דתניא בערכין (ג.) הכל חייבין בזימון וקאמר הכל לאתויי מאי לאתויי נשים (טור או״ח קצ״ט).

D. אנדרוגינוס וטומטום — the two faces of doubt

Seif 8 — אנדרוגינוס מזמן למינו

אנדרוגינוס מזמן למינו ואינו מזמן לא לאנשים ולא לנשים:
Seif 8: an androginos makes a zimun for its own kind, but makes none either for men or for women.
אנדרוגינוס מזמן למינו ואינו מזמן לא לאנשים ולא לנשים (שו״ע או״ח קצ״ט:ח). The Rambam gives the ground: אנדרוגינוס מזמן למינו ואינו מזמן לא לנשים ולא לאנשים מפני שהוא ספק (רמב״ם הלכות ברכות פרק ה׳ הלכה ז׳). The Beit Yossef points to the parallel in the shofar: אנדרוגינוס מוציא את מינו אבל לא את שאינו מינו (ראש השנה כ״ט ע״א), and gives the reason: משום דאנדרוגינוס הוי בריה בפני עצמו הלכך למינו מיהא מזמן (בית יוסף או״ח קצ״ט).

Seif 9 — טומטום אינו מזמן כלל

טומטום אינו מזמן כלל:
Seif 9: a tumtum makes no zimun at all.
טומטום אינו מזמן כלל (שו״ע או״ח קצ״ט:ט) — and likewise for the shofar: טומטום אינו מוציא לא את מינו ולא את שאינו מינו (ראש השנה כ״ט ע״א). The Beit Yossef explains the difference from the preceding seif: וטעם הטומטום שאינו מזמן אפילו עם מינו משום דאיכא למיחש שמא ימצא זה זכר והללו נקבות או איפכא (בית יוסף או״ח קצ״ט).
summary: the two seifim say a single thing. The androginos is a category — a doubt with a contour, and a contour permits a "kind of its own". The tumtum is pure doubt — nothing is yet determined, and two tumtumim are not even assured of being alike. A doubt that can be bounded still leaves a place; a total doubt leaves none.

E. קטן ומנודה — discernment and distance

עוֹנַת הַפְּעוֹטוֹת — the age of the "little ones", from which a child has enough discernment for his acts to count. The Beit Yossef fixes it: והוא שהגיע לעונת הפעוטות דהיינו בן ז׳ או ח׳ כל חד וחד לפום חורפיה (בית יוסף או״ח קצ״ט) — seven or eight years old, each according to his sharpness.

Seif 10 — קטן שהגיע לעונת הפעוטות

קטן שהגיע לעונת הפעוטות ויודע למי מברכין מזמנין עליו ומצטרף בין לשלשה בין לעשרה:
הגה וי״א דאין מצרפין אותו כלל עד שיהא בן שלש עשרה שנה דאז מחזקינן ליה כגדול שהביא שתי שערות (הרא״ש ומרדכי פרק שלשה שאכלו וטור) וכן נוהגין ואין לשנות. וחרש ושוטה אם מכוונים ומבינים מצטרפין לזימון אע״פ שאין החרש שומע הברכה (מהרי״ל):
Seif 10: a minor who has reached the age of discernment and knows to Whom we bless — a zimun is made on him, and he joins both for three and for ten. Gloss (Rama): and some say he is not joined at all until he is thirteen years old, for then we hold him as an adult who has produced two hairs (the Rosh, the Mordechai in the chapter "Three who ate", and the Tur); and such is the custom, and it is not to be changed. And a deaf-mute and a shoteh, if they are attentive and understand, do join for the zimun, even though the deaf one does not hear the blessing (Maharil).
The Mechaber's criterion is awareness: קטן שהגיע לעונת הפעוטות ויודע למי מברכין מזמנין עליו ומצטרף בין לשלשה בין לעשרה (שו״ע או״ח קצ״ט:י). This is the Gemara's own conclusion, which sets aside every opinion reported before it: ולית הלכתא ככל הני שמעתתא אלא כי הא דאמר רב נחמן קטן היודע למי מברכין מזמנין עליו (ברכות מ״ח ע״א). The baraita in Arakhin already included him: הכל מצטרפין לזימון לאתויי מאי לאתויי קטן היודע למי מברכין (ערכין ג׳ ע״א). And the Rambam codified it: קטן היודע למי מברכין מזמנין עליו ואף על פי שהוא כבן שבע או כבן שמונה (רמב״ם הלכות ברכות פרק ה׳ הלכה ז׳).
The Rama rules otherwise for Ashkenazi practice: וי״א דאין מצרפין אותו כלל עד שיהא בן שלש עשרה שנה (רמ״א או״ח קצ״ט:י), and he closes the door: וכן נוהגין ואין לשנות (רמ״א או״ח קצ״ט:י). This is one of the most visible practical divergences of the siman between Sefardim and Ashkenazim — and exactly the kind of point where one follows one's Rav and one's community.
The second gloss widens in the other direction: וחרש ושוטה אם מכוונים ומבינים מצטרפין לזימון אע״פ שאין החרש שומע הברכה (רמ״א או״ח קצ״ט:י). summary: what the Rama withholds from the child is not understanding but minority; where understanding is present and minority is not, he joins.

Seif 11 — מי שנדוהו על עבירה

מי שנדוהו על עבירה אין מזמנין עליו:
Seif 11: one who was placed under a ban for a transgression — no zimun is made on him.
מי שנדוהו על עבירה אין מזמנין עליו (שו״ע או״ח קצ״ט:י״א). The Beit Yossef closes the siman by referring back to where he had already written it: מי שנדוהו על עבירה כתבתי בסימן נ״ה שאין מזמנין עליו (בית יוסף או״ח קצ״ט).
summary: the siman closes on its own subject. The zimun is the act by which diners declare themselves together before the blessing; one whom the community has set at a distance cannot be counted in that gathering — not because he has ceased to be a Jew, but because the ban bears precisely on joining.
The siman in one sentence: a zimun is made on one who is settled at the meal, obligated, and joined — hence השמש שאכל כזית מזמנין עליו, עם הארץ גמור מזמנין עליו בזמן הזה and אבל גר גמור מזמנין עליו on one side; and כותי בזמן הזה, גר שמל ולא טבל, אונן בחול, טומטום and מי שנדוהו על עבירה on the other; between them נשים ועבדים וקטנים, of whom אין מזמנין עליהם אבל מזמנין לעצמן; and the child שהגיע לעונת הפעוטות ויודע למי מברכין, whom the Mechaber joins and whom the Rama's custom awaits at thirteen.

Practical cases

Case 1 — The one serving the meal ate standing between two courses: does he count?

Situation: only two guests are seated, and the person serving ate a piece of bread in passing. Are we three for the zimun?
Conduct: yes, once he has eaten a kazayit — השמש שאכל כזית מזמנין עליו (שו״ע או״ח קצ״ט:א); and this is already the mishna: והשמש שאכל כזית והכותי מזמנין עליו (ברכות מ״ה ע״א). What might have raised a doubt is that he is not settled at the table; the Gemara removes it: פשיטא מהו דתימא שמש לא קבע קמ״ל (ברכות מ״ז ע״ב). Below a kazayit, however, he does not count: והשמש שאכל פחות מכזית והנכרי אין מזמנין עליו (ברכות מ״ה ע״א). In practice, one follows one's Rav.

Case 2 — Three women ate together: must they make a zimun?

Situation: a meal of women, with no man at the table. And the other case: a family meal where men and women are seated together.
Conduct: among themselves it is optional — נשים מזמנות לעצמן רשות (שו״ע או״ח קצ״ט:ז); at the shared table it is obligatory and is discharged by the men's zimun: אבל כשאוכלות עם האנשי׳ חייבות ויוצאות בזימון שלנו (שו״ע או״ח קצ״ט:ז), and the Rama adds אע״פ שאינן מבינות (רמ״א או״ח קצ״ט:ז). Take care not to confuse the two: they do not serve to make up the three — נשים ועבדים וקטנים אין מזמנין עליהם (שו״ע או״ח קצ״ט:ו). And when they make their own zimun, ובלבד שלא יזמנו בשם (שו״ע או״ח קצ״ט:ו). In practice, one follows one's Rav.

Case 3 — Only two adults, but a nine-year-old is at the table

Situation: two men and a boy of nine who knows very well to Whom we bless. May a zimun be made?
Conduct: it depends on the custom one follows. For the Mechaber, yes: קטן שהגיע לעונת הפעוטות ויודע למי מברכין מזמנין עליו ומצטרף בין לשלשה בין לעשרה (שו״ע או״ח קצ״ט:י), in accordance with the Gemara's conclusion — ולית הלכתא ככל הני שמעתתא אלא כי הא דאמר רב נחמן קטן היודע למי מברכין מזמנין עליו (ברכות מ״ח ע״א). For the Rama, no: וי״א דאין מצרפין אותו כלל עד שיהא בן שלש עשרה שנה (רמ״א או״ח קצ״ט:י), and וכן נוהגין ואין לשנות (רמ״א או״ח קצ״ט:י). This is a point the community and the Rav decide.
