A siman of a single seif, and a rule that closes a door: once the vow has taken effect, a man does not release himself, and no clause inserted in advance changes that. But before the vow takes effect everything is still possible — and a vow for a term needs nothing at all.

Plan of study

1. The principle — and a heading that announces two subjects
2. The text of the Shulḥan Arukh, clause by clause
3. The vocabulary:
4. Where it comes from: the Tur, the Rambam, the Rosh, the Rivash
5. The apparatus, entry by entry — and two absences
6. The revision table
7. Three real situations

1. The principle — and a heading that announces two subjects

The siman’s heading names two figures: “ הנודר על תנאי או מי שתולה נדרו בדעת אחרים ” (שו״ע יו״ד רל״א:א) — the one who vows on condition, and the one who hangs his vow on another’s consent. The single seif treats them in one movement, because they fail for the same reason: neither can take the sage’s place.

The siman in one sentence. Once the vow has taken effect there is only one way out: a מומחה, or three ordinary men. No clause inserted at the moment of the vow creates a second door — neither “I may annul it whenever I wish” nor “so-and-so may annul it whenever he wishes”. But before the vow has taken effect, annulment is possible; and a vow set for a fixed term needs nothing at all: it lapses of itself at the appointed time.

2. The text of the Shulḥan Arukh

The siman has a single seif. Here it is in full, with its opening line, and then clause by clause.

Single seif — who releases, and why a condition changes nothing

A vow and an oath are released only by an expert, or by three ordinary men.
Two ways, and only two. The מומחה is a recognised sage who releases on his own; failing that, three הדיוטות — men without title, who nevertheless know what they are doing. Siman 228 sets out both; our siman only says there is no third.
for even if he stated and stipulated, at the moment of the vow or the oath, that whenever he wished he would annul it from its root
The case is that of the provident man: he attaches an escape clause to his vow. Note the word מעיקרו — “from its root”: he asks not merely to be able to stop, but that the vow be deemed never to have existed. That is exactly what a התרה does — and exactly what he cannot grant himself.
or that he hung it (on another) — that he would annul it whenever he wished: it is nothing.
The word באחר stands in parentheses in the edition: it is a source note, which we copy as it stands. And the verdict falls with the same word as siman 225: אינו כלום — not “it is difficult” but “it has no effect at all”.
for from the moment the vow takes effect it has no release except through an expert or three ordinary men.
Here is the reason: The decisive moment is that of חלות, taking effect. Before it, one is still in a time when the word can be undone another way; after it, the only exit is the one the Torah provided.
And even if he hung it on another’s consent, and that man upheld it, and was afterwards asked about his upholding — it avails nothing.
The case is subtle and the Taz unfolds it: the other gave his agreement — so the vow took effect — and then thought better of it and had his own agreement released. In vain: what he released was his confirmation, not the vow.
But if he did not uphold it, and immediately on hearing it said that it should not be a vow — the vow is void.
The Rama gives the reverse. The word that carries everything is מיד, immediately. This is not a release, it is an annulment: the vow never took effect, because it hung on an agreement that never came. The Rama names his source: “ כן משמע מדברי הרא״ש כלל י׳ סי׳ ג׳ ומל׳ הטור ” (רמ״א יו״ד רל״א:א).
And all the more so if he expressly stipulated that his fellow could annul it: his fellow may annul it as long as the vow has not taken effect.
Take care not to read this clause as the opposite of the Meḥaber. The Meḥaber refuses a clause that would allow annulment after the vow takes effect; the Rama permits annulment so long as it has not. The dividing line is always the same: חל / לא חל. Source: “ ריב״ש סי׳ תפ״ו וקפ״ב ” (רמ״א יו״ד רל״א:א), and cross-reference: “ ועיין לעיל סי׳ רכ״ח סעיף ל״ז ול״ח ” (רמ״א יו״ד רל״א:א).
However, if he vowed for a set term, he needs no release: when the term arrives it lapses of itself.
The last clause is a breath, and it lights up all the rest by contrast. A vow bounded in time needs no escape door, because it has no wall beyond the term. The difference from the clause refused above is exactly this: here the limit is inside the vow; there it was upon the vow.

3. The vocabulary of the siman

מומחה — a recognised sage who releases alone. Siman 228 states that in our time no one is held to be מומחה to the point of releasing alone; in practice, then, it is the second way that serves.
ג׳ הדיוטות — three ordinary men. The word הדיוט does not mean ignorance: it means absence of title. They must know what is at stake and know how to open a פתח.
ביטול — annulment. It needs neither sage nor formula: it works in any language, but only before the vow has taken effect. That is the Rama’s regime in this siman.
התרה — release. It uproots the vow from its origin, but it requires the sage or the three, and it operates only after the vow has taken effect.
תולה נדרו בדעת אחרים — to hang one’s vow on another’s consent. Two very different forms hide under that phrase, and the Shakh separates them at ס״ק א: hanging it on an agreement (the other may then prevent it), or charging the other with releasing it later (which cannot be done).
נדר לזמן — a vow for a term. It is not released: it expires.

4. The sources — the Tur, the Rambam, the Rosh, the Rivash

The Tur — the Shulḥan Arukh copies him almost word for word

The comparison is worth making slowly. The Tur writes “ אין הנדר ניתר אלא ע״פ חכם מומחה או ג׳ הדיוטות ” (טור יורה דעה רל״א); the Shulḥan Arukh writes “ אין הנדר והשבועה ניתרים אלא על פי מומחה או בג׳ הדיוטות ” (שו״ע יו״ד רל״א:א). Two differences, both deliberate: the Meḥaber adds והשבועה, and he replaces חכם מומחה with מומחה alone.

The Rambam —

The second sentence is the foundation of our whole siman, in six words of Hebrew: no man can release his own oath. A clause by which a man reserves the right to annul his vow whenever he wishes is nothing other than an attempt to release himself — in advance.

The authorities the Rama names

For the first half of his gloss: “ כן משמע מדברי הרא״ש כלל י׳ סי׳ ג׳ ומל׳ הטור ” (רמ״א יו״ד רל״א:א). For the second: “ ריב״ש סי׳ תפ״ו וקפ״ב ” (רמ״א יו״ד רל״א:א).

The two seifim of siman 228 to which this siman refers

These two seifim are the practical counterpart of ours, and siman 228 itself refers here. 228:37 says that an oath sworn on another’s consent needs a proper release — unless he states that such was his intention from the start. 228:38 gives the case where permission suffices: where the oath from the outset concerned the absence of authorisation.

5. The apparatus, entry by entry

This siman carries seven entries: two of the Shakh, three of the Taz — the last in two paragraphs — and two of the Ba’er Hetev.

The Shakh — two entries

The Shakh begins by correcting a reading:

Then he opens the door the Meḥaber had not named:

Everything turns on the difference between שיבטלנו read as “that he release it” and שיבטלנו read as “that he prevent the vow from taking effect”. The first is refused — the sage’s role is not delegated. The second is permitted: the man whose agreement conditioned the vow may refuse it, and in any words at all.

ס״ק ב, on the Rama’s gloss. The Shakh describes two distinct mechanisms by which annulment can work:

The second mechanism is the finer one: the vow was framed so as not to take effect until the fellow had heard it. He annuls it the moment he hears it — and so the vow never took effect at all.

The Taz — three entries, one of them in two paragraphs

ס״ק א explains the Meḥaber’s closing case:

ס״ק ב raises a difficulty on the Rama’s gloss:

The Taz refuses to read the Rama as giving the third party an automatic power of annulment. It is necessary, he says, that the vower state that such was his intention from the start — and that is exactly what siman 228:37 requires.

ס״ק ג restricts the reach of that power, then reports a case. These are two paragraphs of the same ס״ק, not two entries: we quote them under the same number.

Second paragraph of the same ס״ק — the case of the spouses:

The case is a man who asks his wife for a mutual undertaking: neither to remarry after the other’s death. The Taz reports that neither vow takes effect — his for a reason of its own, hers because she undertook only on the strength of his undertaking. A digitisation typo is to be flagged here: the edition prints אינוחל as one word where two are meant. We copy without restoring.

The Ba’er Hetev — two entries

A point to flag. At ס״ק א the Shakh refers to “ בסימן רכ״ח ס״ק צ״ח ” (ש״ך יו״ד רל״א ס״ק א) — that is, to his own ס״ק צ״ח on siman 228; the Ba’er Hetev, condensing him, writes “ כמ״ש בסי׳ רכ״ח סל״ז ” (באר היטב יו״ד רל״א ס״ק א), that is seif 37. The two point to the same place by two different referencing systems. We copy both.

Two works with no entry on this siman

The Pitḥei Teshuva and the Nekudot HaKesef have no entry here. Nothing follows from that either way as to the halakha: the Pitḥei Teshuva writes when the responsa literature has something to add, and the Nekudot HaKesef when the Shakh wishes to answer the Taz. They are found in force close by — the Pitḥei Teshuva with six entries at siman 229 and twenty at siman 232, the Nekudot HaKesef with four entries in each of those two simanim. Not one entry has been manufactured here to fill a column.

6. Table — each clause and its sense

AuthorTextSense
Meḥaber“ אין הנדר והשבועה ניתרים אלא על פי מומחה או בג׳ הדיוטות ” (שו״ע יו״ד רל״א:א)Two ways of release, and no third.
Meḥaber“ שאפילו פירש והתנה בשעת הנדר או השבועה אימתי שירצה שיבטלנו מעיקרו ” (שו״ע יו״ד רל״א:א)An escape clause a man grants himself is worth nothing.
Meḥaber“ דמיד כשחל הנדר אין לו התרה אלא על ידי מומחה או ג׳ הדיוטות ” (שו״ע יו״ד רל״א:א)The reason: once it takes effect, only the appointed way.
Meḥaber“ ואפילו אם תלאו בדעת אחר וקיימו ושוב נשאל על הקיום אינו מועיל ” (שו״ע יו״ד רל״א:א)Releasing a third party’s confirmation does not release the vow.
Rama“ אבל אם לא קיימו ומיד ששמעו אמר שלא יהיה נדר הנדר בטל ” (רמ״א יו״ד רל״א:א)The third party’s immediate refusal prevents the vow from taking effect.
Rama“ וכ״ש אם התנה בפירוש שחבירו יוכל לבטלו דיוכל חבירו לבטל כל זמן שלא חל הנדר ” (רמ״א יו״ד רל״א:א)All the more so where that power was expressly given him.
Meḥaber“ ומיהו אם נדר לזמן אין צריך התרה אלא לכשיגיע הזמן בטל ממילא ” (שו״ע יו״ד רל״א:א)A vow for a term expires without release.

7. Practical cases

“I added to my vow: I may annul it whenever I wish”

The clause produces nothing: אינו כלום. The vow took effect, and the ordinary way is required — a מומחה, or three. This is not severity: release is not the vower’s to give, and granting it to himself in advance does not make it his.

“I vowed on condition that my wife agreed, and she said no at once”

This is not the same case, and the answer is the reverse. The vow never took effect, for want of the agreement on which it hung — and the Shakh specifies that the refusal counts in any words. But the Rama’s word “immediately” is decisive, and the Taz underlines it: later, it is no longer possible. A Rav will judge whether the facts fall within this frame.

“I vowed not to eat meat for thirty days”

Nothing to do on the thirty-first day: the vow is spent. There is no need to find three men or to pronounce any formula. The last clause of the seif says so expressly.

8. Questions for review

  1. What are the two ways of release, and which is in use today?
  2. Why is a clause “I may annul it whenever I wish” worth nothing? Find in the seif the line that gives the reason.
  3. What is the decisive word in the Rama’s gloss, and what happens if it is missing?
  4. At ס״ק א the Shakh distinguishes two senses of שיבטלנו. Which, and why is one permitted and the other not?
  5. What difficulty does the Taz raise on the Rama’s gloss, and how does he resolve it?
  6. Why does a vow for a term need no release, while an annulment clause is worth nothing? State the difference.
  7. The Pitḥei Teshuva and the Nekudot HaKesef write nothing here. What may be concluded — and what may not?

Going further

The full mechanism of release — פתח, חרטה, מומחה, three הדיוטות — is at siman 228, whose seifim 37 and 38 are the direct counterpart of our siman. What becomes of a vow released in part is at siman 229. And the question whether one releases at all, and on what conditions, is at siman 230.
