1. The Central Axiom
Universal principle of the Siman:
One may rent property to a non-Jew IF:
One may rent property to a non-Jew IF:
- The non-Jew works for his own interest (אדעתיה דנפשיה עביד)
- There is no מראית עין (appearance of being an employee)
- The trade custom permits it
The universal key: "סתם X לאריסותא?"
The fundamental question is: Is the usual custom of this trade share-cropping (aristut) or day-labor (sakhir yom)?
• If share-cropping (case of field and mill) → 🟢 Permitted
• If day-labor (case of bathhouse and oven) → 🔴 Forbidden

• If share-cropping (case of field and mill) → 🟢 Permitted
• If day-labor (case of bathhouse and oven) → 🔴 Forbidden
2. The 4 types of rental — Decision tree
Step 1 — What type of relationship do I have with the non-Jew?
| Is the non-Jew MY direct EMPLOYEE or a CONTRACTOR? | |
|
👨💼 EMPLOYEE Day-wage (שכיר יום) 🔴 Always forbidden |
🤝 CONTRACTOR Lump sum, share-cropping, or rental (קבלנות / אריסות / השכרה) ⚠️ See step 2 |
Step 2 — What is the asset concerned?
|
🌾 שדה (Field) ⚙️ רחיים (Mill) 🟢 Permitted (custom = aristut/kablanut) |
🛁 מרחץ (Bathhouse) 🔥 תנור (Oven) 🔴 Forbidden (mar'it ayin) |
The 4 types of rental in a mental schema:
| Type | Definition | Status |
|---|---|---|
| 1. שכיר יום | Fixed daily wage | 🔴 Always forbidden |
| 2. קבלנות | Lump sum for defined work | 🟢 Permitted (except bathhouse/oven) |
| 3. השכרת קרקע | Pure rental of land | 🟢 Permitted (except bathhouse/oven) |
| 4. אריסות | Share-cropping (% of fruits) | 🟢 Permitted (ideal case of the field) |
3. The four-assets test
Quick test: Ask yourself a single question — "What is the usual custom of this trade?"
• Share-cropping / lump sum → ✅ Permitted
• Day-wage → ❌ Forbidden
• Share-cropping / lump sum → ✅ Permitted
• Day-wage → ❌ Forbidden
The 4 assets classified by "usual custom":
| Asset | Usual custom | Halakha | Why? |
|---|---|---|---|
| 🛁 מרחץ (Public bathhouse) |
Day-wage | 🔴 Forbidden | Operates 24/7, owner hires employees |
| 🌾 שדה (Field) |
Share-cropping | 🟢 Permitted | Seasonal work, harvest-sharing |
| 🔥 תנור (Oven) |
Day-wage | 🔴 Forbidden | Like bathhouse — operates continuously, employees |
| ⚙️ רחיים (Mill) |
Lump sum / share-cropping | 🟢 Permitted | Like field — task-based work |
The Rama's pivot:
תנור דינו כמרחץ, רחיים דינם כשדה
"The oven = like the bathhouse (forbidden), the mill = like the field (permitted)"
תנור דינו כמרחץ, רחיים דינם כשדה
"The oven = like the bathhouse (forbidden), the mill = like the field (permitted)"
4. Seif Beit — 5 exit routes
Guiding principle: the prohibition of Seif Alef is a gezera (a preventive measure of the Sages), not an intrinsic prohibition. As soon as the cause of the gezera (public מראית עין) disappears — the rental becomes permitted again.
Seif Beit enumerates 5 situations where the cause vanishes.
Seif Beit enumerates 5 situations where the cause vanishes.
Decision tree: may this bathhouse be rented to a non-Jew?
| # | Exit route | Concrete condition | Source | Status |
|---|---|---|---|---|
| (1) | רגילות — Public practice | Rented publicly for 2-3 consecutive years, community aware | Mehaber (Seif Beit) | 🟢 Permitted (all opinions) |
| (2) | בהבלעה / קבלנות — Absorbing lump sum | Overall contract, Shabbat wage absorbed into the week, or non-Jew takes all profits | Tour + Bait Yossef + ט״ז | 🟢 Permitted (ט״ז + ב״ח), ⚠️ Mahari Avohav strict |
| (3) | בית דירה — Private home bathhouse | Inside a house, only residents enter | Hagahot of the Rama | 🟢 Permitted (undisputed) |
| (4) | שכרם מגוי — Sub-rented from a non-Jew | The Jew is not the owner — he sub-rents | Hagahot of the Rama | 🟢 Permitted (undisputed) |
| (5) | קנה ולא ישב — Bought + never inhabited | Purchased but the Jew never settled in | ב״י (in the name of רב נטרונאי גאון) + מג״א + ב״ח | 🟢 Permitted (majority of Acharonim) — strict Rama does not mention it |
Mnemonic for the 5 routes — "PFCSC"
Publication (רגילות) · Forfait / lump sum (בהבלעה) · Contexte privé / private context (בית דירה) · Sous-location / sub-rental (שכרם מגוי) · Cachat sans habitation / purchase without habitation (קנה ולא ישב)

Bdiavad question (post-facto): if one already rented in a forbidden case, may one take the wages?
• Forbidden by the letter of the law (classic שכיר יום) → ❌ Shabbat wage forbidden
• Forbidden because of mar'it ayin → ⚠️ Dispute:
– ב״י + ב״ח (in the name of רב נטרונאי גאון) → 🟢 Wage permitted
– פרי מגדים (אש״א סק״ג) → 🔴 Wage forbidden

5. The 3 key concepts
Concept 1 — אמירה לגוי (Amira la-goï)
"Instruction to the non-Jew"
One may not tell a non-Jew to perform on Shabbat a labor forbidden to the Jew.
Level of prohibition: שבות (rabbinic).
One may not tell a non-Jew to perform on Shabbat a labor forbidden to the Jew.
Level of prohibition: שבות (rabbinic).
Concept 2 — מראית עין (Mar'it Ayin)
"The appearance"
Even if something is permitted on the pure halakhic level, it is forbidden if people might THINK there is a transgression.
Application: this is the reason for the prohibition of the bathhouse and oven by lump sum.

Application: this is the reason for the prohibition of the bathhouse and oven by lump sum.
Concept 3 — אדעתיה דנפשיה עביד
"He acts for his own account"
The non-Jew has a personal interest in finishing the work (because he takes a share of the fruits, or a lump sum), so we say that he is "working for himself".
Application: this is the criterion that renders אריסות and קבלנות permitted.

6. Mnemonics — Memory aids
Acrostic: MA-CHAB
M = Mar'it ayin (appearance — why the bathhouse is forbidden)
A = Amira la-goï (the foundational prohibition)
C = Coutume du métier / Custom of the trade (the decisive criterion)
H = Hovah ou rechout / Obligatory or optional
A = Adata d'Nafshé (he acts for himself)
B = Biens immobiliers / Real estate (the topic of the Siman)

Four-assets formula — "MoSh-ChaR"
Memorize in pairs:
🔴 Forbidden: Merhatz + Tanour (Bathhouse + Oven)
🟢 Permitted: Sadeh + Rehayim (Field + Mill)
Mnemonic: "BAin et FOur sont BAFOués" (forbidden);
"CHAmp et MOulin sont CHAMOnix" (free = permitted)

The 3 pillars of Siman רמ״ג
1. הקרקע נקראת על שמו (The land is known as belonging to the Jew)
2. דרך התעסקות (What is the trade custom?)
3. הנאת ישראל בשבת (Is there a direct Shabbat benefit for the Jew?)
2. דרך התעסקות (What is the trade custom?)
3. הנאת ישראל בשבת (Is there a direct Shabbat benefit for the Jew?)
7. Common pitfalls to avoid
❌ Pitfall 1
Thinking that "share-cropping" permits everything.→ No. Share-cropping of the bathhouse is forbidden (mar'it ayin), even if technically it is aristut.
❌ Pitfall 2
Believing that "pure rental" is always permitted.→ No. If the property is known as belonging to the Jew (נקראת על שמו) and the trade custom is שכיר יום, it is forbidden even under pure השכרה.
❌ Pitfall 3
Hiring a non-Jew as שכיר יום and "hoping" it's OK.→ A שכיר יום is always forbidden, without exception. It is the simplest case of אמירה לגוי.
❌ Pitfall 4
Confusing Siman רמ״ג and Siman רמ״ו.→ Siman רמ״ג = real estate (field, bathhouse, oven, mill).
→ Siman רמ״ו = movables (objects, animals, etc.).
The principles are similar but the applications differ.
❌ Pitfall 5
Not taking the local custom into account.→ If in your region the trade custom changes (e.g., a new type of bathhouse functioning as share-cropping), the halakha can adapt — but always consult a Rav.
8. Modern practical cases
| Modern situation | Basic halakha | Solution |
|---|---|---|
| Jewish restaurant with non-Jewish chef | 🔴 Forbidden (= like oven/tanour) | Close on Shabbat, or rent the kitchen to the chef |
| Jewish hotel with non-Jewish staff | ⚠️ Depends on structure | Often: "Heter Iska" company separating the roles |
| Jewish 24/7 factory with non-Jewish operators | ⚠️ According to the trade | Share-cropping (% of profits) or Shabbat sale |
| Jewish bakery with non-Jewish baker | 🔴 Forbidden (= oven/tanour) | Close on Shabbat, or heter mekhira |
| Olive field with non-Jewish worker | 🟢 Permitted under aristut | Aristut (% of olives) |
| Oil press with non-Jewish employee | 🟢 Permitted (= field) | Lump sum or share-cropping |
| Jewish spa with non-Jewish masseur | 🔴 Forbidden (= bathhouse) | Close on Shabbat, or full rental |
| Jewish 24/7 gas station | ⚠️ Very complex | Specific rabbinic solution |
9. Final summary table

Table of main sources
| Topic | Source | Halakhic conclusion |
|---|---|---|
| Bathhouse forbidden | Mishna Shabbat 121, Tour, Beit Yossef | Forbidden even by lump sum (mar'it ayin) |
| Field permitted by aristut | Av. Zara 21, Rambam, Rashba | Permitted because the custom = share-cropping |
| Oven = bathhouse | Rama, Tossafot Shabbat | Same ruling for both |
| Mill = field | Rama, Magen Avraham | Same ruling for both |
| אדעתיה דנפשיה עביד | Sugiyah Av. Zara, Tour, Shulchan Aruch | Decisive criterion for permission |
The 5 commandments of Siman רמ״ג in brief
1. Identify the asset (Bathhouse/Oven = forbidden; Field/Mill = to examine)
2. Identify the relationship (שכיר יום employee = always forbidden)
3. Check the trade custom (Day-wage or share-cropping?)
4. Check the מראית עין (Could the public be misled?)
5. Consult a Rav for complex cases

| Key concept | אדעתיה דנפשיה עביד | שביתת כלים + נראה כשלוחו |
| Decisive criterion | Trade custom (שכיר vs קבלן) | Direct benefit to the Jew (yes/no) |
| Typical solution | Aristut / Kablanut / Pure rental | Hablaa (overall lump sum) |
To review together:
Simanim 243 and 246 form a coherent diptych on "how the Jew can indirectly benefit from a non-Jew's work on Shabbat without transgressing".
The shared rule: the non-Jew must work for himself (אדעתא דנפשיה), and there must be no appearance of being an employee (mar'it ayin).
