✦ ❖ ✦
This siman sets who is fit to go down before the ark (לירד לפני התיבה) as the שליח ציבור. He says ישתבח מעומד ; and he must be הגון — free of sins (ריקן מעבירות), without a bad name (שם רע), humble (עניו), pleasing to the people (מרוצה לעם), with a sweet voice (נעימה). The halakha then treats age and appointment (מינוי), the disqualifications, refusal (סירוב), מחלוקת and wages (שכר). Hebrew text, English translation and explanation of the כ״ו seifim grouped in families, with practical cases.

Our Sages taught (ראש השנה ל״ד:): שְׁלִיחַ צִבּוּר מוֹצִיא אֶת הָרַבִּים יְדֵי חוֹבָתָן — the שליח ציבור discharges the public of its obligation. He is not merely a fine voice: he is שלוחו של ציבור, the emissary who carries the prayer of all. That is why the halakha requires him to be הגון — upright, pleasing to the people, sweet of voice — for through him rise the words of קדושה, קדיש and ברכו. We study here at the level of principle; for personal conduct, one refers to the custom and to the ruling of the Rav.

A. מי הראוי לירד לפני התיבה — the כ״ו seifim by families
שְׁלִיחַ צִבּוּר — the community s representative: the one who goes down before the ark (יורד לפני התיבה) to say aloud the parts of the prayer that require a מנין (קדיש, קדושה, ברכו, the חזרת הש״ץ) and who מוציא את הרבים — discharges the public of its obligation. He must be הגון, worthy of this שליחות.
(seif 1) The שליח ציבור says ישתבח standing. (seif 2) One says ישתבח only after ברוך שאמר and some פסוקי דזמרה. (seif 3) One does not recite the blessing over wrapping in ציצית between the פסוקי דזמרה and ישתבח, but between ישתבח and יוצר [and see below, siman נ״ד, seif ג׳]. Rama: if the חזן had no טלית at first, let him don it before starting ישתבח so as to say the קדיש right after ישתבח without interruption [Kol Bo, siman 5]; and likewise, if there is no מנין in the synagogue, the חזן waits with ישתבח and stays silent until a מנין arrives, and then says ישתבח and קדיש [Maharil].
The חזן s own role begins at ישתבח — the berakha that closes the פסוקי דזמרה, and he says it standing, out of honor and to join the קדיש without a break (see siman נ״ד). The essential: the קדיש must follow ישתבח without הפסק.
Family 2 — the fit חזן (seifim ד׳-ה׳)
(seif 4) The שליח ציבור must be הגון. And who is הגון? One free of sins (ריקן מעבירות), on whom no bad name ever ran even in his youth, humble and pleasing to the people, with a sweet, pleasant voice, versed in תורה, נביאים, כתובים. (seif 5) Lacking all these, one chooses the best of the community in wisdom and good deeds. Rama: an aged עם הארץ with a sweet voice whom the people want, versus a lad of י״ג who understands what he says but has no sweet voice — the lad comes first [Mordechai, end of the first chapter of Chullin]. One who sinned unwittingly (בשגגה) and repented may serve; but one who sinned wilfully (במזיד) — no, for a שם רע ran on him before his תשובה [Responsa of the Or Zarua, tractate Berakhot].
The heart of the criterion is הגון: not perfection, but the absence of a שם רע and upright conduct, together with נעימה and the people s favor (מרוצה לעם). The שוגג / מזיד distinction is not about the sin itself but about reputation: the repentant שוגג is a “צדיק גמור,” while the מזיד has already borne a bad name.
Family 3 — age and appointment (seifim
(seif 6) One appoints (מינוי קבוע) only one whose beard has filled out (נתמלא זקנו), out of honor for the community; but occasionally (באקראי), once he has שתי שערות he may go down — provided he is not appointed by the community, or by a שליח ציבור who appoints him to ease his own burden, to pray in his stead at set times. (seif 7) If there is no one there who knows how to serve as שליח ציבור save a lad of י״ג and a day, better that he serve than that they be deprived of hearing קדושה and קדיש. (seif 8) One who has no beard: whenever it is evident that he has reached the age at which his beard should have filled out, he is deemed נתמלא זקנו; therefore a lad of כ׳, even without a beard, is appointed. Rama: likewise, if he has even a little beard he is deemed נתמלא זקנו, if he is י״ח or older [Beit Yosef in the name of Massekhet Soferim ch. 14 and the Nimukei Yosef, ch. HaKore Omed]. (seif 9) A סריס: some say it is permitted to appoint him if he is כ׳ years old. (seif 10) One may find merit (ללמוד זכות) in places whose custom is that minors go down before the ark to pray ערבית at the close of Shabbat. Rama: and in places where that is not the custom, a minor should not pass before the ark even for ערבית; even if he reaches the age of י״ג on Shabbat day, he should not lead the ערבית of Shabbat, for he is not yet י״ג at that time [Maharil].
Two thresholds: for a fixed post (מינוי קבוע) one requires נתמלא זקנו — out of כבוד הצבור; for the occasional, שתי שערות (adulthood) suffices. “נתמלא זקנו” does not require a real beard: from כ׳, or from י״ח with a little beard, the condition is deemed met.
Family 4 — disqualifications and diction (seifim
(seif 11) The חזן who prolongs his prayer to let his fine voice be heard: if from joy in praising Hachem בנעימה — a blessing on him, provided he prays with gravity and stands in awe and fear; but if he aims to display his voice and delights in it — it is unseemly. And in any case, whoever prolongs his prayer does not do well, because of the burden (טורח) on the community. (seif 12) One does not appoint one who confuses the letters (reading אלפין as עיינין). (seif 13) The פוחח [« my servant Isaiah, naked » (עבדי ישעיה ערום): the Targum renders « my servant Isaiah, פחח »] — that is, one whose garment is torn and arms bare — does not go down before the ark. (seif 14) The blind (סומא) does go down, provided he does not read from the תורה, because of [the rule]: words that are written, you are not permitted to say them by heart (על פה).
The voice serves praise, not pride: to prolong out of vanity is מגונה. Some defects bar the role — faulty diction (which alters the sense of words) and unfit dress (פוחח) — but the blind man is fit, for he is bound by all מצוות and מוציא את הרבים.
Family 5 — appointment, refusal, מחלוקת and wages (seifim ט״ו-כ״ו)
(seif 15) The fixed חזן goes down of himself without waiting to be asked; (seif 16) one who is not a fixed שליח ציבור must refuse a little (סירוב) before going down before the ark, but not too much: the first time he refuses; when they tell him a second time, he readies himself like one who wants to stand; and the third time he stands. And if the one telling him to go down is a great man (אדם גדול), he does not refuse him at all. (seif 17) If the שליח ציבור erred and another must be stood in his place, the one put in his place should not refuse. (seif 18) One who says: I will not go down before the ark because my garments are dyed, or because I have sandals on my feet — he does not go down at all for that prayer, for it is the way of the אפיקורסין to be particular about this, and we fear that some אפיקורסות has crept into him. Rama: and even if he gives a pretext (אמתלא) for his words, it does not help [Beit Yosef in the name of Rabbi Yehonatan]. (seif 19) Some barred the גר from the role — their words were rejected. Even a single individual can block it and say: I do not want so-and-so to be חזן — unless he had already agreed to him at the outset. Rama: and only if that individual has a proper reason, in the judgment of the notables of the town (טובי העיר); otherwise the individual cannot protest against the שליח ציבור [Mahari Weil, siman 60]. And if he is his enemy, he can protest against him before having agreed to him [Maharam of Padua, siman 104, and Maharik, shoresh 44]. And one who is an enemy of the שליח ציבור should not go up to the ספר תורה when he reads the תוכחה [Or Zarua]. (seif 20) If one wants to say the prayer for his father and another wants to say it for someone else, the one whom the community wants to say the prayer — he says it. (seif 21) One does not appoint a שליח ציבור on the word of the lord (השר), even if most of the community wants him. (seif 22) The paid שליח ציבור (בשכר) is preferable to a volunteer. Rama: and no one should lead the prayer without the consent of the community; whoever leads it by force and high-handedness, one does not answer אמן after his blessings [Binyamin Zeev, siman 163, and Agudah, ch. Keitzad Mevarkhin]. (seif 23) The wages of the שליח ציבור are paid from the communal fund: although the שליח ציבור discharges the poor as the rich, the hand of the poor does not reach as far as the rich. Rama: and some say that half is collected according to wealth and half according to the number of persons, and such is the custom of the communities [Maharam of Padua, siman 44]. (seif 24) A community that must hire a רב and a חזן but cannot pay both: if he is a רב מובהק, great in Torah and expert in הוראה, he comes first; if not, the חזן comes first. (seif 25) One does not remove a חזן from his post unless a פסול is found in him. Rama: one does not remove him because of mere rumor, for instance if word went out about him that he was caught with a non-Jewish woman or that he informed on someone; but if witnesses came against him about this or the like, he is removed. A שליח ציבור who is a shochet and bodek should not pray in soiled and foul-smelling garments; and if he refuses to change his garments at prayer time in order to pray, he is removed. A שליח ציבור who speaks obscenely or hums the songs of non-Jews is protested against so that he stop; and if he does not listen, he is removed [Kol Bo, page 125, column 4]. And a שליח ציבור who has grown old and wishes to appoint his son to assist him at times — even if the voice of his son is not as pleasant as his own, if he fills his place in other matters, his son takes precedence over anyone else, and the community cannot protest [Responsa of the Rashba, siman 9]. (seif 26) A community whose custom is to appoint people over communal needs for a term, and when the term arrives these leave and others enter in their place — whether for the חזן, for the צדקה fund, or for other appointments the community needs, whether they take wages for it or not — even if no term was set for them, the unstated is as if stated, since that is their custom. Rama: some have written that the שליח ציבור should pray from a book designated for the community, for it was certainly written לשמו [Maharil in the name of the Rokeach].
The community has authority over the choice: it appoints, approves and, if need be, removes — but only for a proven פסול, not on a mere rumor. The right balance: neither to impose oneself by force (one does not answer אמן to one who prays by force), nor to refuse excessively; and the paid post is preferred, being more stable and dignified.
The siman in one sentence: the one who goes down לפני התיבה is the שלוחו של ציבור — he says ישתבח מעומד, must be הגון (ריקן מעבירות, without שם רע, מרוצה לעם, נעימה), old enough for a fixed post (נתמלא זקנו) or with שתי שערות for the occasional; disqualifications and diction bar him, the community appoints and may remove him for a פסול, and the paid (בשכר) post is preferable.
Practical cases
Case 1 — Who may be חזן?
Situation: whom should the community choose to go down before the ark?
Conduct: one seeks a הגון — free of sins, without a שם רע (even old), humble, pleasing to the people (מרוצה לעם), with a sweet voice (נעימה) and versed in תורה, נביאים, כתובים. If none unites all these, one takes the best of the community in חכמה and good deeds. Voice matters, but it serves praise, never pride.
Case 2 — A בעל תשובה, a minor, an עם הארץ
Situation: should one prefer an aged עם הארץ with a sweet voice, or a minor who understands? And may a בעל תשובה be חזן?
Conduct: the lad of י״ג who understands what he says comes before the aged עם הארץ with the sweet voice — for he knows what he prays. The בעל תשובה who sinned בשגגה and repented is fit; but one who sinned במזיד — no, not because of the sin but because of the שם רע that ran on him. For concrete cases, one follows one s Rav.
Case 3 — ישתבח standing, the טלית, not interrupting
Situation: why does the חזן stand for ישתבח, and what if he has no טלית yet?
Conduct: the חזן says ישתבח מעומד — standing, out of honor, to join the following קדיש without a break. If he had no טלית, let him don it before ישתבח, so that the קדיש follows ישתבח without הפסק. And he says ישתבח only after ברוך שאמר and some פסוקי דזמרה. For the detail, see the Lamdan level and siman נ״ד.
