Siman 233 — the season of vows, for the boy and for the girl (יורה דעה רל״ג)
A single seif, and three ages. Before twelve for a boy, eleven for a girl: his word has no grip, even if he understands perfectly. During the year preceding majority: it binds, on one condition — that he know in whose name he vowed, and this is verified, every time. After: it binds, even if he does not know. (Shulḥan Arukh, Yoreh De’ah 233 — 1 seif.)
A boy of twelve years and a day, a girl of eleven years and a day: if they know in whose name they vowed, their vows are vows — even though they have not produced two hairs. And one examines during the thirteenth year for the boy, the twelfth for the girl; and before that, even if they know, it is not a vow. Three periods in one sentence, and a condition that changes its nature at each boundary.

The single seif in Hebrew, its translation, its clause-by-clause breakdown, the vocabulary (עונת נדרים · מופלא הסמוך לאיש · בדיקה · שתי שערות · עינוי נפש), the sources — the mishnah of נדה מ״ה ע״ב, the Rambam in הלכות נדרים and הלכות שבועות, the Tur — and the four apparatus entries quoted one by one.
Four questions: what the year of examination measures and why it is repeated at every vow; the מופלא הסמוך לאיש, from the Torah on the Rambam’s view and yet without penalty; the Tur’s clause the Shulḥan Arukh did not carry over; and the Rama’s redistribution of the Rambam’s two cases.
The rule in one sentence, the three ages in a diagram, the origin of each clause, the four apparatus entries, the seif clause by clause, what remains open, the vocabulary and the standard pitfalls.
The practical halakha: what binds and what does not according to age, the בדיקה that is repeated, what a parent should do with a child’s vow, and the limit of עינוי נפש. Note: the Admur HaZaken wrote no Shulḥan Arukh on Yoreh De’ah — this is a psak level, not “Daat HaRav”.
There are three periods, not two. From twelve years and a day for a boy and eleven years and a day for a girl, the vow binds if they know in whose name they vowed: “ קטן בן י״ב שנה ויום אחד וקטנה בת י״א שנה ויום אחד אם יודעים לשם מי נדרו ונשבעו נדריהם נדר ושבועתם שבועה ” (שו״ע יו״ד רל״ג:א). From thirteen and twelve, it binds unconditionally.
And if the child is younger but plainly mature?
The seif excludes it expressly, and the word “even” is decisive: “ וקודם שיש י״ב לזכר וי״א לנקיבה אפילו יודעים לשם מי נודרים אינו נדר ” (שו״ע יו״ד רל״ג:א). Below the boundary, maturity does not substitute for age.
What exactly is checked, and who checks it?
One thing only: does he know in whose name he vowed. The Rambam makes it an act, not an impression: “ קָטָן בֶּן שְׁתֵּים עֶשְׂרֵה שָׁנָה וְיוֹם אֶחָד וּקְטַנָּה בַּת אַחַת עֶשְׂרֵה שָׁנָה וְיוֹם אֶחָד שֶׁנִּשְׁבְּעוּ אוֹ נָדְרוּ בֵּין נִדְרֵי אִסָּר בֵּין נִדְרֵי הֶקְדֵּשׁ בּוֹדְקִין אוֹתָן וְשׁוֹאֲלִין אוֹתָן ” (רמב״ם הלכות נדרים פרק י״א הלכה א׳). This is a step taken before a Rav, not a parent’s judgement.
My son was examined six months ago. Does that hold for the year?
No, and this is the Shakh’s contribution: “ שאפילו בדקם בתחלת השנה ונמצאו שיודעים לשם מי נדרו אם נדרו אחר כך בסוף שנה אינו נדר עד שיבדקם פעם אחרת טור ועב״י ” (ש״ך יו״ד רל״ג ס״ק א). What is examined is not an acquired faculty, but knowledge of that vow.
Must the child show the signs of majority?
No, neither before nor after. The seif says so for the first period — “ אע״פ שלא הביאו ב׳ שערות ” (שו״ע יו״ד רל״ג:א) —
and the Shakh extends it to the last: “ ומי״ג ויום א׳ ואילך כו׳. אע״פ שלא הביאו ב׳ שערות ” (ש״ך יו״ד רל״ג ס״ק ב).
My nine-year-old promised something. Should I hold him to it?
His vow does not bind him. But the Rama addresses exactly this question, and his answer is educational: “ ואם הוא דבר קטן וקל ואין בו עינוי נפש אומרים להם שיעמדו בנדרם ושבועתם כדי שלא ירגילו עצמם בזה ” (רמ״א יו״ד רל״ג:א).
Note the limit: nothing that causes the child distress. And the purpose, in the Rambam from whom the Rama draws his gloss, is wider: “ צָרִיךְ לְהִזָּהֵר בַּקְּטַנִּים הַרְבֵּה וּלְלַמֵּד לְשׁוֹנָם דִּבְרֵי אֱמֶת בְּלֹא שְׁבוּעָה כְּדֵי שֶׁלֹּא יִהְיוּ רְגִילִים לְהִשָּׁבַע תָּמִיד ” (רמב״ם הלכות שבועות פרק י״ב הלכה ח׳).
Why does the Taz write nothing here?
The siman is brief and the Shakh says everything in it. Nothing about the halakha follows. The Taz is present in force all around: seventeen entries at siman 229, thirty-four at siman 232, sixty-six at siman 234. The Nekudot HaKesef, being the Shakh’s reply to the Taz, by their nature have nothing to write where the Taz is silent. Not one entry has been manufactured here to fill a column.
