1. The central axiom
Siman 355 in one sentence.
Open water is a karmelis: transferring between it and a house requires a "partition." The siman codifies two leniencies: the suspended partition (mechitza teluyah), virtually "extended downward" toward the water (גוד אחית), and kocho — when the object or water arrives indirectly, not thrown directly. Kevod habriyos further widens these leniencies for the outhouse.

The siman codifies two leniencies: the suspended partition (mechitza teluyah), virtually "extended downward" toward the water (גוד אחית), and kocho — when the object or water arrives indirectly, not thrown directly. Kevod habriyos further widens these leniencies for the outhouse.
2. Condensed key concepts
| Concept | Definition | Application |
|---|---|---|
| גְּזוּזְטְרָא | Overhanging balcony above water | Drawing requires a partition |
| מְחִיצָה תְּלוּיָה | Suspended partition (גוד אחית) | Permitted above water |
| כֹּחוֹ | "His force" — indirect arrival | Permitted in any karmelis |
| כְּבוֹד הַבְּרִיּוֹת | Human dignity | Eases for the outhouse |
| עֹמֶק עֲשָׂרָה | Water 10 tefachim deep | Required for "water" status |
3. The two leniencies
Leniency 1 — suspended partition: a partition that does not touch the water is virtually "extended downward" (גוד אחית). Valid only above water (10 deep), and made to permit.
↓
Leniency 2 — kocho: when the object or water is not thrown directly but arrives indirectly (on a board, along a wall), it is permitted in any karmelis.
↓
Expansion — kevod habriyos: for the outhouse, we ease (broken board, outhouse between two houses without eruv b'dieved).
4. Decision tree
Q1: Do you wish to draw water from a gezuzṭra or ship?
↓ YES → partition around the hole (4×4); ship → perforated board suffices
Q2: Is it an outhouse above water?
↓ YES → suspended partition made to permit, or board (kocho)
Q3: Is the outhouse above a non-water karmelis (ditch)?
↓ YES → suspended partition useless; only a board (kocho) works
→ Water less than 10 tefachim → no "water" status. In doubt → consult your Rav.
5. Suspended partition: conditions
| Condition | Requirement |
|---|---|
| Place | Only above water (not a dry ditch) |
| Water depth | At least 10 tefachim; otherwise no "water" status |
| Intent | Made to permit transferring — not only for privacy |
| Alternative (kocho) | A board / reed that receives indirectly — valid in any karmelis |
6. Mnemonic תָּלוּי
ת — תְּלוּיָה עֲשׂוּיָה לְהַתִּיר: the suspended partition must be made to permit, and only above water.
ל — לִמְלֹא בִּמְחִיצָה: for drawing water, a partition around the 4×4 hole (on a ship, a perforated board suffices).
ו — וְכֹחוֹ בְּכַרְמְלִית: what arrives indirectly (kocho) is permitted in any karmelis.
י — יֵשׁ עֹמֶק עֲשָׂרָה: only water 10 tefachim deep has "water" status.
7. Pitfalls to avoid
Pitfall 1: Believing an ordinary partition (made for privacy) suffices. It must be made to permit transferring.
Pitfall 2: Using a suspended partition above a dry ditch. This leniency is only above water.
Pitfall 3: Relying on shallow water. Water less than 10 tefachim has no "water" status.
Pitfall 4: Drawing from a gezuzṭra without a partition. A partition is needed, at least around the 4×4 hole.
8. Practical cases
| Situation | Analysis | Conduct |
|---|---|---|
| Drawing from a balcony above water | Karmelis → house | Partition around the hole (4×4) |
| Drawing from a ship | Leniency | Perforated board (גוד אחית) |
| Outhouse above water | Suspended partition / kocho | Partition made to permit, or board |
| Outhouse above dry ditch | Non-water karmelis | Only a board (kocho) works |
| Shallow water (less than 10) | No "water" status | Suspended partition useless |
9. Final synthesis table
| Item | Detail |
|---|---|
| Topic of the siman | Drawing / transferring above water; outhouse above water |
| Number of seifim | 5 |
| Mishnah Berurah | 49 entries |
| Talmudic source | עירובין פ"ז ע"ב — פ"ח ע"א |
| Golden rule | Two leniencies: suspended partition (over water) and kocho (any karmelis) |
| Practical decision | Delicate cases — you must consult your Rav |
10. The practical takeaways of Siman 355
For daily conduct
- Drawing water from a balcony: partition around the hole (4×4); on a ship, a perforated board suffices.
- Suspended partition: valid only above water (10 deep), made to permit.
- Kocho (indirect arrival): permitted in any karmelis.
- Outhouse: kevod habriyos widens leniencies.
- In doubt — consult your Rav.
- Deep pilpul — Level 2; Chabad shitah — Level 4.
