summary: heading of the siman, then seif א. A non-Jew who enters to lodge in passing: if he entered without permission, he never forbids; if he entered with permission: if he is accustomed to come, he forbids at once; if he is not accustomed, he forbids only after thirty days.

summary: the men of the king's army who entered the houses of the Jews, whether by force or willingly: if the householders have, in those places the non-Jews entered, objects that may not be moved on Shabbos, they do not forbid [carrying] to [the householders].

1. The Yerushalmi: accustomed or not, with or without permission (seif א)

The Tur writes the rule in these words: « כותי הנכנס בחצר לשם אכסנאות אם נכנס שלא ברשות אינו אוסר לעולם ואם נכנס ברשות אם הוא רגיל לבא אוסר מיד ואם אינו רגיל אינו אוסר עד לאחר ל׳ יום » (טור או״ח שפ״ד) — a non-Jew who enters the courtyard to lodge in passing: if he entered without permission, he never forbids; if he entered with permission: if he is accustomed to come, he forbids at once; if he is not accustomed, he forbids only after thirty days. The Beis Yosef gives its source: « ירוש׳ כתבוה התוס׳ והרא״ש בפ׳ הדר » (בית יוסף או״ח שפ״ד) — [it is] a Yerushalmi; Tosafos and the Rosh wrote it in the chapter Ha-dar; and he adds: « ולא נזכר זה בדברי הרמב״ם » (בית יוסף או״ח שפ״ד) — this is not mentioned in the words of the Rambam.

The text of the Yerushalmi — the Beis Yosef copies it within the Rashba's responsum that he brings for seif ב (sections 4 and 5): « אית תניי תני. הקוסטור אוסר מיד ואכסניא לאחר ל׳ יום אית תניי תני הקוסטור אוסר לאחר ל׳ יום ואכסניא אינו אוסר לעולם » (בית יוסף או״ח שפ״ד) — some [Tannaim] teach: the קוסטור forbids at once, and the lodger (אכסניא) after thirty days; some teach: the קוסטור forbids after thirty days, and the lodger never forbids. The Yerushalmi reconciles: « מאן דמר הקוסטור אוסר מיד ברגיל ואכסניא לאחר ל׳ יום בשאינו רגיל ומאן דמר הקוסטור לאחר ל׳ יום באילין דעאלין ברשות ואכסניא אינו אוסר לעולם באילין דעאלו בלא רשות » (בית יוסף או״ח שפ״ד) — the one who says “the קוסטור forbids at once” [speaks] of one who is accustomed, and “the lodger, after thirty days”, of one who is not; the one who says “the קוסטור, after thirty days” [speaks] of those who enter with permission, and “the lodger never forbids”, of those who enter without permission.

Seif א carries these two distinctions: with or without permission, accustomed or not.

2. “Entered with permission”: the room, the debt, the habit (seif א)

The Mishnah Berurah — on “to lodge in passing”: « ר״ל שלא נכנס לשם לקבוע שם דירתו אלא לפי שעה להתאכסן שם » (משנה ברורה שפ״ד ס״ק א) — he did not enter to fix his dwelling there, but for a time, to lodge there. On “without permission”: « לאו דוקא אלא ר״ל שלא נכנס ברשות » (משנה ברורה שפ״ד ס״ק ב) — not to be taken literally: it means he did not enter with permission. On “with permission”: « ר״ל שהשאילו או השכירו חדר מיוחד להתאכסן שם » (משנה ברורה שפ״ד ס״ק ג) — they lent or rented him a room set aside for lodging there.
The Shulchan Aruch HaRav — for “with permission”, he writes: « שֶׁהִשְׂכִּירוּ אוֹ הִשְׁאִילוּ לוֹ חֶדֶר מְיֻחָד לַאֲכִילָה » (שו״ע הרב שפ״ד:א) — that they rented or lent him a room set aside for eating (Level 4, point א).

The non-Jew who holds a debt on the house. The Magen Avraham: « נ״ל דעכו״ם שיש לו חוב על הבית מקרי ברשות ועיין בח״מ סי׳ רל״ו עסי׳ שפ״ב סט״ו עססי׳ ש״ע » (מגן אברהם שפ״ד ס״ק א) — it seems to me (נ״ל) that a non-Jew who holds a debt on the house is called [entered] with permission; and see Choshen Mishpat, siman 236, siman 382 and the end of siman 370. The Mishnah Berurah brings it and adds: « כתב מג״א דעכו״ם שיש לו חוב על הבית ונכנס שלא ברשות בעד חובו מיקרי ברשות ואוסר ויש מקילין בזה » (משנה ברורה שפ״ד ס״ק ג) — the Magen Avraham wrote that a non-Jew who holds a debt on the house, and entered without permission on account of his debt, is called [entered] with permission, and forbids; and some are lenient in this. The Shulchan Aruch HaRav writes, in his seif, that the non-Jew who holds a debt on the house is called “entered with permission” (Level 4, point א).

The Mishnah Berurah — on “accustomed to come”: « היינו שרגיל לבוא תמיד להתאכסן שם ועי״ז חשוב כקבוע וצריך לשכור ממנו הרשות » (משנה ברורה שפ״ד ס״ק ד) — he always comes to lodge there; he is thereby counted as fixed, and one must rent his right from him. On “after thirty days”: « דעד זמן זה חשוב כאורח ואינו אוסר וכמו לעיל בס״ס ש״ע וע״ש מה שכתבתי בבה״ל » (משנה ברורה שפ״ד ס״ק ה) — until that time he counts as a guest and does not forbid, as above at the end of siman 370; and see there what [the author] wrote in the Biur Halachah.

3. The guest who is merely received, and the house rented to a non-Jew (seif א)

The Biur Halachah, on “he forbids only after thirty days”: « וכמו גבי אכסנאי ישראל לעיל בסוף סימן ש״ע ומיירי הכא ג״כ כמו התם ששאל או ששכר ממנו המקום להתאכסן דאם נתארח אצלו בעלמא מבלי שאלה או שכירות בודאי אינו אוסר לעולם מדיכול לסלוקי בכל עת ובכל שעה » (ביאור הלכה שפ״ד) — as with the Jewish lodger above at the end of siman 370; and here too, as there, it speaks of one who borrowed or rented the place from him to lodge in; for if he is merely received as a guest, without a loan or rental, he certainly never forbids, since one can send him away at any time and any hour.

The question of the Acharonim. « והקשו האחרונים דהא לעיל בריש סי׳ שפ״ב מבואר בהג״ה דישראל שהשכיר או השאיל ביתו לעכו״ם אינו אוסר עליו דלא השאיל לו אדעת דליאסר הרי דמקילינן גבי עכו״ם ואמרינן דלא השאיל לו וכו׳ אף שהיה בשאלה או בשכירות גמורה וכ״ש הכא גבי אכסנאות בעלמא » (ביאור הלכה שפ״ד) — the Acharonim asked: above, at the beginning of siman 382, it is explained in the gloss [of the Rema] that a Jew who rented or lent his house to a non-Jew, [the non-Jew] does not forbid him, for he did not lend it to him with the intention of being forbidden; so we are lenient with a non-Jew and say that he did not lend it to him, etc., even when there was a full loan or rental — all the more so here, for a mere lodging in passing.

The Chemed Moshe: « ותירץ בעל חמד משה דמיירי הכא שאין בעה״ב בביתו דלא שייך לומר שלא השאיל לו אדעתא דליאסר [והתירוץ הזה נסתר מתשובת הרמב״ם המיוחסת להרשב״א סימן ר״כ עי״ש בראש התשובה] » (ביאור הלכה שפ״ד) — here it speaks of a case where the householder is not in his house, where one cannot say that he did not lend it with the intention of being forbidden [and this answer is contradicted by the responsum of the Rambam attributed to the Rashba, siman 220; see there, at the beginning of the responsum].

The Gaon Rav Zalman (הגר״ז): « והגר״ז תי׳ דלא מקילינן גבי עכו״ם אלא בשהיה השאלה או השכירות לזמן מרובה דאין סברא שיאסור עליו זמן רב חצירו בשביל העכו״ם משא״כ הכא דאינו אלא אכסנאי לחודש ימים או מעט יותר בזה לא מקילינן כלל גבי עכו״ם טפי מבאורח ישראל » (ביאור הלכה שפ״ד) — we are lenient with a non-Jew only when the loan or rental is for a long time, for it is not reasonable that his courtyard be forbidden to him for a long time because of the non-Jew; which is not so here, where he is only a lodger for a month or a little more: here we are in no way more lenient with a non-Jew than with a Jewish guest. The Shulchan Aruch HaRav writes, at the end of his seif: « וְכָל זֶה בְּאַכְסְנָאִים, שֶׁאֵינָם קְבוּעִים שָׁם. אֲבָל הַמַּשְׂכִּיר בֵּיתוֹ לְנָכְרִי לָדוּר בּוֹ בִּקְבִיעוּת שָׁנָה אוֹ שְׁנָתַיִם — אֵינוֹ אוֹסֵר בְּכָל עִנְיָן, שֶׁבְּוַדַּאי לֹא הִשְׂכִּיר לוֹ בֵּיתוֹ עַל דַּעַת שֶׁיֶּאֱסֹר עָלָיו בִּקְבִיעוּת כָּל הַשָּׁנָה כֻלָּהּ » (שו״ע הרב שפ״ד:א) — all this concerns lodgers, who are not established there; but one who rents his house to a non-Jew to live in it permanently, a year or two: [the non-Jew] does not forbid [the landlord] in any case, since he certainly did not rent him his house so that he would impose a prohibition on him on a fixed basis, the whole year (Level 4, point ג).

The Vilna Gaon: « אבל דעת הגר״א בסי׳ שפ״ב דלא מקילינן כלל בנכרי טפי מבישראל והא דמקילינן בסי׳ שפ״ב לאו משום דשוכר עכו״ם הוא דאפילו אם היה שוכר ישראל נמי לא היה אוסר דמיירי התם בשהיה לו רשות למשכיר או למשאיל לסלוקיה בכל עת שירצה » (ביאור הלכה שפ״ד) — the view of the Vilna Gaon, in siman 382, is that we are in no way more lenient with a non-Jew than with a Jew; the leniency of siman 382 is not because the tenant is a non-Jew, for even a Jewish tenant would not forbid: it speaks there of a case where the one who rents or lends has the right to send him away whenever he wishes.

The Biur Halachah then discusses these answers and proposes another, following the Eliyah Rabbah; then he concludes: « ומ״מ לדינא צ״ע אם יש להקל בלא יכול לסלוקי מאחר שמדברי הרמב״ם מוכח דלא ס״ל האי דינא וכמו שהבאנו בסי׳ שפ״ב ס״א בשער הציון בשם ס׳ בית מאיר » (ביאור הלכה שפ״ד) — nevertheless, for the halachah, it requires examination (צ״ע) whether one may be lenient when one cannot send him away, since the words of the Rambam prove (מוכח) that he does not hold this rule, as he brought in siman 382, seif 1, in the Sha'ar HaTziyun, in the name of the Beis Meir.

4. The source of seif ב: the Rashba's responsum and tefisas yad (seif ב)

The Beis Yosef brings the source of seif ב: « השיב הרשב״א על שר א׳ ששלחו המלך עם פרשים לשמור העיר והפרשים נכנסו בבתי היהודים מהם בחזקה ומהם ברצון הבעלים דכיון שיש לבעלי בתים באותן המקומות שנכנסו הכותים כלים שאסור לטלטלם בשבת אינם אוסרים עליהם דקי״ל כר׳ יהודה דאמר אם יש שם תפיסת יד של בע״ה אינו אוסר » (בית יוסף או״ח שפ״ד) — the Rashba answered, concerning an officer whom the king had sent with horsemen to guard the city, the horsemen having entered the houses of the Jews, some by force and some with the owners' consent: since the householders have, in those places the non-Jews entered, objects that may not be moved on Shabbos, they do not forbid them; for we hold like Rabbi Yehudah, who says: if there is a tefisas yad of the householder there, [the occupant] does not forbid.

The Mishnah of Rabbi Yehudah. « בֵּית הַתֶּבֶן וּבֵית הַבָּקָר וּבֵית הָעֵצִים וּבֵית הָאוֹצָרוֹת — הֲרֵי זֶה עֵירוּב, וְהַדָּר שָׁם — אוֹסֵר. רַבִּי יְהוּדָה אוֹמֵר: אִם יֵשׁ שָׁם תְּפִיסַת יָד שֶׁל בַּעַל הַבַּיִת — אֵינוֹ אוֹסֵר » (עירובין פ״ה ע״ב) — the straw shed, the cattle shed, the wood shed and the storehouse: [an eruv placed there] is an eruv, and one who lives there forbids; Rabbi Yehudah says: if there is a tefisas yad of the householder there, he does not forbid. Rashi: « והדר שם - אם השאיל בעל הבית בית התבן שלו לאחר לדור שם אוסר עליו בחצר הואיל ופתוח לחצר » (רש״י עירובין פ״ה ע״ב) — if the householder lent his straw shed to another to live in, [that one] forbids him [carrying] in the courtyard, since it opens onto the courtyard; « אם יש שם תפיסת יד של בעל הבית - שיש לבעל הבית מקום בדירתו של זה שנותן שם כליו להצניע: אינו אוסר עליו - דכל רשותא דחצר דידיה הוא כאילו דר עמו בבית » (רש״י עירובין פ״ה ע״ב) — the householder has a place in this one's dwelling where he puts his objects away; [the occupant] does not forbid him, for the whole domain of the courtyard is [the householder's]: it is as if he lived with him in the house.

The Gemara asks: « הֵיכִי דָּמֵי תְּפִיסַת יָד? כְּגוֹן חֲצֵירוֹ שֶׁל בּוֹנְיָיס » (עירובין פ״ה ע״ב) — what is tefisas yad like? For example, the courtyard of Bunyas. דָּבָר שֶׁאֵינוֹ נִיטָּל בְּשַׁבָּת — אֵינוֹ אוֹסֵר » (עירובין פ״ו ע״א) — Rabbah bar bar Chanah says: for example, the peg of a plough. Rav Nachman says, it was taught in the school of Shmuel: an object that is taken on Shabbos, [the occupant] forbids; an object that is not taken on Shabbos, he does not forbid. Rashi: « דבר הניטל בשבת - אינו תפיסת יד ואוסר דאי בעי שקיל ושדי ליה לבראי » (רש״י עירובין פ״ו ע״א) — an object that is taken on Shabbos is not tefisas yad, and [the occupant] forbids, for if one wished, one would take it and throw it outside.

Seif ב and the Shulchan Aruch HaRav — seif ב writes « כלים שאסור לטלטלם בשבת » (שו״ע או״ח שפ״ד:ב); the Shulchan Aruch HaRav writes « כֵּלִים שֶׁאֵינָם נִטָּלִים בְּשַׁבָּת » (שו״ע הרב שפ״ד:א) (Level 4, point ב).

5. The soldiers who entered by force (seif ב)

Seif ב writes « בין בחזקה בין ברצון » (שו״ע או״ח שפ״ד:ב) — by force or willingly; seif א writes « אם נכנס שלא ברשות אינו אוסר לעולם » (שו״ע או״ח שפ״ד:א) — if he entered without permission, he never forbids.

The Rashba, in the Beis Yosef — after the rule of the objects: « והנכנסים בלא רשות אע״פ שלא נשאר בבית שום דבר לישראל נראה מהירושלמי שאינו אוסר » (בית יוסף או״ח שפ״ד) — those who enter without permission, even if nothing of the Jew remains in the house, it appears from the Yerushalmi that [they] do not forbid; he cites the Yerushalmi (section 1), and ends: « ונראה דהלכה כמאן דמיקל דקי״ל הלכה כדברי המיקל בעירוב עכ״ל » (בית יוסף או״ח שפ״ד) — and it seems that the halachah follows the one who is lenient, for we hold that the halachah follows the lenient view in matters of eruv; end of quotation.

The Magen Avraham: « צ״ע דבס״א כ׳ דשלא ברשות אינו אוסר ואפשר דס״ל דחיל המלך כברשות דמי דדינא דמלכותא דינא וכמ״ש רסי׳ ת״מ » (מגן אברהם שפ״ד ס״ק ב) — this requires examination, for in seif א he writes that one who [enters] without permission does not forbid; it is possible that he holds that the king's army is like [having entered] with permission, for the law of the kingdom is the law, as written at the beginning of siman 440; « אבל ברשב״א משמע דחיל המלך שוה לשאר עכו״ם עבב״י וצ״ע » (מגן אברהם שפ״ד ס״ק ב) — but from the Rashba it appears that the king's army is like other non-Jews; see the Beis Yosef; and it requires examination; « ועכ״פ אינן אוסרים פחות מל׳ יום אם אין רגילין לבוא ואם יש לישראל רשות להניח כלים בחדרם אין אוסרים עסי׳ שפ״ב סי׳ י״ח » (מגן אברהם שפ״ד ס״ק ב) — in any case, they do not forbid before thirty days if they are not accustomed to come; and if the Jew has the right to put objects in their room, they do not forbid; see siman 382, seif 18.

The Mishnah Berurah: « הקשו המפרשים דהא בסעיף א׳ מבואר דשלא ברשות אינו אוסר כלל ותירצו דמיירי שמתאכסנים ע״פ דינא דמלכותא כמו שנהוג כשאנשי חיילים באים לעיר הפקידים קובעים מקומות בעד החיל בבתי העיר » (משנה ברורה שפ״ד ס״ק ו) — the commentators asked that in seif א it is explained that one who [enters] without permission does not forbid at all; they answered that it speaks [of a case where] they lodge according to the law of the kingdom, as is the custom when soldiers come to a town: the officials fix places for the troops in the houses of the town; « ובזה אפי׳ לא נתרצה הבעה״ב נמי אוסר דהפקיד יש לו רשות ע״ז מן המלכות וכנכנס ברשות דמי » (משנה ברורה שפ״ד ס״ק ו) — then, even if the householder did not consent, [the soldier] also forbids, for the official has the right to this from the kingdom, and it is like entering with permission; « ואם משנה הפקיד מחוק שנתן המלך והוא עושה בחזקה הרי הוא כשאר עכו״ם ואינו אוסר » (משנה ברורה שפ״ד ס״ק ו) — and if the official departs from the law the king gave and acts by force, [the soldier] is like other non-Jews, and does not forbid; « ובספר משכנות יעקב סי׳ קי״ב חולק לגמרי על פסק המחבר ודעתו דלגבי אנשי חיל תמיד ברשות בעלים קיימא ושמן עליו ובכל גווני אינו אוסר » (משנה ברורה שפ״ד ס״ק ו) — and the Mishkenos Yaakov, siman 112, disputes the Mechaber's psak entirely: in his view, as regards soldiers, [the place] always remains in the owners' domain, they were assigned to him (ושמן עליו), and in every case [the soldier] does not forbid.

The Shulchan Aruch HaRav writes « מֵהֶם בְּחָזְקָה וּמֵהֶם בְּרָצוֹן » (שו״ע הרב שפ״ד:א) — some by force and some willingly; and, when the householders have no objects in those rooms: « וְאִם לָאו — אוֹסְרִים בַּחֲצֵרוֹת שֶׁנִּכְנְסוּ בָּהֶן בִּרְשׁוּת לְאַחַר ל׳ יוֹם, אַף עַל פִּי שֶׁאֵינָם רְגִילִים לָבֹא שָׁם. אֲבָל הַנִּכְנָסִים בְּחָזְקָה אֵינָם אוֹסְרִים לְעוֹלָם » (שו״ע הרב שפ״ד:א) — otherwise, they forbid, in the courtyards they entered with permission, after thirty days, even if they are not accustomed to come there; but those who enter by force never forbid (Level 4, point ב).

This page does not decide between these texts; consult your Rav.

6. The householder's objects: which ones, and if there are none (seif ב)

The Taz's question. « זהו מתשו׳ הרשב״א הביאו ב״י ותמה אני דדברי הרשב״א סתרי אהדדי » (ט״ז או״ח שפ״ד ס״ק א) — this is from a responsum of the Rashba, brought by the Beis Yosef; and I wonder: the words of the Rashba contradict each other; « דהא כ׳ המ״מ בפ״ב מה״ע משמו הביאו ב״י ורמ״א סי׳ שפ״ב ס״א דאם השאיל לו או השכיר ביתו לעכו״ם אינו אוסר דלא השאיל לו אדעתא דליאסר עליו » (ט״ז או״ח שפ״ד ס״ק א) — for the Maggid Mishneh, in chapter 2 of the laws of eruvin, writes in his name — the Beis Yosef and the Rema bring it in siman 382, seif 1 — that if one lent or rented his house to a non-Jew, [the non-Jew] does not forbid, for he did not lend it to him with the intention of being forbidden; « א״כ הכא אמאי יאסרו אנשי חיל עליו כל שאין לבעלי בתים כלים שם וצ״ע רב » (ט״ז או״ח שפ״ד ס״ק א) — if so, why here should the soldiers forbid him, as long as the householders have no objects there? This requires much examination (וצ״ע רב).

Must the objects be precisely ones that may not be moved? The Biur Halachah, on these words: « הקשו המפרשים מסי׳ שפ״ב סי״ח דמבואר שם דכל שיש לו רשות להניח שום כלי ג״כ סגי » (ביאור הלכה שפ״ד) — the commentators asked from siman 382, seif 18, where it is explained that as soon as he has the right to put down any object, that too suffices; « וכתב א״ר דהתם שאני דעי״ז הוי כשכירו ולקיטו משא״כ הכא דהוא הבעה״ב ולשווייה לעכו״ם כאורח בעינן דוקא שיהיו שם כלים שאסורים לטלטל וכדלעיל בסי׳ ש״ע ס״ב » (ביאור הלכה שפ״ד) — the Eliyah Rabbah wrote that there it is different: through this he is like his hired worker and laborer (כשכירו ולקיטו); whereas here [the Jew] is the householder, and to make the non-Jew a guest, there must be precisely objects there that may not be moved, as above, siman 370, seif 2; « וכן הסכים בח״א וגם הגר״ז העתיק כהשו״ע אך מהמ״א משמע דהוא מצדד להקל בזה במש״כ ואם יש לישראל רשות וכו׳ וכן הבין הח״א את דבריו » (ביאור הלכה שפ״ד) — and so the Chayei Adam agreed, and the Gaon Rav Zalman too copied as the Shulchan Aruch; but from the Magen Avraham it appears that he leans toward leniency in this, by what he writes “and if the Jew has the right…”, and so the Chayei Adam understood his words; « אכן לפ״ז הי״ל להמ״א לחלוק על השו״ע ולא לכתוב סתם » (ביאור הלכה שפ״ד) — however, on this reading, the Magen Avraham should have disputed the Shulchan Aruch, and not written without qualification; « וע״כ נלפענ״ד דדברי המגן אברהם קאי רק אדלעיל כשנכנס בחזקה » (ביאור הלכה שפ״ד) — therefore it seems to me, in my humble opinion, that the words of the Magen Avraham refer only to what precedes, when he entered by force; « וע״ז הכריע שאף אם נחמיר בזה עכ״פ בשיש לו רשות להישראל להניח כלים בחדרם [אף כלים שמותר לטלטלם] אין להחמיר בזה יותר מהמבואר בסימן שפ״ב סי״ח » (ביאור הלכה שפ״ד) — and on this he decided that, even if we are stringent in this, at least when the Jew has the right to put objects in their room [even objects that may be moved], we are not more stringent than what is explained in siman 382, seif 18; « מ״מ אף אם המג״א לא כוון להקל בזה יש להסתפק למעשה מאחר שהמאמר מרדכי כתב להקל בזה וכן בפמ״ג נשאר בזה בצ״ע וכן בבית מאיר מחלק בזה איזה חילוקים עיי״ש וא״כ אפשר דיש להקל בשעת הדחק » (ביאור הלכה שפ״ד) — nevertheless, even if the Magen Avraham did not intend to be lenient in this, there is room for doubt in practice, since the Maamar Mordechai wrote to be lenient in this, the Pri Megadim remained with a צ״ע, and the Beis Meir makes some distinctions in it — see there; so it is possible to be lenient in a case of pressing need.

The Mishnah Berurah — on “they do not forbid”: « דתו הו״ל האי עכו״ם אצלו רק כאורח לפי שעה וכדלעיל בסי׳ ש״ע ס״ב » (משנה ברורה שפ״ד ס״ק ח) — this non-Jew is then, for him, only a guest for a time, as above, siman 370, seif 2.
Without tefisas yad — the Mishnah Berurah, on “upon them”: « אבל אם אין לו תפיסת יד אוסר אם שהה יותר מלמ״ד יום אם אינו רגיל וכנ״ל » (משנה ברורה שפ״ד ס״ק ט) — but if he has no tefisas yad, [the non-Jew] forbids if he stayed there more than thirty days, when he is not accustomed, as above. The Biur Halachah, on “they do not forbid them”: « אבל בלא תפיסת יד אוסר ודוקא בלא יכול לסלוקי אבל ביכול לסלוקי בכל גווני אינו אוסר [מביאור הגר״א] » (ביאור הלכה שפ״ד) — but without tefisas yad, [the non-Jew] forbids, and only when one cannot send him away; if one can send him away, he does not forbid in any case [from the Biur of the Vilna Gaon].

7. Summary of the shitos and halachic conclusion

The foundation — seif א comes from the Yerushalmi of the chapter Ha-dar, which Tosafos and the Rosh wrote, according to the Beis Yosef; seif ב comes from a responsum of the Rashba, which relies on Rabbi Yehudah and tefisas yad (Eruvin 85b):
