Siman 161 permits nothing: it classifies and it enforces. This level follows the Mehaber’s line of ruling seif by seif, then the places where the Shach and the Taz part — and there it is the Nekudot HaKesef, the Shach’s answer to the Taz, that decide.

1. שורש הפסק — what this siman settles, and what it does not

A note on method. The Admur HaZaken did not write a Shulhan Arukh on Yoreh De’ah: this level is not a “Daat HaRav” but a level of psak, resting on the Shach, the Taz, the Nekudot HaKesef, the Ba’er Hetev, the Pit’hei Teshuva and the Rambam — each cited in its place. It sets out what the decisors hold, not what should be done in a real case. For the application to your own case, ask your Rav.

Siman 160 stated the gravity of the prohibition. Siman 161 does not state what is permitted: it states of what order the forbidden thing is, and what the court does with it. It is a siman of classification and recovery, not of permission.

What this siman does not settle. It does not say whether a given transaction is interest — that is the business of simanim 162 to 177. It says what becomes of a transaction already known to be one.

2. פסק המחבר — the map of the eleven seifim

3. אבק רבית — what is not recovered, and must nonetheless be returned

This is the line of ruling most exposed to misunderstanding, and the seif says it in one sentence:

« אבק רבית אינה יוצאת בדיינים ואם בא לצאת ידי שמים חייב להחזיר » (שו״ע יו״ד קס״א:ב)
The practical rule. “The court does not take it back” and “one may keep it” are two different propositions, and the seif adopts the first while refusing the second. One who has taken dust of interest must return it — only, no tribunal will compel him.

The Rema’s gloss brings the single exception, and it is narrow:

« מלבד רבית מוקדמת ומאוחרת אפילו לצאת ידי שמים אינו חייב להחזיר » (רמ״א יו״ד קס״א:ב)

The Pit’hei Teshuva records that not all agree — the Radbaz exempts even toward Heaven:

« שפסק כדעת הפוסקים דגם לצאת י״ש א״צ להחזיר » (פתחי תשובה יו״ד קס״א ס״ק ד)
Two corollaries that practice forgets. (1) Seif 3: the borrower may not take the law into his own hands — if he seized, it is taken from him; except, says the Shach, where the poskim dispute the very nature of the sum. (2) Seif 4: consent is the condition of non-recovery. Extortion, coercion before a tribunal, an erroneous ruling — and the sum becomes recoverable again.

And when he comes to return it, the Pit’hei Teshuva adds a duty nothing would suggest: he must tell the other why he is returning it.

4. יוצאה בדיינים — how Torah interest is enforced

The seif states the enforcement and its limit in the same sentence:

« שהיו כופין ומכין אותו עד שתצא נפשו אבל אין בית דין יורדין לנכסיו » (שו״ע יו״ד קס״א:ה)
This is not the execution of a debt. The Beit Yosef, in the name of the Rashba and the Ran, writes it: it is the court’s coercion to bring about the fulfilment of a positive commandment — and the Shach names the commandment.
« דהא דאמרינן יוצאה בדיינים היינו לומר דכופין אותו משום מ״ע דוחי אחיך עמך ומכין אותו עד שתצא נפשו כדי שיקיים המצוה אבל אין ב״ד יורדין לנכסיו » (בית יוסף יו״ד קס״א)
« כדין שאר מצות עשה דכתיב וחי אחיך עמך » (ש״ך יו״ד קס״א ס״ק ז)
The most disputed point of the siman. The Taz: coercion presupposes a claim by the borrower. The Panim Meirot and the Knesset HaGedola oppose him; the She’ilat Yaavetz upholds the Taz at least where the borrower had waived. A real case here belongs to a court, not to private decision.

The Shach bounds the immunity in the other direction, and that bound is firm:

« נראה דאם כבר החזיר הרבית על פי ב״ד או מעצמו ואח״כ חזר ותפס משל לוה בעד הרבית יורדין לנכסיו » (ש״ך יו״ד קס״א ס״ק ח)
In practice. A lender who returned and then repaid himself by force is no longer under the regime of interest: he is under that of theft, and the court then descends into his property.

5. יורשים ובעל תשובה — after the fact: the heir and the penitent

Two situations, one criterion: is the object still there?

« לקח רבית קצוצה ומת אין הבנים צריכים להחזיר אלא אם כן היה דבר מסויים כגון פרה וטלית ועשה אביהם תשובה ולא הספיק להחזיר עד שמת » (שו״ע יו״ד קס״א:ו)
« אם בא לעשות תשובה מעצמו להחזיר הרבית אם הוא דבר מסויים מקבלים ממנו » (שו״ע יו״ד קס״א:ז)
The heirs. They owe nothing, save on two conditions together: the object is identifiable, and the father had set about making amends without having had the time. The Shach gives the reason — the father’s honour, not an inherited debt.
« שאז חייבים להחזיר משום כבוד אביהם » (ש״ך יו״ד קס״א ס״ק י)
« דאמר קרא אל תקח מאתו נשך לדידיה אזהר רחמנא ולא לבריה » (ט״ז יו״ד קס״א ס״ק ד)
The penitent. What is no longer identifiable is not accepted from him, so as not to shut the door of repentance. But the Shach sets two bounds that practice must know: one who persists instead of coming of his own accord has it taken from him against his will; and the leniency is the court’s, not Heaven’s.

The sense of “identifiable”. The Perisha: anything still in kind. The Nekudot HaKesef — the Shach correcting himself — : in the strict sense, and they prove it from the Rambam, who writes “theft still extant” on one side and “interest that is an identifiable object” on the other.

6. שטר שיש בו רבית — what the drafting of the deed decides

This is the only seif in the siman that yields a rule of drafting.

« שטר שיש בו רבית בין של תורה בין של דבריהם גובה את הקרן לבדו והוא שיהא ניכר שהוא רבית » (שו״ע יו״ד קס״א:י״א)
« כגון שהוא מפורש בשטר הקרן בפני עצמו » (רמ״א יו״ד קס״א:י״א)
« אבל אם אינו מפורש אלא שכולל הקרן עם הרבית אינו גובה בו אפילו הקרן » (שו״ע יו״ד קס״א:י״א)
Three cases, three outcomes. (1) The interest is written separately: the principal is collected — and the deed must nonetheless be torn. (2) Only the principal is written, witnesses testifying to the interest: the principal is collected, and the order to tear does not reach this case (Shach). (3) Principal and interest merged: nothing is collected, not even the principal.

Where the Taz and the Shach part. For the Taz, the requirement of legibility protects the validity of the witnesses; for the Shach, it guards against collecting the interest under the name of principal — and the witnesses are not disqualified. The Nekudot HaKesef rule against the Taz in two words.

Two points of practice. (1) If the borrower admits the principal, the Taz writes that he must pay it — the refusal to collect bears only on collection by the deed. (2) And the Shach closes the siman with a rule worth knowing: the borrower owes nothing of the profit he made with the money, however great; but it is fitting to fine him to give of it to the poor of the city.

Recapitulation in four lines.
  1. Loan + fixed sum = Torah interest: the court coerces the lender but does not seize his property.
  2. Every other wage for waiting = dust of interest: the court does not take it back — and it must be returned.
  3. The borrower’s consent is what protects the lender; remove it, and the sum becomes recoverable again.
  4. After the fact, everything depends on the object: still there, one returns and one accepts; gone, one neither returns nor accepts — save toward Heaven.
