1. The Shulchan Aruch text
Siman שט״ו contains 13 seifim of the Mechaber (Rav Yosef Karo), codifying the halachos pertaining to making an ohel (roof/shelter) on Shabbos.
Seif א — Making an ohel: roof forbidden, walls permitted
- Forbidden to make a tent on Shabbat and festival — even a temporary one.
- And only a ROOF: partitions are permitted. A partition is forbidden only if it validates a sukkah or permits carrying.
- Rama: but a partition made merely for modesty — permitted; hence one may hang a curtain before the doorway, even permanently.
Seif ב — Tosefes ohel: completing a pre-existing shelter
- Poles fixed at one end in the ship’s side and bent at the other into the opposite side, over which a mat is spread for shade:
- if they are a tefah wide, or even not, provided less than three tefahim separate them: they already count as a tent.
- It is then permitted to spread the mats on them on Shabbat — this is but an addition to a temporary tent. And likewise a mat already spread a tefah: one may spread the rest.
Seif ג
- When setting up a bed: forbidden to set the legs first and lay the boards upon them.
- He shall set the boards first in the air, and the legs beneath them after.
- And this when the legs are joined panels, like a chest’s sides; but the legs of our beds and of the table — permitted in every case.
Seif ד
- A bed strung with cords: if three tefahim separate cord from cord — forbidden to spread a sheet on it, for he makes a tent;
- and forbidden to remove the cloth beneath, for he demolishes a tent.
- But if a cushion, mattress or cloth a tefah wide lay on it from before Shabbat: permitted on Shabbat to spread over the whole bed.
Seif ה
- A jointed chair opened to sit on — the leather unfolding — and closed when put away, the leather folding back:
- permitted to open it at the outset.
Seif ו
- When stacking jars one upon another, one on two:
- he holds the upper one in his hand and arranges the lower two beneath it — and not the reverse.
Seif ז
- Permitted to set one book here, another there, and a third across them.
- Rama: since he has no need of the space beneath them.
Seif ח
- Every sloping tent having no tefah at its ridge, nor a tefah’s width within three tefahim of the ridge:
- this is a temporary tent — and one who makes it outright on Shabbat is exempt.
Seif ט
- The strainer one hangs to put lees in for clarifying, stretching its mouth on every side:
- this counts as making a tent — forbidden to spread it.
Seif י
- A folded cloak whose cords were in place from before Shabbat:
- permitted to spread it, and permitted to take it down — and likewise the parokhet.
Seif
- A bridal canopy, having no tefah at its ridge nor a tefah’s width within three of it: being prepared for that use —
- permitted to spread and to take down, provided it does not hang a tefah above the bed.
Seif
- One who spreads a curtain must take care not to make a tent in spreading it.
- Hence: a large curtain is hung by two; by one — forbidden.
- And a canopy having a roof — it is not stretched, even by ten: it cannot but rise a little from the ground and make a temporary tent.
Seif
- A cloth spread over a jar’s mouth to cover it: he shall not spread it over the whole — on account of tent —,
- but leave part of it uncovered.
- And this when the vessel lacks a tefah of being full; otherwise — permitted, there is no tent here.
2. The general context — the melachah of ohel
What is this siman about?
Siman שט״ו deals with ohel (אהל — roof, shelter, canopy). Making a roof on Shabbos is a toladah (derivative) of the melachah of boneh (building). The siman lays out a subtle and very practical distinction: the roof is forbidden, but the walls are permitted.
- אהל קבע (ohel keva) — a permanent shelter → forbidden מן התורה (toladah of boneh).
- אהל עראי (ohel arai) — a temporary shelter → forbidden מדרבנן (gezeirah, "lest one come to ohel keva").
- תוספת אהל (tosefes ohel) — completing an already-existing shelter (at least a tefach) → permitted!
Its place within Hilchos Shabbos
Siman שט״ו concludes the "building bloc" (313–314–315) by dealing with covering. This is the siman that governs umbrellas, awnings, crib netting, strollers' canopies — anything that "covers." Especially practical in the summer and for young parents.
3. The key halachic concepts
4. Map of the 13 seifim
| Seif | Topic | Central concept |
|---|---|---|
| 1 | Roof forbidden, walls permitted; tznius curtains | גג vs מחיצה |
| 2 | Completing a shelter with a pre-existing tefach |
| 3 | Setting up a bed / table: order of actions | Avoiding "making a roof" |
| 4-6 | Spreading a mat or sheet for shade | Ohel arai |
| 7-9 | Umbrellas, awnings, courtyard covers | Temporary roof |
| 10-11 | Covering a barrel, a pot | Tefach / insignificant ohel |
| 12-13 | Canopies, four-poster beds, borderline cases | Tosefes vs new ohel |
- Is this a roof (horizontal, covering) or a wall (vertical)?
- If a wall → generally permitted
- If a roof → was a tefach already in place before Shabbos? If so → one may complete it
- Otherwise → forbidden (ohel arai)
5. The Mishnah Berurah — opening entries
The Mishnah Berurah of Rav Yisrael Meir Kagan (the Chofetz Chaim) contains 49 entries on this siman. Here are the first ones — to better understand the meaning of the seifim:
For the full text of all 49 entries, see Sefaria: Mishnah Berurah 315.
6. The Rama's position
The Rama adds a rich gloss to seif 1, codifying the cases of permitted walls:
- Tznius wall — a partition made for simple tznius is permitted. Hence: hanging a curtain before a doorway, or a paroches before the aron kodesh → permitted.
- Condition: not to form a roof of a tefach at the top of the curtain.
- Permitted: a partition against the sun, the cold, or to shield the candles from the wind.
- Forbidden: a partition before light for marital purposes, or before sefarim to relieve oneself — unless a tefach was already in place from before Shabbos.
- Mechaber → lays out the gag/mechitzah principle.
- Rama → details the permitted walls (tznius) and their limits.
- Chabad → Shulchan Aruch HaRav, Siman
7. Modern practical cases
| Situation | Halachic analysis |
|---|---|
| Umbrella (opening / closing) | Forbidden according to most poskim — this is making an ohel arai. An umbrella already open before Shabbos = permitted to stand under it. |
| Stroller canopy / sunshade | If the canopy has a tefach extended before Shabbos → one may unfold it further (tosefes ohel). Otherwise → borderline case, consult your Rav. |
| Mosquito net over a crib | If it forms a roof → ohel problem. If a tefach was set up before Shabbos → one may complete it. |
| Curtain, room divider, partition | Permitted — it is a wall (mechitzah), not a roof. Unless it renders a sukkah valid or creates a domain for carrying. |
| Covering a pot, a dish | Permitted — a cover almost touching the contents is not a significant "ohel." The issue arises when there is an empty space of a tefach beneath. |
| Retractable awning / patio cover | Extending = making an ohel. If a tefach was extended before Shabbos → completing is permitted. |
| Children's play tent | Setting up a tent on Shabbos = ohel, forbidden. Leaving it set up from before Shabbos = OK. |
8. Practical summary of the Siman
- Making an ohel (roof/shelter) on Shabbos = toladah of boneh, forbidden — even temporarily (gezeirah).
- Only the roof (gag) is involved; the walls (mechitzos) are permitted.
- Tosefes ohel: if a tefach of roof was in place before Shabbos, one may complete it.
- Tznius wall (curtain, paroches): permitted — without forming a roof at the top.
- Mechitzah hamateres (rendering a sukkah valid / creating a domain): forbidden.
- Practical solution: extend a tefach before Shabbos (umbrella, canopy, awning).
9. Comprehension questions
- Of which melachah is ohel a toladah?
- What is the fundamental distinction between gag and mechitzah?
- What is the difference between ohel keva and ohel arai? Why is arai also forbidden?
- What is tosefes ohel? What is the condition of the tefach?
- Why is a tznius curtain permitted, but a partition that renders a sukkah valid forbidden?
- May one open an umbrella on Shabbos? And a stroller canopy?
- What is the practical solution for using an awning / umbrella on Shabbos?
