Siman 135 — In which vessels there is concern of libation

Material, use and coating: what a vessel took from the wine that passed through it, and what takes it back. Glass, metal, stone, wood, leather, earthenware, כלי נתר and מאני דקוניא; passing use and מכניסו לקיום; then the ladder of remedies — שכשוך, מילוי ועירוי, כדי קליפה, כבשן, הגעלה, יישון י״ב חדש (Shulchan Aruch, Yoreh De'ah 135 — 16 seifim)

Vessels in which wine is not kept standing. Four words, and the whole grid of the siman is already set: it is not the wine that is judged but the vessel — and first of all by the use made of it.

Shulchan Aruch, Yoreh De'ah 135:1

Frequently asked questions — Siman 135

Can a vessel that held forbidden wine be used again?

Yes, in almost every case, and the siman only states at what price. For a vessel of passing use that is not pitched, the Mehaber writes: « כלים שאין מכניסין לקיום בין שהם של עור בין שהם של עץ ושל זכוכית ושל אבן ושל מתכת אם אינן מזופתין משכשכן היטב במים ומותרים » (שו״ע יו״ד קל״ה:א). For a vessel in which wine is kept standing, a three-day emptying is required: « כלים שמכניסים בהם יין לקיום צריכי׳ עירוי בין שלקחם ישנים מהעובד כוכבים בין שהם שלנו ונשתמש בהם העובד כוכבים אפילו לפי שעה ומיהו בעירוי סגי להו אפילו הם זפותים » (שו״ע יו״ד קל״ה:ז). The reason for this relative leniency is given by the gemara itself: « זֶה תַּשְׁמִישׁוֹ בְּחַמִּין, וְזֶה תַּשְׁמִישׁוֹ בְּצוֹנֵן. » (עבודה זרה ל״ד ע״א) — wine is used cold. For the application to your situation, consult your Rav.

How exactly is a מילוי ועירוי performed?

Three refinements matter. The three days may be spread apart — the Shach writes so in the name of the Tur and the Rashba: « ואפילו לכתחלה יכול לעשות ג׳ ימים מפוזרים. Water poured off before twenty-four hours does not count: « ואם שפך המים קודם שעמדו בו כ״ד שעות לא עלו לו אותם המים » (שו״ע יו״ד קל״ה:י״ב). And the Shach, in his נקודות הכסף as reported by the Beer Hetev, gives the underlying reason: « ומטעם זה לא בעינן ג׳ מעל״ע רצופים אלא ג׳ פליטות זה אחר זה מיהו בלא״ה מותר בדיעבד ולאו דוקא הכא אלא בכל כלי היין שנשתמשו בהן בדיעבד בלי הכשר כלל משום דמסתמא איכא ס׳ נגד הקליפה ושרי לדידן כדלקמן סי׳ קל״ז עכ״ל): » (באר היטב יו״ד קל״ה ס״ק כ״א). For the application to your situation, consult your Rav.

Is there a vessel that no treatment can recover?

One only, and the Mehaber writes it without reservation: « בולעים הרבה ביותר ואין להם טהרה עולמית אפילו ביישון י״ב חדש ואפילו באין מכניסין בהם לקיום ואפי׳ היה תחילת תשמישן ביד ישראל » (שו״ע יו״ד קל״ה:ה). The gemara mentions it once: « כְּלֵי נֶתֶר אֵין (לוֹ) [לָהֶן] טׇהֳרָה עוֹלָמִית. Seif 6 adds to it green-glazed vessels, for the same reason — alum. The Shach notes in passing that the identification of the mineral is disputed between Rashi and the Rambam: « אבל הרמב״ם שם סתר בארוכה דברי האומרים כן ופי׳ שהוא הנקרא טפל בל׳ ערבי » (ש״ך יו״ד קל״ה ס״ק י״ח). For the application to your situation, consult your Rav.

Are glass and stainless steel treated like wood and clay?

No, and this is the most useful point in practice. Glass is exempted by all from the stringency of the storage vessel: « יש מי שאומר שלא החמירו בשביל שמכניסו לקיום » (שו״ע יו״ד קל״ה:ח), and the Shach gives the reason in the name of the Ran: « דשועים וקשים הם ובליעתם מועטת מכל הכלים. Metal is not exempted: the Mehaber rules like the broadest opinion, and a metal tank that keeps wine requires an emptying. The Beit Yosef reports the position of the Rosh, which is the one adopted: « וכן מסתבר דכיון שהיין משתהה בתוכו זמן מרובה נבלע בתוכו וכן אמרינן גבי נודות של עור אין לחלק במכניסו לקיום » (בית יוסף יו״ד קל״ה). For the application to your situation, consult your Rav.

A non-Jew merely touched a still-moist vat: must it be treated?

This is the point of the siman that the Acharonim did not settle. The Shach reports the Perishah, for whom only a use forbids: « דוקא בנשתמש בהן אבל אם נגע בהם בשעת טפיחה לא נאסר דגזרו משום שמא ישתמש בהם העובד כוכבים ויכניס בהן לקיום » (ש״ך יו״ד קל״ה ס״ק כ״ב). The Taz rejects that distinction in the firmest terms: « ודבריו תמוהים מכל צידי צדדים חדא דמנין לנו לחלק בזה הא אין לנו רמז בתלמוד מזה » (ט״ז יו״ד קל״ה ס״ק ט), and draws from it a practical ruling about lees sold to a non-Jew. But the Shach, in his נקודות הכסף, sides with the Perishah, and the Beer Hetev reports both views without choosing: « ובנה״כ מסכים לדעת הפרישה בכאן מטעם כיון דאינו מזופף לא גזרו בנגיעה כולי האי להחמיר להצריכו עירוי » (באר היטב יו״ד קל״ה ס״ק י״ג). This is exactly the kind of question to be settled with your Rav.

What is to be done with a cask that can neither be filled with water nor immersed?

Seif 15 opens the thermal route: « כלי עץ וכלי עור וכלי חרס אפילו מזופתים ואפילו מכניסן לקיום ניתרים בהגעלה בכלי ראשון » (שו״ע יו״ד קל״ה:ט״ו). And the Rama describes the common practice, which is still ours: « ויש מתירין אפילו ע״י עירוי שמערה בהן רותחין ולגלגלן » (רמ״א יו״ד קל״ה:ט״ו). The Taz sets the condition that must not be forgotten: « נראה דוקא מכלי ראשון דכל מה שאפשר לקרב לנו לעיקר הדין כן עבדינן לכתחלה » (ט״ז יו״ד קל״ה ס״ק י״ט) — the water must come from a keli rishon. Finally, if one can wait, seif 16 permits everything with no act at all, and the Pitchei Teshuvah specifies that these are lunar months: « דהנך חדשים הם חדשי לבנה כל חודש כ״ט יום ע״ש: » (פתחי תשובה יו״ד קל״ה ס״ק ג). For the application to your situation, consult your Rav.
