1. The axiom: wine that remains a value

The starting point:

Simanim 123 to 131 asked what makes wine forbidden. Siman 132 starts from the other end: the wine is forbidden, and it is still worth money. A barrel does not vanish because a non-Jew touched it; it stands in the cellar, it has a price, someone is willing to buy it, and a labourer worked for it. The question of the siman is therefore no longer one of status but of circulation: how far can the value of forbidden wine travel before it stops being its price?

Seven seifim, and they read as a ladder: at each rung the Jew stands further from the wine.

The Gemara rejects two explanations before keeping a third — and it is the third that matters: « קְנָס הוּא שֶׁקָּנְסוּ חֲכָמִים בַּחֲמָרִין וּבְיֵין נֶסֶךְ » (עבודה זרה ס״ב ע״א).

The Shakh repeats it exactly where the consequence shows: « משום קנס כדאית׳ ברבינו ירוחם שהביא הב״י וכן באשר״י שם » (ש״ך יו״ד קל״ב ס״ק ד).

💡 The marker: do not look here for what makes wine forbidden — that is the business of the preceding simanim. Look for where the money comes from. Whenever the siman seems strict, the money is the wine’s price; whenever it seems lenient, the money is something else: compensation, a debt, a release.

2. The 3 reflex questions

■ 1. WHERE DOES THE MONEY COME FROM? Is it the price of the wine — then we are at the heart of the prohibition; is it compensation, a pre-existing debt, or the price of a release — then it is not the wine’s money, and the siman does not reach it.

■ 2. IN WHAT ORDER? Was the price fixed before the non-Jew took the wine away? Did he pay before it was measured? Did he take the wine before handing over the money? The siman does not judge the sale: it looks at the second in which the wine ceased to be the Jew’s.

■ 3. WHAT EXACTLY DID HE SAY? “Appease the king for me” or “take my place”; “wait until I sell” or nothing at all; “buy them a drink” or “here is a dinar, hold it until then”. In the last four seifim the wording decides — because it settles who performs the act.

On the first question the Taz supplies the language of compensation: « דלאו מכר הוא אלא אומר לו שפכת ייני ואבדת ממוני ודמי יין כשר קא שקיל » (ט״ז יו״ד קל״ב ס״ק א).

On the second, the mishnah: « הַמּוֹכֵר יֵינוֹ לְנׇכְרִי, פָּסַק עַד שֶׁלֹּא מָדַד — דָּמָיו מוּתָּרִין, מָדַד עַד שֶׁלֹּא פָּסַק — דָּמָיו אֲסוּרִין » (עבודה זרה ע״א ע״א).

On the third, Rav: « מוּתָּר לָאָדָם לוֹמַר לְגוֹי: צֵא וְהָפֵס עָלַי מְנָת הַמֶּלֶךְ » (עבודה זרה ע״א ע״א).

⚠ The methodological error to avoid: starting with “is the wine forbidden?”. Throughout this siman the answer is yes, and it is given in advance. Starting there loses the one useful question, which is what the Jew receives and on what account.

Basis: seifim 1 to 3, with the Shakh and the Taz. The sorting is by where the money comes from, not by the person or the amount.

💡 Why the first row and the second-to-last resemble each other: in both, a Jew receives money from a non-Jew on account of forbidden wine — and in both it is permitted, for the same underlying reason: it is not the wine’s price. There it repairs a loss; here it is the equivalent of wages due. The wine was never the object of the exchange.

In the last four seifim the Jew no longer sells anything. He asks something of a non-Jew — to serve drinks, to pay a levy, to wait — and we look at what he asked for.

⚖ The two criteria that sort this table

  1. Earmarking. An obligation that targets no specific asset forbids nothing: « לָא שְׁנָא מַקִּיפוֹ, וְלָא שְׁנָא שֶׁאֵין מַקִּיפוֹ, אַף עַל גַּב דִּמְשַׁעְבַּד לֵיהּ, כֵּיוָן דְּלָא מְיַיחַד שִׁיעְבּוּדֵיהּ — לָא מִיתְּסַר » (עבודה זרה ס״ג ע״ב). Once the dinar is frozen for this use it becomes an earmarking, and the wine already belongs to the Jew.
  2. Wording. Two sentences describing the same operation do not share a status, because they do not name the same actor. The Shakh shows it from both sides: « ואפילו הוא בענין שאין הישראל היה יכול ליפטר מן המלך אלא ביין מותר כיון שלא פירש לעובד כוכבי׳ בפירוש שיתן למלך יי״נ » (ש״ך יו״ד קל״ב ס״ק ל״ד) on one hand, and « משמע דאפילו היה יכול לפייסו בדברים אחרים מ״מ כיון שא״ל היה במקומי כו׳ אסור לכ״ע » (ש״ך יו״ד קל״ב ס״ק ל״ה) on the other.

5. פסק ומדד — the four configurations of the sale (seif 2)

Seif 2 is the longest in the siman, and it reduces to a four-row table. Only two variables: when the price was fixed, and which vessel the wine was poured into.

The mishnah: « הַמּוֹכֵר יֵינוֹ לְנׇכְרִי, פָּסַק עַד שֶׁלֹּא מָדַד — דָּמָיו מוּתָּרִין, מָדַד עַד שֶׁלֹּא פָּסַק — דָּמָיו אֲסוּרִין » (עבודה זרה ע״א ע״א).

And the Meḥaber gives the mechanism: « פסק עד שלא משך דמיו מותרים שמשפסק סמכה דעתו ומשמשך קנה ויין נסך אינו נעשה עד שיגע בו נמצא בשעת מכירה היה מותר » (שו״ע יו״ד קל״ב:ב).

Why take payment rather than merely fix a price? The Taz: « דבעובד כוכבים קונה משיכה או כסף ומ״ה צריך ליקח הדמים דאז קונה בכסף » (ט״ז יו״ד קל״ב ס״ק ד).

⚖ The Rama’s three mitigations of the fourth row

  1. After the fact the whole batch is permitted save the value of the residue: « מיהו אם מדד לכלי של עובד כוכבים שיש בו עכבת יין שאינו נאסר רק מכח תערובות מעט יין שהיה בכלי בדיעבד כולו מותר בהנאה חוץ מדמי מעט היין שהיה בכלי » (רמ״א יו״ד קל״ב:ב). And the Shakh rejects the reading that would make this a deliberate nullification: « אלא ודאי בדיעבד בכל ענין מותר וזה ברור » (ש״ך יו״ד קל״ב ס״ק כ״א).
  2. The position of the residue counts: at the mouth of the vessel it forbids at once; at the bottom, the wine is already acquired before reaching it.
  3. A non-Jew who lifts in order to acquire has settled everything in advance: « וכן אם מדדו העובד כוכבים והגביהו תחילה לקנותו הכל מותר דהרי קנאו תחילה קודם שמדד » (רמ״א יו״ד קל״ב:ב). But the Shakh sets a limit: « אבל בהגביה בשעה שמודד אינו קונה שאותה הגבהה אינה לקנייה אלא למדידה » (ש״ך יו״ד קל״ב ס״ק כ״ה).
⚠ What the Meḥaber omitted, and why: the Rambam added that if he measured without taking payment the money is forbidden even where the price was fixed — « וְאִם מָדַד וְלֹא לָקַח דָּמִים אַף עַל פִּי שֶׁפָּסַק דָּמָיו אֲסוּרִים שֶׁמִּשֶּׁיַגִּיעַ לַכְּלִי נֶאֱסַר כִּסְתָם יֵינָם » (רמב״ם הלכות מאכלות אסורות פרק י״ג הלכה כ״ד). The Meḥaber did not carry it over. The Shakh explains: « והמחבר השמיט זה משום דסבירא ליה דכיון דמיד שהגיע לכלי קנהו ולא מיתסר אלא משום ניצוק ולא אמרינן ניצוק לסתם יינם אלא לאסור בשתיה » (ש״ך יו״ד קל״ב ס״ק י״ח).

6. The barrel received as wages, and the window that closes (seif 3)

A non-Jew employs Jewish workmen and sends them a barrel of wine in payment. They can neither drink it nor sell it. The whole seif turns on a window of a few seconds.

The mishnah: « הָאוּמָּנִין שֶׁל יִשְׂרָאֵל שֶׁשָּׁלַח לָהֶם נׇכְרִי חָבִית שֶׁל יֵין נֶסֶךְ בִּשְׂכָרָן — מוּתָּר לוֹמַר: תֵּן לָנוּ אֶת דָּמֶיהָ, מִשֶּׁנִּכְנְסָה לִרְשׁוּתָן — אָסוּר » (עבודה זרה ע״א ע״א).

And the Meḥaber puts in their mouths the sentence to say: « אם עד שלא קבלוה בשכרם מותר שיאמרו לו עד שאתה שולח לנו חבית זו תהא שלך ותתן לנו דמים כנגדה » (שו״ע יו״ד קל״ב:ג).

💡 The fine point to keep: they do not say “take it back”, since taking back presupposes having had. They say: let it remain yours, and give us its value instead. The difference is not stylistic: it settles whether the barrel was theirs for a second, and hence whether they are selling it.

Once the window has closed, the Tur says what follows: « ואם לאחר שזכו בו אמרו לו תן לנו דמיו אסורין שהרי הוא כאילו מוכרין אותו לו » (טור יו״ד קל״ב).

But if the barrel entered their premises without their accepting it, nothing has happened: « אבל לא קבלוה בשכרם אע״פ שנכנס לרשותם לא זכו בו שאין חצירו של אדם קונה לו בע״כ » (ש״ך יו״ד קל״ב ס״ק כ״ז).

And the Rama adds the clause about the age: « וע״ל סימן קכ״ג דאף משקבלה שרי בזמן הזה » (רמ״א יו״ד קל״ב:ג) — which the Shakh at once bounds: « דשם נתבאר דסתם יינם בזמן הזה מותר בהנאה במקום הפסד וא״כ הכא נמי שרי » (ש״ך יו״ד קל״ב ס״ק כ״ח).

⚠ The trap: assuming the mishnah and the Shulḥan Arukh say the same thing. The mishnah says משנכנסה לרשותן, the Meḥaber says משקבלוה בשכרם. Without Shakh ס״ק כ״ז one would read the first as a physical fact — the barrel is in the yard, that settles it — whereas it is a legal one.

7. The dinar advanced to the tavern-keeper (seif 4)

The Jew has no wine. He has non-Jewish workers to feed and a tavern-keeper on the corner. How can he become responsible for wine he never saw?

The Meḥaber lays down the basic prohibition: « מי ששכר פועלים עובדי כוכבים ופסק להם מזונות אסור להשקותם יין נסך » (שו״ע יו״ד קל״ב:ד).

Then the solution, and its limit: « ואם אמר להם צאו ושתו מחנוני פלוני ואני פורע אם לא הקדים לו דינר מותר אע״פ שייחד לו דינר והוא בעין ביד בעל הבית אבל אם הקדים לו דינר אסור » (שו״ע יו״ד קל״ב:ד).

The Gemara had first ruled out the idea that mere credit forbids: « לָא שְׁנָא מַקִּיפוֹ, וְלָא שְׁנָא שֶׁאֵין מַקִּיפוֹ, אַף עַל גַּב דִּמְשַׁעְבַּד לֵיהּ, כֵּיוָן דְּלָא מְיַיחַד שִׁיעְבּוּדֵיהּ — לָא מִיתְּסַר » (עבודה זרה ס״ג ע״ב).

And it is Rav Pappa who isolates the difficult case: « אֶלָּא הָכָא אַמַּאי חוֹשֵׁשׁ מִשּׁוּם שְׁבִיעִית? הָא לָא מְיַיחַד שִׁיעְבּוּדֵיהּ הָכָא! אָמַר רַב פָּפָּא: כְּגוֹן שֶׁהִקְדִּים לוֹ דִּינָר » (עבודה זרה ס״ג ע״ב).

⚖ What the advanced dinar changes, in three lines

  1. Without a dinar — even if he mentally set a coin aside for it — there is only a personal obligation, and an obligation forbids nothing.
  2. With a dinar frozen until performance, the wine already belongs to him at the keeper’s; it is he who gives them to drink, and it is forbidden: « ודוקא כשאמר לו יהא דינר זה בידך עד שתשקה לפועלים ואני אחשוב עמך באחרונה אבל אם נתנו לו להוציאו עכשיו אם יצטרך לו מותר » (שו״ע יו״ד קל״ב:ד).
  3. With a dinar given to be spent freely, the Meḥaber, following the Rashba, permits. The Tur objects — « ואינו נראה דכיון שהקדים לו הדינר מיד נקנה לו היין ובשליחותו נתנו להם » (טור יו״ד קל״ב) — and the Shakh inclines his way: « מיהו במקו׳ הפסד קי״ל דסתם יינם בזמן הזה מותר בהנאה » (ש״ך יו״ד קל״ב ס״ק ל״א).

The Rama’s gloss opens a door: « וכן מי שמזמן עובד כוכבים אצלו מותר ליתן מעות לעבדו לקנות להם יי״נ » (רמ״א יו״ד קל״ב:ד), and the Taz gives the reason: « והטעם בכל בו כיון שהוא אומר לקנות בעבורם נמצא שהיין אינו שלו » (ט״ז יו״ד קל״ב ס״ק ט).

⚠ The limit that gets forgotten: this detour works for a servant, not for a friend. The Shakh: « ונראה דוקא עבדו אבל אסור לומר כך לישראל אחר דרוצה בקיומו של יי״נ עד שיעשה שליחותו לעובד כוכבים » (ש״ך יו״ד קל״ב ס״ק ל״ב). And the Beit Yosef himself hesitates: « ויש לפקפק בזה משום דיד עבד כיד רבו דמי » (ש״ך יו״ד קל״ב ס״ק ל״ג).

8. The king and the storehouse: two formulas, two regimes (seifim 5–6)

Two seifim, one situation: a public charge payable in wine, and a non-Jew sent to settle it. The Jew touches nothing. And yet one case is permitted and the other forbidden — for no reason but what was said.

Rav lays down the permission: « מוּתָּר לָאָדָם לוֹמַר לְגוֹי: צֵא וְהָפֵס עָלַי מְנָת הַמֶּלֶךְ » (עבודה זרה ע״א ע״א).

The baraita seems to contradict him: « אַל יֹאמַר אָדָם לְגוֹי עוּל תַּחְתַּי לָעוֹצֵר » (עבודה זרה ע״א ע״א).

And Rav distinguishes: « הָא לָא דָּמְיָא אֶלָּא לְהָא, אֲבָל אוֹמֵר לוֹ מַלְּטֵנִי מִן הָעוֹצֵר » (עבודה זרה ע״א ע״א).

💡 The surprising point: the criterion is not material possibility. The Shakh says so in both directions. On one side: « ואפילו הוא בענין שאין הישראל היה יכול ליפטר מן המלך אלא ביין מותר כיון שלא פירש לעובד כוכבי׳ בפירוש שיתן למלך יי״נ » (ש״ך יו״ד קל״ב ס״ק ל״ד). On the other: « משמע דאפילו היה יכול לפייסו בדברים אחרים מ״מ כיון שא״ל היה במקומי כו׳ אסור לכ״ע » (ש״ך יו״ד קל״ב ס״ק ל״ה). It therefore makes no difference whether the Jew could have discharged the levy otherwise — the wording decides.

The Taz says the same in the Ri’s name: « ואע״ג דלא מצי לסלוקי ליה בזוזי מותר כיון שלא אמר ליה בפירוש תן לו » (ט״ז יו״ד קל״ב ס״ק י).

⚠ The strict view the Meḥaber did not adopt: for a yesh omrim in the Tur, once the administration has entered the quota in the Jew’s name no formula saves anything — « ואין היתר אלא כל זמן שלא כתבו שמותר לומר לעובד כוכבים פייס בשבילי שלא יכתבו עלי » (ש״ך יו״ד קל״ב ס״ק ל״ז).

9. The recovered debt — רוצה בקיומו (seif 7)

The last seif is the most abstract in the siman, and the one that reaches furthest beyond wine. The Jew does nothing at all: he waits to be paid.

The baraita: « יִשְׂרָאֵל שֶׁהָיָה נוֹשֶׁה בְּגוֹי מָנֶה, וּמָכַר עֲבוֹדָה זָרָה וְהֵבִיא לוֹ, יֵין נֶסֶךְ וְהֵבִיא לוֹ — מוּתָּר » (עבודה זרה ס״ד ע״א).

And the reason for its second half: « סֵיפָא, מִשּׁוּם דְּהָוֵה לֵיהּ כִּי רוֹצֶה בְּקִיּוּמוֹ » (עבודה זרה ס״ד ע״א).

The Meḥaber copies it without qualification: « ואם אמר לו קודם שימכור המתן לי עד שאמכור אלילים או יין נסך שיש לי ואביא לך אע״פ שהוא סתם יינם ומכר והביא לו הרי זה אסור מפני שהישראל רוצה בקיומו כדי שיפרע ממנו חובו » (שו״ע יו״ד קל״ב:ז).

The Ri reads the restriction out of the baraita’s own words: « אבל אם יש לו ערב או שיכול ליפרע ממקום אחר אין אמירתו של עובד כוכבים מועלת כלום » (תוספות עבודה זרה ס״ד ע״א ד״ה אבל אם אמר לו המתן ואביא לך).

The Raavad sets a different test: « והראב״ד חילק כשבידו לנגשו ומרצונו ממתין לו אסור שהרי על ידו מתקיים ע״א אבל כשאין בידו לנגשו וע״כ ממתין לו מותר » (ש״ך יו״ד קל״ב ס״ק ל״ט).

And the Rama takes the first: « ויש אומרים דאין איסור זה של רוצה בקיומו אלא דוקא אם אינו יכול להפרע ממקום אחר אבל אם יוכל להפרע ממקום אחר וכל שכן אם יש לו ערב מותר » (רמ״א יו״ד קל״ב:ז).

💡 Why money in a non-Jew’s hand is never caught: Tosafot ground it on a verse — « ונראה הטעם כי מה שעבודת כוכבים תופסת דמיה משום דכתיב והיית חרם כמוהו כל שאתה מהיה ממנו כמוהו ובישראל דוקא נאמר ולא לבני נח » (תוספות עבודה זרה ס״ד ע״א ד״ה מסתברא דמי עבודת כוכבים ביד עובד כוכבים מותרין). The rule making an idol seize its price is addressed to Israel. This is the key to the whole siman: money is never tainted in itself, only by what a Jewish hand did with it.
⚠ The Taz’s complement, which looks at the other side: when does the money of an idol remain forbidden in the non-Jew’s hand? « דוקא כשמוכר לקנות בדמיו צרכי עבודת כוכבי׳ שאז נשארו הדמים באיסורן » (ט״ז יו״ד קל״ב ס״ק י״א) — and the reason: « ואע״ג דבעלמא קיימא לן הזמנה לאו מלתא היא מ״מ הכא שאני כיון שבאו מעובד כוכבים ושם ישובו » (ט״ז יו״ד קל״ב ס״ק י״א). This is a deliberate departure from the general rule of הזמנה לאו מלתא.

10. The Rama’s gloss, and the Shakh’s line

Four times in this siman the Rama inserts the same gloss. It must be read at its source — in siman 123, where he expressly refers back here.

The Meḥaber in siman 123: « סתם יינם של עממים עובדי כוכבים אסור בהנאה וה״ה למגעם ביין שלנו » (שו״ע יו״ד קכ״ג:א).

The Rama in the same place: « ובזמן הזה שאינו שכיח שהאומות מנסכים לעבודת כוכבים י״א דמגע עובד כוכבים ביין שלנו אינו אסור בהנאה רק בשתייה » (רמ״א יו״ד קכ״ג:א).

And its first consequence: « ולכן מותר לגבות בחובו מן עובד כוכבים סתם יינם מפני דהוי כמציל מידם » (רמ״א יו״ד קכ״ג:א).

But he himself sets the boundary in the next sentence: « אבל לכתחלה אסור לקנותו ולמכרו כדי להשתכר בו » (רמ״א יו״ד קכ״ג:א).

And he closes: « ויש מקילין גם בזה וטוב להחמיר וע״ל סימן קל״ב » (רמ״א יו״ד קכ״ג:א).

⚖ The Shakh’s line, in two moves

On the Rama’s broadest formula the Shakh writes: « מיהו לכתחלה יש ליזהר » (ש״ך יו״ד קל״ב ס״ק כ״ו) — and supplies the measure: « דבמקום שאין הפסד אף בזמן הזה אין להתיר בהנאה » (ש״ך יו״ד קל״ב ס״ק כ״ו).

He repeats it elsewhere in the same terms: « דשם נתבאר דסתם יינם בזמן הזה מותר בהנאה במקום הפסד וא״כ הכא נמי שרי » (ש״ך יו״ד קל״ב ס״ק כ״ח), and again: « מיהו במקו׳ הפסד קי״ל דסתם יינם בזמן הזה מותר בהנאה » (ש״ך יו״ד קל״ב ס״ק ל״א).

💡 The formula to keep: the Meḥaber measures in benefit — is there a hana’ah here? The Rama and the Shakh measure in loss — is there a hefsed here? Both read the same text and do not end with the same map, because they are not counting in the same currency. For practice, see level 4 — and your Rav.

11. The 6 golden rules

⚖ Six rules that carry you through the siman

  1. The ban is a קנס, not a quality of the money. It is therefore personal: it catches the one who sold, not the one who buys after him.
  2. Compensation is not a price — unless a sale was already under way between the same parties over the same wine.
  3. In a sale it is not what you do that counts but the order. Price before the pull; money before the measuring; goods before payment.
  4. What you never owned you cannot sell. Hence the sentence to say before accepting the barrel — and the rule that a courtyard does not acquire against its owner’s will.
  5. A personal obligation forbids nothing; an earmarking does. An open account is permitted, a frozen dinar is not.
  6. The wording is part of the act. “Appease him” and “take my place”, “wait” and silence, describe the same operations and do not share a status.

12. Mnemonic — « ק.נ.ס »

ק · נ · ס — three letters, three reflexes, and the very word by which the Gemara characterises the prohibition.

ק — קנס. What is forbidden is a penalty on a man, not a taint in the money. Hence: personal, and it lapses where there is no one to penalise.

נ — נזק. Compensation is not a price. Always ask first whether what is paid repairs a loss or buys goods.

ס — סדר. The order of the acts decides everything: the price, the pull, the payment, the measuring. Change the order and you change the ruling.
💡 How to use it: put the three letters in order before any case. ק — who would be penalised, and why? נ — does the money repair or purchase? ס — what came before what? If all three answers are clear, the case already belongs to one of the tables above.

Rama: after the fact all is permitted for benefit save the value of the residue; the position of the residue matters; a non-Jew who lifts in order to acquire has settled it in advance; and nowadays the widespread custom is to sell wine without observing these rules.
3The barrel received as wagesJewish workmen who worked for a non-Jew who sends them a barrel of wine in payment: so long as they have not accepted it as wages, it is permitted, for they may tell him “rather than sending us this barrel, let it stay yours and give us its value”. Once accepted, it is forbidden. Rama: see siman 123, from which it appears that nowadays it is permitted even after acceptance.
4Feeding non-Jewish workersOne who hired non-Jewish workers and undertook their board must not give them yayin nesekh to drink. If he tells them “go and drink at such a keeper’s and I will pay”: with nothing advanced it is permitted, even if he set a dinar aside for it and has it in hand; with a dinar advanced it is forbidden. And that only where he said “let this dinar stay with you until you give the workers to drink, and I shall settle with you at the end”; but if he gave it to be spent now if needed, it is permitted. Rama: likewise, one who hosts a non-Jew may give money to his servant to buy some for them.
5The king’s shareA Jew who owns wine and must give a known share of it to the king may tell a non-Jew “appease the king for me”, even though the non-Jew hands over yayin nesekh and is then reimbursed. But he may not say “be in my place to give to the king”.
6The lord’s storehouseA lord distributing his wine among the people and taking payment for it: a Jew shall not say to a non-Jew “here are four zuz, enter in my place in the lord’s storehouse” — so that the non-Jew take the wine entered in the Jew’s name and pay the lord for it. Rama: יש אומרים that this ban applies only where he cannot be paid elsewhere, and all the more so if he has a guarantor; and nowadays, since they do not pour libations, one need not be strict about stam yeinam and it is permitted in any case — see siman 144.
