1. The axiom: forbidding and recovering are two questions

The whole siman rests on one distinction. A transaction may be forbidden without the court taking back what it yielded. Forbidding belongs to the Torah or the Sages; taking back belongs to a positive commandment, and has conditions of its own. Never read an answer from the first column as though it held for the second.

The sentence that announces it is the first of the siman, and it bears on the smallest case:

« בפחות משוה פרוטה יש איסור רבית אבל אין מוציאין אותו בדיינין » (שו״ע יו״ד קס״א:א)
A prohibition that is not recovered is not half a prohibition. Seif 2 says so expressly of dust of interest: the court does not take it back, and whoever would discharge his duty toward Heaven must return it.

2. The three reflex questions

Before any case in the block of interest, three questions in this order and in no other.

4. The frontier: רבית קצוצה and אבק רבית

5. יוצאה בדיינים — a mitzva, not a debt

The seif says two things together, and their assembly is the doctrine.

« שהיו כופין ומכין אותו עד שתצא נפשו אבל אין בית דין יורדין לנכסיו » (שו״ע יו״ד קס״א:ה)
The Beit Yosef, in the name of the Rashba and the Ran, explains: this is not the execution of a debt, it is the coercion a court applies to bring about the fulfilment of a positive commandment.
« דהא דאמרינן יוצאה בדיינים היינו לומר דכופין אותו משום מ״ע דוחי אחיך עמך ומכין אותו עד שתצא נפשו כדי שיקיים המצוה אבל אין ב״ד יורדין לנכסיו » (בית יוסף יו״ד קס״א)

Three consequences to remember. (1) No seizure of property. (2) According to the Taz, a claim by the borrower is required — disputed by the Panim Meirot and the Knesset HaGedola. (3) The Shach bounds the immunity: a lender who returned and then seized by force is a thief, and there one does descend into his property.

6. דעת הלוה — the thread linking seifim 2, 3, 4 and 7

A single word runs through four seifim: what the borrower willed.

Remember the Nekudot HaKesef’s formulation: theft and interest are not restored by the same rule, because interest came into his hand with the consent of the one who gave it.

7. דבר מסויים — the heir and the penitent

Two seifim, one word, and one must know which of the two regimes applies.

To know. The Perisha, reported by the Shach, holds that “identifiable” is not to be taken strictly. The Nekudot HaKesef — that is, the Shach himself, correcting his own note — hold the opposite, and prove it from the Rambam.

The underlying question. Why must the interest be recognizable? For the Taz, because otherwise the witnesses would be disqualified. For the Shach and the Nekudot HaKesef, because one would fear collecting the interest under the name of principal — and the witnesses are not disqualified.

9. The vocabulary of the block — from 159 to 177

10. Golden rules, mnemonic and classic pitfalls

Five golden rules.
  1. “It is only dust of interest” has never meant “one may keep it”.
  2. The criterion is not the name of the transaction but what the money pays for: אגר נטר.
  3. Two conditions make Torah interest, and both are needed: the way of a loan, and a sum fixed at the time of the loan.
  4. Recovery of interest is the performance of a mitzva, not of a debt: hence the absence of seizure, and every difficulty that follows.
  5. After the fact — heirs, penitent, cloak — the question becomes: is the object still there?
Mnemonic — the four words of the siman.
אגר נטר: is it interest? · קצוב: is it of the Torah? · מדעת: is it taken back? · מסויים: is it accepted?
Four classic pitfalls.
  1. Thinking that “not recoverable” means “permitted”. Seif 2 says exactly the opposite in its second half.
  2. Confusing coercion of the person with seizure of property. Seif 5 states the one and refuses the other in a single sentence.
  3. Attributing the Ramban’s view to the Rema at seif 11: that is the Taz’s reading, and the Nekudot HaKesef refuse it in two words.
  4. Taking “identifiable” as a synonym of “still existing”. That is the Perisha’s reading, and the Shach himself corrected it.
For practice. This level is a study recapitulation. A real financial arrangement is judged on its exact terms, and the classification it receives decides real sums. For the application to your own case, ask your Rav.
