📜 The text of the Shulchan Aruch — 2 seifim

summary: the heading of the siman, then the seif. Two courtyards, and three houses between them, open to one another, and they wish to make the eruv together: [the people of] each courtyard pass through the house next to it and place their eruv in the middle house; they are permitted in all three. Each house next to the courtyard counts for it as a gatehouse [beis sha'ar], and need not give bread; the middle one is the house in which the eruv is placed, and need not give bread.

summary: two courtyards, and two houses between them; they did not make the eruv together, but each courtyard for itself. [The people of] each courtyard passed through the house next to it and placed their eruv in the house next to the other courtyard: they have not acquired the eruv, for each one placed the eruv in the gatehouse of another courtyard.

1. The sugya — the ten houses, Rav's statement and Rachava's question, in Eruvin 75b-76a

The source in the Gemara

The Beis Yosef connects seif א to a statement of Rav Nachman, « מימרא דר״נ » (בית יוסף או״ח שע״ט), and seif ב to a question that was resolved: « בעי׳ דאיפשיטא » (בית יוסף או״ח שע״ט).

Just before, the Gemara deals with ten houses, one inside the other. Rav Yehudah, in the name of Shmuel: « עֲשָׂרָה בָּתִּים זֶה לִפְנִים מִזֶּה, פְּנִימִי נוֹתֵן אֶת עֵירוּבוֹ, וְדַיּוֹ » (עירובין ע״ה ע״ב) — the innermost gives its eruv, and that suffices; Rabbi Yochanan: « וְרַבִּי יוֹחָנָן אָמַר: אֲפִילּוּ חִיצוֹן » (עירובין ע״ה ע״ב) — even the outer one [the Gemara specifies: the one just outside the innermost]; and their dispute is this: « מָר סָבַר: בֵּית שַׁעַר דְּיָחִיד שְׁמֵיהּ בֵּית שַׁעַר. וּמָר סָבַר: לָא שְׁמֵיהּ בֵּית שַׁעַר » (עירובין ע״ה ע״ב) — one master holds that the gatehouse of a single person is called a gatehouse, the other that it is not. Rashi, on Shmuel's statement, explains that the houses one passes through « כולן נעשין בית שער לו ואינן אוסרין על בני חצר אלא פנימי לבדו » (רש״י עירובין ע״ה ע״ב) — all become a gatehouse for the innermost, and do not forbid the people of the courtyard; only the innermost forbids. The Mechaber, for his part, like the Rambam (Hilchos Eruvin, chapter 4, halachah 9), writes that the two innermost give [their share], and not the innermost alone; he writes the case of the ten houses in siman ש״ע · 370: « עשרה בתים זה לפנים מזה וכולם עוברים זה לזה ויוצאים דרך החיצון לחצר שנים הפנימיים לבד צריכים ליתן בעירוב והשאר פטורים שחשובים כולם כבית שער » (שו״ע או״ח ש״ע:ז) — ten houses one inside the other, all passing from one to the next and going out to the courtyard through the outermost: the two innermost alone must give [their share] to the eruv, and the rest are exempt, for they all count as a gatehouse.

Then comes the statement of Rav Nachman, in the name of Rabbah bar Avuha, in the name of Rav: « שְׁתֵּי חֲצֵירוֹת וּשְׁלֹשָׁה בָּתִּים בֵּינֵיהֶן, זֶה בָּא דֶּרֶךְ זֶה, וְנוֹתֵן עֵירוּבוֹ בָּזֶה. וְזֶה בָּא דֶּרֶךְ זֶה, וְנוֹתֵן עֵירוּבוֹ בָּזֶה » (עירובין ע״ה ע״ב) — two courtyards and three houses between them: [the people of] one pass through this [house] and place their eruv in this one [the middle], and [those of] the other pass through that [house] and place their eruv in this one; « זֶה נַעֲשֶׂה בֵּית שַׁעַר לָזֶה, וְזֶה נַעֲשֶׂה בֵּית שַׁעַר לָזֶה » (עירובין ע״ו ע״א) — this one becomes a gatehouse for this one, and that one for that one; « אֶמְצָעִי הָוֵה לֵיהּ בַּיִת שֶׁמַּנִּיחִין בּוֹ עֵירוּב, וְאֵין צָרִיךְ לִיתֵּן אֶת הַפַּת » (עירובין ע״ו ע״א) — the middle one is the house in which the eruv is placed, and it need not give the bread. Rashi describes the layout: « בית זה פתוח לחצר זו וזה לזו ובית אמצעי פתוח לב׳ הבתים » (רש״י עירובין ע״ה ע״ב) — this house opens onto this courtyard, that one onto that one, and the middle house opens onto the two houses.

Then Rachava tested the Rabbanan: « בָּדֵיק לְהוּ רַחֲבָה לְרַבָּנַן: שְׁתֵּי חֲצֵרוֹת וּשְׁנֵי בָתִּים בֵּינֵיהֶם, זֶה בָּא דֶּרֶךְ זֶה וְנָתַן עֵירוּבוֹ בָּזֶה, וָזֶה בָּא דֶּרֶךְ זֶה וְנָתַן עֵירוּבוֹ בָּזֶה, קָנוּ עֵירוּב אוֹ לָא » (עירובין ע״ו ע״א) — two courtyards and two houses between them: [the people of] one pass through this [house] and place their eruv in that one, and [those of] the other likewise: have they acquired the eruv, or not? He sharpens his question: « מִי מְשַׁוֵּית לְהוּ לְגַבֵּי דְּהַאי בַּיִת, וּלְגַבֵּי דְּהַאי בֵּית שַׁעַר [וּלְגַבֵּי דְּהַאי בֵּית שַׁעַר, וּלְגַבֵּי דְּהַאי בַּיִת] » (עירובין ע״ו ע״א) — do you count it, with respect to the one, as a house, and with respect to the other as a gatehouse? (the reverse formulation is in brackets in the text Sefaria serves). They answered him: « שְׁנֵיהֶן לֹא קָנוּ עֵירוּב, מָה נַפְשָׁךְ: אִי בֵּית שַׁעַר מְשַׁוֵּית לֵיהּ, הַנּוֹתֵן אֶת עֵירוּבוֹ בְּבֵית שַׁעַר אַכְסַדְרָה וּמִרְפֶּסֶת — אֵינוֹ עֵירוּב » (עירובין ע״ו ע״א) — neither of them acquired the eruv, whichever way you take it: if you count it as a gatehouse, one who places his eruv in a gatehouse, a portico or a gallery — it is not an eruv; « אִי בַּיִת מְשַׁוֵּית לֵיהּ — קָא מְטַלְטֵל לְבַיִת דְּלָא מְעָרֵב לֵיהּ » (עירובין ע״ו ע״א) — if you count it as a house, he carries into a house that has not made the eruv with him.

The Gemara then raises a statement of Rava: « וּמַאי שְׁנָא מִדְּרָבָא? זֶה שֶׁעֵירַב עָלָיו מִבְּעוֹד יוֹם נֶאֱכַל עֵירוּבוֹ בֵּין הַשְּׁמָשׁוֹת, וְזֶה שֶׁעֵירַב עָלָיו בֵּין הַשְּׁמָשׁוֹת נֶאֱכַל עֵירוּבוֹ מִשֶּׁתֶּחְשַׁךְ — שְׁנֵיהֶם קָנוּ עֵירוּב » (עירובין ע״ו ע״א) — how is this different from [the ruling] of Rava? Two people told him: go, make the eruv for us; for one he made it by day, for the other bein hashmashos; the eruv of the first was eaten bein hashmashos, that of the second after nightfall: both acquired the eruv. And it answers: « הָכִי הַשְׁתָּא?! אִי לְגַבֵּי דְּהַאי בֵּית שַׁעַר, לְגַבֵּי דְּהַאי נָמֵי בֵּית שַׁעַר » (עירובין ע״ו ע״א) — is that comparable? there, doubt of day, doubt of night: the matter is not discernible; but here, if it is a house with respect to the one, it is a house with respect to the other; if it is a gatehouse with respect to the one, with respect to the other too it is a gatehouse.

Seif א takes up Rav's statement; seif ב, Rachava's question and the Rabbanan's answer — the answer only, with only one of the two branches of "whichever way you take it" (section 6). The Rambam writes the two cases one after the other (Hilchos Eruvin, chapter 4, halachos 10 and 11), right after the ten houses (halachah 9): see sections 2 and 6.

2. "And they are permitted in all three" — the gatehouse that does not forbid

The seif: « ב׳ חצירו׳ וג׳ בתים ביניהם פתוחים זה לזה ורוצים לערב יחד » (שו״ע או״ח שע״ט:א) — two courtyards, and three houses between them, [the houses being] open to one another, and [the people of the two courtyards] wish to make the eruv together; « חצר זה בא דרך בית שאצלו ונותן עירובו בבי׳ שבאמצע וכן עושה השניה ומותרים בשלשתן » (שו״ע או״ח שע״ט:א) — [the people of] this courtyard come through the house next to it and place their eruv in the middle house, and the second [courtyard] does likewise; and they are permitted in all three [houses].

The Mishnah Berurah (ס״ק א) — on "open to one another": « והם ג״כ פתוחים לחצרות שאצלן » (משנה ברורה שע״ט ס״ק א) — and they are also open to the courtyards next to them. The Rambam writes the case thus: « שְׁתֵּי חֲצֵרוֹת וּבֵינֵיהֶן שְׁלֹשָׁה בָּתִּים פְּתוּחִים זֶה לָזֶה וּפְתוּחִים לַחֲצֵרוֹת » (רמב״ם הלכות עירובין פ״ד ה״י) ; the Ritva too: « והבתי׳ הם פתוחי׳ זה לזה ופתוחי׳ לחצרות והם לתשמיש החצרות ושתי חצרות אלו באו לערב ביחד ונתנו עירובן באמצעית וכלה פשוטה היא » (ריטב״א עירובין ע״ה ע״ב) — the houses are open to one another and open to the courtyards, and they serve the use of the courtyards; these two courtyards came to make the eruv together and placed their eruv in the middle one, and all of it is simple. The Mishnah Berurah then says what the seif teaches: « וקמ״ל דאע״ג דבעלמא אם בית אחד אינו נותן חלק בעירוב הוא בעצמו אסור לטלטל וגם אוסר על בני החצר » (משנה ברורה שע״ט ס״ק א) — it teaches us that although elsewhere, if one house does not give its share in the eruv, it is itself forbidden to carry and also forbids the people of the courtyard, « הכא יצוייר ששום אחד מהשלשה לא יתנו חלק בעירוב ואפ״ה מותרים הכל לטלטל כגון אם יתנו בעלי שתי החצרות את עירובן בבית האמצעי ומטעם שמסיים » (משנה ברורה שע״ט ס״ק א) — here one can picture that none of the three gives its share in the eruv and yet everyone is permitted to carry, for example if the people of the two courtyards place their eruv in the middle house, and for the reason that [the seif] gives at the end.

The Mishnah Berurah explains ומותרים בשלשתן: « ר״ל שהם מותרים לטלטל באותן הבתים והבתים בהן אע״פ שלא נתנו חלק בעירוב » (משנה ברורה שע״ט ס״ק ב) — that is, they are permitted to carry in those houses, and [the people of the] houses in [the courtyards], even though they have not given a share in the eruv. Rashi had already written, on Rav's statement: « אין אחד מדיורי הבתים האלה צריך ליתן פת אלו משום בית שער ואמצעי משום בית שמניחין בו עירוב » (רש״י עירובין ע״ה ע״ב) — none of the residents of these houses need give bread: these, because of the gatehouse, and the middle one, because it is the house in which the eruv is placed.

יסוד — why does a gatehouse not forbid? The Mechaber writes it in siman ש״ע · 370: « הדר בבי׳ שער אכסדרה ומרפס׳ שבחצר אינו אוסר על בני החצר שאינם חשובים דירה » (שו״ע או״ח ש״ע:א) — one who lives in a gatehouse, a portico or a gallery of the courtyard does not forbid the people of the courtyard, for these do not count as a dwelling. The Shulchan Aruch of the Alter Rebbe gives there the reason of the gatehouse: « הַדָּר בְּבֵית שַׁעַר, אַף עַל פִּי שֶׁיֵּשׁ לוֹ ד׳ מְחִצּוֹת, כֵּיוָן שֶׁרַבִּים עוֹבְרִים דֶּרֶךְ שָׁם לְבָתֵּיהֶם — אֵין עָלָיו תּוֹרַת בַּיִת אֶלָּא תּוֹרַת חָצֵר » (שו״ע הרב ש״ע:א) — one who lives in a gatehouse, even though it has four walls, since many pass through it to their houses, it has not the status of a house but that of a courtyard; and, in the case of the ten houses [of which only the outer one opens onto the courtyard], on the third house from the inside: « בַּיִת הַשְּׁלִישִׁי מֵהַפְּנִים הוּא בֵּית שַׁעַר לְב׳ הַפְּנִימִים, וְנִקְרָא בֵּית שַׁעַר שֶׁל רַבִּים, וְאֵינוֹ חָשׁוּב דִּירָה כֵּיוָן שֶׁרַבִּים עוֹבְרִים עָלָיו. אֲבָל בַּיִת הַשֵּׁנִי אֵינוֹ בֵּית שַׁעַר אֶלָּא לְבַיִת אֶחָד הַפְּנִימִי מִמֶּנּוּ, וּבֵית שַׁעַר שֶׁל בַּיִת אֶחָד אֵינוֹ מִתְבַּטֵּל מִתּוֹרַת בַּיִת » (שו״ע הרב ש״ע:ח) — the third house from the inside is a gatehouse for the two inner [houses]; it is called a gatehouse of the many, and does not count as a dwelling, since many pass through it. But the second house is a gatehouse only for one house, the one inside it, and the gatehouse of a single house does not lose the status of a house. The Rambam, on the ten houses: « וְהַשְּׁמוֹנָה בָּתִּים הַחִיצוֹנִים אֵינָן נוֹתְנִין אֶת הָעֵרוּב הוֹאִיל וְרַבִּים דּוֹרְסִין בָּהֶן הֲרֵי הֵן כְּבֵית שַׁעַר וְהַדָּר בְּבֵית שַׁעַר אֵינוֹ אוֹסֵר. אֲבָל הַתְּשִׁיעִי אֵין דּוֹרְסִין בּוֹ רַבִּים אֶלָּא יָחִיד לְפִיכָךְ אוֹסֵר עַד שֶׁיִּתֵּן עֵרוּבוֹ » (רמב״ם הלכות עירובין פ״ד ה״ט) — the eight outer houses do not give the eruv, since many tread through them; they are like a gatehouse, and one who lives in a gatehouse does not forbid. But the ninth is not trodden by many, only by one: therefore it forbids, until it gives its eruv. Both texts set the limit at once: what is a gatehouse for one house only is not cancelled — for the Rav, it does not lose the status of a house; for the Rambam, it forbids until it gives its eruv. This is the rule of the two innermost houses, which the Mechaber also writes in siman ש״ע · 370, seif ז (section 1, where the Gemara discusses the gatehouse of a single person). The Rambam writes right after the case of the three houses, with its reason: « אוֹתָן הַשְּׁלֹשָׁה בָּתִּים אֵינָן צְרִיכִין לִתֵּן אֶת הַפַּת. הָאֶמְצָעִי מִפְּנֵי שֶׁהִנִּיחוּ בּוֹ הָעֵרוּב וְהַשְּׁנַיִם שֶׁמִּצְּדָדָיו מִפְּנֵי שֶׁכָּל אֶחָד מֵהֶן בֵּית שַׁעַר לְאַנְשֵׁי חָצֵר » (רמב״ם הלכות עירובין פ״ד ה״י) — these three houses need not give the bread: the middle one, because the eruv was placed in it; the two at its sides, because each of them is a gatehouse for the people of [the] courtyard. In our siman, the Rav writes: « כִּי שְׁנַיִם הַסְּמוּכִים לַחֲצֵרוֹת הֵם כְּבֵית שַׁעַר, וּבֵית שַׁעַר אֵינוֹ אוֹסֵר » (שו״ע הרב שע״ט:א) — for the two that adjoin the courtyards are like a gatehouse, and a gatehouse does not forbid.

3. The adjoining house and the passage through it — what Rashi, the seif and the Mishnah Berurah name

In seif א, each house next to the courtyard counts for it as a gatehouse (חשוב לו כבית שער); "becomes" (נעשה) is the word of the Gemara and of Rashi. The texts name the house that is next to the courtyard, and the passage through it:

On 76a, Rashi says for which courtyard each house becomes a gatehouse; on 75b, in a single sentence, he names the house open to [the man of the courtyard] and the passage through it. The seif too describes the passage — « חצר זה בא דרך בית שאצלו » (שו״ע או״ח שע״ט:א) — before writing « שכל בית שאצל החצר חשוב לו כבית שער » (שו״ע או״ח שע״ט:א); and the Rav writes both (section 8). In the case of the seif, the house next to the courtyard is also the one that is crossed.

For an eruv that is not placed in the middle house, Tosafos write: « נראה דאפי׳ יתנו העירוב באחד הבתים הסמוכים לחצירות או אפילו באחד מבתי החצירות אלו ג׳ בתים אין צריכין ליתן עירוב דנעשו כולם בית שער לאותה חצר המוליכה עירוב דרך עליהן לחצר אחרת » (תוספות עירובין ע״ו ע״א) — it seems that even if the eruv is placed in one of the houses next to the courtyards, or even in one of the houses of the courtyards [themselves], these three houses need not give eruv, for they all become a gatehouse for the courtyard that brings its eruv through them to the other courtyard. Their words name the passage: the courtyard « המוליכה עירוב דרך עליהן » (תוספות עירובין ע״ו ע״א) — which brings its eruv through them. Who reports this view, and how: section 4.

4. The middle house, and the eruv placed elsewhere

The seif: « והאמצעי הוא בית שמניחין בו עירוב וא״צ ליתן פת » (שו״ע או״ח שע״ט:א) — and the middle one is the house in which the eruv is placed, and need not give bread. The Rambam writes it in the general rule of the eruv of courtyards: « וּבַיִת שֶׁמַּנִּיחִין בּוֹ עֵרוּב אֵינוֹ צָרִיךְ לִתֵּן אֶת הַפַּת » (רמב״ם הלכות עירובין פ״א הט״ז) — the house in which the eruv is placed need not give the bread; and, in the same halachah: « אֲבָל אִם נָתְנוּ בְּבֵית שַׁעַר אֲפִלּוּ בֵּית שַׁעַר שֶׁל יָחִיד אוֹ בְּאַכְסַדְרָה אוֹ בְּמִרְפֶּסֶת אוֹ בְּבַיִת שֶׁאֵין בּוֹ אַרְבַּע אַמּוֹת עַל אַרְבַּע אַמּוֹת אֵינוֹ עֵרוּב » (רמב״ם הלכות עירובין פ״א הט״ז) — but if it was placed in a gatehouse, even the gatehouse of a single person, or in a portico, or in a gallery, or in a house that does not have four amos by four amos, it is not an eruv. The Mechaber writes both rules in siman שס״ו: « הבית שמניחים בו העירוב א״צ ליתן פת » (שו״ע או״ח שס״ו:ג) — the house in which the eruv is placed need not give bread; « ואין מניחין אותו בחצר אלא בבית שראוי לדיר׳ לאפוקי בית שער אכסדר׳ ומרפסת » (שו״ע או״ח שס״ו:ג) — it is not placed in the courtyard, but in a house fit for dwelling, which excludes the gatehouse, the portico and the gallery. The same seif carries a gloss of the Rema: « והמנהג בזמן הזה להניח העירוב בבית הכנסת וכן נהגו הקדמונים ונראה לי הטעם דעירובין שלנו יש להם דין שתוף ואין צריך להניח בבית דירה וע׳ לקמן סי׳ שפ״ו ושפ״ז » (רמ״א או״ח שס״ו:ג) — the custom, in his time, is to place the eruv in the synagogue, and so did the early authorities; and it seems to me that the reason is that our eruvin have the status of shituf, and it need not be placed in a dwelling house; and see below, simanim 386 and 387. The Rema gives this reason as his own ("it seems to me"). The Shulchan Aruch HaRav reports the same custom: « וְהַמִּנְהָג בִּזְמַן הַזֶּה לְהַנִּיחַ הָעֵרוּב בְּבֵית הַכְּנֶסֶת, אַף עַל פִּי שֶׁבֵּית הַכְּנֶסֶת אֵינוֹ רָאוּי לְדִירָה מִפְּנֵי קְדֻשָּׁתוֹ » (שו״ע הרב שס״ו:ו) — the custom, in his time, is to place the eruv in the synagogue, although the synagogue is not fit for dwelling, because of its sanctity: the Rav writes this himself. He also writes: « וּמְקוֹמוֹת שֶׁאֵין לָהֶם לֶחִי אוֹ קוֹרָה לִמְבוֹאוֹתֵיהֶם, אוֹ שֶׁבֵּית הַכְּנֶסֶת אֵינוֹ בְּמָבוֹי הַמְּתֻקָּן בְּלֶחִי אוֹ קוֹרָה, שֶׁאֵין מַנִּיחִים שָׁם עֵרוּב בְּבֵית הַכְּנֶסֶת, כְּמוֹ שֶׁנִּתְבָּאֵר בְּסִמָּן שס״ה » (שו״ע הרב שס״ו:ו) — places whose mavo'os have neither a lechi nor a korah, or whose synagogue is not in a mavoy fixed with a lechi or a korah, where the eruv is not placed in the synagogue, as explained in siman 365. This clause describes those places and refers, for the rule, to siman 365; the Rav's sentence goes on with a permission: « אַף עַל פִּי כֵן מֻתָּרִים לְטַלְטֵל בְּבֵית הַכְּנֶסֶת… » (שו״ע הרב שס״ו:ו) — nevertheless, one may carry in the synagogue. On our siman, the Eliyah Rabbah, commenting on the Levush, writes in the name of the Perishah: « מכאן יש סתירה למנהג קצת מקומות שנתנו עירובין בבית הכנסת ובתי כותים הם מפסיקן ביניהם ובין העירוב ואין יכולין לטלטל לבית הכנסת למקום עירוב » (אליה רבה שע״ט ס״ק ב) — from here there is a contradiction to the custom of some places that placed the eruvin in the synagogue while houses of Kutim [non-Jews] interpose between them and the eruv, and they cannot carry to the synagogue, the place of the eruv. What this custom changes in the case of seif ב of our siman, this page does not decide: consult your Rav. Our seif writes the words וא״צ ליתן פת twice, after the houses next to the courtyards and then after the middle one; Sefaria places the marker of ס״ק ד before the first occurrence. On these words, the Mishnah Berurah refers: « כמבואר בסימן שס״ו ס״ב » (משנה ברורה שע״ט ס״ק ד) ; in the text of the Shulchan Aruch that Sefaria serves, the law of the house in which the eruv is placed is found in seif ג of siman שס״ו. Which of the two occurrences this ס״ק addresses, this page does not decide.

The view of Tosafos — the eruv placed in a house next to a courtyard, or in a house of the courtyards, without the three houses having to give bread (section 3) — is reported, among others, by the Magen Avraham, the Mishnah Berurah and the Rav, each in its own form:

The Magen Avraham (ס״ק א) — on the words of the seif "in the middle house", in the name of Tosafos: « והתוס׳ כתבו דאפי׳ נתנו העירוב באחד מבתים הסמוכים לחצירות או באחד מבתי החצר אלו הג׳ בתים א״צ ליתן עירוב דנעשו כלם בית שער לאותה חצר המולכת עירוב דרך עליהם לחצר אחרת » (מגן אברהם שע״ט ס״ק א) — Tosafos wrote that even if the eruv was placed in one of the houses next to the courtyards, or in one of the houses of the courtyard, these three houses need not give eruv, for they all become a gatehouse for the courtyard that brings its eruv through them to the other courtyard.
The Mishnah Berurah (ס״ק ג) — after the reason of the passage (section 3): « ויש שכתבו דה״ה אם נתנו שניהם העירוב באחד מבתים הסמוכים לחצרות או באחד משאר בתים שבשתי החצרות אלו השלשה בתים אין צריכין ליתן עירוב דנעשו כולם בית שער לאותה חצר כיון שעוברים דרך עליהם להניח העירוב בה » (משנה ברורה שע״ט ס״ק ג) — some have written that the same applies if both [courtyards] placed the eruv in one of the houses next to the courtyards, or in one of the other houses of the two courtyards: these three houses need not give eruv, for they all become a gatehouse for that courtyard, since one passes through them to place the eruv there.
The Shulchan Aruch of the Alter Rebbe (379:1) — after the rule of the middle house, which he writes without attribution: « וְיֵשׁ אוֹמְרִים שֶׁאֲפִלּוּ נָתְנוּ עֵרוּב בְּאֶחָד מִבָּתִּים הַסְּמוּכִים לַחֲצֵרוֹת, אוֹ אֲפִלּוּ בְּאֶחָד מִבָּתֵּי הַחֲצֵרוֹת עַצְמָן » (שו״ע הרב שע״ט:א) — « אֵין ג׳ בָּתִּים אֵלּוּ צְרִיכִים לִתֵּן פַּת, לְפִי שֶׁנַּעֲשׂוּ כֻלָּם כְּבֵית שַׁעַר לְאוֹתָהּ חָצֵר הַמּוֹלֶכֶת עֵרוּבָהּ דֶּרֶךְ עֲלֵיהֶם לְחָצֵר הָאַחֶרֶת » (שו״ע הרב שע״ט:א) — some say that even if the eruv was given in one of the houses adjoining the courtyards, or even in one of the houses of the courtyards themselves, these three houses need not give bread, because they have all become like a gatehouse for the courtyard that brings its eruv through them to the other courtyard.

Tosafos write "it seems"; the Magen Avraham reports the view in their name, without discussing it; the Mishnah Berurah introduces it with "some have written", the Rav with "some say". The Mechaber, the Tur and the Rambam write only the case of the middle house. This page does not say how the Mishnah Berurah or the Rav rule, nor whether one may rely on this view: the question is put to the Rav.

5. Seif ב — a house for one courtyard, a gatehouse for the other? Rachava's question

The seif: « שני חצירו׳ ושני בתים ביניהם ולא עירבו יחד אלא כל אחת לעצמה » (שו״ע או״ח שע״ט:ב) ; « ובא מן חצר זה דרך בית שאצלו והניח עירובו בבי׳ שאצל השני וכן עשה השני » (שו״ע או״ח שע״ט:ב) , « שגם הוא הניח עירובו בבית הסמוך לחצר האחר׳ » (שו״ע או״ח שע״ט:ב) ; « לא קנו עירוב שכל א׳ הניח עירוב בבי׳ שער של חצר אחרת » (שו״ע או״ח שע״ט:ב) — two courtyards, and two houses between them, and they did not make the eruv together, but each for itself; [one] came from this courtyard through the house next to it and placed his eruv in the house next to the second [courtyard], and the second [the one of the second courtyard] did likewise — he too placed his eruv in the house adjoining the other courtyard: they have not acquired the eruv, for each placed the eruv in the gatehouse of another courtyard.

Rashi describes Rachava's case thus: « ואין בני שתי החצירות רוצין לערב זו עם זו אלא כל אחת לעצמה וכל חצר לא הניחה עירובה בבית הפתוח לה אלא עשאתו בית שער והניח עירובה בבית הפתוח לחברתה » (רש״י עירובין ע״ו ע״א) — the people of the two courtyards do not wish to make the eruv with each other, but each for itself; and each courtyard did not place its eruv in the house open to it, but made it a gatehouse, and placed its eruv in the house open to the other. The Ritva: « הא מיירי בשערבה כל חצר לעצמה ויש לכל אחת זכות בבתים ההם שפתוחי׳ להו כל אחת מהן נותנה העירוב בבית הסמוך לחברת׳ ועוש׳ מן הבית הסמוך לה בית שער » (ריטב״א עירובין ע״ה ע״ב) — here it speaks of the case where each courtyard made the eruv for itself, and each has a right in those houses that open to them; each places the eruv in the house next to the other, and makes the house next to itself a gatehouse.

חקירה — is the status of a house said with respect to each courtyard, so that the same house would be a gatehouse for one and a house for the other, or is it one? This is Rachava's question, which Rashi explains thus: « לכל בית לגבי חצר הסמוכה לו כבית שער שלא לאסור עליו וגבי חצר האחרת שעשאתו בית גמור והניח בו עירובה משוינן לה כי בית למיקני עירובה » (רש״י עירובין ע״ו ע״א) — do we count each house, with respect to the courtyard next to it, as a gatehouse, so that it does not forbid it; and with respect to the other courtyard, which made it a full house and placed its eruv in it, do we count it as a house, so that it acquires its eruv?

The Gemara answers no: "if it is a house with respect to the one, it is a house with respect to the other" (section 1). The seif does not report the question; it writes its conclusion, לא קנו עירוב.

6. "Whichever way you take it" — one reason in the seif, two in the Tur

The Gemara reasons מָה נַפְשָׁךְ — whichever way you take it (section 1). Rashi explains both branches. The first: « ודאי אי תרוייהו בית שער משוינן אין אחד מהן עירוב » (רש״י עירובין ע״ו ע״א) — certainly, if we count both as gatehouses, neither is an eruv. The second: « ואי תרוייהו בית גמור. אין אחד מהן עירוב שהרי בית זה מפסיק בין חצר לעירובה והוא לא עירב עמה ואינה יכולה להביא עירובה לתוכה דרך בית זה » (רש״י עירובין ע״ו ע״א) — and if both are full houses, neither is an eruv, for this house interposes between the courtyard and its eruv; it did not make the eruv with it, and [the courtyard] cannot bring its eruv into it through this house. And on "he carries": « קא מטלטל - כל חצר בבית דלא מערב ליה » (רש״י עירובין ע״ו ע״א) — each courtyard, in a house that did not make the eruv with it. The Ritva: « ובודאי כל שאתה עושה אותו בית אסור לטלטל ולהכניס ולהוציא לשם שהרי לא ערבו אותו » (ריטב״א עירובין ע״ה ע״ב) — certainly, any [house] you count as a house, it is forbidden to carry, to bring in and to take out [objects] there, since they did not make the eruv with it; « ואם אתה אומר לזה שהביא הסמוכ׳ לא נידונית כבית נמצא שערובו רחוק ממנו שהרי הבית האסו׳ מפסיק בינו ובין עירובו וא״א לו להביאו אצלו » (ריטב״א עירובין ע״ה ע״ב) — and if you say, of the one who brought [his eruv], that the adjoining one is not judged as a house, it turns out that his eruv is far from him, for the forbidden house interposes between him and his eruv, and he cannot bring it to himself.

The Tur writes the second case with both branches: « ובא חצר זה דרך בית שאצלו והניח עירובו בבית שאצל החצר השני וכן עשה השני לא קנו עירוב » (טור או״ח שע״ט) ; « שאם נחשוב ב׳ הבתים כבית שער הרי נתנו עירובן בבית שער ואינו עירוב » (טור או״ח שע״ט) — for if we count the two houses as gatehouses, they placed their eruv in a gatehouse, and it is not an eruv; « ואם נחשוב אותם כבית גמור הרי כל החצר מפסיק בית בינו ובין הבית שנתן בו עירובו » (טור או״ח שע״ט) — and if we count them as full houses, then, [for] each courtyard, a house interposes between him and the house in which he placed his eruv. Rashi and the Ritva say it in so many words: it is the house that interposes. The Magen Avraham reports this second branch with a reference to the Tur: « ואם נחשוב אותו כבית גמור א״כ כל חצר מפסיק בינו ובין הבית שנתן שם עירובו » (מגן אברהם שע״ט ס״ק ב) ; in the text Sefaria serves, the word בית that follows מפסיק in the Tur does not appear there.

The Mechaber's seif ב writes only the first branch, and almost in the Rambam's words: « שְׁתֵּיהֶן לֹא קָנוּ עֵרוּב. שֶׁכָּל אֶחָד מֵהֶן הִנִּיחַ עֵרוּבוֹ בְּבֵית שַׁעַר שֶׁל חָצֵר אַחֶרֶת » (רמב״ם הלכות עירובין פ״ד הי״א) — neither of them acquired the eruv, for each placed its eruv in the gatehouse of another courtyard. Its opening, for its part, takes up the Tur's, with a few words of difference; and its words « שגם הוא הניח עירובו בבית הסמוך לחצר האחר׳ » (שו״ע או״ח שע״ט:ב) are not in the Tur: they are in the Beis Yosef's explanation of "and the second did likewise": « ומ״ש וכן עשה השני כלומר שגם הוא הניח עירובו בבית הסמוך לחצר אחרת » (בית יוסף או״ח שע״ט). The seif thus brings together the words of the Tur, the Beis Yosef's explanation and the Rambam's reason. This page notes this composition; it does not say why the Mechaber wrote only one branch of the reasoning.

7. The comparison with Rava — the rabbinic doubt, and the houses "that stand before us"

Why not count the house as a gatehouse for one and as a house for the other, when Rava counts the same moment as night for one and as day for the other (section 1)? Rashi explains Rava's ruling: « אלמא משום דבין השמשות ספק הוא וספק דדבריהם להקל ועירוב מדבריהם הוא » (רש״י עירובין ע״ו ע״א) — it follows that, since bein hashmashos is a doubt, and a doubt in their words [of the Sages] is treated leniently, and the eruv is of their words, « לגבי האי שנאכל עירובו בין השמשות משוינן ליה ליליא ואמרינן כבר קנה עירוב ולגבי האי שעירב עליו בין השמשות משוינן ליה יום ועדיין הוה לו שהות לקנות שביתה » (רש״י עירובין ע״ו ע״א) — with respect to the one whose eruv was eaten bein hashmashos, we count it as night, and say that he has already acquired the eruv; with respect to the one for whom the eruv was made bein hashmashos, we count it as day, and he still had time to acquire his Shabbos place.

The Gemara's answer — "there, the matter is not discernible" (section 1) — Rashi explains: « ולא הוו מילי דרבנן כי חוכא ואיטלולא אבל הנך בתים הא קיימי קמן ואי משוינן הכא הכי והכא הכי הויין מילי דרבנן כי חוכא ואיטלולא ולא ניתן פה לצדוקים לרדות » (רש״י עירובין ע״ו ע״א) — [there,] the words of the Sages are not like a mockery; but these houses stand before us, and if we counted [the house] here one way and there another, the words of the Sages would be like a mockery, and one does not give the Sadducees an opening. The Magen Avraham raises the same question on seif ב; he asks why one does not apply here the rule « קי״ל ספיק׳ דרבנן לקולא אי׳ היכא דסתרי אהדדי » (מגן אברהם שע״ט ס״ק ב) — we hold that a rabbinic doubt is treated leniently, [even] where [the two assumptions] contradict each other —, referring, in the text served by Sefaria, to siman 353, seif ג (בסי׳ שנ״ג ס״ג); but that seif of the Shulchan Aruch deals with ledges projecting over the public domain, not with a rabbinic doubt, and Rava's rule is in siman 393, seif ג (below); this page does not correct Sefaria's reading. He answers, signing (גמרא): « התם לא מנכר׳ מלתא הכא קיימי הנך בתים קמן ואי משוי לה להאי חצר בית ולהאי בית שער א״כ הוי כי חוכא ואטלולא » (מגן אברהם שע״ט ס״ק ב) — there, the matter is not discernible; here, these houses stand before us, and if one made it a house for this courtyard and a gatehouse for that one, it would be like a mockery. The words "like a mockery" are not in the Gemara that Sefaria serves: they are in Rashi's explanation.

Which eruv does Rava speak of?

The Mechaber, in siman שצ״ג — he writes Rava's ruling, with its double way of counting: « עירב לשנים לאחד מבעוד יום ונאכל העירוב בין השמשו׳ ולא׳ עירב בין השמשות שניהם קנו עירוב שלאותו שנאכל עירובו בין השמשו׳ אנו חושבין אותו לילה ולאותו שהניח עירובו בין השמשו׳ חושבים אותו יום אבל אם עירב עליו בין השמשו׳ ונאכל עירובו בין השמשו׳ אסור » (שו״ע או״ח שצ״ג:ג) — [if] one made the eruv for two, for one by day, and his eruv was eaten bein hashmashos, and for the other bein hashmashos, both acquired the eruv: for the one whose eruv was eaten bein hashmashos we count [that moment] as night, and for the one who placed his eruv bein hashmashos we count it as day; but if the eruv was made for him bein hashmashos and his eruv was eaten bein hashmashos, it is forbidden. This is the double way of counting that the Gemara refuses for the houses of seif ב, because there the matter is visible.

8. Summary of the shitos and halachic conclusion

The foundation — Rav's statement and Rachava's question in Eruvin 75b-76a, which the Rishonim and Acharonim read as follows:

For halachah lema'aseh, consult your Rav; the custom of the community also counts.

The Shulchan Aruch of the Alter Rebbe — he too counts two seifim for this siman, divided like the Mechaber's. In seif 1, he writes the passage through the adjoining house: « וְעוֹשֶׂה אֶת בַּיִת הַפָּתוּחַ לַחֲצֵרוֹ כְּבֵית שַׁעַר לַחֲצֵרוֹ לַעֲבוֹר דֶּרֶךְ עָלָיו לְהָאֶמְצָעִי » (שו״ע הרב שע״ט:א) — and he makes the house open to his courtyard like a gatehouse of his courtyard, to pass through it to the middle one; he also writes that the two houses adjoining the courtyards are like a gatehouse, which does not forbid (section 2); and he reports the view of Tosafos under "some say" (section 4). In seif 2, he writes the precision that Rashi gives of the case (section 5): « וְכָל חָצֵר לֹא נָתְנָה עֵרוּבָהּ בַּבַּיִת הַפָּתוּחַ לָהּ אֶלָּא עֲשָׂאַתּוּ בֵּית שַׁעַר » (שו״ע הרב שע״ט:ב) — and each courtyard did not give its eruv in the house open to it, but made it a gatehouse; and, like the Mechaber and the Rambam, he gives only the first branch: « לֹא קָנוּ עֵרוּב, שֶׁכָּל אֶחָד הִנִּיחַ עֵרוּבוֹ בְּבֵית שַׁעַר שֶׁל חָצֵר אַחֶרֶת, וְאֵינוֹ עֵרוּב, כְּמוֹ שֶׁנִּתְבָּאֵר בְּסִמָּן שס״ו » (שו״ע הרב שע״ט:ב) — they have not acquired the eruv, for each placed his eruv in the gatehouse of another courtyard, and it is not an eruv, as was explained in siman 366. The comparison of his text with the Mechaber's is at Level 4.
