Siman 161 runs to eleven seifim — the Shulhan Arukh announces them itself: ובו י״א סעיפים. It does not lay down a new prohibition: it draws the frontier. On one side רבית קצוצה, stipulated interest, which is of the Torah and which the court takes back; on the other אבק רבית, dust of interest, which is only of the Sages and which the court does not take back. This distinction governs everything that follows, as far as siman 177.

Siman 161 is the one that draws the frontier. Siman 160 stated the gravity of the prohibition; this one states where the line runs between what the Torah forbids and what the Sages forbade — and, which is not the same thing, between what the court takes back and what it does not. Eleven seifim, and the Shulhan Arukh announces them itself: ובו י״א סעיפים.
דין אבק רבית ואיזו נקרא רבית דאורייתא. ובו י״א סעיפים:

The material of the siman comes from the fifth chapter of Bava Metzia, איזהו נשך. There the Gemara separates, within the very list of cases of interest, those that are of the Torah from those that are only of the Sages:
« עַד כָּאן – רִבִּית קְצוּצָה. מִכָּאן וְאֵילָךְ – אֲבַק רִבִּית » (בבא מציעא ס״א ע״ב)
And immediately after that sentence comes the question on which the whole siman turns: what does the court do with the one and with the other?
« אָמַר רַבִּי אֶלְעָזָר: רִבִּית קְצוּצָה יוֹצְאָה בְּדַיָּינִין, אֲבַק רִבִּית אֵינָהּ יוֹצְאָה בְּדַיָּינִין » (בבא מציעא ס״א ע״ב)
« רַבִּי יוֹחָנָן אָמַר: אֲפִילּוּ רִבִּית קְצוּצָה נָמֵי אֵינָהּ יוֹצְאָה בְּדַיָּינִין » (בבא מציעא ס״א ע״ב)
Rabbi Yohanan derives his view from the verses themselves: the one who took interest was handed over to death, or to the fear of Heaven, and not to restitution.
« רַב אַדָּא בַּר אַהֲבָה אָמַר, אָמַר קְרָא: ״אֶל תִּקַּח מֵאִתּוֹ נֶשֶׁךְ וְתַרְבִּית וְיָרֵאתָ מֵאֱלֹהֶיךָ״ – לְמוֹרָא נִיתַּן וְלֹא לְהִשָּׁבוֹן » (בבא מציעא ס״א ע״ב)
« הוּקְשׁוּ מַלְוֵי רִבִּית לְשׁוֹפְכֵי דָּמִים: מָה שׁוֹפְכֵי דָּמִים לֹא נִיתְּנוּ לְהִשָּׁבוֹן – אַף מַלְוֵי רִבִּית לֹא נָתְנוּ לְהִשָּׁבוֹן » (בבא מציעא ס״א ע״ב)
The general criterion is Rav Nahman’s formula, which the Rema will reproduce almost word for word in seif 1:
« אָמַר רַב נַחְמָן: כְּלָלָא דְרִיבִּיתָא, כֹּל אֲגַר נְטַר לֵיהּ – אָסוּר » (בבא מציעא ס״ג ע״ב)
The verses are those of parashat Behar, of Ki Tetzei and of Mishpatim; the verse of Ezekiel is the one from which Rabbi Yohanan derives his view:

The Tur opens the siman with the reach of the prohibition, then reports the R”i’s two exclusions — land, and anything worth less than a peruta — and the Ramah’s objection to the second:
« חוץ מקרקע כגון שהלוה לו חמשה גפנות טעונות בשש וחוץ מפחות משוה פרוטה » (טור יו״ד קס״א)
« והרמ״ה כתב דאפי׳ בפחות משוה פרוטה אסור מן התורה אבל אין מוציאין אותו בדיינין עד שיהא בו שוה פרוטה » (טור יו״ד קס״א)
He then gives the criterion of form, which the Rema will place in his gloss:
« בין אם דרך הלואה או דרך ממכר או שכירות אלא שאם הוא דרך מקח הוא מדרבנן וזהו אבק רבית אינה יוצאה בדיינין » (טור יו״ד קס״א)
And finally he reports the dispute that seif 3 will settle:
« וכתב הראב״ד נהי שאינה יוצאה אם תפש לוה משל מלוה לא מפקינן מיניה » (טור יו״ד קס״א)
« כתב אפילו תפש לוה משל מלוה מפקינן מיניה דאחר שנתנו לוה למלוה הוא שלו » (טור יו״ד קס״א)
On seif 2 the Beit Yosef reports the view that obliges restitution before Heaven — and the contrary view:
« דבבא לצאת ידי שמים חייב להחזיר » (בית יוסף יו״ד קס״א)
« וכתב עוד שי״א שאפי׳ בבא לצאת ידי שמים אינו חייב להחזיר » (בית יוסף יו״ד קס״א)
And on seif 5 he explains what יוצאה בדיינים precisely consists of:
« דהא דאמרינן יוצאה בדיינים היינו לומר דכופין אותו משום מ״ע דוחי אחיך עמך ומכין אותו עד שתצא נפשו כדי שיקיים המצוה אבל אין ב״ד יורדין לנכסיו » (בית יוסף יו״ד קס״א)
These words will recur from 159 to 177. They are set down here once and for all, because it is this siman that defines them.
Here, in a single table, is what the eleven seifim decide. Two distinct columns, and that is the whole siman: the category of the prohibition is not the same thing as its recovery.

The siman carries 60 entries of apparatus: 20 ס״ק of the Shach, 10 of the Taz, 15 of the Ba’er Hetev, 12 of the Pit’hei Teshuva and 3 Nekudot HaKesef. They are taken here seif by seif, in the order of the text.
The Shach opens with the question raised by the words כל דבר: does interest apply to a loan of land? The poskim dispute it; the Bach concludes stringently, and the Shach reads that as the view of the Mehaber and the Rema.
« יש מחלוקת בין הפוסקים אי שייך רבית בהלואת קרקע וכתב הב״ח דיש להחמיר וכן נראה דעת המחבר והרב » (ש״ך יו״ד קס״א ס״ק א)
On “but it is not extracted through the judges”: even if the judges wished to sit, it is not extracted. The Shach here rejects the Levush’s reason, which explained it by the rule that a court does not attend to less than a peruta.
« נראה דאפילו הדיינים רוצים להזדקק לישב בדין אין מוציאין אותו » (ש״ך יו״ד קס״א ס״ק ג)
And he gives his proof: the Mehaber himself writes, in Hoshen Mishpat, that the court completes a case even for less than a peruta.
« ועוד דהא כתב המחבר שם דגומרין אפילו בפחות מש » (ש״ך יו״ד קס״א ס״ק ג)
The Taz goes back to the source of the exclusion: a כלל ופרט in the verse, requiring that the thing have monetary substance and be movable — whence land and anything worth less than a peruta are excluded.
« והוא נלמד מכלל ופרט שיש בפסוק דבעינן גופן ממון ומטלטלין יצאו קרקעות שאין מטלטלין יצאו פחות משוה פרוטה שאין גופן ממון » (ט״ז יו״ד קס״א ס״ק א)
And he sets out the contrary view, the one the Mehaber adopted: for the Ramah, less than a peruta is indeed money — only, it is not extracted through the judges.
« והרמ״ה ס״ל דפחות משוה פרוטה מקרי ממון אלא שאין מוציאין אותו בדיינים » (ט״ז יו״ד קס״א ס״ק א)
His conclusion on slaves: the Torah excluded them in every case, yet they remain rabbinically forbidden — as with oaths, where land and slaves are excluded by Torah law and nonetheless carry the היסת.
« דמן התורה אתמעט עבדים בכל גווני שזכרנו אלא דמדרבנן אסור » (ט״ז יו״ד קס״א ס״ק א)
And he sets aside the view of his father-in-law, the Bach, who held this to be interest in the full sense.
« וכתב מו״ח ז״ל דבזה הוה באמת רבית גמור ודבריו תמוהין » (ט״ז יו״ד קס״א ס״ק א)
He even faults the Beit Yosef for his “it may be”: the thing is certain, not merely possible.
« למה כתב לשון אפשר והלא ודאי אסור מדרבנן כמו שהוכחנו מן המשנה שזכרנו » (ט״ז יו״ד קס״א ס״ק א)
On the Rema’s gloss, the Taz defines אגר נטר in a few words.
« פירוש בשביל המתנת המעות נותן לו שכר » (ט״ז יו״ד קס״א ס״ק ב)
The Ba’er Hetev gathers both: the Shach on land, the Taz on slaves and deeds.
« וכתב הט״ז דה״ה בעבדים שייך רבית דרבנן ובשטרות פשיטא דשייך רבית דכשמלוה לו השטר מלוה לו ממון ועיקר ההלואה הוא הממון ופשיטא שיש בו רבית גמור » (באר היטב יו״ד קס״א ס״ק א)
And he repeats the Shach’s rejection of the Levush.

And the Taz’s definition, word for word.

The Pit’hei Teshuva at once widens the field, in the name of the Havot Yair: even with no loan at all and no actual sale — wages owed, a transferred debt — as soon as one appeases the creditor with a wage for waiting, it is forbidden.
« שכתב דאפילו אם לא היה כאן הלואה כלל ולא בדרך מקח הנעשה בפועל מיד ליד אלא שהיה לו אצלו שכר פעולה » (פתחי תשובה יו״ד קס״א ס״ק א)
« בכל אלו אם מרצה לבעל חוב באגר נטר אסור » (פתחי תשובה יו״ד קס״א ס״ק א)
And he brings the case of the Shvut Yaakov, which is precisely that of a late-payment penalty: the borrower did not pay on time, the lender warned him that he would have to make good the lost profit, and the borrower agreed. That is a pure wage for waiting, and the Pit’hei Teshuva refuses to rely on the Sema to be lenient.
« וכתב שזה פשוט שיש בזה איסור רבית כי הוא אגר נטר גמור » (פתחי תשובה יו״ד קס״א ס״ק א)
On “it does not come out through the judges”: the Maharit deals with a lender who did not himself receive the dust of interest, a third party having received it for him. The lender acquires nothing — acquisition through another rests on agency, and there is no agent for a transgression.
« וכתב דלא זכה המלוה ויחזיר ללוה דזכיה מתורת שליחות הוא וקי״ל דאין שלד״ע » (פתחי תשובה יו״ד קס״א ס״ק ב)

On “to discharge his duty toward Heaven”: the Beit Yaakov lays down a rule that reaches well beyond our siman. One who pays believing himself liable at law, when he is liable only toward Heaven, is not paying what he thinks he is paying — and the recipient must tell him so.
« ואפילו אם מחזיר לו סתמא צריך להודיע שהוא פטור מדיני אדם » (פתחי תשובה יו״ד קס״א ס״ק ג)
On “he is obliged to return it”: the Radbaz rules against the Mehaber, following the poskim who exempt even toward Heaven. This is the dispute the Beit Yosef had reported.
« שפסק כדעת הפוסקים דגם לצאת י״ש א״צ להחזיר » (פתחי תשובה יו״ד קס״א ס״ק ד)
On “if the borrower seized”: the Shach restricts the rule. Only what is dust of interest in everyone’s view is taken back from the borrower; where the poskim dispute the nature of the sum, it is not taken back from him.
« נראה דוקא א״ר לכ״ע אבל היכא דיש מחלוקת בין הפוסקים אי הוי א״ר או ר״ק אין מוציאין מהלוה אי תפס » (ש״ך יו״ד קס״א ס״ק ד)
The Ba’er Hetev reproduces it as it stands.

On “they said”: the Shach adds the case of dust of interest written into a deed — it is deducted from the sum, it is not collected; a deed still to be collected is not money already collected.
« כתב ב״י בשם בה״ת דכל א״ר דבשטרא מנכינן ליה ולא מגבינן ליה דשטר העומד לגבות לאו כגבוי דמי » (ש״ך יו״ד קס״א ס״ק ה)
And he extends the case of the judge who erred: the same holds if the borrower was condemned for want of proof, and afterwards proved that it was interest.
« אם פסקו לו לשלם מחמת שלא היה לו ראיה ואחר כך בירר בראיה שרבית הוא וכל כיוצא בזה » (ש״ך יו״ד קס״א ס״ק ו)
The Ba’er Hetev repeats it.
« כתב ב״י בשם בה״ת דכל א״ר דבשטרא מנכינן ליה ולא מגבינן ליה דשטר העומד לגבות לאו כגבוי דמי » (באר היטב יו״ד קס״א ס״ק ה)
On “and they would beat him”: the Shach gives the reason for this extreme coercion — it is the regime of every positive commandment, and this one is written in the verse וחי אחיך עמך.
« כדין שאר מצות עשה דכתיב וחי אחיך עמך » (ש״ך יו״ד קס״א ס״ק ז)
On “the court does not descend into his property”: the Shach marks the limit of that immunity. If the lender has already returned it and then seized again from the borrower’s property, it is no longer interest — it is theft, and then they do descend into his property.
« נראה דאם כבר החזיר הרבית על פי ב״ד או מעצמו ואח״כ חזר ותפס משל לוה בעד הרבית יורדין לנכסיו » (ש״ך יו״ד קס״א ס״ק ח)
Here the Taz lays down his most disputed thesis: coercion takes place only if the borrower claims. He supports it from Rashi in the chapter HaRibbit.
« נראה דוקא אם תבעו וראיה מדברי רש״י פרק הרבית » (ט״ז יו״ד קס״א ס״ק ג)
And he draws the practical consequence, which he had already written in Hoshen Mishpat: a creditor of the lender cannot take hold of the interest the lender holds, since the borrower has made no claim.

The Ba’er Hetev reproduces the Taz’s thesis.

And, on the next line, the Shach’s limit.

The Pit’hei Teshuva records the challenge: the Panim Meirot disputes the Taz, and so does the Knesset HaGedola; the She’ilat Yaavetz, for his part, holds the Taz’s ruling to be true at least where the borrower had already waived.

On “unless it was”: the Shach gives the reason for the sons’ obligation — not an inherited debt, but their father’s honour.

On “identifiable object”: the Shach reports the Perisha, for whom the phrase is not to be taken strictly — anything still in kind suffices, as with theft.
« כתב הפרישה דל״ד אלא כל דבר שהוא בעין כמו שגזלו » (ש״ך יו״ד קס״א ס״ק י״א)
And here the Nekudot HaKesef — the Shach answering himself — take the matter up again: the Perisha’s words are forced, and דבר מסוים is indeed to be taken strictly.
« מיהו לפענ״ד דברי הפרישה דחוקים דדוחק לומר דדבר מסוים לאו דוקא הוא » (נקודות הכסף יו״ד קס״א)
Their proof is the Rambam, who writes “theft still extant” on the one side and “interest that is an identifiable object” on the other — two different words for two different regimes.

And they give the reason for the distinction: interest came into his hand with the borrower’s consent, theft did not.

The Taz, for his part, gives the source of the sons’ exemption: the verse warns only the one who takes, not his son.

The Ba’er Hetev repeats it word for word.

The Pit’hei Teshuva reports Rabbi Akiva Eiger’s doubt: may the borrower deduct, from the principal he still owes the heirs, the interest he had paid the father? His conclusion is that he may, but for a different reason than one would expect.

And he adds the symmetrical doubt of the Dagul Mervava: if it is the borrower who has died, must the lender return to his heirs, since restitution rests on וחי אחיך and the dead man will not live by that money?

And the Har HaKarmel pushes the case further still: the heirs slaughtered the cow or tore the cloak — must they pay?

On “of his own accord”: the Shach draws the converse. From one who persists in his rebellion, it is taken back against his will.
« אבל עומד במרדו מוציאין ממנו בע » (ש״ך יו״ד קס״א ס״ק י״ב)
And he shuts the door on the misunderstanding, in the name of the Rivash: that the court does not accept does not mean the man is quit — he remains bound toward Heaven.

The Ba’er Hetev gathers both of the Shach’s remarks on this seif.

On “for the sale stands”: the Mishneh LaMelekh distinguishes. We say the sale stands — and so that the lender may return the money instead of the thing — only where a sum had first been stipulated; without a stipulation, the object itself must be returned. The Sha’ar HaMelekh disputes it.
« דדוקא כשקצץ עמו בדמים ואח״כ נתן לו חפץ בשביל הדמים אז הוא דאמרינן המקח קיים ויחזיר הדמים אבל כשלא קצץ צריך להחזיר לו החפץ בעצמו » (פתחי תשובה יו״ד קס״א ס״ק ט)
On “he must return it to him”: the Shach specifies that it is the vessel, not its price — so that it not be said of the cloak he wears that it is a cloak of interest.

The Taz says the same and extends it: so it is with every identifiable object.

And the Ba’er Hetev records it in the name of the Shach.

The Pit’hei Teshuva names the spring of this rule: קלון, the shameful trace — and from it a whole discussion of the object’s depreciation and of waiver.

And he reports from the Tiferet Tzvi a case much debated: an etrog received as interest — may one fulfil the mitzva with it?

On “it is extracted from him”: the Shach brings the Rashba’s doubt, reported by the Beit Yosef — had he said “I give you twelve dinars of interest on condition that you rent my courtyard, worth only ten, for twelve”, perhaps only ten is taken back, since under the main condition he could receive no more.

The Taz extends the seif’s rule from rental to sale, against the Perisha: one who bought for that sum does not discharge himself by returning the thing.

And he concludes: there is no distinction to be drawn, and in a sale too he returns the whole dinar.

The Ba’er Hetev summarises the Taz’s position and joins to it the Rashba’s doubt.

On “the principal by itself”: the Shach draws two consequences the seif does not state. The deed is collectible even from encumbered property, and the witnesses are not disqualified — for לא תשימון עליו נשך is understood by people to apply only to lender and borrower.
« וגבי אפילו ממשעבדי והעדים לא נפסלו אפילו ברבית דאורייתא דלא תשימון עליו נשך לא משמע לאינשי אלא בלוה ומלוה כן כתבו התוספות והרא״ש ורוב הפוסקים » (ש״ך יו״ד קס״א ס״ק י״ז)
The Taz reads the gloss otherwise: were the interest not written separately, the witnesses would be disqualified, having signed on a prohibited matter.
« דאם לא כן הרי העדים פסולים דרשעים הם שמעידים שחתמו על איסור » (ט״ז יו״ד קס״א ס״ק ז)
And he concludes that on this point the Rema ruled like the Ramban.

It is that sentence the Nekudot HaKesef take up, in two words: “he was not precise”. The Tur, the Shulhan Arukh and the Rema are precisely not like the Ramban, but like Tosafot and the Rosh.

The Ba’er Hetev sets the two readings side by side without deciding: the Taz first, then the Shach.

On “whoever finds it”: the Shach limits the reach of the order to tear — it applies to the first case only, not to the one where only the principal is written.
« ארישא קאי אבל כשלא נכתב בשטר רק הקרן פשיטא דלא יקרענו » (ש״ך יו״ד קס״א ס״ק י״ח)
And he pushes the fear to its limit: even a deed in which Torah interest is spelled out is torn — because a court may err.
« מסיק דאפי׳ מפורש בו רבית דאורייתא חיישינן לב״ד טועין » (ש״ך יו״ד קס״א ס״ק י״ט)
The Taz here deals with the text itself: the reason is in the Hagahot Ashri, “because he transgresses by keeping it” — and the Beit Yosef had a faulty version before him.
« והטעם בהגה׳ אשר״י לפי שהוא עובר בקיומו » (ט״ז יו״ד קס״א ס״ק ט)
The Nekudot HaKesef agree, but restore the priority: the Bach had said it before him, and it appears explicitly in the Sefer HaTerumot.

The Ba’er Hetev summarises the rule of tearing and its limit.

On “not even the principal”: the Shach gives the reason — the fear that he collect the interest under the name of principal — and then the qualification: where the borrower admits the debt, some say he collects.
« דגזרינן שמא יגבה הרבית בתורת קרן ומיהו היכא דהלוה מודה י״א דגובה » (ש״ך יו״ד קס״א ס״ק כ׳)
And he closes the siman on a sentence worth remembering: the borrower owes nothing of the profit he made with the lender’s money, however great — but it is fitting to fine him to give of that profit to the poor of the city.
« ליתן שום דבר מהריוח שהרויח במעות של המלוה אפילו הרויח הרבה אלא שראוי לקנסו ליתן מהריוח לעניי העיר » (ש״ך יו״ד קס״א ס״ק כ׳)
The Taz specifies that the refusal to collect bears only on collection by the deed: if the borrower admits the principal, he must pay it. And he sets aside the contrary view reported in Hoshen Mishpat.

The Ba’er Hetev closes the apparatus by setting the Shach and the Taz side by side one last time.

The matter of this siman is not in the laws of forbidden foods, nor in those of idolatry: it is in the laws of lender and borrower, הלכות מלווה ולווה — chapter four for the substance, chapter six for the definition. The Beit Yosef says so himself:
« וגם הרמב״ם כתב דין זה בפ״ד מהלכות מלוה ולוה » (בית יוסף יו״ד קס״א)
The Rambam begins with what siman 160 had laid down — the reach of the prohibitions:
« הָא לָמַדְתָּ שֶׁהַמַּלְוֶה בְּרִבִּית עוֹבֵר עַל שִׁשָּׁה לָאוִין » (רמב״ם הלכות מלווה ולווה פרק ד׳ הלכה ב׳)
Then comes the sentence that explains why there is no flogging, and which is the foundation of our whole siman:
« אַף עַל פִּי שֶׁהַמַּלְוֶה וְהַלּוֶֹה עוֹבְרִין עַל כָּל אֵלּוּ הַלָּאוִין אֵינָן לוֹקִין עָלָיו מִפְּנֵי שֶׁנִּתָּן לְהִשָּׁבוֹן » (רמב״ם הלכות מלווה ולווה פרק ד׳ הלכה ג׳)
And at once the rule of seif 5, and that of seif 6:

Chapter six gives the definition that seif 5 takes up, with its two conditions:
