📜 The text of the Shulchan Aruch — 4 seifim

summary: heading of the siman, then seif א. The Tzeduki is like a Jew and renounces his domain; but the eruv does not help [with him], since he does not acknowledge the eruv.

summary: the Kuti is like the other non-Jews, and he has no remedy except through renting.

summary: a Jew who is a mumar for idolatry, or for desecrating Shabbos in public — even if he desecrates it only through a rabbinic prohibition — is like a non-Jew; if he desecrates it only in private, even through a Torah prohibition, he is like a Jew and renounces his domain.

summary: a Jew who converted [to another religion] and had houses in the Jewish quarter, whose residents made the eruv for the whole year: if he has no other opening at all, he forbids every Shabbos that falls after he converted; if he has another opening to the non-Jewish quarter, even a small opening he was not used to from the start, he is pushed toward the opening that leads to the non-Jewish quarter.

1. The Mishnah and the Gemara: the Tzeduki and Rabban Gamliel (seif א)

The Mishnah in chapter הדר: « הַדָּר עִם הַנׇּכְרִי בֶּחָצֵר, אוֹ עִם מִי שֶׁאֵינוֹ מוֹדֶה בָּעֵירוּב — הֲרֵי זֶה אוֹסֵר עָלָיו » (עירובין ס״א ע״ב) — one who lives in a courtyard with a non-Jew, or with someone who does not acknowledge the eruv, that person forbids [carrying] to him. It continues with the view of Rabbi Eliezer ben Yaakov: « רַבִּי אֱלִיעֶזֶר בֶּן יַעֲקֹב אוֹמֵר: לְעוֹלָם אֵינוֹ אוֹסֵר עַד שֶׁיְּהוּ שְׁנֵי יִשְׂרְאֵלִים אוֹסְרִין זֶה עַל זֶה » (עירובין ס״א ע״ב) — he never forbids until there are two Israelites who forbid one another; for the non-Jew, see the Shulchan Aruch, siman 382, seif א. It then brings Rabban Gamliel's account: « אָמַר רַבָּן גַּמְלִיאֵל: מַעֲשֶׂה בְּצַדּוּקִי אֶחָד שֶׁהָיָה דָּר עִמָּנוּ בְּמָבוֹי בִּירוּשָׁלַיִם, וְאָמַר לָנוּ אַבָּא: מַהֲרוּ וְהוֹצִיאוּ אֶת הַכֵּלִים לַמָּבוֹי, עַד שֶׁלֹּא יוֹצִיא וְיֶאֱסֹר עֲלֵיכֶם » (עירובין ס״א ע״ב) — there was a Tzeduki who lived with us in a mavoi in Jerusalem, and my father told us: hurry and take the utensils out into the mavoi, before he takes something out and forbids it to you.

The Gemara asks why the Mishnah mentions the Tzeduki, and answers that words are missing: « צַדּוּקִי מַאן דְּכַר שְׁמֵיהּ? חַסּוֹרֵי מִיחַסְּרָא וְהָכִי קָתָנֵי: צַדּוּקִי הֲרֵי הוּא כְּגוֹי, וְרַבָּן גַּמְלִיאֵל אוֹמֵר: צַדּוּקִי אֵינוֹ כְּגוֹי » (עירובין ס״ח ע״ב) — and this is what it teaches: the Tzeduki is like a non-Jew; and Rabban Gamliel says: the Tzeduki is not like a non-Jew. Rashi explains "like a non-Jew": « הרי הוא כנכרי - דאינו יכול לבטל בלא שכירות » (רש״י עירובין ס״ח ע״ב) — he cannot renounce without renting.

The Beis Yosef — on the ruling: « וכתב המרדכי דהלכה דצדוקי הרי הוא כעו״ג והרא״ש כתב שר״מ פסק דצדוקי הרי הוא כעו״ג והוא דחה ראיותיו ופסק כר״ג דצדוקי אינו כעו״ג וכן דעת הרמב״ם בספ״ב מה״ע » (בית יוסף או״ח שפ״ה) — the Mordechai writes that the halachah is that the Tzeduki is like a non-Jew; the Rosh writes that ר״מ ruled that the Tzeduki is like a non-Jew, and he rejected his proofs and ruled like Rabban Gamliel, that the Tzeduki is not like a non-Jew; and this is the view of the Rambam, at the end of chapter 2 of the laws of eruv.

Seif א writes « צדוקי הרי הוא כישראל ומבטל רשות אבל עירוב אינו מועיל כיון שאינו מודה בעירוב » (שו״ע או״ח שפ״ה:א) — the Tzeduki is like a Jew and renounces his domain; but the eruv does not help [with him], since he does not acknowledge the eruv (section 2).

2. The Tzeduki and the eruv: the Rambam and the Tur (seif א)

The Rambam — on those who do not acknowledge the eruv: « אֲבָל אִם הָיָה מִן הָאֶפִּיקוֹרוֹסִין שֶׁאֵין עוֹבְדִין עֲבוֹדַת כּוֹכָבִים וּמַזָּלוֹת וְאֵין מְחַלְּלִין שַׁבָּת כְּגוֹן צְדוֹקִין וּבַיְתוֹסִין וְכָל הַכּוֹפְרִים בַּתּוֹרָה שֶׁבְּעַל פֶּה, כְּלָלוֹ שֶׁל דָּבָר כָּל מִי שֶׁאֵינוֹ מוֹדֶה בְּמִצְוַת עֵרוּב, אֵין מְעָרְבִין עִמּוֹ לְפִי שֶׁאֵינוֹ מוֹדֶה בָּעֵרוּב » (הלכות עירובין פ״ב הט״ז) — if he was one of the heretics who are not idolaters and do not desecrate Shabbos, such as the Tzedukim, the Baysusim and all who deny the Oral Torah — as a general rule, anyone who does not acknowledge the mitzvah of eruv —, one does not make an eruv with him, since he does not acknowledge the eruv. אֲבָל מְבַטֵּל הוּא רְשׁוּתוֹ לְיִשְׂרָאֵל הַכָּשֵׁר וְזוֹ הִיא תַּקָּנָתוֹ » (הלכות עירובין פ״ב הט״ז) — and one does not rent from him, since he is not like an idolater; rather he renounces his domain to the proper Jew, and that is his remedy.
The Tur — « צדוקי הרי הוא כישראל ומבטל רשות אבל לערב כתב הרמב״ם ז״ל שאינו יכול כיון שאינו מוד׳ בעירוב » (טור או״ח שפ״ה) — the Tzeduki is like a Jew and renounces his domain; but as for making an eruv, the Rambam writes that he cannot, since he does not acknowledge the eruv. The Tur attributes the second half of the rule to the Rambam.

The Mishnah Berurah explains "the eruv does not help": « ר״ל אף אם נתן חלק בעירוב אינו מועיל ואוסר עליהן עד שיבטל רשותו להן ולאו דוקא מכת הצדוקים וכה״ג שאינם מודים בתורה שבע״פ ה״ה אם רק אינו מודה במצות עירוב אינו יכול ליתן חלק בעירוב » (משנה ברורה שפ״ה ס״ק ב) — even if he gave a share in the eruv, it does not help, and he forbids them until he renounces his domain to them; and this applies not only to the sect of the Tzedukim and the like who do not acknowledge the Oral Torah: likewise one who merely does not acknowledge the mitzvah of eruv cannot give a share in the eruv.

The Shulchan Aruch HaRav (seif 1 in its numbering) writes: « וְאֵין צָרִיךְ לִשְׂכּוֹר מֵהֶם כְּדֵי לְהַרְחִיק דִּירָתוֹ מֵהֶם, הוֹאִיל וְהֵם שׁוֹמְרֵי שַׁבָּת וְאֵינָם עוֹבְדִים אֱלִילִים. אֲבָל עֵרוּב שֶׁלָּהֶם אֵינוֹ מוֹעִיל, כֵּיוָן שֶׁאֵינָם מוֹדִים בְּעֵרוּב » (שו״ע הרב שפ״ה:א) — one need not rent from them in order to distance his dwelling from them, since they keep Shabbos and are not idolaters; but their eruv does not help, since they do not acknowledge the eruv. See Level 4, point א.

3. The Kuti (seif ב)

Seif ב writes of the Kuti « ואין לו תקנה אלא בשכירות » (שו״ע או״ח שפ״ה:ב) — he has no remedy except through renting. The Tur writes: « וכותי הרי הוא כעו״ג וצריך להשכיר » (טור או״ח שפ״ה) — the Kuti is like a non-Jew, and he must rent out [his domain]. The Beis Yosef: « ומ״ש רבינו וכותי הרי הוא כעו״ג וצריך להשכיר כך פשוט בריש חולין (ו » (בית יוסף או״ח שפ״ה) — what our master [the Tur] writes is plain at the beginning of tractate Chullin (6b).

4. The mumar in the Gemara: in public, in private (seif ג)

Seif ג begins with the mumar for idolatry. The Tur does not mention him; the Beis Yosef explains why: « ולא חש רבינו לכתוב דישראל מומר לע״ג דינו כעו״ג אע״פ שנזכר בגמרא ובדברי הרמב״ם משום דמילתא דפשיטא היא » (בית יוסף או״ח שפ״ה) — our master did not trouble to write that a Jew who is a mumar for idolatry has the law of a non-Jew, although it is mentioned in the Gemara and in the Rambam, because it is obvious. וְאֵין מְעָרְבִין עִמּוֹ וְאֵינוֹ מְבַטֵּל רְשׁוּת אֶלָּא שׂוֹכְרִין מִמֶּנּוּ כְּעוֹבֵד כּוֹכָבִים וּמַזָּלוֹת » (הלכות עירובין פ״ב הט״ז) — a Jew who desecrates Shabbos in public, or who worships idols, is like an idolater in all respects; one does not make an eruv with him, and he does not renounce his domain, but one rents from him as from an idolater. The Shulchan Aruch HaRav (seif 3) also writes of the mumar « הֲרֵי הוּא כְּנָכְרִי לְכָל דְּבָרָיו וְצָרִיךְ לִשְׂכּוֹר מִמֶּנּוּ » (שו״ע הרב שפ״ה:ג) — see Level 4, point ב.

The Beis Yosef gives as the source of public and private a baraisa in chapter וּבְגוֹי, עַד שֶׁיַּשְׂכִּיר » (עירובין ס״ט ע״ב) — a Jew who is a mumar but keeps his Shabbos in the marketplace renounces his domain; one who does not keep his Shabbos in the marketplace does not renounce his domain; for they said: a Jew takes [a] domain and gives [a] domain, and with a non-Jew, [there is no remedy] until he rents out. Rashi: « בשוק - בפרהסיא ואע״ג דמחלל בצנעא » (רש״י עירובין ס״ט ע״ב) — "in the marketplace": in public, even though he desecrates in private.

The Gemara reconciles two teachings about the Tzeduki — one implying that he renounces his domain, the other that he is like a non-Jew; one of its answers: « וְאִיבָּעֵית אֵימָא, לָא קַשְׁיָא: כָּאן — בְּמוּמָר לְחַלֵּל שַׁבָּתוֹת בְּצִנְעָא, כָּאן — בְּמוּמָר לְחַלֵּל שַׁבָּתוֹת בְּפַרְהֶסְיָא » (עירובין ס״ט ע״א) — in one case it speaks of a mumar who desecrates Shabbos in private; in the other, of a mumar who desecrates it in public. Rashi: « ואיבעית אימא - מתני׳ דמשמע צדוקי מבטל במומר לחלל בצנעא » (רש״י עירובין ס״ט ע״א) — the Mishnah, which implies that the Tzeduki renounces, speaks of a mumar who desecrates in private.

One who hides it. אָמַר: כְּגוֹן זֶה מְבַטֵּל רְשׁוּת לְרַבִּי יְהוּדָה » (עירובין ס״ט ע״א) — a man went out [on Shabbos] with an object the Gemara calls חומרתא דמדושא (Rashi discusses its meaning); when he saw Rabbi Yehudah Nesiah, he covered it. It was said: such a person renounces his domain according to Rabbi Yehudah. Rashi: « כגון זה - שמחלל שבת בצנעא » (רש״י עירובין ס״ט ע״א) — such a person: one who desecrates Shabbos in private.

The Mishnah Berurah, on the words אלא בצנעה of seif ג, writes: « ואם מתבייש לעשות זה בפני אדם גדול אף שעושה דבר זה בפני כמה אנשים גם זה לצנעה יחשב » (משנה ברורה שפ״ה ס״ק ו) — if he is ashamed to do it before a great man, even though he does it before several people, this too counts as in private.

A mumar in what respect? Rav Huna says: « אָמַר רַב הוּנָא: אֵיזֶהוּ יִשְׂרָאֵל מוּמָר — זֶה הַמְחַלֵּל שַׁבָּתוֹת בְּפַרְהֶסְיָא » (עירובין ס״ט ע״א) — who is a Jewish mumar? one who desecrates Shabbos in public. Rav Nachman asks him whose view this follows: according to Rabbi Meir, who holds that one suspect in one matter is suspect for the whole Torah, a single prohibition would suffice; according to the Rabbanan, he would have to be a mumar for idolatry. Two answers:

5. Even through a rabbinic prohibition — and the Tzeduki (seif ג)

Seif ג writes: even if he desecrates only through a rabbinic prohibition. The Beis Yosef gives its source: « ומ״ש אפילו אינו מחללו אלא באיסור דרבנן כן דקדקו שם התוס׳ והרא״ש והמרדכי וכן דעת רש״י » (בית יוסף או״ח שפ״ה) — so Tosafos, the Rosh and the Mordechai inferred there, and this is Rashi's view. Then the question of Tosafos and their answer: « והקשו התוס׳ דהא סתם צדוקי אינו נזהר במילי דרבנן ותירצו שרגילין הם ליזהר לפי שהם יראים מחכמים כדאיתא בנדה (לג » (בית יוסף או״ח שפ״ה) — Tosafos object that the ordinary Tzeduki does not guard rabbinic matters, and answer that [the Tzedukim] are accustomed to guard them, because they fear the Sages, as stated in Niddah (33b). The Beis Yosef continues: « ולפי דבריהם הני צדוקים דשכיחי גבן כיון דעברי אמילי דרבנן בפרהסיא הרי הם כעו״ג ושוכרין ואין מבטלים » (בית יוסף או״ח שפ״ה) — according to their words, these Tzedukim found among us, since they transgress rabbinic matters in public, are like non-Jews: one rents from them, and they do not renounce.

The Tzeduki who transgresses rabbinic matters in public. The Beis Yosef continues with the Rambam: « והרמב״ם בפ״ב כתב הברייתא כצורתה ולא הזכיר דין מחלל שבת במילי דרבנן מיהו אפילו את״ל דס״ל דהוי מומר נראה דהני צדוקים לדידיה לא חשיבי מומרים אע״פ שעוברין בפרהסיא אמילי דרבנן דלא הוי מומר עד שיעבור במזיד ובני מזיד דידהו כאונס הוי דמעשה אבותיהן בידיהם וה״ל כתינוק שנשבה בין העו״ג וכמ״ש הוא ז״ל בפי׳ המשנה בפ״א ממסכת חולין » (בית יוסף או״ח שפ״ה) — the Rambam, in chapter 2, copied the baraisa as it stands and did not mention one who desecrates Shabbos in rabbinic matters; but even if he holds him a mumar, it seems that in his view these Tzedukim are not counted as mumarim, although they transgress rabbinic matters in public, for one is not a mumar unless he transgresses deliberately, and their "deliberate" is like duress, since they hold the practice of their fathers: it is like a child captured among non-Jews, as [the Rambam] writes in his commentary on the Mishnah, in the first chapter of Chullin.

For the eruv, or for everything? The Mishnah Berurah, on the words ולענין שארי דברים יש מן האחרונים שסוברין שאינו חשוב כמומר ע״י חילול שבת באיסור דרבנן » (משנה ברורה שפ״ה ס״ק ה) — that is, for this matter: renouncing the domain no longer helps, only renting; and for other matters, some Acharonim hold that he is not counted a mumar through a rabbinic desecration of Shabbos.

The Biur Halachah, on the words אפילו… אלא באיסור דרבנן: « כן מוכח לדעת רש״י וכן הוא ג״כ דעת התוספות והרא״ש והמרדכי והגה״מ והריטב״א והאור זרוע » (ביאור הלכה שפ״ה) — this is evident according to Rashi, and it is also the view of Tosafos, the Rosh, the Mordechai, the Hagahos Maimoniyos, the Ritva and the Or Zarua; then he is in doubt: « ומסתפקנא אם ה״ה איסור מוקצה או כיון דהוא רק טלטול בעלמא לא נעשה מומר עי״ז אח״כ מצאתי בתפארת ישראל שהחמיר ג״כ במוקצה וצ״ע » (ביאור הלכה שפ״ה) — I am in doubt whether the same applies to a prohibition of muktzeh, or whether, since it is merely moving an object, one does not become a mumar through it; later I found that the Tiferes Yisrael is strict on muktzeh as well; and it requires further study. The Biur Halachah does not decide.

6. Who is called a mumar (seif ג)

Seif ג does not say what makes someone a mumar for desecrating Shabbos in public.

The Magen Avraham — « ואם חילל שבת בחד זימנא לא מקרי מומר (הג״מ פ״ב ותוס » (מגן אברהם שפ״ה ס״ק ב) — if he desecrated Shabbos only once, he is not called a mumar; he refers to the Hagahos Maimoniyos (chapter 2) and to Tosafos.

Only once. The Mishnah Berurah writes: « דעון זה חמור כמו עובד עכו״ם שנעשה בזה מומר לכל התורה ודוקא בשרגיל בעון זה אבל אם חילל שבת בחד זימנא בפרהסיא לא מיקרי מומר וי״א דאפילו בחד זימנא מקרי מומר » (משנה ברורה שפ״ה ס״ק ד) — this sin is as grave as that of an idolater, for through it he becomes a mumar for the whole Torah; and only if he is accustomed to this sin: if he desecrated Shabbos once in public, he is not called a mumar; and some say that even once, he is called a mumar. It writes the first view without attribution, then reports that some say otherwise.

The Shulchan Aruch HaRav (seif 3) writes that he is called a public mumar only « אֶלָּא כְּשֶׁרָגִיל בְּכָךְ וְאֵינוֹ נִזְהָר כְּלָל, אֲבָל לֹא כְּשֶׁחִלְּלוֹ פַּעַם בְּאַקְרַאי בְּעָלְמָא, כְּשֶׁהָיָה דָחוּק לְפִי שָׁעָה » (שו״ע הרב שפ״ה:ג) — when he is accustomed to it and does not guard himself at all, but not when he desecrated it once, merely by chance, when he was pressed at the moment. See Level 4, point ג.

What public means, according to the Mishnah Berurah: « ופרהסיא מקרי כשחילל בפני עשרה מישראל או שידע שיתפרסם ביניהם » (משנה ברורה שפ״ה ס״ק ד) — it is called public when he desecrated before ten Jews, or knowing that it will become known among them. And appetite and provocation: « ודע דכל זה כשהוא עובר לתיאבון אבל להכעיס אפילו בשאר עבירות ואפילו שלא בפרהסיא דינו כעכו״ם » (משנה ברורה שפ״ה ס״ק ד) — know that all this is when he transgresses out of appetite; but out of provocation, even with other sins and even not in public, he has the law of a non-Jew.

One who errs. The Biur Halachah: « היינו כשעושה זה בפריקת עול אבל אם הוא מוטעה בדבר שחשב שמותר לו לעשות כן מסתברא שאין זה בכלל מומר » (ביאור הלכה שפ״ה) — that is, when he does it casting off the yoke; but if he errs, thinking he is permitted to do so, it is reasonable that this is not included in mumar. He brings the proof: « כן מוכח מדברי התוספות ד׳ ס״ט ד״ה הוציא בדברי ר״י שם ואפילו לדעת רש״י ג״כ נראה דמותר דאומר מותר בכלל שוגג הוא » (ביאור הלכה שפ״ה) — this is evident from the words of Tosafos (69, s.v. הוציא, in the words of the Ri); and even according to Rashi it seems to be permitted, for one who says "it is permitted" falls under inadvertence.

7. One who converted: the Rashba's responsum (seif ד)

The wording of seif ד is found in a responsum of the Rashba, which the Beis Yosef brings: « כתב הרשב״א בתשובה על אחד שיצא מכלל ישראל והיו לו בתים בשכונת ישראל שעירבו לכל שבתות השנה איברא שאם אין לו פתח אחר כלל שהוא אוסר בכל שבת שחל לאחר שהמיר ששבת זה לא הותר כלל ואע״פ שעירב עם כל בני השכונה לשנה והוא המיר באמצע השנה אין אומרים מותר למקצת שבתות הותרו כולם » (בית יוסף או״ח שפ״ה) — the Rashba writes, in a responsum, about someone who had left the community of Israel and had houses in the Jewish quarter, whose residents had made the eruv for all the Shabbosos of the year: indeed, if he has no other opening at all, he forbids every Shabbos that falls after he converted, for that Shabbos was not permitted at all; and although he made the eruv with all the residents of the quarter for the year and converted in the middle of the year, we do not say: since [carrying] was permitted for some Shabbosos, it was permitted for all. Then: « אבל בנדון שלפנינו שיש לו פתח קטן לשכונת הכותי ואפילו פתח קטן שלא היה רגיל בו מתחלה דוחין אותו אצל הפתח הפתוח לשכונת הכותי דלא עדיף מישראל דבכיוצא בזה אינו אוסר » (בית יוסף או״ח שפ״ה) — but in the case before us, where he has a small opening to the quarter of the Kuti, even a small opening he was not used to from the start, he is pushed toward the opening that leads to the quarter of the Kuti, for he is no better than a Jew, who in such a case does not forbid.

The Rashba's reasons — « וכל שכן שאין צריך עירוב ודוחין אותו אצל שכונת הכותי כדי שלא יאסור ועוד שזה דעתו מעורבת עם הכותי ורגיל אצלם » (בית יוסף או״ח שפ״ה) — all the more so, since he does not need an eruv, he is pushed toward the quarter of the Kuti so that he will not forbid; and moreover, his mind is mingled with the Kuti and he is accustomed to them. כותי שיש לו ד׳ על ד׳ פתוח לבקעה אפילו מכניס גמלים וקרונות כל היום אינו אוסר מ״ט בההוא פתחא דמייחד ליה ניחא ליה » (בית יוסף או״ח שפ״ה) — even if he has only one narrow opening, of four by four, on the side of the Kuti, he is pushed toward that opening, as they said in chapter הדר: a Kuti who has [an opening] of four by four leading to a valley, even if he brings in camels and wagons all day, does not forbid; why? the opening that is his own is the one that suits him.

In the Gemara as Sefaria serves it, this case is said of a "goy": « גּוֹי שֶׁיֵּשׁ לוֹ פֶּתַח אַרְבָּעָה עַל אַרְבָּעָה פָּתוּחַ לְבִקְעָה, אֲפִילּוּ מַכְנִיס וּמוֹצִיא גְּמַלִּים וּקְרוֹנוֹת כׇּל הַיּוֹם כּוּלּוֹ דֶּרֶךְ מָבוֹי, אֵין אוֹסֵר עַל בְּנֵי מָבוֹי. בְּפִיתְחָא דִּמְיַחַד לֵיהּ, בְּהָהוּא נִיחָא לֵיהּ » (עירובין ס״ז ע״א) — a non-Jew who has an opening of four by four leading to a valley, even if he brings in and takes out camels and wagons all day by way of the mavoi, does not forbid the residents of the mavoi; why? the opening that is his own, that is the one that suits him.

The Mishnah Berurah on this seif:

The Magen Avraham, on the words פתח אחר: « ואם פתח לו פתח אחר שמימר עסי׳ שפ״ג » (מגן אברהם שפ״ה ס״ק ג) — and if he opened another opening after converting, see siman 383; the Mishnah Berurah also refers there (ס״ק ט).

8. Summary of the shitos and halachic conclusion

The foundation — a Jew settles the eruv by renouncing his domain, a non-Jew only by renting (baraisa, Eruvin 69b); the siman says from whom one takes a renunciation and from whom one rents:

For halachah lema'aseh, consult your Rav; the custom of the community also counts.
