The Siman — Choulhan Aroukh, Orach Chaim siman
And it contains eleven seifim (י״א סעיפים): having settled what counts as food for a zimun, the Choulhan Aroukh turns to the twin question — who counts as a diner. The siman runs through a long file of people whose place at the table is in doubt, and sorts them into two columns: those with whom a zimun is made and those with whom it is not. On one side, the attendant who ate a kazayit, the am haaretz even a complete one, the finished convert — who may even say על שהנחלת לאבותינו — and the child who knows to Whom we bless. On the other, the Kuti, the gentile and the convert circumcised but not immersed, the onen on a weekday, the tumtum, and one placed under a ban for a transgression. Between the two stands a category of its own: women, slaves and minors, who do not join the men's zimun but make their own — never mixed, and never בשם. The Rama adds two decisive glosses: women are discharged by our zimun even without understanding it, and Ashkenazi custom joins a child only at thirteen.

Study according to my Poskim
Rebuild this siman according to the Rabbanim YOU follow. Choose your Poskim (Rav Ovadia, the Admour HaZaken, the Rebbe, Ben Ish Chai, Mishna Berura, Rav Mordechai Eliyahu…) — Daat AI rebuilds the siman with their opinions, their reasoning, and their disagreements. If your Poskim do not address a point, the AI asks you before expanding.

The main themes of the Siman

שַׁמָּשׁ
the table attendant
The attendant who ate a kazayit: a zimun is made on him (seif 1); so the mishna teaches — the attendant who ate a kazayit and the Kuti, a zimun is made on them (Berakhot 45a) — and the Gemara asks why it was needed: you might have said the attendant is not settled at the meal (Berakhot 47b).
כּוּתִי
the Samaritan
A Kuti nowadays is as an idolater and no zimun is made on him (seif 2); and though the mishna counted him, the law changed from the hour they were made full gentiles (Chullin 6a).
עַם הָאָרֶץ
the unlearned
A complete am haaretz: a zimun is made on him nowadays (seif 3); and though the baraita excludes him, the Tur writes in the name of the Ri that we do join him, so that each not build an altar of his own (טור או״ח קצ״ט).
גֵּר
the convert
A convert circumcised but not immersed: no zimun, for one is no convert until he is both circumcised and immersed (Berakhot 47b); but a full convert counts, and may bless and say על שהנחלת לאבותינו (seif 4).
אוֹנֵן
the mourner before burial
An onen on a weekday, who is exempt from blessing: no zimun is made on him (seif 5); its root is one whose dead lies before him, exempt from all the mitzvot stated in the Torah (Berakhot 17b).
פְּרִיצוּתָא
the mixture not allowed
Women, slaves and minors: no zimun is made on them but they make their own, and never a mixed company — women by themselves and slaves by themselves (seif 6); the Gemara gives the reason: it is different there because of licentiousness (Berakhot 45b).
רְשׁוּת וְחוֹבָה
optional and obligatory
Women making a zimun by themselves is optional; but when they eat with men they are obligated and are discharged by our zimun (seif 7); and the Rama adds: even though they do not understand (רמ״א או״ח קצ״ט:ז).
אַנְדְּרוֹגִינוֹס וְטוּמְטוּם
the two doubts
An androginos makes a zimun for its own kind and neither for men nor for women (seif 8); a tumtum makes none at all (seif 9); and likewise with the shofar — an androginos discharges its own kind but not another (Rosh haShana 29a).
עוֹנַת הַפְּעוֹטוֹת
the age of discernment
A minor who reached the age of discernment and knows to Whom we bless: a zimun is made on him and he joins both for three and for ten (seif 10); and in the Rama's gloss, some say he is not joined at all until he is thirteen (רמ״א או״ח קצ״ט:י).

Frequently asked questions — Siman קצ״ט

Is a zimun made on the attendant who serves the table (Siman 199)?

According to the Choulhan Aroukh, Orach Chaim 199:1, it is — once he has eaten a kazayit: « השמש שאכל כזית מזמנין עליו » (שו״ע או״ח קצ״ט:א). The source is the mishna: « והשמש שאכל כזית והכותי מזמנין עליו » (Berakhot 45a), and the Gemara explains why it had to be taught: « פשיטא מהו דתימא שמש לא קבע קמ״ל » (Berakhot 47b).

Is a zimun made on a complete am haaretz (Siman 199)?

According to the Choulhan Aroukh, Orach Chaim 199:3, it is: « עם הארץ גמור מזמנין עליו בזמן הזה » (שו״ע או״ח קצ״ט:ג). The Tur gives the reason: « והאידנא אמר ר״י שמזמנין עם עם הארץ כדי שלא יהא כל אחד בונה במה לעצמו » (טור או״ח קצ״ט). summary: keeping the unlearned out of the zimun would drive them out of the community altogether.

May a convert say « שהנחלת לאבותינו » in Birkat haMazon (Siman 199)?

According to the Choulhan Aroukh, Orach Chaim 199:4, he may: « אבל גר גמור מזמנין עליו ויכול לברך בהמ״ז ולומר על שהנחלת לאבותינו » (שו״ע או״ח קצ״ט:ד) — the view of the Ri cited in the Tur: « ור״י כתב שיכול לברך שיכול לומר לאבותינו דכתיב אב המון גוים נתתיך » (טור או״ח קצ״ט). One whose conversion is unfinished, however, does not count: « ואפי׳ גר שמל ולא טבל אין מזמנין עליו » (שו״ע או״ח קצ״ט:ד), and the Gemara gives the principle: « דאמר רבי זירא א״ר יוחנן לעולם אינו גר עד שימול ויטבול וכמה דלא טבל נכרי הוא » (Berakhot 47b).

Do women make a zimun (Siman 199)?

According to the Choulhan Aroukh, Orach Chaim 199:7, among themselves it is optional and with men it is obligatory: « נשים מזמנות לעצמן רשות אבל כשאוכלות עם האנשי׳ חייבות ויוצאות בזימון שלנו » (שו״ע או״ח קצ״ט:ז), and the Rama adds « אע״פ שאינן מבינות » (רמ״א או״ח קצ״ט:ז). The source is the baraita: « נשים מזמנות לעצמן ועבדים מזמנים לעצמן נשים ועבדים וקטנים אם רצו לזמן אין מזמנין » (Berakhot 45b), and the Gemara gives the reason: « שאני התם משום פריצותא » (Berakhot 45b) — hence seif 6: « אלא נשים לעצמן ועבדים לעצמן ובלבד שלא יזמנו בשם » (שו״ע או״ח קצ״ט:ו).

Does a minor count for a zimun (Siman 199)?

According to the Choulhan Aroukh, Orach Chaim 199:10, he does: « קטן שהגיע לעונת הפעוטות ויודע למי מברכין מזמנין עליו ומצטרף בין לשלשה בין לעשרה » (שו״ע או״ח קצ״ט:י). The Gemara concludes so: « ולית הלכתא ככל הני שמעתתא אלא כי הא דאמר רב נחמן קטן היודע למי מברכין מזמנין עליו » (Berakhot 48a). The Rama, however, rules otherwise for Ashkenazi practice: « וי״א דאין מצרפין אותו כלל עד שיהא בן שלש עשרה שנה » (רמ״א או״ח קצ״ט:י), and concludes « וכן נוהגין ואין לשנות » (רמ״א או״ח קצ״ט:י).
