One seif, three formulas, and a lesson one does not forget: in a vow, the preposition decides. “Behold I am upon you” closes my property to the other; “behold you are upon me” closes his to me. Then comes the real difficulty: what becomes of the synagogue, of which both are co-owners along with the whole town?

1. The principle of the siman

The preceding siman spoke of a father and a son. This one takes two men at random — Reuven and Shimon, the names halakhic literature always gives to those who have none — and asks a single thing: what exactly did he say?

For the language of a vow is not a manner of speaking, it is an instrument. חרם means “set apart”, cut off from use. To say “behold I am חרם upon you” is to cut oneself off from the other’s use: my property becomes closed to him. To say “behold you are חרם upon me” is to cut the other off from my use: his property becomes closed to me. The difference hangs on a single suffix, and it decides which of the two men will be inconvenienced all year.

The second half of the seif is of an altogether different order, and it is what occupied the commentators. Once the two men have forbidden each other, what of the things they own jointly with third parties? The Temple Mount belongs to all Israel — nobody has a share of his own in it, and nothing is closed. The synagogue belongs to the people of that town: each has a share in it, and that is a real obstacle. The Shulḥan Arukh gives the remedy — convey one’s share — and then reports an opinion for which there is no problem at all.

The three blocks of the seif. (1) Three formulas and, for each, the name of the man who is bound. (2) Shared property: open if it belongs to all Israel, closed if it belongs to the town. (3) The remedy — convey one’s share — and the יש אומרים that makes it superfluous wherever there is no דין חלוקה. Then the Rama’s gloss, which shifts the question to the law of communities.

2. The text of the Shulḥan Arukh

The siman has only one seif, but it is a long one. Here it is in full, with its header and the Rama’s gloss, then clause by clause.

The single seif — the three formulas, communal property, and the remedy

The seif reads in three movements. First three formulas, and for each the name of the man who ends up bound. Then the question these formulas immediately raise: what of the property the two men share with others? Finally the remedy, and a dissenting opinion that makes it unnecessary in most cases.

Reuven who said to Shimon: “behold I am חרם upon you”, or: “behold you are forbidden my benefit” —
The two formulas are equivalent and say the same thing: what is mine is closed to you. The word עליך, “upon you”, places the prohibition on the addressee’s side.
Reuven is permitted the benefit of Shimon, and Shimon is forbidden the benefit of Reuven.
The vow is not reciprocal, and it does not bind the speaker. The man who spoke keeps access to the other’s property; it is the other who loses access to his.
And if he said to Shimon: “behold you are חרם upon me” —
A single word changes — עלי instead of עליך — and everything flips. “Upon me” means: what is yours is closed to me. The speaker has forbidden himself.
Reuven is forbidden the benefit of Shimon, and Shimon is permitted the benefit of Reuven.
The exact mirror image of the first clause. This reversal is the whole interest of the siman: the outcome turns not on intention but on the preposition.
“Behold I am חרם upon you, and you upon me” — both are forbidden to benefit from each other.
The two formulas together produce a reciprocal prohibition. It is that case, and only that one, which will raise the question of communal property: two equally bound men who are co-owners of the same thing.
And they are permitted in things that are in the joint ownership of all Israel, like the Temple Mount and the courtyards.
What belongs to all Israel belongs, in a sense, to no one in particular: neither of them has a share in it that the other could object to his using.
And they are forbidden in things that are in the joint ownership of the people of that city, like the synagogue, the ark and the books.
Here, by contrast, each has a real and identifiable share: entering the synagogue means entering the other’s share too. It is around this clause that the whole discussion in the apparatus is knotted.
And what is their remedy? That they convey to another the share they have in it, and it then turns out that neither of them benefits from his fellow’s property.
The remedy is a real legal act, not a fiction: one exits the co-ownership. The mishna spoke of writing one’s share over to the נשיא; the Shulḥan Arukh says שיקנו, that they convey it.
And some say they are permitted in anything that has no דין חלוקה.
דין חלוקה is the right to demand partition of jointly held property, which exists only if the thing remains useful once divided. For this opinion a synagogue has no such status, and so no prohibition takes hold in it. The Shakh will adopt it.
Gloss (Rama): and one who lent his house to serve as a synagogue — there is, in the takana of Rabbenu Gershom, that he may not forbid it to one member of the congregation unless he forbids it to all of them.
The Rama moves from the law of vows to the law of communities: the question is no longer what a man can forbid, but what a takana lets him do against a single man. The Shulḥan Arukh says the same in אורח חיים.
Remember. עליך binds the other, עלי binds oneself, the two together bind both. Property of all Israel stays open; the city’s closes — and the remedy is to convey one’s share. One opinion holds that where there is no דין חלוקה, nothing closed at all.

3. The vocabulary of the siman

חרם — literally “what is set apart”. Used in a vow, the word does the same work as a קונם: it withdraws a thing from someone’s use. The siman uses it as the typical formula because it makes the asymmetry most visible.
הנאה — benefit, in the widest sense: any advantage drawn from a thing or a person. It is the ordinary object of these vows — one does not forbid an object, one forbids deriving benefit from it.
דבר של עולי בבל — “what belongs to those who came up from Babylon”, that is, what was consecrated to the use of all Israel on the return from exile: the Temple Mount, the courtyards. The mishna sets it against The Shulḥan Arukh renders the first expression as “in the joint ownership of all Israel”.
דין חלוקה — the right to demand partition of jointly held property. It exists only if the thing remains useful once divided: a courtyard too small to leave each party a usable space has no דין חלוקה. The whole discussion in the apparatus concerns where the synagogue stands on that scale.
תקנת רבנו גרשום — the body of ordinances attributed to Rabbenu Gershom Meor HaGolah. The Rama invokes one here: one may not forbid to some what one leaves open to others, in a house lent to serve as a synagogue.

4. The sources — mishna, Rambam, Tur, Beit Yosef

The mishna — נדרים מ״ז ע״ב and מ״ח ע״א

The whole siman is a mishna, and the Beit Yosef says so in a word: It gives the three formulas with two technical terms the Shulḥan Arukh will replace by proper names — the מודר, the man the vow was made about, and the נודר, the man who uttered it.

The Rambam — הלכות נדרים, chapters ה׳ and ז׳

The Rambam divides the matter over two chapters: the formulas in the fifth, communal property in the seventh. And he adds, in the fifth, a storey the Shulḥan Arukh will not reproduce — that of מלקות. Level 2 returns to it.

The Tur and the Beit Yosef

The Tur follows the Rambam closely and expressly reports the distinction about מלקות. The Beit Yosef does two things that matter: he notes that the Ran differs from the Rambam on that very point, and he reports from the Orḥot Ḥayyim the ruling of the Ra’avad and all the sages of his generation — that one simply cannot forbid one’s share of the synagogue.

The echo in אורח חיים, siman 153

The Shulḥan Arukh wrote on this matter twice: here, in the law of vows, and there, in the law of the synagogue. The Shakh expressly refers to the second place, and gives the number: He is right — and the text there is decisive.

5. The apparatus, entry by entry

This siman carries nine entries: three of the Shakh, three of the Taz, two of the Ba’er Hetev and one of the Pitḥei Teshuva. All are quoted below. The Taz’s first is a special case: a dissertation of nearly four thousand characters, the longest in this whole block. It is divided here into four successive blocks which cover it entirely — all four under the same ס״ק reference, because it is a single entry.

The Shakh — three entries

The first distinguishes the law from the takana; the second takes the side of the יש אומרים; the third refers to אורח חיים.

ס״ק א — “ כמו ב״ה ” — the law says one thing, the takana another

ס״ק ב — “ וי״א ” — the synagogue has no דין חלוקה, and that is the main view in the Shas

ס״ק ג — “ ומי שהשאיל ” — see the Rama in אורח חיים

The Taz — three entries

The first is a dissertation in four movements, quoted below in four blocks under one and the same reference.

ס״ק א — “ כמו בית הכנסת ” — the Rambam’s contradiction, in four movements

ס״ק ב — “ ויש אומרים שהם מותרים ” — it is the view of the Ramban and the Ran

ס״ק ג — “ שאינו רשאי ” — the reference to אורח חיים on the Rama’s gloss

The Ba’er Hetev — two entries

He reports the Shakh, and then — and this is the service he renders — sets the Taz against him and names the divergence.

ס״ק א — “ תקנתם ” — the Shakh, reported and named

ס״ק ב — “ חלוקה ” — the Shakh on one side, the Taz on the other

The Pitḥei Teshuva — one entry

Two words, and a reference to a later responsum.

ס״ק א — “ וי״א שהם מותרים ” — see the Taz, the Shakh, and the Mishkenot Yaakov

One work with no entry on this siman

The Nekudot HaKesef have no entry on this siman. That makes sense: the Nekudot HaKesef are the Shakh’s reply to the Taz, and they appear only where the Shakh judged he had to answer point by point. Here his reply is already contained in his own ס״ק ב — he takes the side opposite the Taz and writes that it is the main view in the Shas. The Nekudot HaKesef are read at the neighbouring siman 223, and at siman 226. No entry has been manufactured here.

7. Practical cases

Four situations, and in each the same first question: what words exactly were uttered?

“I want nothing more from you”

Put that way, in English, this is not yet a vow — it is a declaration of intent. But if the sentence was said in the form of a vow, one must know which way it leans: did the man close the other’s property to himself (עלי) or his own to the other (עליך)? That is the first thing the Rav will ask.

Two members of one congregation have forbidden each other

This is exactly the case of the seif. The Meḥaber writes that they are forbidden in the synagogue, the ark and the books, and gives the remedy. But the Shakh immediately recalls that by the Ra’avad’s takana a man cannot forbid his share of the synagogue or of the books — and that if he did, his prohibition is none. The Shulḥan Arukh says so himself in או״ח קנ״ג:ט״ו.

A lent house that serves as a synagogue

This is the Rama’s gloss, and it changes register: the question is no longer what a vow can reach but what a communal takana allows. The owner cannot single out one member; he must forbid it to the whole congregation or to nobody.

A place open to everyone

The seif counts the Temple Mount and the courtyards among the property of all Israel, where the vow does not bite. The mishna adds הבור שבאמצע הדרך, the cistern in the middle of the road. The criterion is not public use but the absence of any private share.

8. Comprehension questions

  1. “הריני עליך חרם” and “הרי אתה עלי חרם”: which of the two men is bound in each case, and by what word can one tell?
  2. Why does property belonging to all Israel escape the vow while the town’s does not? The criterion is not public use: what is it?
  3. What is the remedy the seif gives, and how does it differ from the mishna’s formula?
  4. The יש אומרים makes the remedy unnecessary in certain cases. Which, and why?
  5. The Shakh and the Taz disagree about the synagogue. Who says what, and where does the Ba’er Hetev write it?
  6. The Rambam distinguishes a case where one receives מלקות from one where one does not. Where does the difference lie, and who reports it?
  7. The Shakh sets the law against a takana. What does the takana say, whose is it, and where does the Shulḥan Arukh adopt it?

To go further

Return to siman 223 for the case of the father and the son, then read siman 225, which shows what happens when a man purports to forbid something that is not his at all. Siman 226 takes up the question of דין חלוקה for two partners, and siman 228 says how a vow that has taken hold is undone.
