The practical questions

  1. Before anything: which formula?
  2. Communal property: what stays open and what closes
  3. The synagogue: an open dispute, and a takana that overrides it
  4. A house lent to serve as a synagogue
  5. One work with no entry, and four contemporary situations

1. Before anything: which formula?

This level sets out the halakha as the Shakh, the Taz, the Ba’er Hetev and the Pitḥei Teshuva give it on this siman. It does not replace a Rav. A note on the compartment: the Admur HaZaken did not write a Shulḥan Arukh on Yoreh De’ah. This level is a level of psak, not a “Daat HaRav”.
The first question is always the same, and purely factual: what words were uttered? The outcome depends not on what the man intended but on the preposition. “עליך” → the other is bound. “עלי” → oneself. Both together → both.

2. Communal property: what stays open and what closes

The seif’s rule is easy to remember and easy to misapply. It is not public use that decides, it is the share. In a thing belonging to all Israel nobody has an identifiable share and the vow does not bite. In a thing belonging to the people of a town, each of them has a share, and one man’s share is an obstacle to the other.
The remedy is an act, not a word. The seif says שיקנו חלקם — that they convey their share to another. The Rambam describes the procedure: each writes his share over to the נשיא or to anyone else, ומזכה לו בחלקו על ידי אחר, conveying it to him through a third party. It is an act of קנין, with all that this entails.

3. The synagogue: an open dispute, and a takana that overrides it

On the point of law the siman’s two great commentators do not agree, and neither prevails in the text. The Taz defends the Meḥaber’s first opinion — forbidden. The Shakh holds that the יש אומרים is the main view in the Shas — permitted. The Ba’er Hetev presents both without choosing, and the Pitḥei Teshuva refers to both, adding a later responsum.
But the practical question lies elsewhere. The Shakh opens his comment with a distinction not to be missed: this whole debate is מדינא. And, he says, there is a takana — the Ra’avad and all the sages of his generation — by which a man cannot forbid his share of the synagogue or of the books, and if he did so anyway, The Shulḥan Arukh writes it himself in או״ח קנ״ג:ט״ו. That is what governs a real case.

4. A house lent to serve as a synagogue

The Rama’s gloss settles a very concrete and very frequent case: a man makes a room of his house available to a minyan, then falls out with one of the worshippers. May he shut the door on him? No — he must shut it on the whole congregation or on nobody. The Shulḥan Arukh says the same in אורח חיים, and the Rama adds there an important proviso: this holds only if he lent it unconditionally at the outset.

5. One work with no entry, and four contemporary situations

The Nekudot HaKesef have no entry on this siman. They are the Shakh’s reply to the Taz, and here the Shakh replied in his own ס״ק ב. They are read at simanim 223 and 226. No entry has been reconstructed here.
A quarrel between two members of the same synagogue. Even if a vow was made, the Ra’avad’s takana removes the power to forbid one’s share of the synagogue and of the books. What remains to be examined is what is not communal: the house, the car, the lending of an object.
An asset held by an association — a study hall, a library, equipment. One must first establish who owns it in law. If it belongs to an association or a trust, and not to the members individually, the question of the share does not arise in the same terms. That belongs to the law of legal persons as much as to the law of vows, and it must be asked.
The remedy, in practice. Transferring one’s share to a third party is a real act of acquisition, with a real acquirer. It is neither a declaration nor a formula, and it is not improvised: it is an operation carried out under a Rav’s direction.
And if one does not remember the formula? This is the commonest case, and it is real: nobody utters a vow weighing his prepositions. There is no general answer — reconstructing the words and classifying them is precisely the Rav’s work.
