Why a Level 4 dedicated to the Alter Rebbe? The Shulchan Aruch HaRav is not a commentary on the Mechaber: it is a Shulchan Aruch in its own right, written by the Alter Rebbe, with its own division and its own numbering of the seifim. Here the Shulchan Aruch HaRav has one seif, and the Mechaber's Shulchan Aruch has two; the references on this page follow the Rav's numbering, except where the Mechaber's Shulchan Aruch is named.
This page gathers, for Siman 384, the full text of the Rav with its translation, where his text differs from the Mechaber's seifim, and the practical conduct that follows from it.

A non-Jewish guest (achsanai): does he hinder [the eruv]? It contains a single seif:
A non-Jew who enters one of the houses of the courtyard to lodge there as a guest (achsanaus): if he entered without permission, he never forbids; and if he entered with permission — they rented or lent him a room set aside for eating —, if he comes regularly, he forbids immediately, on his arrival; and if he does not come regularly, he does not forbid until after thirty days, as was explained in Siman 370 concerning a Jewish guest. And a non-Jew who holds a debt on the house is called “entered with permission”.
And the men of the king's army who entered the houses of the Jews, some by force and some willingly: if the householders have, in those rooms the non-Jews entered, objects (keilim) that are not taken on Shabbos, they do not forbid upon them in any case; and if not, they forbid in the courtyards they entered with permission after thirty days, even though they do not come there regularly. But those who enter by force never forbid.
(And all this is with guests, who are not settled there. But one who rents his house to a non-Jew to live in it on a fixed basis, a year or two — [the non-Jew] does not forbid in any case, for he certainly did not rent him his house with the intent that he should forbid upon him on a fixed basis the whole year, as was explained in Siman 382.)

Where the Rav's text differs from the Mechaber's seif
This survey compares the Rav's text with the Mechaber's two seifim, quoted side by side. It does not present these points as unique to the Rav: details the Rav writes in the body of the law are already found in the Magen Avraham on this siman, and the Taz already sets the rule of the house rented to a non-Jew against the seif of the soldiers. Each point names where they are found.
Point א — “entered with permission”: the room set aside, the debt on the house (Shulchan Aruch HaRav 384:1)
What “entered with permission” means
What the Mechaber writes: «
What the Rav writes: he sets the case, « נָכְרִי הַנִּכְנָס לְאֶחָד מִבָּתֵּי הֶחָצֵר לְשֵׁם אַכְסְנָאוּת » (שו״ע הרב שפ״ד:א); he says what entering with permission is, « וְאִם נִכְנַס בִּרְשׁוּת, שֶׁהִשְׂכִּירוּ אוֹ הִשְׁאִילוּ לוֹ חֶדֶר מְיֻחָד לַאֲכִילָה » (שו״ע הרב שפ״ד:א); he refers to Siman ש״ע, « כְּמוֹ שֶׁנִּתְבָּאֵר בְּסִמָּן ש״ע בְּאַכְסְנַאי יִשְׂרָאֵל » (שו״ע הרב שפ״ד:א); and he adds « וְנָכְרִי שֶׁיֵּשׁ לוֹ חוֹב עַל הַבַּיִת נִקְרָא "נִכְנַס בִּרְשׁוּת" » (שו״ע הרב שפ״ד:א).
What is already found before him: the Magen Avraham proposes (נ״ל) the case of the debt: « נ״ל דעכו״ם שיש לו חוב על הבית מקרי ברשות » (מגן אברהם שפ״ד ס״ק א). After the Rav, the Mishnah Berurah writes: « ר״ל שהשאילו או השכירו חדר מיוחד להתאכסן שם » (משנה ברורה שפ״ד ס״ק ג), then « כתב מג״א דעכו״ם שיש לו חוב על הבית ונכנס שלא ברשות בעד חובו מיקרי ברשות ואוסר ויש מקילין בזה » (משנה ברורה שפ״ד ס״ק ג); and on the thirty days, it too refers to Siman ש״ע, « וכמו לעיל בס״ס ש״ע » (משנה ברורה שפ״ד ס״ק ה).
The difference: the Mechaber's seif writes « ואם נכנס ברשות » (שו״ע או״ח שפ״ד:א) without saying what it is; the Rav says it — a room set aside that they rented or lent him, « חֶדֶר מְיֻחָד לַאֲכִילָה » (שו״ע הרב שפ״ד:א), where the Mishnah Berurah, after him, writes « להתאכסן שם » (משנה ברורה שפ״ד ס״ק ג). The case of the debt, which the Magen Avraham proposes, the Rav writes in the body of the law, without reservation; the Mishnah Berurah reports the Magen Avraham and adds « ויש מקילין בזה » (משנה ברורה שפ״ד ס״ק ג). The commentators differ on this case; consult your Rav.
Practical consequence: according to the Rav's text, the non-Jewish guest never forbids if he entered without permission; if he entered with permission — a room set aside for eating that they rented or lent him, or a debt on the house —, he forbids on his arrival if he comes regularly, and after thirty days if he does not (Shulchan Aruch HaRav 384:1).
Point ב — the men of the king's army (Shulchan Aruch HaRav 384:1)
With or without the householder's objects in the room
What the Mechaber writes: «
What the Rav writes: « וְאַנְשֵׁי חֵיל הַמֶּלֶךְ שֶׁנִּכְנְסוּ בְּבָתֵּי הַיְּהוּדִים, מֵהֶם בְּחָזְקָה וּמֵהֶם בְּרָצוֹן, אִם יֵשׁ לְבַעֲלֵי בָתִּים בְּאוֹתָם חֲדָרִים שֶׁנִּכְנְסוּ בָּהֶם הַנָּכְרִים כֵּלִים שֶׁאֵינָם נִטָּלִים בְּשַׁבָּת — אֵינָם אוֹסְרִים עֲלֵיהֶם בְּכָל עִנְיָן » (שו״ע הרב שפ״ד:א); then « וְאִם לָאו — אוֹסְרִים בַּחֲצֵרוֹת שֶׁנִּכְנְסוּ בָּהֶן בִּרְשׁוּת לְאַחַר ל׳ יוֹם, אַף עַל פִּי שֶׁאֵינָם רְגִילִים לָבֹא שָׁם.
What is already found before him: the Taz writes that the Mechaber's seif ב comes from a responsum of the Rashba, « זהו מתשו׳ הרשב״א הביאו ב״י » (ט״ז או״ח שפ״ד ס״ק א), and questions it (point ג). After the Rav, the Mishnah Berurah writes « הקשו המפרשים דהא בסעיף א׳ מבואר דשלא ברשות אינו אוסר כלל ותירצו דמיירי שמתאכסנים ע״פ דינא דמלכותא » (משנה ברורה שפ״ד ס״ק ו), « ובזה אפי׳ לא נתרצה הבעה״ב נמי אוסר דהפקיד יש לו רשות ע״ז מן המלכות וכנכנס ברשות דמי » (משנה ברורה שפ״ד ס״ק ו), « ואם משנה הפקיד מחוק שנתן המלך והוא עושה בחזקה הרי הוא כשאר עכו״ם ואינו אוסר » (משנה ברורה שפ״ד ס״ק ו), and « ובספר משכנות יעקב סי׳ קי״ב חולק לגמרי על פסק המחבר ודעתו דלגבי אנשי חיל תמיד ברשות בעלים קיימא ושמן עליו ובכל גווני אינו אוסר » (משנה ברורה שפ״ד ס״ק ו); when the householder has no hold (תפיסת יד) [in the room], the commentators differ (Level 2, section 6). On the objects that may not be moved, the Biur Halachah writes « וגם הגר״ז העתיק כהשו״ע » (ביאור הלכה שפ״ד); he discusses whether other objects suffice, and concludes, « מאחר שהמאמר מרדכי כתב להקל בזה » (ביאור הלכה שפ״ד), « וא״כ אפשר דיש להקל בשעת הדחק » (ביאור הלכה שפ״ד).
The difference: the Mechaber writes « בין בחזקה בין ברצון » (שו״ע או״ח שפ״ד:ב), and sets only the case where the householders have, in those places, « כלים שאסור לטלטלם בשבת » (שו״ע או״ח שפ״ד:ב): the soldiers do not forbid. The Rav writes « מֵהֶם בְּחָזְקָה וּמֵהֶם בְּרָצוֹן » (שו״ע הרב שפ״ד:א) and, in that case, « אֵינָם אוֹסְרִים עֲלֵיהֶם בְּכָל עִנְיָן » (שו״ע הרב שפ״ד:א); then he writes the opposite case, which the Mechaber's seif does not write: those who entered with permission forbid after thirty days, even if they do not come regularly, and « אֲבָל הַנִּכְנָסִים בְּחָזְקָה אֵינָם אוֹסְרִים לְעוֹלָם » (שו״ע הרב שפ״ד:א), the rule the Rav writes at the start of the seif for a non-Jew who entered without permission, « אִם נִכְנַס שֶׁלֹּא בִרְשׁוּת — אֵינוֹ אוֹסֵר לְעוֹלָם » (שו״ע הרב שפ״ד:א). On soldiers who entered by force, and on the case where there are no such objects, the commentators differ (above; Level 2, sections 5 and 6; Level 3, section 5). This page does not say where the Rav's text stands among these readings; consult your Rav.
Practical consequence: according to the Rav's text, if the householders have, in the rooms the soldiers entered, objects that are not taken on Shabbos, the soldiers do not forbid in any case; if not, those who entered with permission forbid after thirty days, even if they do not come regularly, and those who entered by force never forbid (Shulchan Aruch HaRav 384:1); on this last case, and on the case where there are no such objects, the commentators differ (above; Level 2, sections 5 and 6).
Point ג — the house rented to a non-Jew on a fixed basis (Shulchan Aruch HaRav 384:1)
The guest and the settled tenant
What the Mechaber writes: his two seifim on this siman speak only of the guest and of the soldiers, and do not make this distinction. The rule of a Jew who rents or lends his house to a non-Jew is written in the Rema's gloss on Siman שפ״ב, seif א: the non-Jew does not forbid upon him, since he did not rent or lend it to him so that he should forbid upon him.
What the Rav writes: in parentheses, at the end of the seif, « וְכָל זֶה בְּאַכְסְנָאִים, שֶׁאֵינָם קְבוּעִים שָׁם.
What is already found before him: the Taz sets against the soldiers the rule of the rented house: « דאם השאיל לו או השכיר ביתו לעכו״ם אינו אוסר דלא השאיל לו אדעתא דליאסר עליו א״כ הכא אמאי יאסרו אנשי חיל עליו כל שאין לבעלי בתים כלים שם וצ״ע רב » (ט״ז או״ח שפ״ד ס״ק א). After the Rav, the Biur Halachah raises the same question about the guest of the Mechaber's seif א, « והקשו האחרונים דהא לעיל בריש סי׳ שפ״ב מבואר בהג״ה דישראל שהשכיר או השאיל ביתו לעכו״ם אינו אוסר עליו » (ביאור הלכה שפ״ד), and reports several answers, among them the Rav's: « והגר״ז תי׳ דלא מקילינן גבי עכו״ם אלא בשהיה השאלה או השכירות לזמן מרובה דאין סברא שיאסור עליו זמן רב חצירו בשביל העכו״ם משא״כ הכא דאינו אלא אכסנאי לחודש ימים או מעט יותר בזה לא מקילינן כלל גבי עכו״ם טפי מבאורח ישראל » (ביאור הלכה שפ״ד); then « אבל דעת הגר״א בסי׳ שפ״ב דלא מקילינן כלל בנכרי טפי מבישראל » (ביאור הלכה שפ״ד); and he concludes « ומ״מ לדינא צ״ע אם יש להקל בלא יכול לסלוקי » (ביאור הלכה שפ״ד).
The difference: the Mechaber, on this siman, writes no distinction between the guest and the settled tenant; the Rav writes it, with its reason, « שֶׁבְּוַדַּאי לֹא הִשְׂכִּיר לוֹ בֵּיתוֹ עַל דַּעַת שֶׁיֶּאֱסֹר עָלָיו בִּקְבִיעוּת כָּל הַשָּׁנָה כֻלָּהּ » (שו״ע הרב שפ״ד:א), and a reference to Siman שפ״ב. The Biur Halachah reports this distinction as the Rav's answer to the Acharonim's question (« והגר״ז תי׳ »), and reports other answers; the Acharonim differ; consult your Rav.
Practical consequence: according to the Rav's text, when one rents his house to a non-Jew to live in it on a fixed basis, a year or two, [the non-Jew] does not forbid [the landlord] in any case, since he certainly did not rent him his house so that he would impose a prohibition on him on a fixed basis, the whole year; the rules of the guest (points א and ב) concern those who are not settled there (Shulchan Aruch HaRav 384:1).

The practical Chabad conduct
Points of halachic conduct that flow directly from the Shulchan Aruch HaRav Siman 384, in the Chabad sensibility. The siman has a single seif: each point refers to that seif, in the order of the text.
For the Chabad Chassid — Siman 384
- ① The non-Jewish guest: if he entered without permission, he never forbids; if he entered with permission — a room set aside for eating that they rented or lent him, or a debt on the house —, he forbids on his arrival if he comes regularly, and otherwise after thirty days. On the debt, the commentators differ: see section 2. Reference: Shulchan Aruch HaRav 384:1.
- ② The men of the king's army: if the householders have, in the rooms they entered, objects that are not taken on Shabbos, they do not forbid in any case; if not, those who entered with permission forbid after thirty days, even if they do not come regularly, and those who entered by force never forbid. On soldiers who entered by force, and on the case where there are no such objects, the commentators differ: see section 2; consult your Rav. Reference: Shulchan Aruch HaRav 384:1.
- ③ The house rented on a fixed basis: when one rents his house to a non-Jew to live in it on a fixed basis, a year or two, [the non-Jew] does not forbid [the landlord] in any case, « שֶׁבְּוַדַּאי לֹא הִשְׂכִּיר לוֹ בֵּיתוֹ עַל דַּעַת שֶׁיֶּאֱסֹר עָלָיו בִּקְבִיעוּת כָּל הַשָּׁנָה כֻלָּהּ » (שו״ע הרב שפ״ד:א). On this distinction, the Acharonim differ: see section 2; consult your Rav. Reference: Shulchan Aruch HaRav 384:1.
