📜 The text of the Shulchan Aruch — 5 seifim

summary: the heading of the siman, then seif א. The eruv was made, then it was spoiled, and one of the residents comes to remake it. From the same kind: he need not inform them, even if the first is used up and even if he makes the eruv for them from what is theirs. From another kind: if the first is used up, he must inform them when he takes from what is theirs, and not when he takes from his own. If the first was only diminished: he need not inform them, even with what is theirs.

summary: residents were added to the courtyard; if the house opens onto two courtyards, they must be informed, since perhaps they do not want to make the eruv with these.

summary: the measure of the eruv at its beginning. Eighteen participants or fewer: a dried fig (grogeres) for each. More than eighteen, even a thousand or more: food for two meals, which is eighteen dried figs, like six eggs; and some say like eight eggs.

summary: an eruv that fell below its measure after the first Shabbos began, if any amount at all remains, is valid for the other Shabbosos as well.

summary: eruv bread that has gone moldy and is unfit to eat is like bread that is used up: the eruv must be made anew. The Rema: hence the custom to make the eruv from a matzah loaf, which does not quickly go moldy and can be kept over Pesach and all year; this is better, so that people do not forget; whoever wishes to make the eruv every Erev Shabbos may do so; and he refers to siman שצ״ד.

1. The sugya — the Mishnah of Eruvin 80b and the question “what case are we dealing with?”

The Mishnah

The source of the siman is the Mishnah in Eruvin 80b: « נִתְמַעֵט הָאוֹכֶל — מוֹסִיף וּמְזַכֶּה, וְאֵין צָרִיךְ לְהוֹדִיעַ. נִתּוֹסְפוּ עֲלֵיהֶן — מוֹסִיף וּמְזַכֶּה, וְצָרִיךְ לְהוֹדִיעַ » (עירובין פ׳ ע״ב) — the food [of the eruv] diminished: he adds, transfers ownership, and need not inform; [residents] were added: he adds, transfers ownership, and must inform. For the first half, Rashi gives the reason: « שהרי כולן נתרצו בתחלה » (רש״י עירובין פ׳ ע״ב) — all of them agreed at the outset.

The Gemara

The Gemara asks which case the Mishnah means: « בְּמַאי עָסְקִינַן? אֲפִילּוּ כָּלָה נָמֵי » (עירובין פ׳ ע״ב) — if it is one kind, why say “diminished”? Even if used up it would be the same! And the other way: « אֶלָּא בִּשְׁנֵי מִינִין, אֲפִילּוּ נִתְמַעֵט נָמֵי לָא » (עירובין פ׳ ע״ב) — if it is two kinds, even when diminished it should not be allowed without informing; for a baraisa teaches: « כָּלָה הָאוֹכֶל, מִמִּין אֶחָד — אֵין צָרִיךְ לְהוֹדִיעַ, מִשְּׁנֵי מִינִים — צָרִיךְ לְהוֹדִיעַ » (עירובין פ׳ ע״ב). It answers in two ways: « אִיבָּעֵית אֵימָא: מִמִּין אֶחָד, מַאי נִתְמַעֵט — נִתְמַטְמֵט » (עירובין פ׳ ע״ב) — one kind, and “diminished” means “wholly reduced” (Rashi: נתמטמט - כלה לגמרי); « וְאִיבָּעֵית אֵימָא: מִשְּׁנֵי מִינִין, כָּלָה שָׁאנֵי » (עירובין פ׳ ע״ב) — or two kinds, and an eruv that is used up is a different case.

Rashi, on the second answer — « ודוקא נקט נתמעט ודקא קשיא לך מברייתא כלה שאני דברייתא כלה דווקא נקט אבל נתמעט אפילו מב׳ מינין אין צריך להודיע » (רש״י עירובין פ׳ ע״ב) — the Mishnah says “diminished” deliberately, and the baraisa says “used up” deliberately: an eruv that was only diminished, even if topped up from another kind, does not require informing.

Seif א of the Mechaber combines the baraisa with this reading of the second answer. From the same kind, even if used up: « אם בא לערב ממין הראשון אפי כלה א״צ להודיע ואפי׳ מערב עליהם משלהם » (שו״ע או״ח שס״ח:א); from another kind, used up: « ואם בא לערב ממין אחר אם כלה הראשון צריך להודיע להם אם מערב משלהם » (שו״ע או״ח שס״ח:א); only diminished: « ואם לא כלה הראשון אלא נתמעט אע״פ שמערב משלהם א״צ להודיעם » (שו״ע או״ח שס״ח:א). What neither the Mishnah nor the baraisa says outright — that the difference between “from his own” and “from what is theirs” matters — is the subject of section 3.

2. Taking the residents’ bread — the Taz and siman

Seif א exempts one from informing when remaking the eruv from the same kind, « ואפי׳ מערב עליהם משלהם » (שו״ע או״ח שס״ח:א). How does one take what is theirs? The Taz attaches a condition, which he draws from the end of the previous siman: « כ״כ סוף סימן שס״ז דלקיחת הפת אין להם ליקח מבית בע״ה אלא בידיעת א׳ מבני הבית » (ט״ז או״ח שס״ח ס״ק ב). The passage of siman שס״ז he refers to is: « בני החצר אין יכולים ליקח פתו מביתו לערב שלא מדעת אחד מבני הבית אפילו רגיל עמהם ואוסר עליהם » (שו״ע או״ח שס״ז:א).

The Biur Halachah, on the words ואפילו מערב עליהם משלהם, explains why the Mishnah Berurah did not copy the Taz: « עיין בט״ז ולא העתקתיו במ״ב משום שהשיגו עליו הרבה אחרונים וגם הפמ״ג היסב דבריו לכונה אחרת » (ביאור הלכה שס״ח) — many Acharonim disputed him, and the Pri Megadim turned his words to another meaning. The Biur Halachah does not say here what the objection is.

The Shulchan Aruch of the Alter Rebbe — he writes the condition in the seif itself: « וּבִלְבָד שֶׁלֹּא יִטּוֹל פִּתָּם מִבָּתֵּיהֶם שֶׁלֹּא מִדַּעְתָּם, אֶלָּא בְּנֵי הַבַּיִת יִתְּנוּ לוֹ » (שו״ע הרב שס״ח:א). Level 4 counts it among the points where the Rav’s text differs from the Mechaber’s, without deciding: the Mechaber lays down the same rule in siman שס״ז, without attaching it to this case (שו״ע או״ח שס״ז:א); the Taz attaches it to this seif (ט״ז או״ח שס״ח ס״ק ב, above), and many Acharonim contested him, according to the Biur Halachah.

3. Two readings of the Mishnah — Rashi and the Rambam

Rashi, as the Beis Yosef reports him — on the Gemara cited in section 1, he refers “one kind” and “two kinds” to the kind from which the eruv is redone: « ופירש״י במין אחד שחוזר ומערב מן המין האחד מב׳ מינים שעירב בשנייה ממין אחר אבל הרמב״ם כתב בפ״ה מה״ע » (בית יוסף או״ח שס״ח) — “of one kind”: he redoes the eruv from that same kind; “of two kinds”: the second time, he made it from another kind. The Beis Yosef goes on: “but the Rambam wrote, in chapter 5 of the laws of eruv…”, and so sets the Rambam's reading against Rashi's.
The Rambam — in chapter 5 he speaks of a courtyard that opens onto two alleys and makes the shituf with one of them. He first states why its residents must be informed: « שֶׁאֵינָן מִשְׁתַּתְּפִין אֶלָּא מִדַּעְתָּן שֶׁאֵינָהּ זְכוּת לָהֶן שֶׁמָּא בַּמָּבוֹי הַשֵּׁנִי רוֹצִים לְהִשְׁתַּתֵּף וְלֹא בָּזֶה » (הלכות עירובין פ״ה ה״ד). The Beis Yosef infers: « נראה מדבריו דמאי דאמרינן במין אחד ובב׳ מינים אתחלת עירוב קאי » (בית יוסף או״ח שס״ח) — for the Rambam, “one kind” and “two kinds” describe the original eruv, not the kind it is remade from. And he concludes, regarding the Tur: « ודברי רבינו הם כפירש״י » (בית יוסף או״ח שס״ח).
Rabbeinu Yehonasan, and the text of the Mechaber — the Beis Yosef cites Rabbeinu Yehonasan: « וה״ר יהונתן כתב אם בא לערב מאותו המין הראשון אפילו כלה מוסיף ומזכה ואפי׳ מערב עליהם משלהם וא״צ להודיע ואם בא לערב ממין אחר אם כלה הראשון צריך להודיע להם אם מערב משלהם ואם משלו א״צ להודיע כלל » (בית יוסף או״ח שס״ח), and says why he copies his words: « וזה כדברי רש״י ולפי שבאו כל החילוקים מבוארים יפה בדבריו כתבתי » (בית יוסף או״ח שס״ח). Seif א of the Shulchan Aruch takes up these three distinctions almost word for word (section 1). The continuation of Rabbeinu Yehonasan's text, on the diminished eruv, reads « ואם נתמעט מוסיף ומזכה אם ממין אחד וא״צ להודיע להם בין שיערב משלו בין משלהם » (בית יוסף או״ח שס״ח); seif א exempts from informing for an eruv that is only diminished in the sentence that deals with another kind, and this page does not decide how the two relate.

The Biur Halachah sets out the views on the end of the seif,

And he concludes: « ומ״מ לדינא אין לזוז מדברי השו״ע מאחר שהרבה פוסקים מקילין בעיקר דין זה אפילו במערב משלהם לדידן דפסקינן דבית הפתוח לשתי חצרות ועירב עם שתיהן מותר בזה ובזה עיין ברשב״א וריטב״א א״כ עכ״פ במערב משלו אין להחמיר » (ביאור הלכה שס״ח) — in law one does not depart from the words of the Shulchan Aruch, since many poskim are lenient on the very principle of this rule, even when the eruv is made from what is theirs, for us who hold that a house opening onto two courtyards, having made the eruv with both, is permitted in both (he refers to the Rashba and the Ritva); hence, at least when one makes it from one's own, one should not be stringent.

4. The underlying hakira — a continuation of the first eruv, or a new beginning?

חקירה — when an eruv is remade or topped up, is the remade eruv a continuation of the first, carried by the consent given at the outset, or a new beginning, which requires what any eruv requires at its start? The Mishnah Berurah uses reasons of both kinds, each in its place.

Where is the line in time? The Mishnah Berurah: « דאלו נתמעט קודם שקידש עליו היום הו״ל כתחלת עירוב אף שכבר הניחו לשם עירוב » (משנה ברורה שס״ח ס״ק י״ד) — diminished before Shabbos began, it is still the beginning of the eruv, even if it has already been set down as an eruv. The Shulchan Aruch HaRav says it in its own words: « שֶׁתְּחִלַּת הָעֵרוּב הוּא תְּחִלַּת כְּנִיסַת הַשַּׁבָּת » (שו״ע הרב שס״ח:ג).

נפקא מינה — one whose house opens onto two courtyards, who had to be informed at the beginning of the eruv. The eruv was spoiled and is remade from the same kind: must he be informed again? The Shulchan Aruch HaRav answers with the reason of continuation: « אֵין צָרִיךְ לְהוֹדִיעַ לוֹ כְּשֶׁנִּתְקַלְקֵל וְחוֹזֵר וּמְתַקְּנִים אוֹתוֹ, שֶׁכֵּיוָן שֶׁכְּבָר נִתְרַצָּה בּוֹ בַּתְּחִלָּה, מִן הַסְּתָם גַּם עַכְשָׁו יִתְרַצֶּה בּוֹ » (שו״ע הרב שס״ח:א). For residents who were added, the Beis Yosef writes in the name of the Ritva: « וכתבתי שם בשם הריטב״א שצריך שבשעת הוספת הדיורין יהיה קיים כשיעור דלדידהו הוי תחלת עירוב » (בית יוסף או״ח שס״ח), and the Mishnah Berurah classes them under the beginning (ס״ק ט, section 5).

Who must be informed? — for a consumed eruv redone from another kind, from what is the residents' (seif א), the Mishnah Berurah cites the Maamar Mordechai, and adds that other Acharonim write the same: « וכתב במאמר מרדכי דדוקא בבית הפתוח לשתי חצרות דלא ידעינן בהי ניחא ליה אבל בפתוח לחצר אחד זכות הוא לו וא״צ דעתו וכ״כ שארי אחרונים » (משנה ברורה שס״ח ס״ק ד) — according to the Maamar Mordechai, in that case, the duty to inform applies only to a house that opens onto two courtyards; for one that opens onto a single courtyard, the eruv is a benefit to him and his consent is not required. For residents who were added (seif ב), the Magen Avraham requires informing also those in a single alley when one makes the eruv from what is theirs (section 5). At the end of ס״ק ט, the Mishnah Berurah adds that the starting rule — an eruv made without the residents' consent — is itself disputed among the poskim: « יש פוסקים דסברי דדוקא אם מערב משלו ויש פוסקים דסברי דיוכל לערב אפילו משלהם בלא דעתם » (משנה ברורה שס״ח ס״ק ט), and refers to the Biur Halachah on siman 367. This page reports these opinions without deciding.

5. Residents who were added — from his own, or from theirs

The Tur, which seif The Beis Yosef reports that the Gemara (81b), in connection with Rabbi Yehudah’s statement, set the Mishnah in the case of a courtyard between two alleys: « בחצר שבין ב׳ מבואות שמתוך שאתה מתירו במבוי זה אתה אוסרו במבוי זה אבל אם אינו פתוח אלא למבוי אחד א״צ להודיע משום דזכות הוא לו וזכין לאדם שלא בפניו » (בית יוסף או״ח שס״ח). On the Mishnah itself, Rashi names those who are informed: « לדיורין שניתוספו אם דעתן בעירוב וכגון שמערב משלהן » (רש״י עירובין פ׳ ע״ב).

The Beis Yosef reports two readings of the second half of the Mishnah, the clause on added residents (“he adds, transfers ownership, and must inform”).

מחלוקת — one who tops up the eruv for the added residents from his own: must he inform?

The Mishnah Berurah follows the Magen Avraham — « וצריך לעשות עירוב דוקא בידיעתם אבל שלא בידיעתם לא ואפילו אם מערב עתה משלו » (משנה ברורה שס״ח ס״ק ט) — and cites the other view: « ויש מקילין שיכול לערב משלו בכל גווני » (משנה ברורה שס״ח ס״ק ט).

The Shulchan Aruch of the Alter Rebbe — its seif 2 writes, for the added residents: « אֲפִלּוּ אִם מְזַכֶּה לָהֶם מִשֶּׁלּוֹ — צָרִיךְ לְהוֹדִיעַ לְכָל מִי מֵהֶם שֶׁצָּרִיךְ לְהוֹדִיעַ לוֹ בִּתְחִלַּת עֵרוּב, דְּהַיְנוּ כָּל מִי שֶׁבֵּיתוֹ פָּתוּחַ לִשְׁתֵּי חֲצֵרוֹת » (שו״ע הרב שס״ח:ב) — even if he transfers to them from his own, he must inform, among them, each of those who must be informed at the start of an eruv, that is, whoever has a house opening onto two courtyards —, with the reason: « כִּי שֶׁמָּא אֵינוֹ חָפֵץ כְּלָל לְעָרֵב בְּחָצֵר זוֹ אֶלָּא בְּאַחֶרֶת » (שו״ע הרב שס״ח:ב). On this point (even from his own), its text agrees with the Magen Avraham, not with Rabbeinu Yehonasan; the Mishnah Berurah will write likewise. Among the added residents, the Rav's text names only those whose house opens onto two courtyards; the Magen Avraham (above) also requires informing those in a single alley when one makes the eruv from what is theirs; the page does not say whether the Rav departs from this second point.

6. The measure — eighteen, two meals, six or eight eggs

The Gemara sets the threshold, and at once restates it — eighteen and no more? say rather: from eighteen onward: « כַּמָּה הוּא מְרוּבִּין? שְׁמוֹנֶה עֶשְׂרֵה, וְתוּ לָא: אֵימָא מִשְּׁמוֹנֶה עֶשְׂרֵה וְאֵילָךְ » (עירובין פ׳ ע״ב); it then asks why Rav Yehudah (in Shmuel's name) chose this number: « וּמַאי שְׁמוֹנֶה עֶשְׂרֵה דְּנָקֵט » (עירובין פ׳ ע״ב), and Rav Yitzchak son of Rav Yehudah explains it: « כׇּל שֶׁאִילּוּ מְחַלְּקוֹ לִמְזוֹן שְׁתֵּי סְעוּדוֹת בֵּינֵיהֶן וְאֵין מַגַּעַת גְּרוֹגֶרֶת לְכׇל אֶחָד וְאֶחָד — הֵן הֵן מְרוּבִּין, וְסַגִּי בִּמְזוֹן שְׁתֵּי סְעוּדוֹת » (עירובין פ׳ ע״ב); hence « וְאַגַּב אוֹרְחֵיהּ קָא מַשְׁמַע לַן דִּשְׁתֵּי סְעוּדוֹת הָוְיָין שְׁמוֹנֶה עֶשְׂרֵה גְּרוֹגְרוֹת » (עירובין פ׳ ע״ב).

The two measures are not added together: the measure is the smaller of the two, since each is stated as a leniency. And the Mishnah Berurah, on seif The Tur states the threshold to the exact number: « בזמן שהן עד שמנה עשר ושמנה עשר בכלל שיעורו כגרוגרת לכל אחד » (טור או״ח שס״ח).

Six eggs or eight — the seif writes כששה ביצים and then וי״א שהם כשמונה ביצים.

The Shulchan Aruch HaRav gives both measures, the second under the name “some say”: « שֶׁהֵם כְּשִׁשָּׁה בֵּיצִים בֵּינוֹנִית פַּת » (שו״ע הרב שס״ח:ג) and « וְיֵשׁ אוֹמְרִים שֶׁב׳ סְעֻדּוֹת הֵן כִּשְׁמוֹנֶה בֵּיצִים » (שו״ע הרב שס״ח:ג). The site does not convert these measures into modern units.

Does the measure apply to an eruv of courtyards? — the Beis Yosef:

Rashi, on the Mishnah כִּכָּר כְּאִיסָּר וְהוּא שָׁלֵם, requires the measure: « ובלבד שיהיו שם ככרות הרבה כגרוגרת לכל אחד ואחד » (רש״י עירובין פ׳ ע״ב). Like the Tur (and the Raavad, according to the Beis Yosef), seif ג of the Mechaber requires a measure for the eruv of courtyards. For the eggs, it writes six without attribution, the measure the Beis Yosef gives in the name of the Rambam, and gives eight, the one he gives in the name of the Tur, under

7. The remnants of the eruv — Rabbi Yosei, and “so that the children not forget”

The Mishnah continues: « אָמַר רַבִּי יוֹסֵי: בַּמֶּה דְּבָרִים אֲמוּרִים — בִּתְחִילַּת עֵירוּב, אֲבָל בִּשְׁיָרֵי עֵירוּב — כׇּל שֶׁהוּא » (עירובין פ׳ ע״ב), and adds: « וְלֹא אָמְרוּ לְעָרֵב בַּחֲצֵירוֹת אֶלָּא כְּדֵי שֶׁלֹּא לְשַׁכֵּחַ אֶת הַתִּינוֹקוֹת » (עירובין פ׳ ע״ב). Rashi explains these last words: « תורת עירובי חצירות מהתינוקות הבאין הלכך מקילינן ביה » (רש״י עירובין פ׳ ע״ב). Rabbeinu Yehonasan, cited by the Beis Yosef, sets the line at the first Shabbos: « בשיורי עירוב שנתמעט משיעורו משנכנס בשבת ראשון כל שהוא וא״צ להוסיף עליו אפי׳ לשבת הבאה ואם נתמעט קודם שנכנס שבת ראשון תחלת עירוב קרינן ביה » (בית יוסף או״ח שס״ח).

חקירה — why does any remnant at all suffice?

נפקא מינה — when the eruv and the shituf are made together. The Mishnah Berurah cites the Magen Avraham: the rule of remnants applied only in the time of the Talmud, « שהיו עושין עירובי חצרות ושיתופי מבואות כ״א בפני עצמו » (משנה ברורה שס״ח ס״ק ט״ז).

The Biur Halachah shows that the Magen Avraham’s view has a source: « ולאו דברי עצמו הוא דבאמת מבואר כן בדברי ר׳ יהונתן בסוגיא זו וכן הוא דעת רש״י במתני׳ שם דהאי ולא אמרו אדברי ר׳ יוסי קאי » (ביאור הלכה שס״ח), and first ties the opposing view to the Tur (he goes on to other sources, among them the Rashba's Avodas HaKodesh): « ומ״ש שיש חולקין הוא דעת הטור שפסק בסי׳ שפ״ז דסומכין על שיתוף במקום עירוב והכא פוסק כר״י דשיורו בכל שהוא » (ביאור הלכה שס״ח). His conclusion: « וע״כ נראה דיש להקל בזה בשעת הדחק » (ביאור הלכה שס״ח), and « ולכתחלה בודאי נכון ליזהר בזה » (ביאור הלכה שס״ח). The Mishnah Berurah likewise: « ולכתחלה בודאי צריך ליזהר להוסיף עד כשיעור » (משנה ברורה שס״ח ס״ק ט״ז).

The Taz — another reason not to rely on a diminished eruv — « דיש ליזהר שלא לסמוך על עירוב שנתמעט דשמא יתמעט משיעורו ויתוספו אחר כך דיורין באותו עיר ואז צריך להוסיף בשביל׳ » (ט״ז או״ח שס״ח ס״ק ד) — new residents may arrive, and for them the measure will be needed. He then proposes a remedy: « או ראוי שיאמר כל אדם בשעת ברכה ולכל מי שיתוסף בעיר הזאת כדיעה ראשונה שם וא״כ אין חשש באם יתוספו אח״כ » (ט״ז או״ח שס״ח ס״ק ד) — or else that everyone say, at the time of the blessing: “and for whoever will be added in this town”, as the first view cited there [in siman שס״ו, seif ט, to which he has just referred]; then there is no concern if others are added afterwards. The Biur Halachah reports this advice, explains that according to the Taz it would work even when the eruv has diminished below its measure, and writes that several Acharonim have already objected to it: « אכן מה שסיים הט״ז עוד עצה לזה שיאמר כל אדם בשעת ברכה ולכל מי שיתוסף בעיר הזה וזה מהני אפילו כשיתמעט משיעורו כבר השיגו ע״ז כמה אחרונים » (ביאור הלכה שס״ח). He does not name these Acharonim and does not detail their objection here. The Shulchan Aruch HaRav, for residents who arrive after the eruv has diminished below its measure, writes that one must add for them, and that even an explicit conferral made at the outset gave them no eruv as long as they did not live there: « וְאִם נִתּוֹסְפוּ דִיּוּרִין אַחַר שֶׁנִּתְמַעֵט הָעֵרוּב מִשִּׁעוּרוֹ … This page does not say whether the Rav is among the Acharonim the Biur Halachah has in mind.

8. The broken loaf — whole at the time it is set down

In siman שס״ו, the Mechaber wrote: « אין מערבין בפרוסה » (שו״ע או״ח שס״ו:ו). The Gemara (Eruvin 81a) gives two reasons, one for the piece: « וּפְרוּסָה מַאי טַעְמָא לָא? אָמַר רַבִּי יוֹסֵי בֶּן שָׁאוּל אָמַר רַבִּי: מִשּׁוּם אֵיבָה » (עירובין פ״א ע״א), the other for the case where all gave pieces: « עֵירְבוּ כּוּלָּן בִּפְרוּסוֹת מַהוּ? May the remnant of the eruv be a piece? The Taz: « ומ״ש בסי׳ שס״ו שאין מערבין בפרוסה היינו בשבת ראשון » (ט״ז או״ח שס״ח ס״ק ג) — his wording names the first Shabbos (בשבת ראשון), not, like the Mishnah Berurah below, the moment the eruv is deposited (בשעה שהניחה); it does not say what holds for a loaf broken before the first Shabbos began, and this page does not place the Taz among the views that follow.

An eruv loaf that broke — the Magen Avraham cites two views.

The Magen Avraham decides: « לכן נ״ל כמהרי״ל דכיון שבשעת הנחה היה שלם תו לא גזרינן שמא יחזור הדבר לקלקולו » (מגן אברהם שס״ח ס״ק ג). He at once adds a reservation about a remnant that no longer has the measure: « ומ״מ נ״ל דאם לא נשאר בו כשיעור פסול » (מגן אברהם שס״ח ס״ק ג); it comes right after his ruling on the broken loaf, and he suggests seeing in it the reason of רמ״מ, who is stricter, for whom even a piece that has the measure does not allow leniency: « ואפשר דזהו טעמו של רמ״מ בסימן נ״ח דמסיק דכל רבותיו נהגו לעשו׳ אחר דס״ל דגם בפרוסה אין להקל אפי׳ יש בו כשיעו׳ » (מגן אברהם שס״ח ס״ק ג). This page does not decide the exact scope of this reservation; it is cited in full and explained in section 7.

The Shulchan Aruch of the Alter Rebbe — he writes, like the Maharil, that a loaf broken before Shabbos began is valid, and he adds a condition that the Maharil, as the Magen Avraham reports him, does not name: provided its measure remains (the Magen Avraham, for his part, sets the reservation cited above); he gives the reason: « וַאֲפִלּוּ אִם נִפְרַס קֹדֶם כְּנִיסַת הַשַּׁבָּת — כָּשֵׁר אִם שִׁעוּרוֹ קַיָּם עַד כְּנִיסַת הַשַּׁבָּת, שֶׁהֲרֵי לֹא הִצְרִיכוּ שָׁלֵם אֶלָּא בִּשְׁבִיל שֶׁלֹּא יָבֹאוּ לִידֵי מַחֲלֹקֶת, וְאִם כֵּן דַּיּוֹ כְּשֶׁהוּא שָׁלֵם בִּשְׁעַת הַנָּחָתוֹ » (שו״ע הרב שס״ח:ג). The Magen Avraham names the Gemara’s second reason in order to set it aside once the loaf was placed whole: « תו לא גזרינן שמא יחזור הדבר לקלקולו » (מגן אברהם שס״ח ס״ק ג); it is to the responsum רמ״מ that he ascribes this reason: « ומיהו שם משמע שטעמו דגזרינן שמא יחזור הדבר לקלקולו » (מגן אברהם שס״ח ס״ק ג). The Rav, for his part, gives as the reason for requiring a whole loaf And he adds the limit: « אֲבָל אִם נִתְמַעֵט מִשִּׁעוּרוֹ קֹדֶם כְּנִיסַת הַשַּׁבָּת, אַף אִם הַמְּשֻׁיָּר הוּא כִּכָּר קָטָן שָׁלֵם — פָּסוּל » (שו״ע הרב שס״ח:ג).

9. The bread that goes moldy — what is no longer edible

יסוד — the eruv must be edible at the moment Shabbos begins. The Rambam: « וּלְעוֹלָם צָרִיךְ שֶׁיְּהֵא הָעֵרוּב אוֹ הַשִּׁתּוּף מָצוּי וְאֶפְשָׁר לְאָכְלוֹ כָּל בֵּין הַשְּׁמָשׁוֹת » (הלכות עירובין פ״א הכ״א). The Mishnah Berurah applies this criterion to eruv bread when it is not known when it went moldy (ס״ק כ, below).

The Beis Yosef reports this passage and closes it with עכ״ל — so the ומיהו נ״ל belongs to the author he cites: « אם נתעפש פת העירוב ונפסל מלאכול הרי הוא כמי שכלה כולה לגמרי וצריכים לערב מחדש אבל אם לא נפסל כ״כ אפילו נשתייר בו פורתא אין צריכין להוסיף דסוף עירוב בכל דהו ומיהו נ״ל שאמר בתוספות שאם נתוספו דיורין לאחר שנתמעט האוכל צריכין להוסיף דכיון דנתוספו ה״ז להם כתחלת עירוב ולפיכך ראוי להוסיף דשמא יתוספו עליהם דיורין » (בית יוסף או״ח שס״ח) — the end of this passage is the hakira of section 4: for the added residents, it is a beginning. The Beis Yosef cites this passage after naming תשובת הרמב״ן סימן רי״ב, and refers back to it further on with « וכבר כתבתי בסמוך בשם הרמב״ם » (בית יוסף או״ח שס״ח): this page does not decide between the two names.

The Mishnah Berurah — what counts as moldy: « וה״ה כשהתליע בתולעים קטנים » (משנה ברורה שס״ח ס״ק י״ח); « היינו כשנתעפש כולו » (משנה ברורה שס״ח ס״ק י״ט); and the case of doubt: « ואם ראה ד״ז בשבת ואינו ידוע לו מתי נתעפש אם קודם שבת או בשבת תלינן לקולא ואמרינן דמקרוב נתעפש ובהמ״ש היה ראוי לאכול » (משנה ברורה שס״ח ס״ק כ). For an eruv of which one is unsure whether it still existed at בין השמשות, the Rambam likewise writes: « וְאִם סָפֵק הֲרֵי זֶה עֵרוּב שֶׁסְּפֵק הָעֵרוּב כָּשֵׁר » (הלכות עירובין פ״א הכ״א).

10. The gloss of the Rema — matzah, or an eruv every Erev Shabbos

The Rema draws a custom from seif ה: « ולכן נהגו לעשות העירוב חלת מצה שאינה ממהרת להתעפש » (רמ״א או״ח שס״ח:ה), judges it better — « וזה טוב יותר מלערב כל שבת ושבת שלא ישכחו מלערב » (רמ״א או״ח שס״ח:ה) — and leaves the choice open: « מיהו אם רוצים לערב כל ע״ש ולאכול העירוב כל שבת הרשות בידם » (רמ״א או״ח שס״ח:ה).

The Taz — the opposite view: « ולעד״נ דיותר טוב לערב כל ע״ש דרוב פעמים שהמצה של העירוב מתקלקלת ומתעפשת מאורך הזמן ואינו ראוי לאכילה כלל והוה כלה לגמרי » (ט״ז או״ח שס״ח ס״ק ד). He also notes a custom that he forbids: « ועוד יש מנהג בקצת קהלות שבע״ש הגדול הולך השמש מבית לבית ונותן לכל א׳ קצת ממצת העירוב וזהו איסור דהרי באותה שבת אין שם עירוב כלל » (ט״ז או״ח שס״ח ס״ק ד). And he gives the conduct for the individual: « והרוצה לעשות עצהי״ט יערב משלו בכל ע״ש ויזכ׳ ע״י אחר ובזה לא חיישי׳ לקלקול העירוב של בה״כ ולא יברך כיון שיש בבה״כ מצת העירוב והברכות אינם מעכבות » (ט״ז או״ח שס״ח ס״ק ד).

The Mishnah Berurah writes it in the name of the Acharonim: «

The Shulchan Aruch of the Alter Rebbe — he reports the custom and its reason, then: « זֶהוּ טַעַם הַמִּנְהָג. Two elements of the Taz appear here: an eruv every Erev Shabbos, for the same reason — the matzah that spoils and goes moldy over time —, and the conduct of the individual who has his eruv acquired through another, without a berachah. Level 4 compares this seif with the Rema’s gloss, and names the Taz, in whom this conduct is already found The Mishnah Berurah, which attributes it to the Acharonim, writes it in terms very close to the Rav’s: « והרוצה לעשות עצהיו״ט יערב משלו בכל ע״ש ויזכהו לכל הקהל ע״י אחר ובזה אין חשש אם יתקלקל העירוב שבבהכ״נ ולא יברך על שלו כיון שיש עירוב בבהכ״נ ושמא הוא כשר והברכות אין מעכבות » (משנה ברורה שס״ח ס״ק כ״א).
Eating the eruv — on ולאכול העירוב כל שבת, the Mishnah Berurah gives the reason: « משום דהואיל ואיתעביד ביה מצוה חדא יתעבד ביה מצוה אחריתא » (משנה ברורה שס״ח ס״ק כ״ב). The Rema refers to siman שצ״ד.

11. Summary of the shitos and halachic conclusion

The foundation — the Mishnah of Eruvin 80b, the Gemara that reads it, and the question whether the remade eruv is a continuation of the first or a beginning:

For halachah lema'aseh, consult your Rav; the custom of the community also counts.
