Level 4 — Daat HaRav (the Alter Rebbe) — Siman י״ד (ציצית שעשאן עכו״ם ונשים וטלית שאולה)

The way of the Alter Rebbe on who makes the tzitzit and whose talit it is: the עֲשִׂיָּה לְשֵׁם מִצְוָה (a non-Jew pasoul, a woman kasher), tying without kavana (no berakha), the borrowed talit (30 days — « כְּסוּתְךָ », מַתָּנָה עַל מְנָת לְהַחֲזִיר), another's talit (נִיחָא לֵיהּ — fold it back, do not move it), tefillin and sefarim, and the partners' talit — in the sensibility of Chabad.

Why a Level 4 dedicated to the Alter Rebbe? The Shulchan Aruch of the Alter Rebbe is not a commentary on the Mehaber (מחבר) — it is an autonomous and complete Shulchan Aruch, written by the Alter Rebbe (Rabbi Schneur Zalman of Liadi, founder of Chabad, disciple of the Maggid (מגיד) of Mezeritch). Its singularity: it combines halacha (הלכה) + the reasons of the mitzvot (טעמי המצוות) + the inner dimension in a single work, and it rules with a unique Talmudic rigor.

For Chabad, the Alter Rebbe is הפוסק האחרון — his ruling is the decisive authority. The Rebbe explicitly instructed to study the Shulchan Aruch of the Alter Rebbe (שולחן ערוך הרב) seriously. סעיף א נָכְרִי שֶׁהֵטִיל צִיצִית בְּבֶגֶד — פָּסוּל, שֶׁנֶּאֱמַר "דַּבֵּר אֶל בְּנֵי יִשְׂרָאֵל" — בְּנֵי יִשְׂרָאֵל יַעֲשׂוּ צִיצִית, וְלֹא נָכְרִי.

A non-Jew who attaches tzitzit — pasoul. A non-Jew (נָכְרִי) who attached tzitzit to a garment — they are pesulim, for it is said: « דַּבֵּר אֶל בְּנֵי יִשְׂרָאֵל וְעָשׂוּ לָהֶם צִיצִת » — the Bnei Israel shall make the tzitzit on the corner, and not a non-Jew. Chiddush of the Rav: he formulates the derasha as a rule of עֲשִׂיָּה — the attaching (הֲטָלָה) on the corner is the act the Torah reserves for בני ישראל; this foundation carries the whole siman (the woman, the minor, the kavana).

סעיף ב הָאִשָּׁה כְּשֵׁרָה לְהָטִיל צִיצִית… וַהֲלָכָה כַּסְּבָרָא הָרִאשׁוֹנָה, וּמִכָּל מָקוֹם טוֹב לִזָּהֵר לְכַתְּחִלָּה כַּסְּבָרָא הָאַחֲרוֹנָה.

The woman — kasher; the lechatchila precaution. A woman is kasher to attach tzitzit to a garment, because she is included in « בְּנֵי יִשְׂרָאֵל ». But some compare tzitzit to tefillin: just as women are pesulot to write [tefillin] because they are not obligated to wear them (cf. sim. לט) — so they would be pesulot to attach tzitzit, not being obligated in the mitzvah of tzitzit. According to them, even a minor (קָטָן) is pasoul to attach tzitzit — even if an adult stands over him and tells him to act לְשֵׁם מִצְוַת צִיצִית. But the spinning (טְוִיָּה) and the twining (שְׁזִירָה) — kasher by women and minors, even lechatchila, according to all. The halacha follows the first opinion; nevertheless it is good to take care lechatchila according to the last opinion. Chiddush of the Rav: he rules the din (כְּשֵׁרָה) while integrating the Rama's stringency as טוֹב לִזָּהֵר; he extends the debate to the קָטָן, and confines it to the הֲטָלָה — the spinning and twining remaining kasher according to all.

סעיף ג הֵטִיל יִשְׂרָאֵל צִיצִית בְּלֹא כַּוָּנָה — פְּסוּלִים, וְכֵן הֲלָכָה ; וּבִשְׁעַת הַדְּחָק יִלְבַּשׁ טַלִּית זוֹ אֲבָל לֹא יְבָרֵךְ עָלֶיהָ.

Attaching without kavana — pasoul; the she'at hadechak without a berakha. If a Jew attached tzitzit without intention — that is, without intending לְשֵׁם מִצְוַת צִיצִית — one authority says they are kasher: otherwise, why did Scripture need to disqualify the non-Jew, who never intends לשם מצות ציצית? But others say: attached without kavana — pesulim; Scripture only needed to disqualify the non-Jew where a Jew stands over him, assists him and tells him to act לְשֵׁם צִיצִית — and even so they are pesulim. Such is the halacha (וְכֵן הֲלָכָה). Nevertheless, in a time of pressing need (בִּשְׁעַת הַדְּחָק) — if he has no other properly tzitzited talit, and he also cannot untie the tzitzit and re-attach them with kavana, for instance because it is Shabbat — one relies on the first opinion: he wears this talit but does not bless on it, for berakhot are not indispensable (דִּבְרָכוֹת אֵינָן מְעַכְּבוֹת). Chiddush of the Rav: he rules the machloket like those who disqualify (וכן הלכה), then defines the she'at hadechak precisely (no other talit and impossible to redo — e.g. Shabbat) — and grounds the "no berakha" on the principle ברכות אינן מעכבות.

סעיף ד הַשּׁוֹאֵל טַלִּית שֶׁאֵינָהּ מְצֻיֶּצֶת — פָּטוּר כָּל שְׁלֹשִׁים יוֹם ("כְּסוּתְךָ" — וְלֹא שֶׁל אֲחֵרִים) ; לְאַחַר שְׁלֹשִׁים — חַיָּב מִדְּרַבָּנָן.

The borrowed talit — exempt thirty days. One who borrows from his fellow a talit without tzitzit — exempt from attaching tzitzit to it for thirty days, for it is said: « כְּסוּתְךָ » — your garment, and not that of others. But after thirty days — he must attach tzitzit to it miderabbanan, because it appears to be his (נִרְאֶה כְּשֶׁלּוֹ). And these thirty days must be consecutive (רְצוּפִים): if he returned it to the owner within the thirty days and then borrowed it again — it does not combine; he counts the thirty days from the second borrowing. Chiddush of the Rav: he spells out the mechanics of the derabbanan — its foundation is the appearance (נראה כשלו), hence the requirement of consecutive days and the new count after a return.

סעיף ה אִם רוֹצֶה לְהָטִיל בָּהּ צִיצִית תּוֹךְ שְׁלֹשִׁים יוֹם וּלְבָרֵךְ — הָרְשׁוּת בְּיָדוֹ וְאֵינָהּ בְּרָכָה לְבַטָּלָה.

אִם רוֹצֶה לְהָטִיל בָּהּ צִיצִית תּוֹךְ שְׁלֹשִׁים יוֹם וּלְבָרֵךְ עָלָיו — הָרְשׁוּת בְּיָדוֹ וְאֵינָהּ בְּרָכָה לְבַטָּלָה. וְאַף עַל פִּי שֶׁהוּא פָּטוּר מִן הַדָּבָר — יָכוֹל לוֹמַר "וְצִוָּנוּ לְהִתְעַטֵּף", כְּמוֹ שֶׁהַנָּשִׁים מְבָרְכִין עַל כָּל הַמִּצְוֹת שֶׁהֵן פְּטוּרוֹת מֵהֶם, מִטַּעַם שֶׁיִּתְבָּאֵר בְּסִימָן יז עַיֵּן שָׁם:

Blessing within the thirty days — the liberty (הָרְשׁוּת בְּיָדוֹ). If he wants to attach tzitzit to it within the thirty days and bless on it — he is free to do so, and it is not a berakha levatala. Although he is exempt from the matter — he may say « וְצִוָּנוּ לְהִתְעַטֵּף », as women bless on all the mitzvot from which they are exempt, for the reason to be explained in sim. יז. Chiddush of the Rav: he anchors the berakha of the exempt on the model of the women — an "exempt" is not a "stranger" to the mitzvah; hence the formula הָרְשׁוּת בְּיָדוֹ that returns throughout the siman.

סעיף ו הַשּׁוֹאֵל טַלִּית מְצֻיֶּצֶת — חַיָּב לְבָרֵךְ עָלָיו מִיָּד… הֲרֵי הִיא שֶׁלּוֹ בְּמַתָּנָה עַל מְנָת לְהַחֲזִיר.

הַשּׁוֹאֵל מֵחֲבֵרוֹ טַלִּית מְצֻיֶּצֶת — חַיָּב לְבָרֵךְ עָלָיו מִיָּד, מִשּׁוּם דְּאַדַּעֲתָּא דְּהָכֵי הִשְׁאִילוֹ לוֹ שֶׁיְּבָרֵךְ עָלָיו , וְכֵיוָן שֶׁאִי אֶפְשָׁר שֶׁיְּבָרֵךְ בְּרָכָה הַמְחֻיֶּבֶת עַל טַלִּית שְׁאוּלָה — אֲנַן סָהֲדֵי דְּנִתְכַּוֵּן הַמַּשְׁאִיל בְּלָשׁוֹן הַמּוֹעִיל , וְאִם אִי אֶפְשָׁר לוֹ לְבָרֵךְ עָלָיו אֶלָּא אִם כֵּן הִיא שֶׁלּוֹ — הֲרֵי הִיא שֶׁלּוֹ בְּמַתָּנָה עַל מְנָת לְהַחֲזִיר :

A borrowed talit already tzitzited — he blesses at once. One who borrows from his fellow a talit with tzitzit — he must bless on it at once (מִיָּד), because it was for this purpose (אַדַּעֲתָּא דְּהָכֵי) that he lent it to him — that he bless on it; and since one cannot say an obligatory berakha over a borrowed talit — אֲנַן סָהֲדֵי (we are witnesses) that the lender intended the effective formula: if he can only bless on it if it is his — behold, it is his, as a gift on condition of return (מַתָּנָה עַל מְנָת לְהַחֲזִיר). Chiddush of the Rav: this is the legal heart of the siman — he grounds the Rama's gloss (blessing on a borrowed tzitzited talit) on an umdena: the loan reclassifies itself as a מתנה על מנת להחזיר.

סעיף ז בַּמֶּה דְּבָרִים אֲמוּרִים? בְּטַלִּית הַמְיֻחֶדֶת לְמִצְוַת צִיצִית ; אֲבָל מַלְבּוּשׁ שֶׁל אַרְבַּע כְּנָפוֹת — אֵין הַשּׁוֹאֵל צָרִיךְ לְבָרֵךְ.

בַּמֶּה דְּבָרִים אֲמוּרִים? בְּטַלִּית הַמְיֻחֶדֶת לְמִצְוַת צִיצִית , כְּגוֹן טַלִּית גָּדוֹל אוֹ מַה שֶּׁקּוֹרִין אַרְבַּע כְּנָפוֹת, דְּבָזֶה וַדַּאי לֹא מַקְנֶה לוֹ אֶלָּא כְּדֵי לַעֲשׂוֹת הַמִּצְוָה וּלְבָרֵךְ עָלָיו, וְלָכֵן הֲוֵי כְּאִלּוּ נְתָנָהּ לוֹ בְּמַתָּנָה עַל מְנָת לְהַחֲזִיר. אֲבָל הַמַּשְׁאִיל לַחֲבֵרוֹ מַלְבּוּשׁ שֶׁל אַרְבַּע כְּנָפוֹת, שֶׁאָדָם לוֹבֵשׁ אוֹתוֹ דֶּרֶךְ מַלְבּוּשׁ בְּעָלְמָא וְלֹא לְשֵׁם מִצְוַת צִיצִית, אֶלָּא שֶׁמֵּטִיל בּוֹ צִיצִית מִפְּנֵי שֶׁיֵּשׁ בּוֹ אַרְבַּע כְּנָפוֹת — אֵין הַשּׁוֹאֵל צָרִיךְ לְבָרֵךְ עָלָיו, מִשּׁוּם דְּאֵין לָנוּ בֵּרוּר שֶׁהִשְׁאִילוֹ לְשֵׁם מִצְוָה שֶׁנֹּאמַר דַּהֲוָה כְּאִלּוּ נְתָנָהּ לוֹ בְּמַתָּנָה עַל מְנָת לְהַחֲזִיר, דְּשֶׁמָּא לְמַלְבּוּשׁ בְּעָלְמָא הִשְׁאִילוֹ. אֲבָל אִם יִרְצֶה לְבָרֵךְ — הָרְשׁוּת בְּיָדוֹ , כְּמוֹ שֶׁנִּתְבָּאֵר לְעֵיל :

The limit — a mitzvah talit vs a mere garment. Of what do we speak? Of a talit dedicated to the mitzvah of tzitzit — a talit gadol, or what is called an arba kanfot — where, certainly, he only conveyed it to him in order to perform the mitzvah and bless on it: it is therefore as if he gave it as a gift on condition of return. But one who lends his fellow a four-cornered garment worn as a mere garment (not לשם מצות ציצית), to which tzitzit are attached because it has four corners — the borrower need not bless on it: we have no certainty (בֵּרוּר) that he lent it for the mitzvah — perhaps he lent it as a mere garment. But if he wants to bless — he is free to do so, as explained above. Chiddush of the Rav: the מתנה על מנת להחזיר only operates where the umdena is certain — hence the threefold gradation: mitzvah talit (blesses), mere garment (optional), and the next seif's case (per the lender's mind).

סעיף ח הַשּׁוֹאֵל טַלִּית כְּדֵי לַעֲלוֹת לַדּוּכָן, לִקְרוֹת בַּתּוֹרָה אוֹ לֵירֵד לִפְנֵי הַתֵּבָה — הַכֹּל לְפִי דַּעַת הַמַּשְׁאִיל.

One who borrows a tzitzited talit to go up to the duchan, to go up to read in the Sefer Torah, or to go down before the teva: if the lender knows that the borrower wears it לְשֵׁם מִצְוַת צִיצִית — then it was for this purpose that he lent it, that he bless on it: it is as a gift on condition of return, and the borrower says an obligatory berakha, as if it were actually his. But if it is not in the lender's mind that the borrower wears it for the mitzvah — thinking that he only wears it for the honor of the congregation (כְּבוֹד הַצִּבּוּר) — we can no longer say "gift on condition of return", and the borrower need not say an obligatory berakha; if he wants to bless — he is free to do so. Chiddush of the Rav: everything is measured by the lender's mind — the same aliyah to the Torah obligates or does not obligate the berakha, depending on what the lender knows of the borrower's intent.

Another's talit without his knowledge — נִיחָא לֵיהּ. It is permitted to wrap oneself in one's fellow's talit without his knowledge, and he is not like the borrower-without-consent (שׁוֹאֵל שֶׁלֹּא מִדַּעַת) who is called a robber (גַּזְלָן): there is here no concern of loss of the principal (כִּלּוּי קַרְנָא), since he only wraps himself in it for the moment and returns it afterwards — and it is pleasing to a man that a mitzvah be performed with his property (נִיחָא לֵיהּ לְאִינִישׁ שֶׁיֵּעָשֶׂה מִצְוָה בְּמָמוֹנוֹ), where there is no loss to the purse (חֶסְרוֹן כִּיס). However, if he found the talit folded — he too must fold it back after removing it: if he does not fold it, the owner will mind (יַקְפִּיד) — and he becomes a borrower-without-consent, called a gazlan. He need not fold it exactly by its first folding — another folding suffices. And on Shabbat — he need not fold it at all; see sim. שב. Chiddush of the Rav: he grounds the permission on the absence of כילוי קרנא (not on a vague presumption), and makes the owner's הקפדה the exact line at which the mitzvah tips into גזל.

Occasional — yes; regular or moved — no. They only permitted wrapping oneself in one's fellow's talit without his knowledge occasionally (בְּאַקְרַאי בְּעָלְמָא); but on a regular basis (בִּקְבִיעוּת) — forbidden, lest the owner mind. And even occasionally, they only permitted it in the place where the owners left it: one may not take it out from that place to another — from the synagogue to his house, or from the owner's house to the synagogue — and even if he later returns it to the place from which he took it — forbidden, for it does not please a man that his belongings be moved about to a place not designated for them. Chiddush of the Rav: the נִיחָא לֵיהּ is no blank check — it is measured by what the owner would really accept: neither קביעות, nor moving it out of its place, even with a return.

But if he wants to bless — he is free to do so, as explained above (seifim ו, ח, ט). Chiddush of the Rav: the system's coherence — the מתנה על מנת להחזיר requires the owner's daat; without it, the talit remains "another's" (no obligatory berakha), but the door of the voluntary berakha stays open.

Another's tefillin — he blesses (חוֹבַת הַגּוּף). Likewise, it is permitted to don occasionally one's fellow's tefillin without his knowledge — and he must bless on them, because tefillin are an obligation of the body (חוֹבַת הַגּוּף), and the tefillin need not be specifically his. Only let him take care to fold them back if he found them folded, and not to take them out of the place where they were laid — lest the owner of the tefillin mind: it would be a מִצְוָה הַבָּאָה בַּעֲבֵרָה. Chiddush of the Rav: the structural distinction from the talit — tzitzit is an obligation of the garment (« כסותך », hence no obligatory berakha on another's), tefillin an obligation of the body (hence an obligatory berakha even on another's); and he names the risk: מצוה הבאה בעבירה.

Another's sefarim — forbidden. One's fellow's books — it is forbidden to study in them without his knowledge, even occasionally: the owner of the sefarim fears that one may read in them a great deal until they tear from much handling (יִקָּרְעוּ מֵרֹב מִשְׁמוּשָׁם), and for this reason it is not pleasing to him (לֹא נִיחָא לֵיהּ) that anyone study in them at all. (And for sefarim deposited with a talmid chacham — see Choshen Mishpat sim. רצב seif כ.) Chiddush of the Rav: the נִיחָא לֵיהּ is a criterion of fact, not a pious fiction — where there is foreseeable loss (books wear out), the presumption reverses: לא ניחא ליה, even for the mitzvah of Torah study.

Borrowed tzitzit are not tzitzit. Just as a borrowed talit is not within the obligation of tzitzit — so borrowed tzitzit (threads) are not tzitzit at all and do not exempt the garment, for it is said: « וְעָשׂוּ לָהֶם » — from their own (מִשֶּׁלָּהֶם). And they are only called "borrowed" if the lender stipulated that he return those very threads that he borrowed from him; but if he need not return those very threads — it is not a borrowing (שְׁאִילָה) but a loan (הַלְוָאָה), and they are as actually his: it is therefore permitted to attach them to the garment even lechatchila. And even if he stipulated to return those very threads — they are only pesulim if the lender does not know that he is borrowing them לְשֵׁם צִיצִית (thinking he wants them for some other work); but if the lender knows that the borrower wants to attach the threads to the garment לשם ציצית and lent them for that purpose — the borrower may attach them even lechatchila: it is as a gift on condition of return, as explained above in seif ז for the borrowed talit. Chiddush of the Rav: he transposes to the threads the siman's double tool — the monetary distinction שאילה / הלואה, and the umdena of the מתנה על מנת להחזיר.

סעיף טו טַלִּית שֶׁל שֻׁתָּפִין — חַיֶּבֶת בְּצִיצִית, שֶׁנֶּאֱמַר "עַל כַּנְפֵי בִגְדֵיהֶם" — לְשׁוֹן רַבִּים, לְרַבּוֹת שֶׁל שֻׁתָּפִין.

The yesod: the עשייה לשמה, the « כסותך ולא של אחרים », the מתנה על מנת להחזיר, the ניחא ליה

The Alter Rebbe's reading of this siman holds in four movements. First, he grounds the עֲשִׂיָּה לְשֵׁם מִצְוָה: « דַּבֵּר אֶל בְּנֵי יִשְׂרָאֵל » excludes the non-Jew, includes the woman (with the lechatchila precaution), and the kavana is indispensable — except in a she'at hadechak, without a berakha (seifim א-ג). Second, the borrowed talit: « כְּסוּתְךָ » — וְלֹא שֶׁל אֲחֵרִים — exempt thirty days, obligated miderabbanan afterwards (נראה כשלו), with liberty to bless before (seifim ד-ה). Then he deploys the מַתָּנָה עַל מְנָת לְהַחֲזִיר: the borrowing of a tzitzited talit reclassifies itself by אֲנַן סָהֲדֵי — according to the talit's purpose and the lender's mind (seifim ו-ח, יד). Finally, the נִיחָא לֵיהּ: another's talit without his knowledge — permitted occasionally, with its exact limits; tefillin (bless — חובת הגוף), sefarim (forbidden), and the partners' talit (seifim ט-יג, טו).

עשייה לשמה — בני ישראל ולא נכרי

The עשייה לשמה (who makes the tzitzit)

The principle (seifim א-ב). « דַּבֵּר אֶל בְּנֵי יִשְׂרָאֵל וְעָשׂוּ לָהֶם » — the Bnei Israel, and not a non-Jew: a non-Jew's הֲטָלָה is pesula. The woman is kasher (included in בני ישראל); the opinion comparing to tefillin disqualifies her (and the קטן with her) — halacha follows the first, but טוֹב לִזָּהֵר lechatchila. The spinning and twining — kasher by all.

The kavana (seif ג). Attached without intent לשם מצות ציצית — pasoul (וְכֵן הֲלָכָה); in a she'at hadechak (no other talit, impossible to redo — e.g. Shabbat) — one wears it without a berakha, דברכות אינן מעכבות.

כסותך — ולא של אחרים

The borrowed talit (the thirty-day exemption)

The principle (seif ד). « כְּסוּתְךָ » — your garment, not another's: the borrowed untzitzited talit is exempt thirty days; after thirty days — obligated miderabbanan, because it appears to be his (נִרְאֶה כְּשֶׁלּוֹ). The thirty days are רְצוּפִים — a return and a re-borrowing restart the count.

The berakha of the exempt (seif ה). He may attach tzitzit and bless within the thirty days — הָרְשׁוּת בְּיָדוֹ, like women on the mitzvot from which they are exempt (cf. sim. יז).

מתנה על מנת להחזיר — אנן סהדי

The מתנה על מנת להחזיר (the berakha on the borrowed talit)

The mechanism (seif ו). Borrowed already tzitzited — he blesses at once: אַדַּעֲתָּא דְּהָכֵי הִשְׁאִילוֹ, and אֲנַן סָהֲדֵי that the lender used "the effective formula" — the borrowing reclassifies as a מַתָּנָה עַל מְנָת לְהַחֲזִיר.

The gradations (seifim ז-ח, יד). A mitzvah talit (talit gadol, arba kanfot) — obligatory berakha; a mere four-cornered garment — no בֵּרוּר, optional berakha; duchan / Torah / teva — per the lender's mind (לשם מצוה or כבוד הציבור). And the borrowed threads: « וְעָשׂוּ לָהֶם » — מִשֶּׁלָּהֶם; הַלְוָאָה = his own; a knowing loan לשם ציצית = מתנה על מנת להחזיר.

ניחא ליה — וגבולותיו

The ניחא ליה and its limits (talit, tefillin, sefarim, partners)

The principle (seifim ט-יא). Another's talit without his knowledge — permitted: no כִּלּוּי קַרְנָא, and נִיחָא לֵיהּ לְאִינִישׁ שֶׁיֵּעָשֶׂה מִצְוָה בְּמָמוֹנוֹ. Limits: fold it back if it was folded (not on Shabbat — cf. sim. שב), occasional only, do not move it from its place; and no obligatory berakha (the owner knows nothing) — free to bless.

Tefillin, sefarim, partners (seifim יב-יג, טו). Another's tefillin — permitted occasionally and one blesses (חוֹבַת הַגּוּף); sefarimforbidden (fear of tearing — לא ניחא ליה); the partners' talit — obligated (« בִּגְדֵיהֶם » — plural).

MB on 14:2 — the machloket on the kavana לשמה, and the compromise without a berakha. Way of the Alter Rebbe — chiddush: he rules וְכֵן הֲלָכָה like those who disqualify, then defines the שְׁעַת הַדְּחָק (no other talit and impossible to redo — e.g. Shabbat) and grounds the no-berakha on דִּבְרָכוֹת אֵינָן מְעַכְּבוֹת (seif ג).

Another's talit without his knowledge — tefillin / sefarim (seifim ט-יג) OH 14:4 — « מותר ליטול טלית חבירו ולברך עליה, ובלבד שיקפל אותה אם מצאה מקופלת ». Gloss on 14:4 — the same for tefillin; but not sefarim (fear of tearing). MB on 14:4 — the ניחא ליה, the folding (not on Shabbat), the limits of the permission. Way of the Alter Rebbe — chiddush: he adds the din of the borrowed threads — « וְעָשׂוּ לָהֶם » מִשֶּׁלָּהֶם, with the distinction שְׁאִילָה / הַלְוָאָה (seif יד); and the partners' talit — obligated, « עַל כַּנְפֵי בִגְדֵיהֶם » in the plural (seif טו).

The main lines of the Rav's way on this siman

Four orientations that characterize the Alter Rebbe's sensibility on who makes the tzitzit and whose talit it is — beyond the mere application of the rules. Each follows the structure: principle of the siman → the Rav's reading → practical consequence. Each line rests on the Rav's real text (§1).

קו א — עשייה לשמה

The עשייה לשמה (non-Jew, woman, kavana)

Principle of the siman: tzitzit made by a non-Jew are pesulim; the woman is kasher (seif 1 of the Mehaber); attached without kavana — one does not bless on them (seif 2).

The Rav's reading: « בְּנֵי יִשְׂרָאֵל יַעֲשׂוּ » — the הֲטָלָה is the reserved act; the woman — halacha kasher, טוֹב לִזָּהֵר lechatchila (and the קטן within the debate); without kavana — pasoul (וכן הלכה), and in a she'at hadechak one wears it without a berakha.

Practical consequence: only buy tzitzit tied by a Jew לשמה (serious certification); lechatchila, have them tied by men; a doubt about kavana → redo the הטלה, or consult a Rav (seifim א-ג).

קו ב — כסותך ולא של אחרים

The exemption of the borrowed talit — and the berakha of the exempt

Principle of the siman: the borrowed talit is exempt from tzitzit for thirty days (seif 3 of the Mehaber).

The Rav's reading: « כְּסוּתְךָ » — the exemption is deoraita; the obligation after thirty days is derabbanan, grounded on appearance (נִרְאֶה כְּשֶׁלּוֹ) — hence the consecutive days; and the exempt may bless (הרשות בידו), like the women.

Practical consequence: a talit kept more than thirty days (long loan, rental) → attach tzitzit to it (derabbanan); a return and re-borrowing → new count; for mixed cases → consult a Rav (seifim ד-ה).

קו ג — מתנה על מנת להחזיר

The מתנה על מנת להחזיר (the berakha grounded in law)

Principle of the siman: the Rama — borrowed already tzitzited, one blesses at once (gloss on seif 3).

The Rav's reading: he grounds this psak — אֲנַן סָהֲדֵי that the lender "spoke the effective formula": the borrowing reclassifies as a מַתָּנָה עַל מְנָת לְהַחֲזִיר; hence the gradations: mitzvah talit / mere garment / duchan-Torah-teva per the lender's mind; and the transposition to the threads (seif יד).

Practical consequence: on the synagogue's talit or a friend's lent for an aliyah — one blesses; on a mere borrowed four-cornered garment — optional berakha; when in doubt about the lender's mind → consult a Rav (seifim ו-ח, יד).

קו ד — ניחא ליה וגבולותיו

The ניחא ליה and the threshold of the הקפדה

Principle of the siman: taking one's fellow's talit for the mitzvah — permitted, provided one folds it back (seif 4 of the Mehaber; Rama: tefillin yes, sefarim no).

The Rav's reading: the permission rests on the absence of כִּלּוּי קַרְנָא; the owner's הַקְפָּדָה is the line of גזל (מצוה הבאה בעבירה) — hence: fold back (not on Shabbat), אַקְרַאי only, do not move it; no obligatory berakha without his knowledge; tefillin — bless (חובת הגוף); sefarim — forbidden (loss).

Practical consequence: in the synagogue one may occasionally wrap oneself in another's talit — fold it back and leave it in its place; do not make it a habit; never study in another's books without consent; for a concrete case → consult a Rav (seifim ט-יג).

הלכה למעשה — מנהג חב״ד

The practical Chabad conduct

Six points of conduct that flow directly from siman י״ד in the sensibility of the Alter Rebbe and Chabad — presented at the level of principle, referring to the Rav for the detail of particular cases and minhagim.

For the Chabad Chassid — Siman י״ד (ציצית שעשאן עכו״ם ונשים וטלית שאולה)

  • ① The עשייה לשמה — who ties the tzitzit. Tzitzit attached by a non-Jew are pesulim (« בְּנֵי יִשְׂרָאֵל יַעֲשׂוּ — וְלֹא נָכְרִי »); when buying, verify that they were tied by a Jew לשמה (serious certification). A woman is kasher by the halacha — but טוֹב לִזָּהֵר lechatchila (have them tied by men). Basis: SA HaRav seifim א-ב.
  • ② The kavana — and the she'at hadechak without a berakha. Tzitzit attached without intent לשם מצות ציצית — pesulim (וכן הלכה): redo them with kavana. In a time of pressing need (no other talit, impossible to redo — e.g. Shabbat) — wear this talit without a berakha (ברכות אינן מעכבות). Basis: SA HaRav seif ג.
  • ③ The borrowed untzitzited talit — thirty days. Exempt from attaching tzitzit for thirty consecutive days (« כְּסוּתְךָ » — ולא של אחרים); after thirty days — obligated miderabbanan (it appears his). Within the thirty days he may attach and bless — הרשות בידו. Long loan or rental → refer to the Rav. Basis: SA HaRav seifim ד-ה.
  • ④ The borrowed tzitzited talit — one blesses (מתנה על מנת להחזיר). A borrowed talit gadol (friend, synagogue) for the mitzvah — one blesses on it at once: אנן סהדי, a gift on condition of return. To go up to the duchan / Torah / before the teva — per the lender's mind (לשם מצוה: obligatory berakha; כבוד הציבור: optional). A mere four-cornered garment — optional berakha. Basis: SA HaRav seifim ו-ח.
  • ⑤ Another's talit without his knowledge — the limits of the ניחא ליה. Permitted to wrap oneself in it occasionally (באקראי) for the mitzvah; fold it back if it was folded (not on Shabbat — cf. sim. שב); do not move it (neither from the synagogue home, nor the reverse); not on a regular basis; the berakha is not obligatory (free). Tefillin — likewise, and one blesses (חובת הגוף). Sefarim — no: it is forbidden to study in another's books without his consent. Basis: SA HaRav seifim ט-יג.
  • ⑥ Borrowed threads · the partners' talit. Borrowed tzitzit threads (to be returned themselves) are not valid — « וְעָשׂוּ לָהֶם » מִשֶּׁלָּהֶם; if they need not be returned themselves, it is a הלואה — they are his and valid; knowingly lent לשם ציצית — valid (מתנה על מנת להחזיר). The partners' talit — obligated (« בִּגְדֵיהֶם ») — the basis of the communal talit; details → consult a Rav. Basis: SA HaRav seifim יד-טו.
