The Siman —
And it contains two seifim (ב׳ סעיפים): Siman 237 — סדר תפלת ערבית — had just settled the evening service; this one leaves prayer for study, and speaks of nothing but the night. Seif 1 sets out a comparison and a sanction: night study demands more care than day study, and one who lets it fall is punished more severely. Seif 2 draws from this the most concrete ruling in the siman: a man who has fixed himself a daily measure of study, and whom the day's affairs prevented from completing it, completes it at night — and מיד, without delay. The siman therefore does not say how much one must learn; it says when the debt is reckoned, and when it is paid.

Frequently asked questions — Siman רל״ח

Why does night study demand more care than day study (Siman 238)?

That is the first seif: « צריך ליזהר בלמוד הלילה יותר מבשל יום והמבטלו עונשו מרובה » (שו״ע או״ח רל״ח:א). The Tur gives the reason: « ובענין לימוד הלילה יותר ויותר מבשל יום בני הזהר כמו שאמרו חז״ל אין רינה של תורה אלא בלילה שנאמר קומי רוני בלילה » (טור או״ח סימן רל״ח), resting it on the Gemara: « אמר רבי שמעון בן לקיש לא איברי סיהרא אלא לגירסא » (עירובין ס״ה ע״א). The Mishnah Berurah compresses the argument: « כדאמרינן לא איברי לילא אלא לגירסא וכיון דלכך נברא הלילה ע״כ צריך ליזהר בה יותר » (משנה ברורה, מ״ב רל״ח:א). The Rambam supplies the underlying reason: « אף על פי שמצוה ללמד ביום ובלילה אין אדם למד רב חכמתו אלא בלילה » (רמב״ם הלכות תלמוד תורה פרק ג הלכה יג). For practice, one follows one's Rav.

What does it mean that the punishment of one who neglects it is greater (Siman 238)?

The Mechaber writes: « והמבטלו עונשו מרובה » (שו״ע או״ח רל״ח:א), and the Tur explains it from the quality of the hours: « הלכך כיון ששעות הלילה נוחין ורצויין ללמוד המבטלן עונשו מרובה » (טור או״ח סימן רל״ח). The Mishnah Berurah supplies the talmudic source: « כל בית שאין ד״ת נשמעין בו בלילה אש אוכלתו » (משנה ברורה, מ״ב רל״ח:ב), which is the statement of Rabbi Elazar: « ואמר רבי אלעזר כל בית שאין דברי תורה נשמעים בו בלילה אש אוכלתו » (סנהדרין צ״ב ע״א). The Arukh HaShulchan repeats the same pairing: « ולכן צריך ליזהר בלימוד הלילה יותר מביום, והמבטלו עונשו מרובה » (ערוך השלחן רל״ח:ב). For practice, one follows one's Rav.

I missed my study quota because of work: when must I make it up (Siman 238)?

The second seif answers: « אם יש לו חק קבוע ללמוד כך וכך ליום והיה טרוד ביום ולא השלימו ישלימנו בלילה מיד » (שו״ע או״ח רל״ח:ב). Its source is the practice of Rav Acha bar Yaakov reported by the Tur: « רב אחא בר יעקב יזיף ביממא ופרע בליליא » (טור או״ח סימן רל״ח). The Mishnah Berurah defines the force of the word The Arukh HaShulchan reads that word differently: « אין הכוונה מיד שתכנס הלילה, דמנא לן לומר כן » (ערוך השלחן רל״ח:ג), and: « אלא הכוונה שישלים מיד בלילה ולא יניח למחר, וכן משמע בטור ע״ש » (ערוך השלחן רל״ח:ג). And because a regular practice taken upon oneself has the force of a vow, the Magen Avraham advises: « דהוי נדר ולכן יתנה בתחלה שלא יהיה עליו נדר » (מגן אברהם רל״ח:א). For practice, one follows one's Rav.
