1. The axiom: a mixture is measured, not judged

The starting point:

Simanim 123 to 133 asked what makes wine forbidden, and what may be done with it. Siman 134 starts elsewhere: the wine is forbidden, it has run somewhere, and one must know what becomes of whatever it ran into. The question is therefore no longer one of status but of measure — and the siman teaches that the measure is not a single figure.

Thirteen seifim, and three variables that govern everything before quantity comes into play.

The mishna sets out both regimes at a stroke: « יֵין נֶסֶךְ אָסוּר וְאוֹסֵר בְּכׇל שֶׁהוּא, יַיִן בְּיַיִן וּמַיִם בְּמַיִם בְּכׇל שֶׁהוּא, יַיִן בְּמַיִם וּמַיִם בְּיַיִן בְּנוֹתֵן טַעַם » (עבודה זרה ע״ג ע״א).

And the gemara gives the reason for the stringency, in three words: « בִּשְׁלָמָא יֵין נֶסֶךְ, מִשּׁוּם חוּמְרָא דַּעֲבוֹדָה זָרָה, אֶלָּא טֶבֶל מַאי טַעְמָא » (עבודה זרה ע״ג ע״ב).

💡 The marker: never ask “how much?” first. In this siman quantity is the last question, and in the strictest case it does not arise at all.

2. The 3 reflex questions: which kind · which direction · which stream

■ 1. WHICH KIND? Wine into wine, vinegar into vinegar — the same kind, and the משהו applies. Wine into water, vinegar into wine — different kinds, and we fall back to taste. And kind is read off the name, not off the raw material.

On the first question, the Rambam on vinegar: « יֵין נֶסֶךְ שֶׁהֶחֱמִיץ וְנָפַל לְתוֹךְ חֹמֶץ שֵׁכָר אוֹסֵר בְּכָל שֶׁהוּא מִפְּנֵי שֶׁהוּא בְּמִינוֹ שֶׁשְּׁנֵיהֶן חֹמֶץ הֵן » (רמב״ם הלכות מאכלות אסורות פרק ט״ז הלכה ל״ה).

On the second, the Shach in the Ran’s name: « וטעמא דמלתא שאותו דבר שעומד במקומו חשוב יותר מן הבא עליו » (ש״ך יו״ד קל״ד ס״ק א).

On the third, the Mehaber: « מפני שהעמוד היורד מפי החבית גדול » (שו״ע יו״ד קל״ד:א).

⚠ The methodological error to avoid: treating the siman as a table of thresholds — “a משהו here, sixty there, six elsewhere”. The thresholds are only the output of the calculation; what is to be learned is the order of the three questions.

💡 Why rows 4 and 5 stand opposed: wine and wine vinegar are materially the same product but for a fermentation, and yet they are two kinds; grape vinegar and barley vinegar have nothing in common, and they are one kind. The Shach gives the reason in three words: « דבתר שמא אזלינן » — we follow the name.

The Shach states the extreme of the first case: « ואפילו היין המותר נפל בפעם אחת הרבה על הטפה של יי״נ עד שיש ס׳ אפ״ה אסור » (ש״ך יו״ד קל״ד ס״ק א).

And he opens a door in a case of great loss: « ומיהו בהפסד מרובה וכה״ג יש לסמוך אהרמב״ן והרא״ש וטור דס״ל דבהית׳ לתוך איסור נמי אם נפל בבת אחת ויש ס׳ מותר » (ש״ך יו״ד קל״ד ס״ק א).

💡 Why row 3 is symmetrical while the first two are not: because a thick column mixes everything at once. Where there is no succession there is no first and no second — and the question of direction loses its object.

5. The barrel among barrels, and the custom of our time (seif 2)

Seif 2 does two distinct things: it opens an economic way out, and it carries the gloss that governs practice.

⚠ Do not confuse the two leniencies: the Rama’s bears on wine mixing into wine — a liquid in a liquid. That of small containers bears on counted objects. A significant barrel remains an object, and the Pitchei Teshuva recalls that the custom of sixty does not reach it.

6. Water: רואין, תחילה, and the six parts (seifim 4–5)

Seifim 4 and 5 form a single mechanism: water does not reawaken the prohibition, so it may be counted alone; and six times less of it is needed than elsewhere.

💡 Why six and not sixty: sixty is the measure of a taste one no longer wishes to perceive. Six is the threshold beyond which it is no longer wine. These are not two levels of one scale but two different reasonings — which is why the threshold of six never leaves water.

7. Wine spilt on solids: getting in or not (seifim 8–11)

Seifim 8 to 11 change the question. We no longer measure: we ask whether the liquid got in.

The Rambam gives the material reason: « וְלָמָּה אֵין בּוֹדְקִין אֶת הַחִטִּים בְּנוֹתֵן טַעַם מִפְּנֵי שֶׁהֵן שׁוֹאֲבוֹת וְהַיַּיִן נִבְלָע בָּהֶן » (רמב״ם הלכות מאכלות אסורות פרק ט״ז הלכה ל״ד).

⚠ The one figure the siman does not give: how long “a long time” is. The Taz makes it almost immediate: « משמע דזמן מועט הוא מועט דומיא דמיד וכל שיש שהות יותר מזה מקרי מרובה » (ט״ז יו״ד קל״ד ס״ק י). The Shach gives twenty-four hours: « נראה דמעת לעת בעינן כמ״ש לעיל סימן ק״ה ס״ק ב׳ » (ש״ך יו״ד קל״ד ס״ק כ״ז). It is the siman’s only numerical dispute, and it decides every real case.

8. Hot, cold, and what spoils (seifim 9 and 12)

Two seifim set out one rule through two opposite examples: what spoils does not forbid — but what first improved is no longer redeemed.

💡 The rule in one line: taste is judged neither in the prohibition nor in the ingredient, but in what is put on the table. And order matters: improving first and spoiling afterwards leaves the prohibition in place.

9. Manufactured drinks (seif 13)

Seif 13 leaves the accident for the manufacture — and it is the seif that speaks most directly to our own day.

⚠ The trap of seif 13: it speaks not of a mixture that occurred but of a mixture that is expected. Hence the question to ask is not “is there any?” but “is it customary to put some in?” — and hence the Pitchei Teshuva’s answer, on the ban on nullifying deliberately, applies to any production.

10. The contradiction of seif 3 — who says what

Seif 3 permits and then forbids in the same sentence. Here, on one page, is what each one makes of it.

💡 What to retain in practice: whatever the reading, the result is the same — a prohibition that accumulates to the point of taste forbids. The divergence bears on the text, not on conduct.

11. The 6 golden rules

  1. Kind before quantity. Ask first whether it is the same kind. Within its kind, libation wine has no threshold; outside it, it follows the common rule of taste.
  2. Kind is read off the name. Not the raw material, not the taste, not the origin: the name. That is what makes two vinegars one kind, and wine and its vinegar two kinds.
  3. What stands in place prevails over what comes upon it. Pouring permitted onto forbidden is not the same operation as letting forbidden fall into permitted.
  4. What is bound to fall counts as fallen. Hence the difference between the small flask and the barrel — and hence that an interrupted stream changes the law.
  5. Taste is never nullified. What was nullified little by little forbids again as soon as it reaches taste. This is the Rama’s ruling in seif 3, and the Shach’s foundation.
  6. Taste is judged in the dish, not in the ingredient. And order matters: improving first and spoiling afterwards saves nothing.

12. Mnemonic — “K.D.S.”

K — Kind (מין)
D — Direction (who fell upon whom)
S — Stream (trickle or column)

Three letters, and the order binds: one moves to the next only once the previous is answered. Quantity is not in the mnemonic — because it is never the first question, and in the strictest case it does not arise.

💡 How to use it: faced with a real case, write the three letters and fill them in before opening a book. Nine times out of ten the siman’s answer appears before one has looked for a threshold.

13. The 5 classic pitfalls

  1. Thinking that “one drop suffices” always holds. It holds only within the same kind, and only where the permitted was poured onto the forbidden. Three lines later the same Mehaber permits a pouring that lasts all day.
  2. Confusing the six parts and the sixty. Six parts apply only to water, since beyond them wine ceases to be wine. In wine or in a dish, where wine improves, we return to sixty — the Shach says so expressly.
  3. Extending the custom of sixty to barrels. The Rama’s leniency bears on a liquid mixed into a liquid. A significant container remains a counted object, and the Pitchei Teshuva recalls this for our time.
  4. Treating rinsing as a general solution. It applies only to what has not absorbed, and it has a clock the siman does not quantify: the Taz makes it very short, the Shach extends it to twenty-four hours. And for wheat it never applies.
  5. Judging taste in the ingredient. A spice may be spoiled in itself and improve the dish: then it forbids. This is the Shach’s last remark, and it decides more concrete cases than any other.
