📑 Study outline
1. The text of the Shulchan Aruch
Siman 329 contains 9 se'ifim of the Mechaber codifying the laws on for whom we are mechalel Shabbos — pikuach nefesh.
Se'if 1
- All פיקוח נפש overrides Shabbat — and he who is prompt in it is praiseworthy.
- Even if a fire broke out in another courtyard and he fears it will pass to this one and come to danger — one extinguishes it, so that it not pass.
Se'if 2
- In פיקוח נפש one does not follow the majority.
- Even if there were nine non-Jews and one Jew in a courtyard, and one of them went off to another courtyard and a collapse fell on him there — one clears it: since the original fixed group remains in its place, we reckon him as half and half.
- But if all of them moved off, and at the moment of moving one went aside and it fell on him — one does not clear it: since the original fixture has left its place, we say « whatever separates, separates from the majority ».
Se'if 3
- One upon whom a collapse fell — doubt whether alive or dead, doubt whether he is there or not, and even granting he is there, doubt whether non-Jew or Jew — one clears it for him.
- And this though several doubts are compounded.
Se'if 4
- Even if they found him crushed, able to live only a moment — one clears it.
- And they examine as far as his nostrils: if they sensed no breath of life at his nostrils, then he is certainly dead.
- And it makes no difference whether they reached his head first or his feet first.
Se'if 5
- If he found the upper ones dead, he shall not say « those below are already dead ».
- But he clears for them — perhaps they are still alive.
Se'if 6
- Non-Jews laying siege to Jewish towns: if they came over money — one does not profane the Shabbat for them.
- If they came over lives — and even where it is unstated — one goes out against them armed, and profanes the Shabbat for them.
- And in a town near the frontier — even if they came only over straw and stubble — one profanes the Shabbat for them. Rama: and even if they have not yet come, but wish to come.
Se'if 7
- There is one who says that in our time, even if they came over money, one profanes — for if the Jew does not let them plunder and seize his property, they will kill him; and that is a matter of lives.
- Rama: and even so, all according to the case.
Se'if 8
- One who sees a ship carrying Jews tossed at sea, and likewise a flooding river, and likewise a lone man pursued:
- It is a mitzvah upon every man to profane the Shabbat for them in order to save them.
Se'if 9
- All who go out to rescue return to their place with their weapons.
2. General context
What does this siman discuss?
Siman 329 directly extends Siman 328: if the latter dealt with the choleh, this one deals with all other dangers — collapse, fire, military siege, shipwreck, drowning, individual pursued. The question is no longer "what illness" but "for whom and in what doubt" one transgresses Shabbos.
Place in Hilchos Shabbos
Siman 329 follows Siman 328 (the choleh) and precedes the simanim on the yoledes (330) — all three form the block of pikuach nefesh.
3. Key halachic concepts
Four concepts structure the 9 se'ifim:
- פיקוח נפש דוחה שבת — saving a life overrides Shabbos; absolute principle.
- ספק נפשות להקל — in doubt of life, one is "lenient" — i.e., one transgresses to save; one doesn't await certainty.
- קבוע — "established": a Jew present in a fixed place is not "diluted" in a majority of non-Jews; treated as half-and-half, one saves.
- עיר הסמוכה לספר — border town: its fall endangers the whole country, so we defend it even for minor stakes.
4. The se'ifim in detail
| Se'ifim | Theme | Rule |
|---|---|---|
| 1 | Principle and future danger | Pikuach nefesh overrides Shabbos, even for a spreading fire |
| 2-5 | One buried under collapse | One digs despite doubts; kavua; check breath; continue under the dead |
| 6-7 | Military siege | For lives yes; border town always; today even for money |
| 8-9 | Shipwreck, pursued, return | Mitzvah to save; rescuers return in arms |
5. The Mishnah Berurah — opening entries
The Mishnah Berurah has 21 entries on this siman. The first illuminate se'if 1:
6. The Rema's position
The Rema adds a brief but weighty gloss on se'if 6:
7. Modern practical cases
| Situation | Analysis |
|---|---|
| Person buried / missing (earthquake, collapse) | One digs and searches, even in doubt of survival or identity (se'ifim 2-5). |
| Fire threatening neighboring homes | If people may be trapped, one intervenes even before the spread (se'if 1). |
| Defense of Israel, military alert at the border | Border town: one mobilizes even for a potential threat (se'if 6 + Rema). Halachic basis for defense on Shabbos. |
| Rescue at sea, drowning, assault | Mitzvah for each to be mechalel to save; rescuers may then return (se'ifim 8-9). |
8. Practical synthesis of the Siman
- Pikuach nefesh overrides Shabbos — always, and the zealous is praiseworthy.
- Doubt obligates action — safek nefashos lehakel: doubt on survival, presence, identity — one saves anyway.
- Future danger — one doesn't wait: fire threatening to spread, enemy wanting to come.
- Border town — defended even for minor stakes, since its fall endangers the whole country.
- Don't discourage rescuers — they return home with their weapons.
9. Comprehension questions
- What is the relationship between Siman 329 and the previous siman (328)?
- Why does one dig out a buried person despite "several superimposed doubts" (se'if 3)?
- What is קבוע (kavua) and how does it operate (se'if 2)?
- Why is Shabbos transgressed for a border town even for straw (se'if 6)?
- What is checked to determine if a buried person is still alive (se'if 4)?
- Why do rescuers return "in arms" (se'if 9)?
