1. The Central Axiom

קציצה as conceptual pivot.
Siman רמ״ז revolves around a single halakhic mechanism: as long as the non-Jew has not agreed on a precise price with the Jew, he is visibly the agent of the Jew (שלוחו של ישראל) — forbidden. The moment a firm קציצה is agreed upon, he becomes an independent worker acting for his own interest (אדעתא דנפשיה) — permitted.

All details of the siman are merely variations of this pivot across 6 borderline cases: vague price, daily worker, free transport, spontaneous trip, yearly worker.

3. The 3 Key Concepts

Concept 1 — קציצה (Kotsétsa)

Definition: agreeing on a precise price for the task to be accomplished.

Concept 2 — אדעתא דנפשיה (Adata de-nafshéh)

Definition: acting for one's own interest, and not as the Jew's agent.

Concept 3 — קביעות בי דואר (Kéviut bei doar)

Definition: a fixed collecting agent permanently installed in the destination city.

4. Decision tree — from Friday evening to distant days

Question 1: Is there קציצה (agreed price)?
If NO → study seif Hé: does the non-Jew leave on his own? If yes → permitted. Otherwise → forbidden.
Question 2: Does the non-Jew leave before the entrance of Shabbat?
If NO → absolutely forbidden, period.
Question 3: Which day of the week?
Sunday-Wednesday (יום א-ד) → Mehaber: require קביעות or שהות. Rama: permitted without additional condition.
Thursday-Friday → require קביעות בי דואר OR שהות (time margin to deliver before Shabbat).

5. חקירת היסוד — why the קציצה changes everything

3 possible readings of the קציצה:
(a) Exit from shlikhout: the קציצה breaks the agency link. The non-Jew is no longer שלוחו של ישראל — he is קבלן עצמאי.
(b) Shift of perception: the קציצה changes the public gaze. The observer sees a worker acting for his wage, not for the Jew.
(c) Suppression of the Jew's right: with קציצה, the Jew no longer has the power to impose timing. The non-Jew is master of execution.

Practical consequence: depending on which of the three readings one adopts, certain modern situations are permitted or not. For Amazon Prime — the קציצה (the shipping price set) is firm, but the customer can track the delivery in real time: reading (c) might pose a problem (the customer retains a certain pressure power). Contemporary poskim generally side with readings (a-b).

6. Mnemonic — K-A-K

KKotsétsa (קציצה): an agreed price in advance. This is the structural condition.

AAdata (אדעתא דנפשיה): the non-Jew acts for his own interest. This is the effect of the kotsétsa.

KKéviut (קביעות בי דואר): a fixed recipient at arrival. This is the protection against חיפוש בשבת.

To memorize: "K-A-K — the letter leaves with the קציצה (price), arrives thanks to the אדעתא (the non-Jew's own interest), arrives without incident thanks to the קביעות (fixed recipient)."

8. 5 Common pitfalls to avoid

Pitfall 1: Believing that "I pushed hard on the price" = קציצה.
→ As long as the non-Jew has not accepted a firm sum, there is no קציצה.
Pitfall 2: Thinking that a yearly employee can be sent Friday for a routine letter.
Forbidden according to Mehaber and Rama (unless specifically hired for mail — subtle distinction).
Pitfall 3: Confusing seif Hé (the non-Jew leaves on his own) with a case where one nonetheless asks for a detour.
→ If detour for the Jew → reintroduces agency. Seif Hé requires that the trip be already independently decided.
Pitfall 4: Handing a letter on Friday at 5 PM thinking that the קציצה is enough.
→ One also needs: (a) the non-Jew to leave before Shabbat, (b) קביעות OR שהות. Three conditions, not one.
Pitfall 5: Relying on Rama Monday-Wednesday when there is no קציצה at all.
