Our Sages taught (משנה ברכות פ״ג מ״ג): נשים ועבדים וקטנים פטורים מקריאת שמע — women, slaves and minors are exempt from the ק״ש. This siman clarifies who is exempt (הפטורים) and why: the nature of a מצות עשה שהזמן גרמא, the טרדת מצוה of the groom, and one who is עוסק (occupied) at the time of the ק״ש. We study here at the level of principle; for personal conduct, one refers to the custom and to the ruling of the Rav.

A. Who is exempt from the ק״ש — the ה׳ seifim
הַפְּטוּרִים מִקְּרִיאַת שְׁמַע — those exempt from the ק״ש — the siman gathers several kinds of exemption: one that flows from a מצות עשה שהזמן גרמא (women and slaves; minors not yet at חינוך); one that flows from a legitimate distraction (the groom — טרדת מצוה); and one that flows from being עוסק (occupied) with another mitzvah or an activity at the time of the ק״ש (צרכי רבים, אכילה, מרחץ…).
Séif 1 — נשים ועבדים: women and slaves
נשים ועבדים פטורים מקריאת שמע, מפני שהוא מצות עשה שהזמן גרמא; ונכון הוא ללמדם שיקבלו עליהן עול מלכות שמים. הגה: ויקראו לפחות פסוק ראשון.
Séif 1: women and slaves are exempt from the ק״ש, because it is a positive time-bound commandment (מצות עשה שהזמן גרמא); and it is proper to teach them to accept upon themselves the yoke of the Kingdom of Heaven (עול מלכות שמים). Rama: and they should read at least the first verse.
The ק״ש has a fixed time only in the evening and the morning: it is a מצות עשה שהזמן גרמא, from which women (and slaves) are exempt. Nevertheless, since the ק״ש is קבלת עול מלכות שמים — the acceptance of the divine kingship — it is נכון (proper) to teach it to them; and the Rama specifies that they read at least the first verse (שמע ישראל).
Séif 2 — קטנים: minors
קטנים פטורים מקריאת שמע; לרבנו תם כשלא הגיעו לחינוך, ולרש״י אפילו הגיעו לחינוך מפני שאינו מצוי אצלו בזמן קריאת שמע בערב וישן הוא בבוקר; וראוי לנהוג כרבנו תם.
Séif 2: minors are exempt from the ק״ש; for Rabbeinu Tam as long as they have not reached the age of חינוך (education), and for Rashi even after they reach it — because the child is not usually with the father at the time of the ק״ש in the evening and is asleep in the morning; and it is proper to act like Rabbeinu Tam.
A קטן is in principle exempt from the mitzvot. The question is חינוך: must the father habituate him to the ק״ש once he is able? רבנו תם: only once he has reached חינוך. רש״י: even then there is no practical חינוך for the ק״ש, since the child אינו מצוי with the father in the evening and sleeps in the morning. The Mehaber concludes וראוי לנהוג כרבנו תם — it is proper to follow Rabbeinu Tam and habituate him.
Séif 3 — הכונס את הבתולה: the groom
הכונס את הבתולה פטור מקריאת שמע ג׳ ימים אם לא עשה מעשה, מפני שהוא טרוד טרדת מצוה; והני מילי בזמן הראשונים, אבל עכשיו שגם שאר בני אדם אינם מכוונים כראוי — גם הכונס את הבתולה קורא. הגה: ועיין לעיל סימן צ״ט אם שכור יקרא קריאת שמע.
Séif 3: one who marries a virgin (הכונס את הבתולה) is exempt from the ק״ש for three days if he did not consummate, because he is troubled by the anxiety of the mitzvah (טרדת מצוה); and this was so only in the time of the early ones, but nowadays, when even the rest of the people do not concentrate as they should — the groom too reads. Rama: and see above siman צ״ט whether a drunk man should read the ק״ש.
The groom is טרוד (preoccupied) by a טרדת מצוה — the concern of the mitzvah of marriage — and cannot concentrate on the ק״ש. Formerly this exemption held because others truly concentrated; nowadays, when even they אינם מכוונים כראוי (do not concentrate as they should), he has no advantage: גם הכונס את הבתולה קורא — he reads like everyone.
Séif 4 — צרכי רבים: occupied with communal needs
היה עוסק בצרכי רבים והגיע זמן קריאת שמע — לא יפסיק, אלא יגמור עסקיהם ואחר כך יקרא אם נשאר עת לקרות.
Séif 4: if he was occupied with communal needs (צרכי רבים) and the time of the ק״ש arrived — he does not interrupt, but finishes their affairs and then reads if there is time left to read.
One who is עוסק בצרכי רבים is עוסק במצוה — engaged in a mitzvah of public service. The principle העוסק במצוה פטור מן המצוה applies: he does not interrupt, he first completes what he undertook for the community, then reads the ק״ש if there is still time to read.
Séif 5 — עוסק באכילה: occupied with eating or the bathhouse
היה עוסק באכילה, או שהיה במרחץ, או שהיה עוסק בתספורת, או שהיה מהפך בעורות, או שהיו עוסקים בדין — להרמב״ם גומר ואחר כך קורא קריאת שמע; ואם היה מתיירא שמא יעבור זמן קריאה ופסק וקרא, הרי זה משובח. ולהראב״ד מפסיק וקורא אף על פי שיש שהות לקרות.
Séif 5: if he was occupied with eating, or in the bathhouse (מרחץ), or getting a haircut (תספורת), or working hides (מהפך בעורות), or occupied with a civil case (בדין) — for the Rambam he finishes and then reads the ק״ש; and if he feared the time to read would pass, and stopped and read, this is praiseworthy. And for the Raavad he interrupts and reads, even though there is time left to read.
Here there is no mitzvah but an occupation (eating, bathhouse, haircut, tanning, a legal case). Two views: for the רמב״ם, he finishes then reads — and if he chose to stop out of fear the time would pass, הרי זה משובח (this is praiseworthy). For the ראב״ד, he interrupts and reads at once, even if time remains. For the practical conduct, one follows one's Rav.
The siman in one sentence: exempt from the ק״ש are the נשים ועבדים (מצות עשה שהזמן גרמא — yet they read at least the first verse), the קטנים (וראוי לנהוג כרבנו תם) and the הכונס את הבתולה (טרדת מצוה — but nowadays he reads); one who is עוסק בצרכי רבים does not interrupt; and one who is עוסק באכילה or in the bathhouse — for the רמב״ם he finishes then reads, for the ראב״ד he interrupts and reads.
Practical cases
Case 1 — Teaching women and children
Situation: a woman (or a child) is exempt from the ק״ש. Should it still be taught to her?
Conduct: although exempt as from a מצות עשה שהזמן גרמא, it is נכון to teach them to accept the עול מלכות שמים; per the Rama, they read at least the first verse (שמע ישראל). For the קטן, וראוי לנהוג כרבנו תם — one habituates him once he has reached חינוך. For the practical application, one follows one's Rav.
Case 2 — The groom today
Situation: a groom (הכונס את הבתולה) who has not yet consummated, within the three days. Does he read the ק״ש?
Conduct: formerly he was exempt out of טרדת מצוה, but the Mehaber rules that nowadays — when even others do not concentrate as they should — גם הכונס את הבתולה קורא, he reads like everyone. (And if a man is drunk, see siman צ״ט.) For the details, one follows one's Rav.
Case 3 — The one occupied (עוסק) at the time of the ק״ש
Situation: he was occupied (with a communal need, eating, the bathhouse…) and the time of the ק״ש arrives. Does he interrupt?
Conduct: if he is עוסק בצרכי רבים (a public mitzvah) — לא יפסיק: he finishes then reads if time remains (העוסק במצוה פטור מן המצוה). If he is עוסק באכילה or in the bathhouse — להרמב״ם he finishes then reads (and if he stopped out of fear, הרי זה משובח), and להראב״ד he interrupts and reads. For the conduct le-maaseh, one follows one's Rav.
