📜 The text of the Shulchan Aruch — 4 seifim
summary: heading of the siman, then seif א. A resident of the courtyard who forgot and did not make the eruv with the others forbids them [to carry]; their remedy: he renounces his domain in their favour, saying: my domain is renounced to you, or is acquired by you. There is no need to acquire by a kinyan sudar, and he may renounce even after nightfall. If he lives with four or five, he must renounce to each one, saying: to you and to you; some say it is enough to say: to all of you. If he renounced without specifying, he renounced only his domain in the courtyard: they may carry from their houses to the courtyard, and so may he, since he is merely a guest there; but they may not carry from his house to the courtyard, nor may he. Some say he must lock his house, so as not to come to carry forbiddenly, open it only when he wishes to go out and come in, and lock it right after.
summary: if he renounced to them the domain of his house as well, they are permitted, he as well as they, to carry to the courtyard, from his house as from theirs.
summary: if he does not wish to renounce his domain to them but to rent it to them: some say it is effective like a renunciation, and some say it is not effective.
summary: if the residents who made the eruv renounce their domain to one who did not, he carries from his house to the courtyard, but not from their houses — in small type, in parentheses: unless they expressly renounced the domain of their houses as well (ב״י); they are forbidden even from his house to the courtyard, for many do not become guests of one. Likewise if there are only two and one renounces to the other: the one who renounces is forbidden even in what is his fellow's, and the fellow is permitted even in what is his own; likewise many who did not make the eruv and gave their domain to many who did — an individual becomes a guest of many, but many do not, even of many, nor an individual of an individual. Two forgot: they may renounce, each to all the residents — to many who made the eruv, provided each renounces to each, or to one who did not. But one does not renounce to two who did not make the eruv, for even after the renunciation they are two, and one forbids the other; and even if he says to one: I renounce to you on condition that you renounce in turn to your fellow, it is not effective.
1. The Mishnah and the Gemara — one who forgot to make the eruv (seif א)
The Beis Yosef gives the source of the seif: « משנה בפרק הדר » (בית יוסף או״ח ש״פ). His house is forbidden, to him and to them, for bringing in and for taking out; their houses are permitted, to him and to them. The Gemara explains what this presupposes (section 4).
The seif speaks of one who forgot; the Mishnah Berurah writes: « נקט ששכח לאשמועינן דאפילו בכה״ג אוסר כשלא ביטל אבל ה״ה דאפילו כשהזיד ולא עירב מהני ביטול » (משנה ברורה ש״פ ס״ק א). The Rambam opens his chapter thus: « אַנְּשֵׁי הֶחָצֵר שֶׁעֵרְבוּ כֻּלָּן חוּץ מֵאֶחָד מֵהֶן שֶׁלֹּא עֵרֵב עִמָּהֶן בֵּין מֵזִיד בֵּין שׁוֹכֵחַ הֲרֵי זֶה אוֹסֵר עֲלֵיהֶן » (הלכות עירובין פ״ב ה״א).
The formula, without an act of acquisition — the Beis Yosef traces this part of the seif to a baraisa: « ברייתא שם (סט:) ישראל מומר משמר שבתו בשוק מבטל רשות » (בית יוסף או״ח ש״פ). Here it is: « מִפְּנֵי שֶׁאָמְרוּ: יִשְׂרָאֵל נוֹטֵל רְשׁוּת וְנוֹתֵן רְשׁוּת. Rashi, on the last word: « לזכות - בקנין סודר » (רש״י עירובין ס״ט ע״ב). The baraisa addresses one person; seif א writes its two formulas in the plural, and repeats, like the baraisa as Rashi explains it, that he needs no kinyan sudar.
The time of the renunciation — the Mishnah brings a dispute: « מֵאֵימָתַי נוֹתְנִין רְשׁוּת? The seif follows Beis Hillel: he may renounce even after nightfall. The Rambam: « וּבִטּוּל רְשׁוּת בְּשַׁבָּת מֻתָּר לְכַתְּחִלָּה » (הלכות עירובין פ״ב ה״ב).
יסוד — a courtyard where one resident did not make the eruv is forbidden from the onset of Shabbos; yet the renunciation permits it, even when made on Shabbos. The Biur Halachah, on the seif's words
2. Hakira — withdrawing from one's domain, or transferring it? (seif א)
The Mishnah Berurah gives the reason: « דהוא רק סילוק רשותא בעלמא שמסלק עצמו מרשותו כדי שלא יאסור עליהם ומה״ט מותר לבטל אף משתחשך » (משנה ברורה ש״פ ס״ק ג). The Magen Avraham, on the words The Shulchan Aruch HaRav writes it in his seif 1: « וְאַף עַל פִּי שֶׁאֵין קוֹנִין קִנְיָן בְּשַׁבָּת, מִכָּל מָקוֹם כַּאן אֵין צָרִיךְ שֶׁיִּקְנוּ הֵם רְשׁוּתוֹ, אֶלָּא שֶׁהוּא יְסַלֵּק עַצְמוֹ מֵרְשׁוּתוֹ, וּמִמֵּילָא אֵין מִי שֶׁיֶּאֱסֹר עֲלֵיהֶם; וּלְסַלֵּק עַצְמוֹ מֵרְשׁוּתוֹ מֻתָּר אַף בְּשַׁבָּת » (שו״ע הרב ש״פ:א).
חקירה — is the renunciation only the withdrawal of the one who renounces, or does it also make those to whom he renounces acquire his domain? The baraisa from which the seif's formula comes uses the word of acquisition, קנה (section 1). On the end of the Mishnah, the Gemara considers a case where the recipient is told: « וְאֵין נוֹטְלִין רְשׁוּת. And in the Shulchan Aruch HaRav, the first opinion on renting — the one he follows for halachah, in his seif 4 — compares renting to the renunciation, and speaks of a free gift: « יֵשׁ אוֹמְרִים שֶׁשְּׂכִירוּת מוֹעֶלֶת בְּיִשְׂרָאֵל כְּמוֹ שֶׁמּוֹעֶלֶת בְּנָכְרִי, לְפִי שֶׁהַשְּׂכִירוּת אֵינָהּ גָּרוּעַ מֵהַבִּטּוּל שֶׁהִיא מַתָּנָה בְּחִנָּם » (שו״ע הרב ש״פ:ד).
The Mishnah Berurah uses both languages: withdrawal, to explain that one renounces without an act of acquisition and even after nightfall (ס״ק ג); the share that was transferred, to explain what the recipient may renounce in turn: « דחלקו יכול לבטל אבל לא חלק שהקנוהו לו » (משנה ברורה ש״פ ס״ק כ״ד). This page does not decide between the two readings.
The connection is this page's own: the question touches, among other things, renting on Shabbos — the Magen Avraham suggests, with reservation, forbidding it between Jews as an act of commerce (section 7) — and the renunciation passed on, which the end of seif ד rules ineffective (section 10).
3. לך ולך or לכולכם — Rabbi Eliezer and the Rabbanan (seif א)
The Gemara links the question to a dispute about one who renounces his courtyard: « לְדִבְרֵי רַבִּי אֱלִיעֶזֶר: הַמְבַטֵּל רְשׁוּת חֲצֵירוֹ — רְשׁוּת בֵּיתוֹ בִּיטֵּל. It asks what this teaches, and answers: « לֹא נִצְרְכָא אֶלָּא לַחֲמִשָּׁה שֶׁשְּׁרוּיִן בְּחָצֵר אֶחָד וְשָׁכַח אֶחָד מֵהֶן וְלֹא עֵירַב » (עירובין כ״ו ע״ב) — « לְדִבְרֵי רַבִּי אֱלִיעֶזֶר: כְּשֶׁהוּא מְבַטֵּל רְשׁוּתוֹ, אֵין צָרִיךְ לְבַטֵּל לְכׇל אֶחָד וְאֶחָד » (עירובין כ״ו ע״ב); « לְרַבָּנַן: כְּשֶׁהוּא מְבַטֵּל רְשׁוּתוֹ, צָרִיךְ לְבַטֵּל לְכׇל אֶחָד וְאֶחָד » (עירובין כ״ו ע״ב).
Rashi — the reason for the dispute: « דלר' אליעזר מבטל בעין יפה מבטל ולא אמרינן חצר דגלי גלי בית דלא גלי לא גלי ונילף מינה דהיכא דבטיל לחד מינייהו בטיל לכולהו » (רש״י עירובין כ״ו ע״ב). And for the Rabbanan: « ולרבנן צריך לבטל לכל אחד ואחד כי היכי דלגבי בית סבירא להו דמאי דלא פריש לא בטיל הכא נמי למאן דלא פריש לא בטיל » (רש״י עירובין כ״ו ע״ב). He also explains why renouncing to one does not suffice, even when that one made the eruv with the others: « דאע״ג דהאי דבטיל ליה עירב עם חבירו כי עירב מאתמול אדעתא דההיא חולקא לא עירב דההיא שעתא לאו דידיה הוא » (רש״י עירובין כ״ו ע״ב).
יסוד — according to Rashi, two of the rules of seif א — renouncing to each one, and the unspecified renunciation that covers only the courtyard (section 4) — come, for the Rabbanan, from one idea: what he did not specify, he did not renounce.
The Gemara brings a question of Abaye to Rabbah: « בְּעָא מִינֵּיהּ אַבָּיֵי מֵרַבָּה: חֲמִשָּׁה שֶׁשְּׁרוּיִין בְּחָצֵר אַחַת, וְשָׁכַח אֶחָד מֵהֶן וְלֹא עֵירַב, כְּשֶׁהוּא מְבַטֵּל רְשׁוּתוֹ צָרִיךְ לְבַטֵּל לְכׇל אֶחָד וְאֶחָד אוֹ לָא? A baraisa is raised against him (section 10), where one who did not make the eruv gives his domain to one who did; Rabbah answers: « וְרַבָּה: הָכָא בְּמַאי עָסְקִינַן, דַּהֲוָה וּמִית » (עירובין ע׳ ע״א) — the other one died. The Gemara explains the baraisa according to each: « לְאַבָּיֵי דְּאִיתֵיהּ, וְקָא מַשְׁמַע לַן: דְּאֵין צָרִיךְ לְבַטֵּל רְשׁוּת לְכׇל אֶחָד וְאֶחָד » (עירובין ע׳ ע״א); according to Rabbah, he died. The Beis Yosef traces the seif's rule to these passages: « ואם דר עם ד' או ה' צריך לבטל לכל אחד וא' וכו' הכי אמרינן בעירובין (כו.)
The formula: the Rambam and the Tur. The Tur: « צריך לבטל לכל א' ואחד שיאמר רשותי מבוטלת לך ולך או יאמר לכולכם בכלל » (טור או״ח ש״פ). The Beis Yosef explains where the second formula comes from: « ומ״ש או יאמר לכולכם בכלל בפ״ב מה״ע כתב ה״ה דהכי משמע מדברי רש״י בספ״ב דעירובין (כו:) ושלשון הרמב״ם בזה צריך תלמוד » (בית יוסף או״ח ש״פ). Seif א writes the first without attribution, and brings the second as an opinion: « צריך לבטל לכל א' וא' שיאמר רשותי מבוטלת לך ולך וי״א שדי שיאמר רשותי מבוטל' לכולכם » (שו״ע או״ח ש״פ:א).
The Taz infers from the first opinion that to all of you does not suffice, and suggests a reason: « משמע דלדיע' זו לא מהני לכולכם ונרא' הטעם דמצינו רובו ככולו וע״כ אי אמר לכולכם אפשר דלא נתכוין רק על הרוב » (ט״ז או״ח ש״פ ס״ק א). The Magen Avraham, on to each one, in the name of the Maggid Mishneh: « ואם לא עשה כן אף למי שביטל אסור » (מגן אברהם ש״פ ס״ק ב). The Mishnah Berurah brings the Eliyah Rabbah's ruling, and the sentence continues with a condition: « ולדינא מסיק הא״ר דהעיקר כהי״א דמהני גם כשאמר לכולכם וכ״ז כשעומד נגד כולם ואמר להם לשון זה » (משנה ברורה ש״פ ס״ק ה).
The Shulchan Aruch HaRav, in his seif 1, writes without attribution the formula addressed to all, and specifies: « וְאִם דָּר עִם ד' אוֹ ה' — צָרִיךְ לְבַטֵּל לְכָל אֶחָד וְאֶחָד, שֶׁיֹּאמַר "רְשׁוּתִי מְבֻטֶּלֶת לְכֻלְּכֶם", וְלֹא דַי שֶׁיְּבַטֵּל לְאֶחָד מֵהֶם, אַף עַל פִּי שֶׁזֶּה שֶׁמְּבַטֵּל לוֹ כְּבָר עֵרֵב עִם הַשְּׁאָר » (שו״ע הרב ש״פ:א); then he brings the other formula as an opinion, and rules: « וְיֵשׁ אוֹמְרִים שֶׁלֹּא דַי שֶׁיֹּאמַר "רְשׁוּתִי מְבֻטֶּלֶת לְכֻלְּכֶם", אֶלָּא צָרִיךְ שֶׁיְּפָרֵשׁ וְיֹאמַר "מְבֻטֶּלֶת לְךָ וּלְךָ". The point about one who already made the eruv is the one whose reason Rashi gives (above); see Level 4, point א.
A renunciation made before the eruv. The Biur Halachah derives from Rashi's reason: « ולפ״ז אם היה הבטול מבע״י קודם שעירב דכי עירב אדעתא דהאי חולקא נמי עירב מהני הבטול שביטל לו לבד » (ביאור הלכה ש״פ). And it infers, according to the Rosh's view of the baraisa of the one who dies: « ה״ה בענינינו אפילו היה הביטול שביטל לו לאחר שעירב כיון שהוא קודם ביה״ש חל העירוב גם על החלק שביטלו לו » (ביאור הלכה ש״פ).
4. Renouncing without specifying — the courtyard, not the house; the guest (seif א)
The Gemara, on the Mishnah (section 1): « בֵּיתוֹ הוּא דְּאָסוּר, הָא חֲצֵירוֹ שַׁרְיָא » (עירובין ס״ט ע״ב). It asks how to understand this, and answers: « הָכָא בְּמַאי עָסְקִינַן, כְּגוֹן שֶׁבִּיטֵּל רְשׁוּת חֲצֵירוֹ, וְלֹא בִּיטֵּל רְשׁוּת בֵּיתוֹ.
Rashi — why he is a guest in their houses: «
The Gemara speaks of one who renounced his courtyard; the Rambam writes the rule for an unspecified renunciation: « הַמְבַטֵּל רְשׁוּתוֹ סְתָם רְשׁוּת חֲצֵרוֹ בִּטֵּל רְשׁוּת בֵּיתוֹ לֹא בִּטֵּל » (הלכות עירובין פ״ב ה״ב), and so does seif א. The Mishnah Berurah: « וכ״ש אם אמר רשות חצרי מבוטלת לכם דאין הבית בכלל » (משנה ברורה ש״פ ס״ק ו).
Why is he himself forbidden, from his own house? He is a guest of theirs; why should he not carry from his house to the courtyard? The Beis Yosef brings Rabbeinu Yehonasan: « וכתב ה״ר יהונתן ביתו אסור לבני חצר שהרי לא ביטל רשות ביתו בפירוש » (בית יוסף או״ח ש״פ), and the passage continues: « דלא דמי לשאר בתים שבחצר דשרי בהו דהתם ה״ט דאמרי' דהוי אורח לגבייהו אבל בביתו אין דרך לומר דהוי כאורח » (בית יוסף או״ח ש״פ); and further: « ועוד דאם היה מוציא מביתו היה נראה שחזר בו מביטולו » (בית יוסף או״ח ש״פ).
The Magen Avraham: « וגם הוא אסור שהרי בביתו אין לומר שהוא אורח » (מגן אברהם ש״פ ס״ק ג). The Shulchan Aruch HaRav, in his seif 2: « לְפִי שֶׁאֵין אוֹמְרִים שֶׁהוּא כְּאוֹרֵחַ אֶצְלָם אֶלָּא לְעִנְיַן תַּשְׁמִישׁ מִבָּתֵּיהֶם לֶחָצֵר, אֲבָל תַּשְׁמִישׁ שֶׁמִּבֵּיתוֹ אוֹ לְבֵיתוֹ — אֵין לוֹמַר שֶׁהוּא אוֹרֵחַ » (שו״ע הרב ש״פ:ב).
Bringing in, too: the Mishnah says of his house that it is forbidden for bringing in and for taking out (section 1); the Rambam writes, of their houses: « בִּטֵּל לָהֶן זֶה שֶׁלֹּא עֵרֵב רְשׁוּת חֲצֵרוֹ בִּלְבַד הֲרֵי אֵלּוּ מֻתָּרִין לְהוֹצִיא וּלְהַכְנִיס מִבָּתֵּיהֶן לֶחָצֵר וּמֵחָצֵר לְבָתֵּיהֶן אֲבָל לְבֵיתוֹ אָסוּר » (הלכות עירובין פ״ב ה״א). Seif א speaks only of carrying from his house to the courtyard; the Shulchan Aruch HaRav adds וכן להכניס, as the Mishnah says (Level 4, point ב). For him, from their houses, the Biur Halachah: « עיין פרישה שכתב דהוא מותר להוציא מביתם אפילו קודם שהחזיקו וכן מבואר בחידושי הרשב״א להדיא » (ביאור הלכה ש״פ).
5. Locking one's house — the baraisa and its readings (seif א)
A baraisa, about a house between two courtyards, asks what one does: « כֵּיצַד הוּא עוֹשֶׂה? The Gemara offers another reading: « וְאִיבָּעֵית אֵימָא: לְעוֹלָם תַּרְתֵּי, כֵּיוָן דְּדָשׁ בֵּיהּ — אָתֵי לְטַלְטוֹלֵי » (עירובין ע״ט ע״ב).
Rashi — on the second reading: «
A rule, or an opinion? The Tur writes it as a rule: « הילכך צריך לנעול ביתו שלא יבא להוציא באיסור » (טור או״ח ש״פ). The Beis Yosef brings those who distinguish: « והתוספות והרא״ש בדף קכ״ה והמרדכי כתבו לחלק בין ההיא לאנשי חצר ששכח אחד מהם ולא עירב וגם הרמב״ם בפ״ב לא הזכיר הא דנועל ביתו » (בית יוסף או״ח ש״פ). And he limits the matter: « מיהו נראה דהיינו דוקא במבטל רשות חצירו ולא רשות ביתו » (בית יוסף או״ח ש״פ). Seif א writes it as an opinion: « וי״א שצריך לנעול ביתו כדי שלא יבא להוציא באיסור » (שו״ע או״ח ש״פ:א).
On this baraisa, the Magen Avraham brings a question, which he raises on the words of seif ב: see section 6.
The Mishnah Berurah limits the opinion to one who did not renounce his house: « ר״ל כשלא ביטל רשות ביתו דכשביטל מותר לכתחלה להוציא מביתו הוא והם כמ״ש בס״ב » (משנה ברורה ש״פ ס״ק י), and writes: « ובמקום הדחק יש לסמוך להקל שאין צריך נעילת בית » (משנה ברורה ש״פ ס״ק י״א). The Shulchan Aruch HaRav, after the opinion, writes: « וְהַמֵּקֵל לֹא הִפְסִיד, כִּי יֵשׁ לוֹ עַל מִי לִסְמוֹךְ » (שו״ע הרב ש״פ:ב) (Level 4, point ב).
6. The house too — a complete guest, and who carries first (seif ב)
A question the Magen Avraham brings, on seif ב, about the baraisa of locking (section 5). If it suffices to renounce his house as well, why does the baraisa speak of locking? « מ״ש הע״ש דא״כ למה אמרי' דף ע״ט נועל ביתו הל״ל לבטל גם רשות ביתו ויהיה מותר להוציא » (מגן אברהם ש״פ ס״ק ד).
His answer: « לא דק דהתם מיירי בשני יחידים כדאיתא בגמ' ברש״י ואז הוא אסור דחד לגבי חד לא הוי אורח » (מגן אברהם ש״פ ס״ק ד). And otherwise: « ובלא״ה לק״מ דמיירי שאינו רוצה לבטל רשות ביתו שלא להרבות עליו נכנסי' ויוצאים » (מגן אברהם ש״פ ס״ק ד).
The Beis Yosef, on the source of seif The Rambam: « וְגַם הוּא מֻתָּר מִפְּנֵי שֶׁלֹּא נִשְׁאַר לוֹ רְשׁוּת וַהֲרֵי הוּא כְּאוֹרֵחַ אֶצְלָם וְהָאוֹרֵחַ אֵינוֹ אוֹסֵר » (הלכות עירובין פ״ב ה״א).
יסוד — the Beis Yosef gives the reason for the permission, and sets a condition on it: « אבל במבטל רשות חצירו ורשות ביתו הוי אורח גמור לגבייהו ומותר להוציא אף מביתו כיון דלא נשאר לו שום רשות שלא ביטלו והוא שלא יוציא עד שיחזיקו הם וכמ״ש בסי' שאחר זה » (בית יוסף או״ח ש״פ). The Magen Avraham, on the seif's words The Mishnah Berurah: « היינו לאחר שהחזיקו אנשי החצר את רשותו שהוציאו מבתיהם להחצר » (משנה ברורה ש״פ ס״ק י״ב) — and, in brackets: « דקודם שהחזיקו אם יוציא מביתו לחצר אז חוזר מביטולו וממילא אוסר עליהם והן עליו » (משנה ברורה ש״פ ס״ק י״ב).
Where the concern comes from — the Mishnah: « מִי שֶׁנָּתַן רְשׁוּתוֹ וְהוֹצִיא, בֵּין בְּשׁוֹגֵג בֵּין בְּמֵזִיד — הֲרֵי זֶה אוֹסֵר, דִּבְרֵי רַבִּי מֵאִיר. What follows belongs to siman 381.
The Mishnah Berurah adds, also in brackets: « וכן יזהר שלא יכניס מחצר לביתו קודם שיכניסו הם מהחצר לביתו » (משנה ברורה ש״פ ס״ק י״ב). Seif ב does not speak of this order. The Shulchan Aruch HaRav writes the reason for the permission, « לְפִי שֶׁנַּעֲשֶׂה אוֹרֵחַ גָּמוּר אֶצְלָם, כֵּיוָן שֶׁלֹּא נִשְׁאַר לוֹ שׁוּם רְשׁוּת שֶׁלֹּא בִטְּלָה לָהֶם » (שו״ע הרב ש״פ:ג), and the precaution: « רַק שֶׁיִּזָּהֵר שֶׁלֹּא יוֹצִיא מִבֵּיתוֹ לֶחָצֵר קֹדֶם שֶׁיּוֹצִיאוּ [הֵ]ם מִבָּתֵּיהֶם לֶחָצֵר, כְּדֵי שֶׁיַּחֲזִיקוּ הֵם בֶּחָצֵר תְּחִלָּה, וְלֹא יַכְנִיס מֵחָצֵר לְבֵיתוֹ קֹדֶם שֶׁיַּכְנִיסוּ הֵם מֵחָצֵר לְבֵיתוֹ » (שו״ע הרב ש״פ:ג) (Level 4, point ג).
7. Renting instead of renouncing (seif ג)
The baraisa of the formula (section 1) contrasts the Jew, who renounces, with the non-Jew, from whom one rents. On a Jew who prefers to rent, the Beis Yosef brings two views: « כ״כ הרא״ש בר״פ הדר (דף קנג) גבי צדוקי ושלא כדברי ר״מ שסובר דלא מהני שכירות בישראל והמרדכי בפרק הדר כתב כדברי ר״מ » (בית יוסף או״ח ש״פ); and he adds: « ודברי הרמב״ם בספ״ב מה״ע נוטים לדעת ר״מ שכתב גבי צדוקי ואין שוכרין ממנו לפי שאינו כעכו״ם » (בית יוסף או״ח ש״פ). Here is the Rambam he refers to: « וְאֵין שׂוֹכְרִין מִמֶּנּוּ לְפִי שֶׁאֵינוֹ כְּעוֹבֵד כּוֹכָבִים וּמַזָּלוֹת.
The Taz — on the seif's second opinion: « זהו דעת הר״מ באשר״י ולא זכר טעם ע״ז ונ״ל כיון דבשכירות שוכרין אפי' בפחות מש״פ כדלקמן סי' שפ״ב » (ט״ז או״ח ש״פ ס״ק ב); and he continues: « ומ״ה דוקא בעכו״ם שמצינו שב״נ נהרג על פחות מש״פ משא״כ בישראל דפחות מש״פ לאו כלום הוא ע״כ בטלו השכירות לגמרי בישראל » (ט״ז או״ח ש״פ ס״ק ב).
And on Shabbos? The Rambam writes, of renting from a non-Jew: « שׂוֹכְרִין מִן הָעוֹבֵד כּוֹכָבִים וּמַזָּלוֹת אֲפִלּוּ בְּשַׁבָּת. The Magen Avraham suggests, with reservation, that even the second opinion permits renting on a weekday, and forbids it only on Shabbos: « לולי דמסתפינא הייתי אומר דהר״מ מודה דבחול שרי דלמה יגרע מביטול אלא דשבת אסו' לשכור דהוי כמקח וממכר » (מגן אברהם ש״פ ס״ק ו).
He himself distinguishes renting from a non-Jew: «
The Eliyah Rabbah, who reports this suggestion of the Magen Avraham, objects: « וצריך עיון דבמרדכי ריש פרק הדר כתב דשוכרין מכותים בשבת ולא דמי למקח וממכר דאין זה אלא כמתנה בעלמא שאין עושין אלא להתיר להם טילטול » (אליה רבה ש״פ ס״ק ו), and draws from it: « ואם כן הוא הדין בישראל » (אליה רבה ש״פ ס״ק ו); for the halachah, however, he concludes about a Jew's renting: « ולענין הלכה נראה דאינו מועיל » (אליה רבה ש״פ ס״ק ו). The Shulchan Aruch HaRav writes of renting from a non-Jew: « מֻתָּר לִשְׂכּוֹר מִן הַנָּכְרִי אֲפִלּוּ בְּשַׁבָּת, וְאֵין בְּזֶה מִשּׁוּם מִקָּח וּמִמְכָּר » (שו״ע הרב שפ״ב:ח), and, although renting too is forbidden on Shabbos because it resembles buying and selling: « מִכָּל מָקוֹם כַּאן, כֵּיוָן שֶׁאֵינוֹ שׂוֹכֵר רְשׁוּתוֹ כְּדֵי לְהִשְׁתַּמֵּשׁ בָּהּ אֶלָּא לְהַתִּיר הַטִּלְטוּל בִּלְבָד, אִם כֵּן הַדָּמִים שֶׁנּוֹתֵן לוֹ אֵינוֹ אֶלָּא מַתָּנָה בְּעָלְמָא » (שו״ע הרב שפ״ב:ח).
The Mishnah Berurah explains the second opinion: « ס״ל דלא תקנו שכירות אלא בעכו״ם אבל לא בישראל » (משנה ברורה ש״פ ס״ק י״ג), and brings the ruling: « ולענין הלכה הא״ר פוסק דאין שכירות מועלת בישראל כלל אבל שארי אחרונים מקילין בזה לענין ימי החול כהמ״א » (משנה ברורה ש״פ ס״ק י״ג). The Shulchan Aruch HaRav brings both opinions with their reasons — the first in section 2 — and rules: « וְיֵשׁ אוֹמְרִים שֶׁלֹּא תִקְּנוּ שְׂכִירוּת אֶלָּא בְּנָכְרִי שֶׁאֵין בִּטּוּלוֹ מוֹעִיל, אֲבָל לֹא בְּיִשְׂרָאֵל. וּלְעִנְיַן הֲלָכָה, בְּדִבְרֵי סוֹפְרִים הַלֵּךְ אַחַר הַמֵּקֵל » (שו״ע הרב ש״פ:ד); his seif 4 does not distinguish Shabbos from a weekday; in siman 382, he deals with renting from a non-Jew on Shabbos, and writes that for a Jew, renting for less than a perutah is neither renting nor renunciation (Level 4, point ד).
Renting on Shabbos itself. According to the Magen Avraham's suggestion, renting between Jews would be forbidden on Shabbos as an act of commerce; the Eliyah Rabbah objects, citing the Mordechai, for whom the payment is only a gift; the Mishnah Berurah brings that the Eliyah Rabbah holds a Jew's renting ineffective altogether, and that other Acharonim are lenient on weekdays. The Shulchan Aruch HaRav permits renting from a non-Jew even on Shabbos, the payment being only a gift (שו״ע הרב שפ״ב:ח), and does not write explicitly the case of a Jew. For halachah lema'aseh, consult your Rav.
8. Many renouncing to one — they do not become guests (seif ד)
The Mishnah: « נָתְנוּ לוֹ רְשׁוּתָן — הוּא מוּתָּר, וְהֵן אֲסוּרִין » (עירובין ס״ט ע״ב). Rashi: « אפי' מביתו לחצר דכיון דמשתמשי בחצר אע״ג דלאו מבית דידהו מפקי הוה ליה משקל רשותא דחמשה לגבי חד לא דמו לאורחין » (רש״י עירובין ס״ט ע״ב); and: « חמשה - לאו דוקא » (רש״י עירובין ס״ט ע״ב).
יסוד — one domain, and yet forbidden. The Mishnah Berurah: « דכיון שביטלו לו רשותם נעשה חצירם וביתו רשות אחת » (משנה ברורה ש״פ ס״ק י״ד). And why they are forbidden even from his house: « וא״כ כשחוזרין ומוציאין לתוכה ה״ז כאלו חוזרים בהם ורוצים לזכות בה » (משנה ברורה ש״פ ס״ק ט״ז). It explains the rule in this case: « ר״ל בכגון זה שבאמת החצר והבתים שייך להם אלא כדי שיהא מותר לטלטל נסתלקו מרשותם » (משנה ברורה ש״פ ס״ק י״ח).
The reading in the Tur. The Tur writes: « והם אסורין אף מביתן לחצר ולא אמרינן שהם יהיו כאורחים » (טור או״ח ש״פ). The Taz, on the words of the seif: « כן עיקר ולא כנוסחא שבטור אף מביתן » (ט״ז או״ח ש״פ ס״ק ג). The Mishnah Berurah: « אף מביתו - כצ״ל » (משנה ברורה ש״פ ס״ק ט״ז).
The words in parentheses — the seif carries, in small type, in parentheses, followed by The Beis Yosef brings Rabbeinu Yehonasan: « כתב ה״ר יהונתן נתנו לו רשותם הוא מותר בשלו להוציא מביתו לחצר אבל בשלהם לא שהרי לא סלקו נפשם מבתיהם אלא מן החצר לבדו » (בית יוסף או״ח ש״פ), and writes: « משמע מדבריו שאם ביטלו בפירוש רשות חצירן ורשות בתיהם שהוא מותר להוציא אף מבתיהם וכ״נ מדברי רבינו » (בית יוסף או״ח ש״פ). The text does not name the author of the parenthesis; what it says matches what the Beis Yosef infers from Rabbeinu Yehonasan. The Shulchan Aruch HaRav writes it in his seif 5: « אֶלָּא אִם כֵּן בִּטְּלוּ לוֹ בְּפֵרוּשׁ גַּם רְשׁוּת בָּתֵּיהֶם » (שו״ע הרב ש״פ:ה).
Bringing in from the courtyard to his house. The Magen Avraham: « ואפי' חזקה לא מהני (כ״מ בהר״ר יונתן) וא״כ משמע דמותרים להכניס מחצר לביתו » (מגן אברהם ש״פ ס״ק ז). The Mishnah Berurah, after bringing it: « אבל בא״ר כתב בשם הרבה פוסקים שגם להכניס מחצר לבית אסור וכ״כ באבן עוזר » (משנה ברורה ש״פ ס״ק ט״ז). On their own houses, it writes: « ואפי' ביטלו לו רשות ביתם ג״כ אסורים להוציא בין מביתם ובין מביתו לחצר » (משנה ברורה ש״פ ס״ק י״ז). The Shulchan Aruch HaRav, in his seif 5: « אֲבָל מֻתָּרִים לְהַכְנִיס מֵחָצֵר לְבֵיתוֹ, לְפִי שֶׁאֵין נִרְאֶה חֲזָרָה אֶלָּא כְּשֶׁמַּכְנִיסִים לִרְשׁוּת שֶׁלָּהֶם שֶׁבִּטְּלוּהָ, דְּהַיְנוּ לֶחָצֵר, אֲבָל כְּשֶׁמּוֹצִיאִים מֵרְשׁוּת זוֹ וּמַכְנִיסִים לִרְשׁוּת אַחֶרֶת — אֵין זוֹ נִרְאֵית חֲזָרָה » (שו״ע הרב ש״פ:ה); then: « אֲבָל אֲסוּרִים לְהַכְנִיס מֵחָצֵר לְבָתֵּיהֶם אֲפִלּוּ אִם בִּטְּלוּ לוֹ גַּם רְשׁוּת בָּתֵּיהֶם » (שו״ע הרב ש״פ:ה).
If he took possession first. The Mishnah Berurah brings from the Magen Avraham that even if the individual took possession of the courtyard first, they are forbidden in any case (ס״ק י״ח). The Shulchan Aruch HaRav writes: « וַאֲפִלּוּ אִם כְּבָר הֶחֱזִיק הוּא בֶּחָצֵר — אֵין זֶה מוֹעִיל שֶׁלֹּא יוּכְלוּ הָרַבִּים לַחֲזוֹר בָּהֶם » (שו״ע הרב ש״פ:ה). This page sets these formulations side by side, without deciding between them.
9. Two only; many renouncing to many (seif ד)
The seif: « וה״ה אם היו שנים לבד וביטל א' מהם לחבירו המבטל אסור אף בשל חבירו וחבירו מותר אף בשל עצמו » (שו״ע או״ח ש״פ:ד). The Beis Yosef gives its source, the Maggid Mishneh in the name of the Rashba: « וכתב ה״ה בפ״ב מה״ע בשם הרשב״א דה״ה נמי אם היו שנים לבד וביטל אחד מהם לחבירו המבטל אסור אף בשל חבירו וחבירו מותר בשל עצמו » (בית יוסף או״ח ש״פ).
The word אף. The Magen Avraham reads it otherwise: « וה״ה בשל חבירו והיינו כשנותן לו גם רשות ביתו ואם נתן לו רשות חצירו לבד אסור בשל חבירו » (מגן אברהם ש״פ ס״ק ח).
An individual with an individual. He concludes: « וע״כ נראה דבשעת הדחק יש לסמוך על זה » (ביאור הלכה ש״פ).
The Shulchan Aruch HaRav, in his seif 6, writes of the two: « דִּינוֹ כְּרַבִּים לְגַבֵּי יָחִיד, שֶׁאַף הַיָּחִיד אֵינוֹ נַעֲשֶׂה אוֹרֵחַ לְגַבֵּי יָחִיד אֶלָּא לְגַבֵּי רַבִּים, וְאֵין רַבִּים פְּחוּתִים מִשְּׁנַיִם » (שו״ע הרב ש״פ:ו); and of many renouncing to many: « וְכֵן רַבִּים שֶׁלֹּא עֵרְבוּ שֶׁבִּטְּלוּ רְשׁוּתָם לְרַבִּים שֶׁעֵרְבוּ, אֵינָם נַעֲשִׂים אוֹרְחִים אֶצְלָם, וְדִינָם כְּרַבִּים לְגַבֵּי יָחִיד » (שו״ע הרב ש״פ:ו). The Magen Avraham uses the same rule for the baraisa of locking (Magen Avraham, ס״ק ד; section 6).
The Rambam — two who did not make the eruv, renouncing to each other in turn: « וּמְבַטְּלִין וְחוֹזְרִין וּמְבַטְּלִין.
Many living in one house. The Biur Halachah first brings that, according to the Chemed Moshe, many living in one house count as many; then it notes that it follows from the Shulchan Aruch HaRav (שו״ע הגר״ז, the Alter Rebbe's Shulchan Aruch), in siman 391, that they are like one, and leaves the question as צ״ע: « אכן מדברי שו״ע הגר״ז בסימן שצ״א מוכח דאם רבים דרים בבית אחד כיחיד דמיא והויין בכלל אורחים לגבי רבים עי״ש וצ״ע » (ביאור הלכה ש״פ).
10. Two who forgot — to whom one renounces, and the renunciation passed on (seif ד)
A baraisa, which the Gemara raises against Rabbah (section 3): « וּשְׁנַיִם שֶׁלֹּא עֵירְבוּ נוֹתְנִין רְשׁוּתָן לִשְׁנַיִם שֶׁעֵירְבוּ, אוֹ לְאֶחָד שֶׁלֹּא עֵירַב » (עירובין ע׳ ע״א) — but: « וְאֵין שְׁנַיִם שֶׁעֵירְבוּ נוֹתְנִין רְשׁוּתָן לִשְׁנַיִם שֶׁלֹּא עֵירְבוּ, וְאֵין שְׁנַיִם שֶׁלֹּא עֵירְבוּ נוֹתְנִין רְשׁוּתָן לִשְׁנַיִם שֶׁלֹּא עֵירְבוּ » (עירובין ע׳ ע״א). The Mishnah Berurah explains the case of the one who did not make the eruv: « פי' שלא היו בחצר כ״א ג' אנשים ושום אחד מהן לא עירב ולהכי כשביטלו אותם השנים רשותם להשלישי נמצא שחצר של יחיד הוא וא״צ עירוב » (משנה ברורה ש״פ ס״ק כ״ב). The Beis Yosef, in the passage where he brings Rabbeinu Yehonasan, writes: « עוד משמע מכאן שהי' או השנים שמבטלים רשותן ליחיד צריכין שיבטלו רשותן לו בבת אחת » (בית יוסף או״ח ש״פ); then, according to the reason Rashi gives: « ולפי טעם זה אין הי' או הב' צריכין לבטל רשותן בבת אחת אלא אפי' זה אחר זה מהני וכ״נ שהוא דעת כל הפוסקים שלא חילקו בדבר » (בית יוסף או״ח ש״פ).
The Mishnah says that two forbid each other; the Gemara: « הָיוּ שְׁנַיִם אוֹסְרִין זֶה עַל זֶה. And on the end of the Mishnah, which says that two do not receive a renunciation, the Gemara (section 2) speaks of one who was told
The Rambam — the case without a condition: « וַאֲפִלּוּ חָזַר הָאֶחָד שֶׁלֹּא עֵרֵב וּבִטֵּל רְשׁוּתוֹ לַשֵּׁנִי שֶׁלֹּא עֵרֵב הֲרֵי זֶה אוֹסֵר שֶׁבְּשָׁעָה שֶׁבִּטְּלוּ לוֹ הַמְעָרְבִין אָסוּר הָיָה » (הלכות עירובין פ״ב ה״ד).
Seif ד writes explicitly only the case of the condition, which it introduces with ואפילו: « ואפילו אמר לא' אני מבטל לך על מנת שתחזור ותבטל לחבירך אינו מועיל » (שו״ע או״ח ש״פ:ד). The Taz writes both cases, each with its reason: « כיון שתיכף שביטלו אותן שעירבו לאותן שלא עירבו לא הותר לטלטל בחצר כיון שהיו שנים שוב לא מהני ביטול א' מהם לחבירו ואפי' ע״מ שאמר לא מועיל כיון שלא זכה בחלק שביטלו לו בענין שיוכל לטלטל בחצר אינו יכול להקנו' לחבירו » (ט״ז או״ח ש״פ ס״ק ד). The Magen Avraham, in the name of Rashi: « כיון דלא אקני ליה שיהא הוא מותר אינו מועיל » (מגן אברהם ש״פ ס״ק ט). The Mishnah Berurah reads the case without a condition in the seif's ואפילו: « ר״ל דלא מיבעי אם לא פירש שיחזור ויבטל לחבירו אלא שביטל סתם לראשון והראשון מעצמו חזר וביטל חלק של עצמו וגם חלק שקיבל דלא מהני » (משנה ברורה ש״פ ס״ק כ״ג); then: « אלא אפילו אמר לו לכתחלה אני מבטל לך ע״מ שתחזור ותבטל לחברך לא אמרינן דשליח שויה והוי כאלו הוא בעצמו מבטל להאחרון אלא דכיון דלראשון לא מהני האי בטול לא קני ליה שיוכל לחזור ולהקנות לאחרון » (משנה ברורה ש״פ ס״ק כ״ג).
The Shulchan Aruch HaRav, in his seif 7: « אֲבָל לְרַבִּים שֶׁלֹּא עֵרְבוּ, אֲפִלּוּ לִשְׁנַיִם שֶׁלֹּא עֵרְבוּ — אֵין מְבַטְּלִין לָהֶם » (שו״ע הרב ש״פ:ז); then: « וַאֲפִלּוּ אִם חָזַר הָאֶחָד וּבִטֵּל לַחֲבֵרוֹ — אֵינוֹ מוֹעִיל כְּלוּם » (שו״ע הרב ש״פ:ז), with the reason; and for the condition: « שֶׁכֵּיוָן שֶׁלֹּא זָכָה בְּחֵלֶק שֶׁבִּטְּלוּ לוֹ בְּעִנְיָן שֶׁיּוּכַל לְטַלְטֵל בֶּחָצֵר, אֵינוֹ יָכוֹל לְהַקְנוֹת לַחֲבֵרוֹ » (שו״ע הרב ש״פ:ז). The case without a condition, which the Mechaber's seif does not write explicitly, is found in the Gemara and in the Rambam (above), and in Rabbeinu Yehonasan, as the Beis Yosef reports: « כתב ה״ר יהונתן בפירוש המשנה תני בברייתא שאע״פ שחזר השני וביטל רשותו לחבירו אסור להוציא לחצר דכיון שתיכף שביטלו אותן שעירבו לאותן שלא עירבו לא הותר לטלטל בחצר שוב לא מהני ליה ביטול חבירו » (בית יוסף או״ח ש״פ); the Mishnah Berurah reads it in the seif's ואפילו (above); see Level 4, point ו.
11. Summary of the shitos and halachic conclusion
The foundation — one who did not make the eruv may renounce his domain; according to Rashi, for the Rabbanan what he did not specify he did not renounce; and, according to the Gemara, many do not become guests of one:
- one who forgot to make the eruv forbids the others — and the renunciation is effective even for one who did not make it deliberately (Mishnah Berurah, ס״ק א); he renounces by speech, without a kinyan sudar, and even after nightfall, like Beis Hillel (seif א) — according to the Mishnah Berurah, because it is only a withdrawal from his domain (ס״ק ג);
- if he lives with four or five, he must renounce to each one, like the Rabbanan and Rabbah; the seif writes without attribution the formula to you and to you, the Rambam's, and brings as an opinion that to all of you is enough, which the Tur also accepts (seif א); the Mishnah Berurah brings that the Eliyah Rabbah follows that opinion, and continues: all this, when he stands facing them all and says these words to them (ס״ק ה); the Shulchan Aruch HaRav writes the formula to all of you and rules leniently;
- if he did not specify, he renounced only the courtyard: from their houses to the courtyard, they and he carry, since he is a guest of theirs; from his house to the courtyard, neither they nor he (seif א) — and for bringing in as well, as the Mishnah and the Shulchan Aruch HaRav write; some require him to lock his house (seif א) — according to Rashi's reading, the view of the Tanna of the baraisa (the Gemara's second reading), which the Rosh says to follow stringently, and which others distinguish; the Mishnah Berurah writes that in a pressing situation one may rely on the lenient view (ס״ק י״א), and the Shulchan Aruch HaRav writes that one who is lenient has not lost;
- if he also renounced his house, everyone carries to the courtyard, from his house as from theirs, since he becomes a complete guest (seif ב) — according to the Beis Yosef, the Magen Avraham and the Mishnah Berurah, after they have taken possession of the courtyard (siman 381); and, according to the Mishnah Berurah (ס״ק י״ב) and the Shulchan Aruch HaRav (seif 3), he should not bring in from the courtyard into his house before they have brought in from the courtyard into the house (לביתו): the Mishnah Berurah does not say whose, and the Shulchan Aruch HaRav counts, in 381:1, bringing in into his own house (section 6);
- renting instead of renouncing: two opinions (seif ג), according to the Beis Yosef the Rosh and ר״מ; the Magen Avraham suggests, with reservation, permitting on weekdays and forbidding on Shabbos; the Mishnah Berurah brings the Eliyah Rabbah, for whom a Jew's renting is ineffective, and other Acharonim who are lenient on weekdays (ס״ק י״ג); the Shulchan Aruch HaRav rules leniently;
- many renouncing to one: he carries from his house, not from their houses, unless they expressly renounced them — the parenthesis, which matches what the Beis Yosef infers from Rabbeinu Yehonasan; they are forbidden even from his house — not as the reading in the Tur, writes the Taz (seif ד); bringing in from the courtyard to his house: the Magen Avraham infers it is permitted, the Mishnah Berurah brings the Eliyah Rabbah forbidding it in the name of many poskim, and the Shulchan Aruch HaRav permits it, but not into their houses;
- two only: the one who renounces is forbidden even in what is the other's, and the other permitted even in what is his own, since an individual does not become a guest of an individual (seif ד) — the Maggid Mishneh, in the name of the Rashba, writes the second clause, that of the fellow permitted in what is his own, without “אף” (section 9); and likewise for many without an eruv who give their domain to many who made it (seif ד); the Biur Halachah brings dissenting views and writes that in a pressing situation it seems one may rely on them; on the word אף, the Mishnah Berurah and the Magen Avraham read differently;
- two who forgot may renounce, each to all the residents; one does not renounce to two who did not make the eruv, even on a condition (seif ד) — nor without a condition, as the Gemara, the Rambam, Rabbeinu Yehonasan (Beis Yosef), the Taz and the Shulchan Aruch HaRav write, and the Mishnah Berurah reads it in the seif's ואפילו (ס״ק כ״ג); the Mishnah Berurah writes that it is reasonable (מסתברא) that it is effective if the one who renounced to the first then renounces himself to the second, since all the shares are now his, the first having renounced his own share to him at the outset (ס״ק כ״ד).
