📜 The text of the Shulchan Aruch — 7 seifim

summary: heading of the siman, then seif א. One who renounced his domain and then carried from his house to the courtyard: inadvertently, he does not forbid; deliberately, he forbids, for he goes back on the renunciation he made. If they had already taken possession of it — by carrying from their houses to the courtyard, or by bringing in from the courtyard to their houses — he can no longer go back on his renunciation. According to Rashi, taking possession is effective only if they took possession after nightfall.

summary: there is renunciation from one courtyard to another. Two courtyards with an opening between them, each of which made an eruv for itself and not together: each may renounce its domain in favor of the other, so that the other may use it, and not itself. Two courtyards, one inside the other, where only the outer one made an eruv, the inner one forbidding [carrying] to it: the inner one may cede its domain to it, not to use it and not to pass through it except when it needs to go out, and the outer one will be permitted. Or, if they made the eruv together and placed it in the outer one, and one of the inner one forgot to make the eruv: he may renounce, in favor of each of the residents of the inner one and of each of the outer one; he alone is then forbidden, and all are permitted.

summary: there is renunciation for a ruin. Two houses and, between them, a ruin that belongs to both: if they forgot to make the eruv, one may renounce his domain in favor of the other, so that the other is permitted in it.

summary: there is renunciation from one house to another. Two houses with an opening between them, without an eruv: one renounces in favor of the other. Even the one who renounces may carry from his house to the other's house, but not from the other's house to his own, for he would then be going back and taking possession again of the domain he renounced; likewise, if he has a room open to his house and renounced the domain of his house, he is forbidden to carry from the room to his house. Gloss of the Rema: some say that one does not renounce from one house to another unless he keeps for himself one room that he did not renounce; then it is permitted to bring in [objects] even from the other's house to his own; and it is good to be stringent a priori.

summary: two houses on the two sides of the public domain, which non-Jews enclosed with a partition on Shabbos, so that there is between them something like a courtyard onto which two houses open, and they forbid each other: they cannot renounce one in favor of the other.

summary: the heir renounces. If the one he inherits from did not make the eruv and died on Shabbos, and the heir comes to live in the courtyard and forbids, he may renounce his domain.

summary: one renounces, and then renounces in return. The residents of one courtyard renounce their domain in favor of those of another courtyard, or of one of the residents of the courtyard, until those have carried what they want; then those renounce in return in favor of the ones who had renounced to them, until they too have carried what they want.

1. The Mishnah — one who renounced and carries: Rabbi Meir and Rabbi Yehudah (seif א)

The Beis Yosef opens the siman with its source, a Mishnah in chapter הדר, and reports the ruling: « פלוגתא דר״מ ור׳ יהודה ופסק כר׳ יהודה וכן פסקו הפוסקים » (בית יוסף או״ח שפ״א) — the dispute of Rabbi Meir and Rabbi Yehudah; the ruling follows Rabbi Yehudah, and so ruled the poskim. Seif א writes what Rabbi Yehudah says: inadvertently, he does not forbid; deliberately, he forbids.

What do Rabbi Meir and Rabbi Yehudah disagree about? The Gemara brings two readings. Rav Acha bar Chana, in the name of Rav Sheshes, ties their dispute to that of Rav and Shmuel on renouncing in return (section 10): « מַאי לָאו, בְּהָא קָמִיפַּלְגִי: דְּמָר סָבַר מְבַטְּלִין וְחוֹזְרִין וּמְבַטְּלִין, וּמַר סָבַר אֵין מְבַטְּלִין וְחוֹזְרִין וּמְבַטְּלִין » (עירובין ס״ח ע״ב) — one would hold that one renounces and then renounces in return, the other that one does not. Rav Acha bar Tachlifa, in the name of Rava, rejects this: « לָא, דְּכוּלֵּי עָלְמָא אֵין מְבַטְּלִין וְחוֹזְרִין וּמְבַטְּלִין, וְהָכָא בְּקָנְסוּ שׁוֹגֵג אַטּוּ מֵזִיד קָא מִיפַּלְגִי » (עירובין ס״ח ע״ב) — all agree that one does not renounce in return, and they disagree on whether the inadvertent case was penalized because of the deliberate one.

יסוד — the Rambam gives the reason for each of the two cases in terms of the renunciation itself: « אִם בְּמֵזִיד הוֹצִיא הֲרֵי זֶה אוֹסֵר עֲלֵיהֶן שֶׁהֲרֵי לֹא עָמַד בְּבִטּוּלוֹ. וְאִם בְּשׁוֹגֵג הוֹצִיא אֵינוֹ אוֹסֵר שֶׁהֲרֵי הוּא עוֹמֵד בְּבִטּוּלוֹ » (הלכות עירובין פ״ב ה״ו) — deliberately, he did not stand by his renunciation; inadvertently, he stands by it. Seif א writes « במזיד אוסר שהרי חוזר מביטולו שביטל » (שו״ע או״ח שפ״א:א) — and it adds at once that, if they have already taken possession, he can no longer go back on his renunciation (section 2); the Mishnah Berurah explains these words: « שנראה כחוזר ומחזיק ברשות שביטל. ומ״מ אם חוזר אח״כ ומבטל מחדש מהני » (משנה ברורה שפ״א ס״ק ג) — he appears to go back and take possession again of the domain he renounced; and if he renounces anew afterwards, it is effective.

חקירה — does one who carries deliberately forbid because he goes back on his renunciation, or because he desecrates Shabbos? The Beis Yosef cites Rabbeinu Yerucham, who first writes that after the others took possession he does not forbid, even deliberately, and that this is the view of the Rif, the Rambam, the Rosh and most poskim; then: « אבל לרש״י לפי פירושו וקצת הפוסקים אוסרים במזיד אפי׳ החזיקו כבר כי הוא מחלל שבת בפרהסיא ואינו מבטל אפילו שחילל במילי דרבנן » (בית יוסף או״ח שפ״א) — according to Rashi, by his explanation, and according to some poskim, [one who carried] deliberately forbids even after they took possession, for he desecrates Shabbos in public, and he does not renounce, even if he desecrated only rabbinic laws. The Beis Yosef explains where this view comes from: « והענין הוא דאהא דתניא (שם סט) עד שלא נתן רשותו הוציא בין בשוגג בין במזיד יכול לבטל דברי ר״מ ר׳ יהודה אומר בשוגג יכול לבטל במזיד אין יכול לבטל קסבר רבי יהודה מחלל שבת אין יכול לבטל בלא שכירות » (בית יוסף או״ח שפ״א) — the matter is that, on the Baraisa (ibid., 69), before he gave his domain, if he carried out, unwittingly or deliberately, he may renounce, according to Rabbi Meir; Rabbi Yehudah says: unwittingly, he may renounce; deliberately, he may not, Rabbi Yehudah holds that one who desecrates Shabbos cannot renounce without renting. He then cites the objection of Tosafos to this explanation: « והתוספות (שם) הקשו עליו והעלו דהכא לא מטעם מומר קאמר דמומר לא שייך אלא באדם הרגיל לחלל שבתות ואינו נזהר כלל אבל הכא לא ברגיל איירי וכו׳ ומיהו במאי דמשמע מדברי רש״י דאפילו במילי דרבנן חשיב מומר לא נחלקו עליו התוספות אדרבה כתבו דהכי משמע בגמרא » (בית יוסף או״ח שפ״א) — here [in this Baraisa] it is not because of one who has left the Torah (מומר), which applies only to a man accustomed to desecrating Shabbos and not careful at all, whereas here [in this Baraisa] it is not about a habitual one; but on what follows from Rashi's words — that even for rabbinic laws one is counted as such — Tosafos do not disagree with him, and write on the contrary that this is what the Gemara implies.

Seif א gives as the reason going back on the renunciation, and writes that after the others took possession he can no longer go back.

The Taz's question. In siman 371, seif ב, one who left with no intention of returning and came back on Shabbos does not forbid; the Taz gives as the reason that the Shabbos that was permitted stays permitted, and asks: « ולמה לא נימא כאן ג״כ הכי באם חזר וביטל בשבת דלא יוכל לחזור ולאסור כיון שכבר הותר בכניסת שבת » (ט״ז או״ח שפ״א ס״ק א) — in substance: why not say here too [in the case the Taz describes with the words באם חזר וביטל בשבת, whose sense this page does not decide] that he can no longer go back and forbid, since [the domain] was already permitted when Shabbos began?

His answer: « י״ל דשאני התם דההיתר תלוי בכניסת שבת דהא צריך להסיע מדעתו בכניסת שבת שלא יהי׳ שבת זו בבית זה » (ט״ז או״ח שפ״א ס״ק א) — there, the permission depends on the beginning of Shabbos, since he must have put out of his mind, at that moment, spending this Shabbos in this house; « משא״כ כאן יכול לבטל רשות אפי׳ משחשיכה כמ״ש סי׳ ש״פ ע״כ צריך להיות ההיתר כל השבת דוקא » (ט״ז או״ח שפ״א ס״ק א) — here, one may renounce even after nightfall, so the permission must last the whole Shabbos.

Before the Taz, the Rosh answers differently, on one who left his house to spend Shabbos at his daughter's and returns to it on Shabbos: to those who bring a proof from one who renounced, « ועוד ממבטל רשות שאם חזר והוציא אוסר » (רא״ש עירובין פרק ח׳ סימן ו׳), he answers « ומבטל רשות כיון שחזר והחזיק הוא במבוי קודם שהחזיקו בני מבוי בודאי לא הסיע מלבו » (רא״ש עירובין פרק ח׳ סימן ו׳) — the one who renounced, since he went back and took possession before the others, had certainly not put it out of his mind; and he adds « וכן מצאתי משם הראב״ד ז״ל » (רא״ש עירובין פרק ח׳ סימן ו׳).

The Shulchan Aruch HaRav also writes that one does not say here that the Shabbos that was permitted stays permitted, and takes up the Rosh's answer (which the Rosh also found in the name of the Raavad), other than the Taz's: « שֶׁכֵּיוָן שֶׁחוֹזֵר בּוֹ, אִם כֵּן בְּוַדַּאי לֹא הִסִּיחַ לִבּוֹ לְגַמְרֵי מִתְּחִלָּה, וְלֹא הֻתְּרָה שַׁבָּת מֵעוֹלָם » (שו״ע הרב שפ״א:א) — since he goes back on his renunciation, he certainly had not put it entirely out of his mind from the start, and Shabbos was never permitted; see Level 4, point א.

If he carried on Erev Shabbos, after renouncing. The Biur Halachah cites the Yad Ephraim: « עיין ביד אפרים שמבואר בו דאף אם הוציא בע״ש נמי כחוזר מביטולו דמי ויאסור עליהם כשיתקדש היום » (ביאור הלכה שפ״א) — it is also going back, and he will forbid when the day becomes sanctified. Then: « ואין הדבר מוכרח דאפשר לומר דאף שהביטול יכול להיות מבעוד יום מ״מ לענין חוזר מביטולו לא שייך אלא כשמוציא בשבת ולא כשמוציא בחול » (ביאור הלכה שפ״א) — this is not compelling: one can say that, even if the renunciation may be made by day, going back applies only if he carries on Shabbos, and not on a weekday. The Biur Halachah does not decide here.

2. Taking possession by the other residents (seif א)

The Gemara reports, in Rabbi Meir's version, what Rabban Gamliel told his sons about a Sadducee who lived with him in a mavoi in Jerusalem: « בָּנַי, מַהֲרוּ וְהוֹצִיאוּ מַה שֶּׁאַתֶּם מוֹצִיאִין וְהַכְנִיסוּ מַה שֶּׁאַתֶּם מַכְנִיסִין, עַד שֶׁלֹּא יוֹצִיא הַתּוֹעֵב הַזֶּה וְיֶאֱסֹר עֲלֵיכֶם, שֶׁהֲרֵי בִּיטֵּל רְשׁוּתוֹ לָכֶם » (עירובין ס״ח ע״ב) — hurry and take out what you take out and bring in what you bring in, before this man takes something out and forbids it to you, for he renounced his domain to you. It asks: « לְמֵימְרָא דְּכִי מַפְּקִי אִינְהוּ וַהֲדַר מַפֵּיק אִיהוּ לָא אָסַר » (עירובין ס״ח ע״ב) — if they carried and then he carries, he would not forbid? Does the Mishnah (section 1) not say, according to Rabbi Meir, that he forbids?

The Beis Yosef — on the source of taking possession: « ואע״פ שכתב שם רש״י דלרבי יהודה דמתני׳ לא מהניא חזקה מ״מ כבר כתב דלרבי יהודה דברייתא מהניא וקי״ל הלכה כדברי המיקל בעירוב » (בית יוסף או״ח שפ״א) — although Rashi wrote there that, according to the Rabbi Yehudah of the Mishnah, taking possession is not effective, [Rashi] already wrote that, according to the Rabbi Yehudah of the baraisa, it is effective; and we hold that the halachah follows the lenient view in matters of eruv.
The Rambam — « אֲבָל אִם קָדְמוּ וְהֶחֱזִיקוּ וְהוֹצִיאוּ אִם חָזַר הוּא וְהוֹצִיא בֵּין בְּשׁוֹגֵג בֵּין בְּמֵזִיד אֵינוֹ אוֹסֵר עֲלֵיהֶן » (הלכות עירובין פ״ב ה״ו) — if they got ahead of him, took possession and carried, and then he carries, inadvertently or deliberately, he does not forbid them.

3. Taking out or bringing in: going back and taking possession (seif א)

For the one who renounced, seif א mentions only taking out — המבטל רשותו והוציא אח״כ —; for the others taking possession, it mentions both: « שהוציאו מבתיהם לחצר או שהכניסו מחצר לבתיהם » (שו״ע או״ח שפ״א:א).

The one who renounced brings [an object] in from the courtyard to his house. The Magen Avraham, on the word והוציא: « אבל להכניס מותר אלא א״כ ביטל גם רשות ביתו דאז אסור להכניס » (מגן אברהם שפ״א ס״ק א) — bringing in is permitted, unless he renounced the domain of his house too; then bringing in is forbidden. The Mishnah Berurah reports this distinction in these terms, « כתב המג״א דלא אמרינן שהוא כחוזר ומחזיק אלא ע״י הוצאה מבית לחצר אבל אם מכניס מחצר לבית לא נראה כרוצה לחזור מביטולו ולהחזיק בחצר » (משנה ברורה שפ״א ס״ק ג) — according to it, he speaks of retraction —, then refers to what it wrote in siman 380: « שכמה פוסקים חולקים ע״ז וס״ל דאין חילוק בין הוצאה להכנסה וכמו דלא מחלקינן בין הוצאה להכנסה לענין החזיק וכמו שמסיים המחבר » (משנה ברורה שפ״א ס״ק ג) — several poskim dispute this and hold that there is no difference between taking out and bringing in, just as none is made for taking possession, as the seif writes at its end.

The Shulchan Aruch HaRav writes the same distinction as to retraction: « וְאֵינָהּ נִקְרֵאת חֲזָרָה אֶלָּא כְּשֶׁמּוֹצִיא מִבֵּיתוֹ לֶחָצֵר » (שו״ע הרב שפ״א:א); and he adds, in parentheses: « אֲבָל מִכָּל מָקוֹם אָסוּר לוֹ לְהַכְנִיס מֵחָצֵר לַבַּיִת » (שו״ע הרב שפ״א:א) — since his house is his own and the courtyard is theirs. Literally, the Magen Avraham writes of bringing in « אבל להכניס מותר » (מגן אברהם שפ״א ס״ק א), and the Rav that it is forbidden to him; the Mishnah Berurah reads him as speaking of retraction, and this page does not decide whether, according to the Magen Avraham, bringing in remains permitted to the one who renounced (a question for the Rav); see Level 4, point ב.

יסוד — going back and taking possession are not measured the same way. The Tur, on the house, writes the principle of going back: « שאין נקרא מחזיק אלא כשמכניס לרשות שביטל אבל מה שמוציא ממנו אינו חזרה אבל אינו יכול להוציא מבית חבירו לביתו שאז היה חוזר ומחזיק ברשות שביטל » (טור או״ח שפ״א) — only bringing [an object] into the domain one renounced is called taking possession again; taking it out of it is not going back; but he may not carry from the other's house to his own, for he would then be going back and taking possession again of the domain he renounced (section 7). The Beis Yosef, on the Tur's words they carried from their houses to the courtyard: « ומ״ש החזיקו בו כבר שהוציאו מבתיהם לחצר לאו דוקא דה״ה להכניסו מחצר לבתיהם » (בית יוסף או״ח שפ״א), and he answers the difficulty that the Tur's principle raises: « דלא אמרן כן אלא דוקא לענין חוזר ומחזיק דכשמוציא מרשות שביטל לא מיקרי חזרה אבל לגבי חזקה כל שעושה דבר שהיה נאסר בלא ביטול הוי חזקה » (בית יוסף או״ח שפ״א) — that principle applies only to going back; for taking possession, anything that would have been forbidden without renunciation is taking possession. The Biur Halachah: « בזה מודו כו״ע דשוה הכנסה להוצאה » (ביאור הלכה שפ״א).

The Shulchan Aruch HaRav writes the same distinction: «

After the others took possession, may the one who renounced carry himself? The Magen Avraham, on החזיקו: « ומ״מ לכתחלה אסור להוציא » (מגן אברהם שפ״א ס״ק ב) — even so, a priori, he is forbidden to carry; he refers to siman 380. The Shulchan Aruch HaRav: « אֲבָל הוּא אָסוּר לְהַכְנִיס וּלְהוֹצִיא בֶּחָצֵר אַף לְאַחַר שֶׁהֶחֱזִיקוּ בָּהּ, אֶלָּא אִם כֵּן בִּטֵּל לָהֶם גַּם רְשׁוּת בֵּיתוֹ » (שו״ע הרב שפ״א:א); and he adds « שֶׁאָז נַעֲשֶׂה כְּאוֹרֵחַ גָּמוּר אֶצְלָם » (שו״ע הרב שפ״א:א), which, he writes in seif 4, holds only for one who renounced to many: « וַאֲפִלּוּ אִם הֶחֱזִיקוּ אֵינוֹ מוֹעִיל אֶלָּא בְּיָחִיד שֶׁבִּטֵּל לְרַבִּים, אֲבָל לֹא בְּיָחִיד לְיָחִיד » (שו״ע הרב שפ״א:ד).

4. Taking possession by day — the Tur and Rashi (seif א)

The Tur writes that taking possession is effective by day as well as after nightfall, then cites Rashi: « החזיקו בו כבר שהוציאו מבתיהם לחצר לא שנא מבע״י ל״ש משחשיכה אינו יכול לחזור מביטולו ורש״י פי׳ שאין חזקה מועלת אא״כ החזיקו משתחשך » (טור או״ח שפ״א). The Beis Yosef, on the words whether by day or after nightfall: « ומ״ש ל״ש מבע״י ל״ש משחשכה כן משמע מסתימת המשנה שם » (בית יוסף או״ח שפ״א) — this follows from the Mishnah, which makes no distinction. And on Rashi, whose source he gives — his explanation of the words of the Mishnah in which Rabban Gamliel relates what his father told them, « וְאָמַר לָנוּ אַבָּא: מַהֲרוּ וְהוֹצִיאוּ אֶת הַכֵּלִים לַמָּבוֹי » (עירובין ס״ח ע״ב), of which section 2 cites the Baraisa's version: « ופירש״י והוציאו את הכלים. והחזיקו במבוי ושוב לא יוכל לחזור מביטולו וכשקידש היום עסקינן דחזקה דמבע״י לא מוכחא » (בית יוסף או״ח שפ״א) — they took possession of the mavoi, and he can no longer go back on his renunciation; and it speaks of the time when the day was sanctified, for taking possession by day proves nothing. Seif א writes the rule without condition, then, in Rashi's name, the restriction (משחשיכה).

חקירה — what is this taking possession: an acquisition, a proof, or the lifting of a prohibition?

An acquisition. The Mishnah Berurah, on the view the seif writes first: « דבכל מקום חזקה מועילה בקניה ואע״ג שאין זו חזקה גמורה אפ״ה הקילו חכמים בה דמהני כשאר חזקות » (משנה ברורה שפ״א ס״ק ה) — everywhere, taking possession is effective for acquiring; although this is not a complete taking of possession, the Sages accepted it like the others. And it derives: « ולדעה זו מהני חזקה אף אם החזיק בערב שבת אחר הביטול » (משנה ברורה שפ״א ס״ק ה).

A proof. According to Rashi, taking possession by day proves nothing (לא מוכחא). The Magen Avraham gives the reason: « דאם הוציא מבע״י ליכא חזקה דבלא ביטול נמי יכולין להוציא » (מגן אברהם שפ״א ס״ק ג) — even without renunciation, they may carry by day.

Lifting the prohibition of Shabbos. The Taz reads Rashi differently: « נראה דה״ק דבאמ׳ אין כאן חזק׳ גמור׳ שיקנה קנין גמור אלא דלא בעי אלא לאפקועי איסור שבת וזה אין שייך בע״ש דאין שם איסור טלטול עדיין עד שקידש היום » (ט״ז או״ח שפ״א ס״ק ב) — there is no complete taking of possession here that would fully acquire; it is only a matter of lifting the prohibition of Shabbos, which does not apply on Erev Shabbos, when there is not yet a prohibition of carrying. And he adds: « ובחנם אפקי׳ מו״ח ז״ל להאי ורש״י פי׳ מן נוסחאו׳ הטור וכ׳ שהוא ט״ס אלא הדברים כהוייתן דבאיסור טלטול תליא מילתא » (ט״ז או״ח שפ״א ס״ק ב) — his father-in-law removed in vain the words ורש״י פי׳ from the versions of the Tur, writing that it is a scribal error; the words stand as they are, for the matter depends on the prohibition of carrying.

A use of the courtyard. The Biur Halachah suggests, for the Tur: « אבל לדעת הטור דמהני חזקה אף מבע״י אפשר דלדידיה מהני חזקה ע״י השתמשות בחצר גופא אף שלא הוציא והכניס וכמו בחזקות דעלמא ומ״מ אינו מוכרח » (ביאור הלכה שפ״א) — according to the Tur, who accepts taking possession by day, it might also be done by using the courtyard itself, without taking out or bringing in [objects], like other forms of taking possession; but this is not compelling.

Does the seif hold the first view as primary? The Biur Halachah: « משמע מלשון זה דתופס לעיקר כדעה ראשונה ובאמת צ״ע דדעה ראשונה היא רק דעת הטור ודעת רש״י לאו יחידאה היא » (ביאור הלכה שפ״א) — it follows from this wording that [the Mechaber] holds the first view as primary; but this requires examination, since the first view is only that of the Tur, and Rashi's view is not a lone one: « דכן כתב גם רבינו יהונתן והריטב״א וכן מוכח בתוספות ס״ח ע״ב ד״ה והוציאו » (ביאור הלכה שפ״א). And on the one who rejected Rashi's position: « ומה שכתב הב״ח לדחות שיטת רש״י כבר דחו אחרונים דבריו ויש להחמיר » (ביאור הלכה שפ״א) — what the Bach wrote to reject Rashi's position, the Acharonim have already rejected, and one should be stringent. The Mishnah Berurah refers to it: « ועיין בביאור הלכה שיש להחמיר כדעה זו » (משנה ברורה שפ״א ס״ק ו).

The Shulchan Aruch HaRav writes the restriction first, without a name, and the other view under וְיֵשׁ אוֹמְרִים, then: « וְיֵשׁ לְהַחֲמִיר כִּסְבָרָא הָרִאשׁוֹנָה לְכַתְּחִלָּה, וּבְדִיעֲבַד יֵשׁ לְהָקֵל בְּדִבְרֵי סוֹפְרִים » (שו״ע הרב שפ״א:א) — one should be stringent according to the first view a priori, and after the fact be lenient in [a law] of rabbinic origin; see Level 4, point ג.

Taking possession on Erev Shabbos, after the renunciation. According to the view the seif writes first, it is effective (Mishnah Berurah, ס״ק ה); according to Rashi, it is not, and the Biur Halachah writes that one should be stringent; the Shulchan Aruch HaRav writes that one should be stringent a priori and, after the fact, lenient for a taking of possession made by day after the renunciation.

5. From one courtyard to another — Shmuel and Rabbi Yochanan (seif ב)

Abaye limits Shmuel's statement: « אָמַר אַבָּיֵי: הָא דְּאָמַר שְׁמוּאֵל אֵין בִּיטּוּל רְשׁוּת מֵחָצֵר לְחָצֵר, לָא אֲמַרַן אֶלָּא בִּשְׁתֵּי חֲצֵירוֹת וּפֶתַח אֶחָד בֵּינֵיהֶן, אֲבָל שְׁתֵּי חֲצֵירוֹת זוֹ לִפְנִים מִזּוֹ, מִתּוֹךְ שֶׁאוֹסְרִין — מְבַטְּלִין » (עירובין ס״ו ע״ב) — it applies only to two courtyards with an opening between them; for two courtyards one inside the other, since they forbid [each other], one renounces. The Gemara explains why, in the first case, the one of the inner courtyard cannot renounce in favor of anyone: « הַאי בַּר פְּנִימִית, לְמַאן נִיבַטֵּיל? לִיבַטֵּיל לִבְנֵי חִיצוֹנָה — אֵין בִּטּוּל רְשׁוּת מֵחָצֵר לְחָצֵר » (עירובין ס״ו ע״ב) — in favor of the residents of the inner one, their eruv is not with them; in favor of those of the outer one, there is no renunciation from one courtyard to another. And when the eruv is placed in the inner one and one of the outer one forgot: « שָׁכַח אֶחָד מִן הַחִיצוֹנָה וְלֹא עֵירַב — וַדַּאי פְּנִימִית מוּתֶּרֶת, דְּאָחֲדָא דַּשָּׁא, וּמִשְׁתַּמְּשָׁא, וְחִיצוֹנָה אֲסוּרָה » (עירובין ס״ז ע״א) — the inner one closes the door and uses its courtyard.

Rava himself says elsewhere (section 10): « אֲמַר לֵיהּ: אֲנָא כְּרַבִּי יוֹחָנָן סְבִירָא לִי, דְּאָמַר: יֵשׁ בִּיטּוּל מֵחָצֵר לְחָצֵר » (עירובין ס״ח ע״א). The Beis Yosef: « פלוגתא דשמואל ור׳ יוחנן ופסק הרא״ש כר״י דאמר הכי וכן דעת הרמב״ם בפ״ב מה״ע וכ״כ סמ״ג וסמ״ק » (בית יוסף או״ח שפ״א).

Why does the seif specify, for the first pair of courtyards, that each made an eruv for itself, and, for the second, that only the outer one did? The Beis Yosef, on two courtyards with an opening: « ואין לפרש דלא עירבו כלל דא״כ היאך מבטלין הא קי״ל דלשנים שלא עירבו אין מבטלין לפי שכל אחד אוסר על חבירו » (בית יוסף או״ח שפ״א) — if they had made no eruv at all, how could they renounce? We hold that one does not renounce in favor of two who did not make an eruv, each forbidding the other. On two courtyards one inside the other: « אלא על כרחך לפרש לא עירבו שתיהן אלא החיצונה לבדה דהשתא כיון דפנימית לא עירבה כלל ה״ל רגל האסורה במקומה ואוסרת על החיצונה » (בית יוסף או״ח שפ״א) — the inner one, which made no eruv at all, is then a foot forbidden in its place, which forbids the outer one. And on passage, the Mishnah Berurah: « דאין דריסת הרגל אוסר אלא עם עשיית תשמיש » (משנה ברורה שפ״א ס״ק י״ג).

One who forgot to join the shared eruv — in favor of whom does he renounce? Seif ב speaks of the eruv placed in the outer courtyard and of one of the inner one who forgot: he renounces in favor of each of the residents of both courtyards. The Beis Yosef: « אבל אם ביטל לבני החיצונה ולא לבני הפנימית עדיין פנימית באיסורה עומדת לפי שאין עירובה בחצירה » (בית יוסף או״ח שפ״א) — if he renounces only in favor of those of the outer one, the inner one remains forbidden, for its eruv is not in its courtyard. According to him, these cases follow from the one the Tur writes, and what needed to be taught in addition was this: « ולא איצטריך לאשמועינן אלא היכא דנתנו עירובן בפנימית ושכח א׳ מן החיצונה ולא עירב דפנימית מותרת משום דאחדא דשא ומשתמשת שהרי עירובה בחצירה ואמרה לחיצונה לתקוני שתפתיך ולא לעוותי » (בית יוסף או״ח שפ״א). The Tur: « אבל נתנו עירובן בפנימית ושכח אחד מן החיצונה אף ביטול אין צריכין » (טור או״ח שפ״א). (In the Tur's previous sentence, Sefaria's text has a variant in parentheses: « ושכח א׳ מן הפנימית (ס״א החיצונה) ולא עירב יכול לבטל רשותו » (טור או״ח שפ״א).)

The Mishnah Berurah: « ל״ד דה״ה דאם נתנו עירובן בפנימית ג״כ צריך הפנימי לבטל רשותו לשתי החצרות ולא סגי בשיבטל לפנימית לבד » (משנה ברורה שפ״א ס״ק י״ד); for « דכיון שהעוות בא מהם שהרי אחד מבני חצרם שכח לערב אי אפשר להם להסתלק מבני החיצונה אחרי שנתחברו מתחלה יחד ע״י עירוב אחד » (משנה ברורה שפ״א ס״ק י״ד) — the damage coming from them, since one of the residents of their courtyard forgot to make the eruv, they cannot withdraw from those of the outer one, with whom they joined from the start by one eruv.

The Biur Halachah, on one of the outer one who forgot: « וה״ה אם שכח אחד מבני החיצונה ג״כ בעינן שיבטל לשתי החצרות ולא סגי בשיבטל לבני החיצונה לבד ובני הפנימית יסתלקו מהם [כיון שאין העוות בא מהם] אחרי שהעירוב מונח בחיצונה » (ביאור הלכה שפ״א); « ואם העירוב מונח בפנימית יכולין בני הפנימי להסתלק מהם [אף שלא ביטל רשותו להם] » (ביאור הלכה שפ״א) — he distinguishes according to where the eruv is placed.

The Shulchan Aruch HaRav: « אֲבָל אִם שָׁכַח אֶחָד מִן הַחִיצוֹנָה וְלֹא עֵרֵב — אֵין צָרִיךְ לְבַטֵּל לְהַפְּנִימִית » (שו״ע הרב שפ״א:ב), because the inner one can say to the outer one: « לְתִקּוּנֵי שִׁתַּפְתִּיךָ עִמִּי וְלֹא לְעִוּוּתֵי » (שו״ע הרב שפ״א:ב). This reason is the one the Rav himself gives in siman 378 for an eruv placed in the inner one: « אֲבָל אִם שָׁכַח אֶחָד מִן הַחִיצוֹנָה וְלֹא עֵרֵב — חִיצוֹנָה אֲסוּרָה וּפְנִימִית מֻתֶּרֶת, דְּכֵיוָן שֶׁעֵרוּבָהּ אֶצְלָהּ » (שו״ע הרב שע״ח:ג) — the inner one is permitted, since its eruv is with it; and, for an eruv placed in the outer one, he writes there: « אֲבָל אִם נָתְנוּ עֵרוּבָן בַּחִיצוֹנָה, אֲפִלּוּ שָׁכַח אֶחָד מִן הַחִיצוֹנָה וְלֹא עֵרֵב — שְׁתֵּיהֶן אֲסוּרוֹת, שֶׁאַף אִם הַפְּנִימִית תְּסַלֵּק אֶת הַחִיצוֹנָה מֵעָלֶיהָ, הֲרֵי אֵין עֵרוּבָהּ אֶצְלָהּ » (שו״ע הרב שע״ח:ג) — both are forbidden: even if the inner one sets the outer aside, its eruv is not with it. The Mechaber distinguishes likewise in siman 378: « עירבו ביחד ונתנו עירובן בחיצונה ושכח א׳ בין מן הפנימי׳ בין מן החיצונה ולא עירב שתיהן אסורות עד שיבטל רשותו » (שו״ע או״ח שע״ח:ג); « ואם נתנו עירובן בפנימי׳ ושכח א׳ מן הפנימי׳ ולא עירב שתיהן אסורות אבל אם שכח א׳ מן החיצונה ולא עירב פנימית מותרת » (שו״ע או״ח שע״ח:ג). It is also the reason the Beis Yosef writes for an eruv placed in the inner one. To whom one of the outer renounces when the eruv is placed in the outer one, the Rav's seif does not write; the Beis Yosef and the Biur Halachah: to both courtyards (Level 4, point ד).

6. The ruin (seif ג)

The statements of Shmuel and of Rabbi Yochanan (section 5) also concern the ruin. The Gemara explains why both cases are needed: « דְּאִי אַשְׁמְעִינַן מֵחָצֵר לְחָצֵר, בְּהָא קָאָמַר שְׁמוּאֵל, מִשּׁוּם דְּהָא תַּשְׁמִישְׁתָּא לְחוּד וְהָא תַּשְׁמִישְׁתָּא לְחוּד. וְכִי אִתְּמַר בְּהָא, בְּהָא קָאָמַר רַבִּי יוֹחָנָן, אֲבָל בְּהָךְ מוֹדֵי לֵיהּ לִשְׁמוּאֵל, צְרִיכָא » (עירובין ס״ו ע״ב) — had we been taught only [the case] from one courtyard to another, [we would have said that] Shmuel says so there because the use of each is separate, but that, for a ruin, whose use is one for both, he concedes to Rabbi Yochanan; and had it been said of the ruin, [we would have said that] Rabbi Yochanan says so for it, but that in the other case he concedes to Shmuel. The Beis Yosef: « פלוגתא דשמואל ורבי יוחנן ופסקו כר׳ יוחנן » (בית יוסף או״ח שפ״א). The Rambam: « וְיֵשׁ בִּטּוּל רְשׁוּת בְּחֻרְבָּה כְּדֶרֶךְ שֶׁהוּא בְּחָצֵר » (הלכות עירובין פ״ב ה״ה).

Shared use, or main use. The Gemara considers that, for a ruin, Shmuel might concede, since its use is one for both. The commentators on the seif set aside a consideration that would point the other way. The Magen Avraham: « אף על פי שאין עיקר תשמישתייהו שם » (מגן אברהם שפ״א ס״ק ד). The Mishnah Berurah: « ולא אמרינן שלא הקילו חכמים בביטול רשות אלא בחצר שלפני הבתים שבה הוא עיקר תשמישם » (משנה ברורה שפ״א ס״ק י״ז). Putting the two considerations together is this page's doing.

For a ruin that belongs to both, the Mishnah Berurah refers to siman 376 (ס״ק י״ח). The Shulchan Aruch HaRav adds, in parentheses, with the same reference: « אוֹ שֶׁאֵינָהּ שֶׁל שְׁנֵיהֶם אֲבָל שְׁנֵיהֶם מִשְׁתַּמְּשִׁים בָּהּ בְּתַשְׁמִישׁ נוֹחַ » (שו״ע הרב שפ״א:ג).

7. From one house to another — Rashi's ruling and the Rema's gloss (seif ד)

Rashi, according to the Taz — on seif ד, the Taz writes that there is no going back here, in the Tur's terms (section 3), then: « ומ״ה כתבו התו׳ והרא״ש דמעשה בא לפני רש״י בחופה א׳ ששכחו ולא עירבו והוצרכו להוציא מבית זה לבית זה והתיר להם ע״י שביטלו רשותם לא׳ » (ט״ז או״ח שפ״א ס״ק ג) — Tosafos and the Rosh wrote that a case came before Rashi at a chupah: they had forgotten to make the eruv and needed to carry from one house to another, and he permitted it by having them renounce their domain in favor of one.

Is there renunciation from one house to another? The Beis Yosef reports from Tosafos that Rashi ruled so, and the Ri's objection: « דאם יועיל ביטול מבית לבי׳ א״כ יהיו כולם מותרים לטלטל מזו לזו גם אותם שביטלו להם » (בית יוסף או״ח שפ״א); « דא״כ בטלת תורת עירוב מאותו מבוי שלא יחושו לעשות עוד עירוב כיון דמשתרו כולהו בביטול » (בית יוסף או״ח שפ״א) — if renunciation were effective from one house to another, all would be permitted to carry from one to another, and people would no longer bother to make an eruv. The Ri proposes a way: « ומיהו אור״י דאם יש חדרים בבית יכול לבטל כל הבית בלא חדרים שיהא עכשיו אסור להוציא מן החדר לבית כמו מבית לחצר ואין שייך כאן בטלת תורת עירוב שהרי ישתכר בעירוב יותר מן הביטול » (בית יוסף או״ח שפ״א) — to renounce the house without its rooms, so that carrying from the room to the house is forbidden; one then gains more from an eruv than from renunciation. The quotation from Tosafos continues with an answer: « ונראה דאין מכאן ראיה לחלוק על הוראת רש״י דשפיר דמי דחוזר בו מביטולו כשנוטל כליו והכניס לתוך בית חבירו וחזר והחזיר לביתו שהוא רשות המיוחדת לו נראה כחוזר בו מביטולו וכיון שמפסיד בדבר לא ביטלת תורת עירוב » (בית יוסף או״ח שפ״א) — it is right to say that he goes back on his renunciation when he takes his objects, puts them into the other's house, and then brings them back to his own house, a domain that is his own; and since he loses by this, the law of eruv is not abolished.

He explains in this way the Tur's words that the one who renounces does not carry from the other's house to his own: « ומשום דאינו יכול להוציא מבית חבירו לביתו נמצא שנשתכר בעירוב מבביטול » (בית יוסף או״ח שפ״א); and he cites the Hagahos Maimonios: « והגהות מיימון כתבו סברות אלו בפ״ב מה״ע בשם סמ״ג וסמ״ק ונראה מדבריהם דליתא לדר״ת וכתבו דטוב לשייר חדר אחד שלא יבטל וכדברי ר״י » (בית יוסף או״ח שפ״א).

חקירה — why may the one who renounced not carry from the other's house to his own? The Magen Avraham, on the permission: « שהרי הכל של חבירו » (מגן אברהם שפ״א ס״ק ה); and on the prohibition: « דיחיד לגבי יחיד לא הוי אורח » (מגן אברהם שפ״א ס״ק ו). The Mishnah Berurah develops this reason: « התם מיירי ביחיד לגבי רבים וחשיב רק כאורח לגבייהו אבל הכא מיירי ביחיד לגבי יחיד ויחיד לגבי יחיד לא הוי אורח » (משנה ברורה שפ״א ס״ק כ״א) — in siman 380 it is an individual facing many, who counts only as a guest among them; here, an individual facing an individual, who is not a guest. And: « ולפ״ז אפילו אם החזיק זה שביטלו לו ג״כ אסור למבטל להוציא מביתו » (משנה ברורה שפ״א ס״ק כ״א) — even if the other took possession, it remains forbidden to the one who renounced.

The Biur Halachah comes back to what he wrote in the Mishnah Berurah: « עיין מ״ב מה שכתבנו בזה ונמשכנו אחרי דברי מג״א בזה » (ביאור הלכה שפ״א); « ויותר נראה בדבריהם דאפילו היה המבטל יחיד וביטל לרבים ג״כ אסור לו להוציא מרשותם לרשותו » (ביאור הלכה שפ״א); « שאני הכא דמיירי שלאחר ביטולו הוציא כליו והכניס לבית חבירו ואח״כ מוציאם ומכניסם שוב לרשותו כמקדם נראה כמי שרוצה לחזור ולזכות בביתו שביטל » (ביאור הלכה שפ״א) — it is bringing back home the objects he had put in the other's house that makes him appear to want to acquire his house again. These are, roughly, the terms of Tosafos' answer that the Beis Yosef reported above, and the Biur Halachah says so itself: « עיין בתוס׳ וברא״ש ובאו״ז שמדוקדק כן בדבריהם » (ביאור הלכה שפ״א).

The Shulchan Aruch HaRav writes the Magen Avraham's reason: « וַאֲפִלּוּ הֶחֱזִיק בּוֹ כְּבָר חֲבֵרוֹ — אֵינוֹ מוֹעִיל לְהַתִּיר גַּם לוֹ, כֵּיוָן שֶׁאֵינוֹ נַעֲשֶׂה כְּאוֹרֵחַ אֵצֶל חֲבֵרוֹ, מִפְּנֵי שֶׁהוּא יָחִיד אֵצֶל יָחִיד » (שו״ע הרב שפ״א:ה); see Level 4, section 1, seif 5.

The room open to his house. The Beis Yosef: « נראה דהיינו כשביטל רשות ביתו סתם אבל אם ביטל רשות ביתו ורשות חדרו בהדיא שרי להוציא אפילו מחדר לביתו » (בית יוסף או״ח שפ״א) — according to him, this applies only if he renounced his house without specifying; if he expressly renounced his house and his room, he may carry out even from the room into his house; and « ויותר נראה דלא אסר להוציא מהחדר אלא עד שיחזיקו בני החצר להוציא מבתיהם לחצר אבל אחר שהחזיקו יכול להוציא אפילו מחדרו » (בית יוסף או״ח שפ״א) — and it seems to him rather that the prohibition lasts only until the people of the courtyard have taken possession; afterwards, he may carry out even from his room. The Mishnah Berurah: « וה״ה מבית לחדרו מפני שהוא כמוציא מרשות לרשות » (משנה ברורה שפ״א ס״ק כ״ב); and « ועיין באחרונים שהעלו דאפילו אם ביטל גם רשות חדרו בהדיא אסור להוציא מאחד לחבירו דבזה הוא חוזר ומחזיק ברשותו » (משנה ברורה שפ״א ס״ק כ״ב).

The Shulchan Aruch HaRav writes the case of one who renounced his house without the room: « וּבִטֵּל רְשׁוּת בֵּיתוֹ בִּלְבָד בְּלִי הַחֶדֶר — אָסוּר לְהוֹצִיא מֵהַחֶדֶר לְבֵיתוֹ » (שו״ע הרב שפ״א:ה), and « וַאֲפִלּוּ הוּא יָחִיד אֵצֶל רַבִּים — אֵינוֹ נַעֲשֶׂה כְּאוֹרֵחַ אֶצְלָם לְעִנְיַן הוֹצָאָה וְהַכְנָסָה מֵחֶדֶר לְבַיִת » (שו״ע הרב שפ״א:ה). The Rav's text does not follow the Beis Yosef's second reading (level 4, section 2, point ה).

The Rema's gloss — at the end of seif ד: « וי״א דאין לבטל מבית לבית אלא אם כן ישאיר לעצמו חדר אחד שלא ביטל ואז מותר להכניס אפילו מבית חבירו לביתו וטוב להחמיר לכתחילה » (רמ״א או״ח שפ״א:ד), with its sources, as printed: « ב״י בשם רבינו ירוחם ור״ת והגהות מיימוני פ״ב מהלכות עירובין » (רמ״א או״ח שפ״א:ד). The Taz: « וי״א שמביא רמ״א הוא ר״י ור״ת שחלקו עליו דאין מועיל ביטול מבית לבית דא״כ יהי׳ מותר לטלטל לכולן ויבטל תור׳ עירוב כיון שיש תקנ׳ ע״י ביטול אא״כ ישאיר לעצמו חדר א׳ שלא ביטל » (ט״ז או״ח שפ״א ס״ק ג) — those whom the Rema cites under וי״א are the Ri and Rabbeinu Tam, who disputed [Rashi]: renunciation from one house to another would not be effective, for then all could carry and the law of eruv would be abolished, unless one keeps a room for oneself; and on the wording of the Rema that he had before him: « ומ״ש רמ״א ואף מות׳ להכניס צ״ל ואז מות׳ כו׳ » (ט״ז או״ח שפ״א ס״ק ג). This page reports these attributions as written; it does not reconcile them.

The Magen Avraham's question on « כ״כ הרב״י ודבריהם תמוהים דהא דומה למי שביטל רשות חצירו ליחיד דאסור להוציא מבית חבירו לחצר דנראה שחוזר ומחזיק דיחיד לגבי יחיד לא הוי אורח וכמ״ש סי׳ ש״פ ס״ד וא״כ ה״נ אסור » (מגן אברהם שפ״א ס״ק ז) — it is like one who renounced the domain of his courtyard in favor of an individual, who is forbidden to carry from the other's house to the courtyard, so here too it would be forbidden; and if it speaks of an individual renouncing in favor of many who made an eruv: « ואי מיירי ביחיד המבטל לרבים שעירבו א״כ אפי׳ לא שייר חדר נמי שרי דלא שייך לומר שתשתכח תורת עירוב » (מגן אברהם שפ״א ס״ק ז). The Mishnah Berurah gives the reason for the view: « לפי שיש לחוש שלא תשתכח תורת עירוב מבתים אלו הפתוחים זה לזה שכולם יבטלו בעליהם לאחד » (משנה ברורה שפ״א ס״ק כ״ג).

The Mishnah Berurah reports an answer: « ועיין בחמד משה שתירץ דדין זה דרמ״א מיירי ביחיד לגבי רבים אלא שאותן רבים היו דרים בבית אחד ולא היו צריכין לעירוב וזה ג״כ מקרי רבים וזה היחיד מקרי אורח לגבייהו ולכן מותר לו להכניס מביתם לביתו ואפילו קודם שהחזיקו » (משנה ברורה שפ״א ס״ק כ״ד) — the Rema's ruling would speak of an individual facing many who lived in one house; he is then a guest among them, and may bring [objects] in from their house to his own, even before they took possession. The Biur Halachah offers another reading: « אכן כבר כתבנו שם בשם האבן עוזר והפרישה דיחיד נגד יחיד מיקרי אורח » (ביאור הלכה שפ״א); « ולפ״ז אתי דברי רמ״א כפשוטו ולפלוגי אתי אדברי המחבר שאוסר להכניס ודעתו דיש להתיר אף הכנסה דהוי כאורח דיחיד לגבי יחיד מיקרי אורח » (ביאור הלכה שפ״א) — on this reading, the Rema comes to dispute the Mechaber and to permit bringing in as well. And he concludes: « וכן מצאתי להגר״א שכתב דדעה זו דאז מותר שמובא בהג״ה פליג אדעת המחבר » (ביאור הלכה שפ״א).

The Shulchan Aruch HaRav, just before reporting the view, writes himself, without attribution, following the case of one who renounced his house without the room: « אֲבָל יָכוֹל לְהַכְנִיס מִבָּתֵּיהֶם לְבֵיתוֹ אֲפִלּוּ קֹדֶם שֶׁהֶחֱזִיקוּ הֵם בְּבֵיתוֹ » (שו״ע הרב שפ״א:ה), comparing it to one who renounces the domain of his courtyard, who may carry out [objects] from their houses into the courtyard before they take possession; his terms are close to those of the Rema's gloss; the Chemed Moshe's answer (above) speaks of many who lived in one house and did not need an eruv, and says from their house, in the singular, where the Rav writes from their houses. He then reports the view without the words that then permit bringing in, and then: « וְהָעִקָּר כִּסְבָרָא הָרִאשׁוֹנָה, שֶׁהֲרֵי אַף אִם אֵינוֹ מַשְׁאִיר שׁוּם חֶדֶר — מִשְׂתַּכֵּר הוּא בָּעֵרוּב, שֶׁיְּהֵא מֻתָּר לוֹ לְהַכְנִיס לְבֵיתוֹ מִבֵּית חֲבֵרוֹ שֶׁבִּטֵּל לוֹ בֵּיתוֹ » (שו״ע הרב שפ״א:ה); « וְאַף עַל פִּי כֵן טוֹב לְהַחֲמִיר לְכַתְּחִלָּה לְהַשְׁאִיר חֶדֶר אֶחָד » (שו״ע הרב שפ״א:ה); see Level 4, point ה. The reason he gives for the first view — one who renounces without keeping a room still gains from an eruv — is the one the Beis Yosef writes in explaining the Tur (above).

8. Two houses enclosed by a partition on Shabbos (seif ה)

According to the view that accepts renunciation from one courtyard to another, it develops the question: « הָתָם, דְּאִי בָּעוּ לְעָרוֹבֵי מֵאֶתְמוֹל מָצוּ מְעָרְבִי — בַּטּוֹלֵי נָמֵי מָצֵי מְבַטֵּל — אֲבָל הָכָא, דְּלָא מָצוּ מְעָרְבִי מֵאֶתְמוֹל — בַּטּוֹלֵי נָמֵי לָא מָצֵי מְבַטֵּל. אֲמַר לֵיהּ: אֵין מְבַטְּלִין » (עירובין ס״ז ע״א) — there, had they wanted to make an eruv the day before, they could have, so one may renounce; here, they could not: can one not renounce either, or is there no difference? He answers him: one does not renounce. A baraisa, which the Gemara brings in connection with the heir (section 9), gives this case as an example of a general rule: « זֶה הַכְּלָל, כׇּל שֶׁמּוּתָּר לְמִקְצָת שַׁבָּת — הוּתַּר לְכׇל הַשַּׁבָּת, וְכׇל שֶׁנֶּאְסַר לְמִקְצָת שַׁבָּת — נֶאְסַר לְכׇל הַשַּׁבָּת חוּץ מִמְּבַטֵּל רְשׁוּת » (עירובין ע׳ ע״ב); « כׇּל שֶׁנֶּאְסַר לְמִקְצָת שַׁבָּת, נֶאְסַר לְכׇל הַשַּׁבָּת כּוּלָּהּ — כְּגוֹן שְׁנֵי בָתִּים בִּשְׁנֵי צִידֵּי רְשׁוּת הָרַבִּים, וְהִקִּיפוּם גּוֹיִם מְחִיצָה בְּשַׁבָּת » (עירובין ע׳ ע״ב).

The Magen Avraham: « כיון שלא היו יכולים לערב יחד מבע״י » (מגן אברהם שפ״א ס״ק ח). The Mishnah Berurah links this reason to the baraisa's rule: « כיון שנאסר למקצת השבת נאסר לכל השבת ולא מהני בטול » (משנה ברורה שפ״א ס״ק כ״ה).

The Shulchan Aruch HaRav sets the principle before the case: « הַבִּטּוּל הוּא בִּמְקוֹם עֵרוּב שֶׁמִּבְּעוֹד יוֹם.

9. The heir (seif ו)

אוֹ דִּלְמָא: יוֹרֵשׁ כַּרְעֵיהּ דַּאֲבוּהּ הוּא » (עירובין ע׳ ע״ב) — where one could have made an eruv the day before, one may also renounce; but this one could not: can he then not renounce? Or is the heir his father's leg? Rav Nachman answers: « אֲמַר לֵיהּ: אֲנִי אוֹמֵר מְבַטֵּל, וְהָנֵי דְּבֵי שְׁמוּאֵל תָּנוּ אֵין מְבַטֵּל » (עירובין ע׳ ע״ב).

The objections. The Gemara objects to Rav Nachman from the baraisa cited in section 8, whose exception speaks of one who renounces, and answers: « וְקָתָנֵי: חוּץ מִמְּבַטֵּל רְשׁוּת. It objects from the baraisa of a man from the market who died after nightfall and whom a resident of the courtyard inherits (siman 371, seif ג), and answers: « אַמַּאי אוֹסֵר? The discussion continues with another baraisa, that of the Jew and the convert, which siman 371 studies.

יסוד — the heir could not have made an eruv the day before, and yet he renounces. The Beis Yosef: « ופסק הרא״ש כר״נ וכן פסק הרמב״ם בפרק ב׳ מה״ע » (בית יוסף או״ח שפ״א). The Rambam: « וְהַיּוֹרֵשׁ מְבַטֵּל רְשׁוּת אַף עַל פִּי שֶׁמֵּת מוֹרִישׁוֹ בְּשַׁבָּת שֶׁהַיּוֹרֵשׁ קָם תַּחַת מוֹרִישׁוֹ לְכָל דָּבָר » (הלכות עירובין פ״ב ה״ב) — the heir stands in the place of the one he inherits from, in every respect. The Mishnah Berurah: « אף דאי בעי לערובי מאתמול לא מצי מערב אפ״ה מהני ביטולו משום דיורש כרעיה דאבוה הוא [ש״ס] » (משנה ברורה שפ״א ס״ק כ״ז).

The Shulchan Aruch HaRav opens this case with אֲבָל, after the principle he set for the Mechaber's seif ה (section 8), and writes: « הַיּוֹרֵשׁ — בִּמְקוֹם מוֹרִישׁוֹ הוּא עוֹמֵד, וַהֲרֵי מוֹרִישׁוֹ הָיָה יָכוֹל לְעָרֵב, לָכֵן יָכוֹל הוּא לְבַטֵּל » (שו״ע הרב שפ״א:ו); see Level 4, point ו.

The heir who does not come to live there. The Mishnah Berurah: « אבל אם לא היה בא לדור אינו אוסר על בני החצר דדירה בלא בעלים לא שמה דירה » (משנה ברורה שפ״א ס״ק כ״ו), with a reference to siman 371. The Beis Yosef, on the Tur's words and the heir lives in the courtyard and forbids: « ומ״ש והיורש דר בחצר ואוסר הוא ע״פ מה שנתבאר בסי׳ שע״א » (בית יוסף או״ח שפ״א).

10. Renouncing and renouncing in return — Rav and Shmuel (seif ז)

The Gemara reports that Rava wanted to renounce for a child whose hot water had spilled: « פַּנּוּ לִי מָאנֵי מִבֵּי גַבְרֵי לְבֵי נְשֵׁי, וְאֵיזִיל וְאִיתֵּיב הָתָם וְאֶיבַטֵּיל לְהוּ הָא חָצֵר » (עירובין ס״ח ע״א) — move my things from the men's house to the women's house; I will go and sit there and renounce this courtyard to them. Ravina objects with Shmuel's statement that there is no renunciation from one courtyard to another, and Rava answers: « אֲמַר לֵיהּ: אֲנָא כְּרַבִּי יוֹחָנָן סְבִירָא לִי, דְּאָמַר: יֵשׁ בִּיטּוּל מֵחָצֵר לְחָצֵר » (עירובין ס״ח ע״א). He is then asked why he does not stay in his place, renounce, and then receive their renunciation in return: « נִיתֵּיב מָר בְּדוּכְתֵּיהּ, וְנִיבַטֵּיל לְהוּ לְדִידְהוּ, וְנִיהְדְּרוּ אִינְהוּ וְנִיבַטְּלוּ לֵיהּ לְמָר, דְּהָא אָמַר רַב: מְבַטְּלִין, וְחוֹזְרִין וּמְבַטְּלִין » (עירובין ס״ח ע״ב). It is objected that this is the same reason: « מַאי טַעְמָא אֵין מְבַטְּלִין וְחוֹזְרִין וּמְבַטְּלִין — לָאו מִשּׁוּם דְּכֵיוָן דְּבַטְּלֵיהּ לִרְשׁוּתֵיהּ, אִסְתַּלַּק לֵיהּ מֵהָכָא לִגְמָרֵי, וְהָוֵה לֵיהּ כְּבֶן חָצֵר אַחֶרֶת, וְאֵין בִּיטּוּל רְשׁוּת מֵחָצֵר לְחָצֵר. מָר נָמֵי, לָא נִיבַטֵּיל » (עירובין ס״ח ע״ב) — one who renounced has withdrawn entirely and become like a resident of another courtyard; so the master too should not renounce. The answer: « הָתָם הַיְינוּ טַעְמָא: כִּי הֵיכִי דְּלָא לֶיהֱוֵי מִלְּתָא דְּרַבָּנַן כְּחוּכָא וְאִטְלוּלָא » (עירובין ס״ח ע״ב) — so that the words of the Sages should not become an object of ridicule.

Rav and Shmuel. « גּוּפָא, רַב אָמַר: מְבַטְּלִין וְחוֹזְרִין וּמְבַטְּלִין, וּשְׁמוּאֵל אָמַר: אֵין מְבַטְּלִין וְחוֹזְרִין וּמְבַטְּלִין » (עירובין ס״ח ע״ב). Rav can say it even according to Rabbi Eliezer: « אֲנָא דַּאֲמַרִי אֲפִילּוּ לְרַבִּי אֱלִיעֶזֶר: עַד כָּאן לָא קָאָמַר רַבִּי אֱלִיעֶזֶר הָתָם הַמְּבַטֵּל רְשׁוּת חֲצֵירוֹ — רְשׁוּת בֵּיתוֹ בִּיטֵּל, מִשּׁוּם דִּבְבַיִת בְּלָא חָצֵר לָא דָּיְירִי אִינָשֵׁי.

The Beis Yosef: « מחלוקת דרב ושמואל ופסקו הרי״ף והרא״ש והמרדכי וסמ״ג וסמ״ק כרב דאמר מבטלין וחוזרין ומבטלין וכן דעת הרמב״ם בפ״ב מה״ע » (בית יוסף או״ח שפ״א). The Rambam illustrates it with two who dwell in a courtyard, without an eruv: « שְׁנַיִם שֶׁשְּׁרוּיִים בֶּחָצֵר וְלֹא עֵרֵב.

Must one renounce in return when those who renounced also renounced their houses? The Beis Yosef: « ומשמע דהא דצריך לחזור ולבטל כשביטל רשותו סתם היא שאילו ביטל רשות ביתו בפי׳ שניהם מותרים בין בבית המבטל בין בבית שאר שכינים כמ״ש בסי׳ שקוד׳ זה ואינם צריכים לחזור ולבטל » (בית יוסף או״ח שפ״א) — it follows [ומשמע] that the obligation to renounce in return applies when he renounced his domain without specifying; had he explicitly renounced the domain of his house too, both would be permitted, in the renouncer's house as in that of the other neighbors, as he wrote in the preceding siman, and they would not need to renounce in return. The Magen Avraham: « כיון דרבים הם אפי׳ ביטלו ביתם אסורים להוציא לחצר כמ״ש סי׳ שפ״ד ס״ד דלא כב״י » (מגן אברהם שפ״א ס״ק ט). The Mishnah Berurah writes like the Magen Avraham: « אבל אם לא היו חוזרין ומבטלין להם לא היו מותרים המבטלים להוציא אפי׳ ביטלו גם רשות בתיהם הואיל והם רבים ואינם נעשים אורחים כמש״כ בסימן ש״פ [מ״א וש״א] » (משנה ברורה שפ״א ס״ק כ״ח).

The Shulchan Aruch HaRav writes likewise: « אֲבָל אִם לֹא הָיוּ חוֹזְרִים וּמְבַטְּלִים לָהֶם — לֹא הָיוּ מֻתָּרִים לְהוֹצִיא אֲפִלּוּ בִּטְּלוּ גַּם רְשׁוּת בָּתֵּיהֶם, הוֹאִיל וְהֵם רַבִּים וְאֵינָם נַעֲשִׂים אוֹרְחִים » (שו״ע הרב שפ״א:ז); and he specifies that the other courtyard is a courtyard « לִבְנֵי חָצֵר אַחֶרֶת שֶׁעֵרְבָה לְעַצְמָן » (שו״ע הרב שפ״א:ז); see Level 4, point ז.

11. Summary of the shitos and halachic conclusion

The foundation — the renunciation of the domain, set out in siman 380, extends here from one courtyard to another and to the ruin, following Rabbi Yochanan, and from one house to another, following Rashi's ruling; it has its limits (seif ה) and its form in return (seif ז):
