📜 The text of the Shulchan Aruch — 1 seif
summary: the heading of the siman, then the seif. A wife makes the eruv for her husband without his consent, even if he protested, where he forbids the courtyard to the other residents; for a house open to two courtyards, everything depends on the courtyard through which he habitually passes and on the one with which he habitually makes the eruv; with neither, she makes it without his knowledge, as long as he has not explicitly protested. She may not grant to others a share in what is his without his knowledge. When husband and wife are away, the members of the household may make the eruv, under certain conditions; the residents of the courtyard may not take his bread without the knowledge of any member of the household (so the Mishnah Berurah, ס״ק י״ב, reads שלא מדעת). Then a second opinion (some say), which allows the wife only an eruv made without his knowledge, and the case of the habitual participant who refuses, or of one who is compelled by the beis din. The Rema adds the case of one who withdraws from his eruv.
1. The sugya — Shmuel's two statements in Eruvin 80a
The source in the Gemara
The source of the siman is the sugya of Eruvin 80a-b. It opens with a case: a non-Jewish neighbor refuses to rent his domain to the residents of the courtyard — Rashi describes him thus: « נכרי היה ממונה על כלי זיין העשויין לשמירת העיר » (רש״י עירובין פ׳ ע״א) —, and they ask whether they may rent it from his wife: « אֲתוֹ לְקַמֵּיהּ דְּרַבִּי זֵירָא אֲמַרוּ לֵיהּ: מַהוּ, לְמֵיגַר מִדְּבֵיתְהוּ » (עירובין פ׳ ע״א). Rabbi Zeira answers with the rule of the wife, in the name of Reish Lakish, from Rabbi Chanina: « אֲמַר לְהוּ: הָכִי אָמַר רֵישׁ לָקִישׁ מִשְּׁמֵיהּ דְּגַבְרָא רַבָּה, וּמַנּוּ רַבִּי חֲנִינָא: אִשְׁתּוֹ שֶׁל אָדָם מְעָרֶבֶת שֶׁלֹּא מִדַּעְתּוֹ » (עירובין פ׳ ע״א). A second, similar incident is reported, with a neighbor of Rav Yehudah bar Oshaya; they ask Rav Yehudah bar Oshaya, then Rav Masna, who do not know the answer, and it is Rav Yehudah who answers in the name of Shmuel: « הָכִי אָמַר שְׁמוּאֵל: אִשְׁתּוֹ שֶׁל אָדָם מְעָרֶבֶת שֶׁלֹּא מִדַּעְתּוֹ » (עירובין פ׳ ע״א).
The Gemara at once raises an objection from a baraisa: « נָשִׁים שֶׁעֵירְבוּ וְנִשְׁתַּתְּפוּ שֶׁלֹּא מִדַּעַת בַּעֲלֵיהֶן, אֵין עֵירוּבָן עֵירוּב, וְאֵין שִׁיתּוּפָן שִׁיתּוּף » (עירובין פ׳ ע״א) — women who made an eruv or a shituf without their husbands' consent: it is neither an eruv nor a shituf. It answers: « לָא קַשְׁיָא: הָא — דְּאָסַר, הָא — דְּלָא אָסַר » (עירובין פ׳ ע״א) — one speaks of a man who "forbids", the other of one who does not. And it supports this answer with a second statement of Shmuel: « אֶחָד מִבְּנֵי מָבוֹי שֶׁרָגִיל לְהִשְׁתַּתֵּף עִם בְּנֵי מָבוֹי, וְלֹא נִשְׁתַּתֵּף — בְּנֵי הַמָּבוֹי נִכְנָסִין לְתוֹךְ בֵּיתוֹ וְנוֹטְלִין שִׁיתּוּפָן מִמֶּנּוּ בְּעַל כׇּרְחוֹ » (עירובין פ׳ ע״א) — a resident of the alley who habitually joins in the shituf with them and did not: the residents of the alley enter his house and take his share against his will; from which it infers: « רָגִיל אִין, שֶׁאֵין רָגִיל לָא » (עירובין פ׳ ע״א).
The foundation: the siman starts from these two statements of Shmuel — the first, Rabbi Zeira had also reported, in the name of Reish Lakish, after Rabbi Chanina — and from the baraisa that seems to contradict the first. The Gemara leaves open, among others, these questions, which the Rishonim answer differently: what it means to "forbid" (הא דאסר), and what role habit (רגיל) plays. These are the subject of sections 2 and 3; the dispute that comes out of them is the second opinion of the seif (section 8).
2. The underlying hakira — what does it mean to "forbid" (אוסר)?
חקירה — in the Gemara's answer, is the man who "forbids" defined by a fact — the layout of the houses, which makes his presence forbid the courtyard to the others as long as he is not in the eruv —, or by an intention he has declared, not to make the eruv with them?
- First side — a fact. Rashi explains that where he forbids the residents of the alley, his consent is not required, and that the baraisa speaks of one who does not forbid — and he illustrates it by a layout, a courtyard between two alleys: « על בני המבוי לא בעינן דעתיה ומתניתין בדלא אסר כגון חצר שבין שני מבואות ורגילה עם זה ולא עם זה » (רש״י עירובין פ׳ ע״א). On Shmuel's second statement, however, Rashi uses the language of intention — « ולא נשתתף »: « אינו רוצה ומתכוין לאסור עליהן » (רש״י עירובין פ׳ ע״א) — and the Beis Yosef uses this gloss to support the Tur ("even if he protested", below): « וכן יש לדקדק מדפירש״י אחד מבני מבוי וכו׳ ולא נשתתף אינו רוצה ומתכוין לאסור עליהם » (בית יוסף או״ח שס״ז). For Rashi, this intention does not prevent taking his share against his will: it is Shmuel's statement he is glossing. The first side remains that of his gloss on « הא דאסר ». The Mechaber, in the first opinion, gives an example of it: « וה״מ כשאוסר עליהם כגון שאין הבית פתוח אלא לאותו חצר » (שו״ע או״ח שס״ז:א).
- Second side — an intention. כְּגוֹן שֶׁאָמַר אֵינִי מְעָרֵב עִמָּכֶם אוֹ אֵינִי מִשְׁתַּתֵּף עִמָּכֶם » (רמב״ם הלכות עירובין פ״ה ה״ה) — a wife makes the eruv for him without his knowledge (so the Beis Yosef reads שלא מדעתו here: section 8), provided he does not forbid his neighbors; if he forbids, she makes it only with his consent; and "forbidding" means saying: I am not making the eruv with you. The Beis Yosef reads him so: « נראה מדבריו שהוא מפרש הא דאסר שהוא מתכוין לאסור על שכינו » (בית יוסף או״ח שס״ז).
The Mechaber opens the seif on the first side and brings the second under the name « וי״א » (section 8).
נפקא מינה — a man whose house opens only onto this courtyard, and who said explicitly that he does not want to make the eruv. On the first side, he forbids by the very fact, and his wife makes the eruv for him despite his objection; on the second, it is precisely his declaration that makes him one who forbids, and she makes it only with his consent. On the second opinion of the seif, the Mishnah Berurah writes that she does not make it, even when the house opens onto one courtyard only: « אפילו אם אין הבית פתוח אלא לחצר אחד שאוסר עליהם ע״י מניעתו את העירוב » (משנה ברורה שס״ז ס״ק י״ג).
3. A house open to two courtyards — two kinds of habit
The seif distinguishes two habits: going in and out through a courtyard, which makes him forbid that courtyard, and making the eruv with its residents. It writes them one after the other: « ברגיל שאוסר מערבת שלא מדעתו אפי׳ אינו רגיל לערב » (שו״ע או״ח שס״ז:א) — in the courtyard through which he habitually passes, she makes the eruv without his consent even if he is not accustomed to making it; and in the other, « אע״פ שאינו אוסר אם רגיל לערב עמהם מערבת שלא לדעתו » (שו״ע או״ח שס״ז:א). For the courtyard he habitually uses, the Mishnah Berurah refers to siman 386, seif 9 (ס״ק ד).
יסוד — the habit of making the eruv holds even against a protest, and the Mishnah Berurah gives the reason: « היינו אפילו כשמיחה בה והטעם משום דרכי שלום כיון שעד עתה היה דרכו ליתן חלק בעירוב לכן חל העירוב בכל גווני » (משנה ברורה שס״ז ס״ק ה) — it is for the sake of peace between neighbors (darchei shalom): since until now it was his way to give his share in the eruv, the eruv takes effect in every case.
4. As long as he has not protested — the eruv made without his knowledge
If he neither forbids nor is accustomed, she does not make the eruv against his will; but the seif adds: « וכל זמן שלא מיחה בה בפירוש אפי׳ אם אינו רגיל לערב עמהם ואינו אוסר מערבת שלא בידיעתו דמסתמא ניחא ליה » (שו״ע או״ח שס״ז:א).
Two expressions of the seif, which the Mishnah Berurah glosses each in its place. שלא לדעתו, for the habitual participant, holds even against his protest — that is the opening of ס״ק ה quoted above; שלא בידיעתו means: « פי׳ שאין הבעל יודע מזה » (משנה ברורה שס״ז ס״ק ח) — the husband knows nothing of it.
5. Granting a share to others — what is his, and what is hers
The seif: «
The Tur writes this passage with the other expression: « אבל אינה יכולה לזכות משלו לאחרים שלא מדעתו » (טור או״ח שס״ז). The Beis Yosef specifies that here it does not mean "against his will": « והאי שלא מדעתו אינו כמו שלא מדעתו דלעיל דהוי אפילו בע״כ אבל האי שלא מדעתו היינו שלא בידיעתו » (בית יוסף או״ח שס״ז). At this point the seif of the Shulchan Aruch reads שלא בידיעתו — the very word by which the Beis Yosef explains the Tur.
6. The members of the household — when husband and wife are away
The seif: «
The Tur writes only the case of a single courtyard: « ואפילו בני הבית יכולין לערב שלא מדעתו אם אין הבית פתוח אלא לחצר אחת » (טור או״ח שס״ז). The Beis Yosef adds the case of two courtyards on his own: « ונ״ל דחצר שבין ב׳ מבואות נמי היכא דרגיל לערב באחד מהן ידעינן בהי ניחא ליה ובני הבית מערבין עליו » (בית יוסף או״ח שס״ז) — and this is what the seif writes: « ואפילו אם היה פתוח לשתי חצרות אם הוא רגיל לערב לאחת מהם מערבין עליו » (שו״ע או״ח שס״ז:א).
Bach and Magen Avraham — when the members of the household know that the householder does not want it. The Magen Avraham reports the Bach: « וב״ח כ׳ דאפילו אינו רוצה לערב יכולין לערב אם לא שמיחה בהם בפירוש » (מגן אברהם שס״ז ס״ק ב) — and answers that this holds only for a non-Jew: « דדוקא גבי עכו״ם אמרי׳ כן אבל גבי ישראל אין יכולין לערב אם הוא אינו רוצה » (מגן אברהם שס״ז ס״ק ב).
- The Mishnah Berurah writes, on this passage of the seif: «
- And it gives the reason for the distinction between one courtyard and two: « דזכות היא לו ובודאי לא יקפיד עליהם אבל אם הוא פתוח לשתי חצרות אין יכולים לערב עליו שלא בידיעתו כי איננו זכות לו ודאי כי שמא לא יחפוץ לערב עם חצר זו אלא עם זו אם לא כדמסיים המחבר » (משנה ברורה שס״ז ס״ק י).
7. The residents of the courtyard — taking his bread
The seif: « אבל בני החצר אין יכולים ליקח פתו מביתו לערב שלא מדעת אחד מבני הבית אפילו רגיל עמהם ואוסר עליהם » (שו״ע או״ח שס״ז:א). This is the Tur's sentence: « אבל בני החצר אין יכולין ליקח פתו מביתו לערב שלא מדעת שום אחד מבני הבית ואפי׳ רגיל עמהם ואוסר עליהם » (טור או״ח שס״ז), whose source the Beis Yosef gives: Tosafos and the Rosh, for whom « דדעת אשתו צריך דפשיטא ליה שאין שום עירוב מועיל בע״כ כלומר שלא מדעתו ושלא מדעת אשתו » (בית יוסף או״ח שס״ז). The Mishnah Berurah reads: without the knowledge of any of them — « ר״ל שלא בידיעת אחד מבני בית דאי היה בידיעתם היה מותר כ״ז שלא שמעו מבעה״ב שאינו רוצה בעירוב » (משנה ברורה שס״ז ס״ק י״ב).
The Biur Halachah is puzzled: « ובאמת דין זה תמוה מאוד וכמו שתמהו הב״ח וט״ז ושארי מפרשים » (ביאור הלכה שס״ז) — why should the residents of the courtyard be less than the members of the household, when the reason applies to them too: « דמ״ש בני החצר לחצר אחד או ברגיל להשתתף ומטעם דזכות הוא לו ובודאי ניחא ליה » (ביאור הלכה שס״ז)?
He proposes to read the sentence as going back to the beginning of the siman: « ומ״ש אבל בני החצר וכו׳ לא קאי אדסמיך ליה בדינא דבני ביתו אלא אריש הסימן קאי אדינא דאשתו מערבת אפילו בע״כ » (ביאור הלכה שס״ז) — it does not teach that the residents of the courtyard are less than the household, but that entirely against the householder's will nothing permits others to make the eruv for him. Then he notes what this reading leaves unanswered: « ולכאורה לא אשכחן להרא״ש דמתיר אלא מדעת אשתו ולא מדעת שאר בני הבית וצ״ע » (ביאור הלכה שס״ז). For practice, he writes: « ולדינא יש דיעות בזה בין האחרונים » (ביאור הלכה שס״ז), and he cites, among others, on one side the Taz and the Magen Avraham (in siman 368), from whom it emerges that the residents of the courtyard may not take his bread without the master of the house knowing even for a house opening onto one courtyard only; on the other, the Bach and the Maharam of Lublin, from whom it emerges that it is permitted for a house opening onto one courtyard only; and the Beis Meir and the Nahar Shalom lean this way in practice. He adds, referring to his next note (section 8): « ועיין בבה״ל לקמיה שצדדנו ג״כ דהיכא דהיה רגיל להשתתף עד כה עמהן יש לסמוך עלייהו להקל ליקח שלא בידיעתו » (ביאור הלכה שס״ז).
8. The second opinion, taking by force — and the beis din, according to all
The seif: « וי״א דאין אשתו מערבת אלא שלא בידיעתו אבל אם אומר שאינו רוצה לערב עמהם לא » (שו״ע או״ח שס״ז:א). The Biur Halachah identifies it: « הוא דעת הרמב״ם והמחבר הביאה רק בשם יש אומרים משמע דס״ל לעיקר כדעה קמייתא » (ביאור הלכה שס״ז). And the Mishnah Berurah specifies the reach of this refusal: « ואפילו אם אמר כן לאחר שעירבה נתבטל עירובה למפרע » (משנה ברורה שס״ז ס״ק י״ד).
The readings of the sugya —
- Tosafos and the Rosh: the one who forbids is a matter of fact — for Tosafos, see section 3; the Rosh, quoted by the Beis Yosef, divides Shmuel's two statements according to whether he forbids or not: « הא דאמר שמואל אפילו אינו רגיל מערבין בע״כ היינו בדאסר והא דקאמר הכא רגיל אין שאינו רגיל לא בדלא אסר כגון חצר שבין ב׳ מבואות » (בית יוסף או״ח שס״ז) —, and the wife makes the eruv even if he does not want it. The Beis Yosef quotes the Rosh: « וכתב הרא״ש אשתו של אדם מערבת לו שלא מדעתו ואפילו אם אינו רוצה לערב » (בית יוסף או״ח שס״ז); the Tur adds "even if he protested" (section 2), and the Beis Yosef attaches him to their reading: « ומעתה יתבארו דברי רבינו שמ״ש אשתו של אדם מערבת לו שלא מדעתו אפילו אם מיחה בה היינו מימרא דשמואל וכמו שפירשוה התו׳ והרא״ש » (בית יוסף או״ח שס״ז).
- The Rambam: the one who forbids is the one who said he does not want it (section 2), and Shmuel's statement concerns only an eruv made without his knowledge. The Beis Yosef explains: « ומאי שלא מדעתו דקאמר שאינו יודע בדבר אבל אם יודע ומוחה אינה מערבת » (בית יוסף או״ח שס״ז), and he places the Rif with him: « ודעת הרי״ף נראה שהוא כדעת הרמב״ם » (בית יוסף או״ח שס״ז).
According to the Rambam, what becomes of the Gemara's inference, "if habitual, yes; if not, no"? The Beis Yosef answers that one must assume a different reading: « וצ״ל שאינו גורס רגיל אין שאינו רגיל לא דאין לו ענין לפי שיטה זו » (בית יוסף או״ח שס״ז).
The Magen Avraham keeps the reading of our editions: « ונ״ל דה״ה אשתו ובהכי שפיר מתיישבת סוגיית הגמרא רגיל אין שאינו רגיל לא וא״צ להגיה כמ״ש הב״י » (מגן אברהם שס״ז ס״ק ד) — according to the second opinion, what holds for the residents of the courtyard holds for the wife too: when he is habitual, she makes the eruv against his will. The Biur Halachah also keeps the reading of the editions: « ובאמת אין צורך כלל לשבש הספרים ושפיר אתי שיטה זו אף לפי גרסתנו וכמו שכתב במגן אברהם » (ביאור הלכה שס״ז), and the Mishnah Berurah writes it on the taking by force of the second opinion: « וה״ה אשתו ומיירי שע״י מניעתו את העירוב אוסר עליהם » (משנה ברורה שס״ז ס״ק ט״ו).
What the Biur Halachah draws from it — he considers being strict according to the Rambam, then reports the contrary view and leaves the question open: « אפשר שיש להחמיר כשיטה זו שלא לערב בע״כ של בעה״ב אפילו מדעת אשתו היכי שאינו רגיל להשתתף עמהם מיהו בא״ר ראיתי שכתב שכדעה קמא יש לפסוק לקולא וצ״ע » (ביאור הלכה שס״ז). And he concludes on the case of the habitual participant who forbids: « היוצא מכל זה דמדינא מסתברא דהיכי שרגיל ואוסר בני החצר נוטלין אפילו בע״כ ולא בעינן דעת אשתו כלל ועכ״פ שלא בידיעתו בודאי יש לסמוך להקל דהא הרבה אחרונים מקילין אפילו לדעת הטור » (ביאור הלכה שס״ז). The compulsion itself remains written: by the Rambam, « כּוֹפִין אוֹתוֹ לְהִשְׁתַּתֵּף עִמָּהֶן » (רמב״ם הלכות עירובין פ״ה ה״ב), without naming the beis din — the Beis Yosef, explaining his reading, writes « כופין אותו בב״ד » (בית יוסף או״ח שס״ז) —, and by the seif. For halachah lema'aseh, consult your Rav.
9. The gloss of the Rema — one who withdraws from his eruv
The gloss: « מי שאינו רגיל לערב ועירב עם בני חצר וחזר מעירובו צריך לחזור ולזכות אבל אם רגיל לערב הוי עירוב בעל כרחו » (רמ״א או״ח שס״ז:א). The Rema refers to the Rosh, perek HaDar; the Beis Yosef reports it: « מערב שאמר חוזרני בי מן העירוב ואיני רוצה לערב עם בני החצר ובני המבוי צריך לחזור ולזכות פעם אחרת ולערב » (בית יוסף או״ח שס״ז). The Mishnah Berurah explains the withdrawal: « היינו שאמר חוזרני בי מן העירוב ואיני רוצה לערב ולהשתתף עוד עמכם » (משנה ברורה שס״ז ס״ק י״ח), and its effect: « דבטל עירובו ושיתופו הקודם אף שעדיין הפת מונח במקומו » (משנה ברורה שס״ז ס״ק י״ט).
The Biur Halachah: « הלשון מגומגם קצת דהא מיירי שהפת מונח במקומו » (ביאור הלכה שס״ז) — if the bread is still in its place, what does "grant it again" mean?
His answer: « ונראה דאין הכונה שצריך לזכות וליתן מחדש אלא שצריך לומר בפיו שחוזר ומשתתף עמהם ומזכה לכולם שיהיה להם חלק בפתו ומשום דאמרינן המקפיד על עירובו אינו עירוב » (ביאור הלכה שס״ז) — it is enough that he say he is joining them again and granting all of them a share in his bread, for one who is particular about his eruv has no eruv. Rashi gives the reason for that rule in his comment s.v. צריך להודיע, on a neighbouring baraisa of the sugya; the end of the comment, on one who gives from what is his, deals with another point: « המקפיד על עירובו אינו עירוב שעינו צרה באותה פת ליתן לחביריו אבל משלו אין צריך להודיעו דזכין לו לאדם שלא בפניו » (רש״י עירובין פ׳ ע״א).
Magen Avraham and Mishnah Berurah — does the second half of the gloss, the eruv that holds against his will, apply according to the first opinion of the seif as well, or only according to the וי״א?
- Magen Avraham: « נ״ל דזהו דוקא לדעת הי״א שבני החצר נוטלין בע״כ אבל לסברא הראשונה לעולם אין יכולין לערב בלא דעת אשתו וצ״ע » (מגן אברהם שס״ז ס״ק ה) — only according to the second opinion; and he points out that the Rosh seems to say one thing in perek Chalon and the other in perek HaDar.
- Mishnah Berurah: « ואף לדעה הראשונה דס״ל דבלא דעת אשתו אין בני החצר יכולין ליקח ממנו בע״כ הכא קילא מפני שהפת כבר מונח תחת ידם » (משנה ברורה שס״ז ס״ק כ) — even according to the first opinion, here it is lighter, since the bread is already in their hands.
10. Summary of the shitos and the halachic conclusion
The foundation — two statements of Shmuel and a baraisa (Eruvin 80a), which the Rishonim read differently:
- what "forbidding" means: a fact of the layout of the houses (Rashi on « הא דאסר »; the seif), or the declaration that he does not want it (Rambam) — section 2;
- a house open to two courtyards: the habit of passing through and the habit of making the eruv (the seif; Tosafos; Beis Yosef) — section 3;
- with neither: without his knowledge (the seif), as long as he has not protested (Rosh; Tosafos) — section 4;
- granting others a share in what is his, without his knowledge: no; from her own food: yes (Magen Avraham ס״ק א; Mishnah Berurah ס״ק ז) — section 5;
- the members of the household, when husband and wife are not in town: without his knowledge, one courtyard, or two courtyards if he is accustomed with one of them (Beis Yosef; the seif); not if they know he does not want it, even without an explicit protest (Magen Avraham ס״ק ב; Mishnah Berurah ס״ק ט) — section 6;
- the residents of the courtyard: a passage the Biur Halachah finds difficult; he reports views divided among the Acharonim, then leans, for one who was accustomed, toward those who permit taking his bread without his knowledge — sections 7 and 8;
- the second opinion, that of the Rambam according to the Biur Halachah; the beis din, according to all in the view of the Mishnah Berurah (ס״ק ט״ז) — section 8;
- the Rema: withdrawal, and the discussion of the Magen Avraham and the Mishnah Berurah on its second half — section 9.
