📜 The text of the Shulchan Aruch — 8 seifim
summary: heading of the siman, then the seif. One who lives in a gatehouse, a portico or a gallery of the courtyard does not forbid the residents of the courtyard, for these are not dwellings; one who lives in the straw-house, the wood-house, the cattle-house or the storehouses forbids.
summary: the householder lent or rented out his houses in the courtyard and keeps in each of them objects that are not taken on Shabbos, because of their weight or because of a prohibition, which are things that may not be moved even for the sake of their place: those who live there do not forbid him, they are like his guests, and they too may carry from their houses into the courtyard though they did not give to the eruv. If the houses are not his, neither bought nor rented, they forbid one another. Gloss of the Rema: some say all this applies when there are no other residents in the courtyard; if there are, and their eruv is brought to them — to the other residents, the Magen Avraham explains (ס״ק ה, section 4) —, each must take part in the eruv. Then the bira rented from a non-Jew, one room of which one rents to his fellow: if at the outset he did not rent it with this in mind, it is as if the whole bira were his; if he rented it with this in mind, they are two houses, and tefisas yad does not help.
summary: five groups in a hall divided by partitions. If they all pass through one another and only the outermost opens to the courtyard, only the two innermost give to the eruv. If each has its own opening to the courtyard (gloss of the Rema: or to a gatehouse that opens to the courtyard) and the partitions reach the ceiling to within three tefachim, even of curtains: if the courtyard's eruv is placed in another house, each group gives; if it is placed in the hall, or there are no other residents, they need no eruv — according to the Mishnah Berurah, with temporary partitions only (ס״ק כ״ה). Partitions that do not reach the ceiling, the eruv being placed in another house: one eruv for all five. Gloss of the Rema: those who made partitions are separated, the others are like partners. Real upper rooms (or fixed partitions that reach the ceiling; Mishnah Berurah, ס״ק ל״א): each group gives, even if the eruv is in the hall and even with no other residents (Mishnah Berurah, ס״ק כ״ה, ס״ק ל״ב). The teacher or the scribe living in a householder's house, and the students who live in the Rav's house, each in his room, even with their own opening to the courtyard and eating and sleeping in their room, do not forbid.
summary: residents of a courtyard who all eat at one table, even if each has his own house, need no eruv, they are like one household; with another courtyard, they bring a single eruv and a single loaf, and if the eruv comes to them they do not give. Gloss of the Rema: likewise several householders who eat in one room, each at his own table, even if each sleeps in a room of his own; the curtain sometimes drawn for privacy is not a partition, since it is not there permanently.
summary: one who eats in one place and sleeps in another: the place of his meal is the essential one, and there he forbids. Brothers who eat at their father's and sleep in their own houses do not forbid; if he gives them a portion and they eat in their houses, they forbid — when the rest of the courtyard places its eruv elsewhere; if it is placed in one of these houses, or there are no other residents with them, they need not make an eruv.
summary: the five wives and five slaves who receive a portion from the householder, each eating in his own house, and the student who receives a portion from his teacher and eats in his house, do not forbid one another, if there are no residents with them in the courtyard, or if the eruv comes to them.
summary: ten houses one inside the other, all passing through one another and going out to the courtyard through the outermost: only the two innermost give to the eruv; the others are exempt, they are like a gatehouse.
summary: one who stays as a guest in a courtyard, even in a house of his own, not in a fixed way but for thirty days or less, does not forbid the residents of the courtyard, and he and they are permitted, both in his house and in theirs. Gloss of the Rema: even if the guests are many and the householder one; and only when there is one fixed householder; guests together forbid one another at once. Then a reference to the end of siman שצ״א and, in square brackets, a reference to siman שפ״ד for the non-Jew who stays as a guest.
1. The sugya — the Mishnayos and Baraisos from which the seifim come
The sources in the Gemara
The Beis Yosef traces the seifim of this siman to several passages in Eruvin, and, for seifim ד and ח, to the Rambam and to the Terumas HaDeshen; here they are in the order of the seifim.
Seifim א and ב — the Mishnah in the chapter Keitzad mishtatfin: « הַנּוֹתֵן אֶת עֵירוּבוֹ בְּבֵית שַׁעַר, אַכְסַדְרָה וּמִרְפֶּסֶת — אֵינוֹ עֵירוּב. — A Baraisa in the chapter Hadar deals with the same places when they are in another's courtyard: « מִי שֶׁיֵּשׁ לוֹ בֵּית שַׁעַר, אַכְסַדְרָה, וּמִרְפֶּסֶת בַּחֲצַר חֲבֵירוֹ — הֲרֵי זֶה אֵין אוֹסֵר עָלָיו » (עירובין ע״ב ע״ב) — it adds that the straw-house, the cattle-house, the wood-house and the storehouses forbid; then: « רַבִּי יְהוּדָה אוֹמֵר: אֵינוֹ אוֹסֵר אֶלָּא מְקוֹם דִּירָה בִּלְבַד » (עירובין ע״ב ע״ב). רַב אָמַר » (עירובין ע״ב ע״ב) — and answers on the next page: « מְקוֹם פִּיתָּא, וּשְׁמוּאֵל אָמַר: מְקוֹם לִינָה » (עירובין ע״ג ע״א). For tefisas yad, the Gemara brings a Baraisa of the school of Shmuel (section 3).
Seif ד — the Beis Yosef cites the Rambam there (section 8), and connects it to Rav's view, מְקוֹם פִּיתָּא.
Seifim ה and ו — the Mishnah of the brothers and the Baraisa of the wives and slaves, in the same chapter (section 9).
Seif ז — the discussion of Shmuel and Rabbi Yochanan on ten houses one inside the other (section 10).
Seif ח — the Beis Yosef refers to the Terumas HaDeshen (siman ע״ו); within the Rema's gloss, before the cross-reference to siman שצ״א, the printed edition on Sefaria (Maginei Eretz) carries a reference in square brackets that names it too (section 11).
2. Seif א — what makes a dwelling: the place or the meal
חקירה — what makes a place a dwelling that forbids: the nature of the place — a gatehouse, a portico and a gallery are not, a straw-house is — or the use made of it, the place where one eats one's meal?
- The nature of the place. The Mishnah (section 1) sorts the places into two lists: one who lives in the first does not forbid, one who lives in the second forbids.
- The use. The Baraisa of Rabbi Yehudah: only a place of dwelling forbids; and for Rav, the place of dwelling is the place of bread (section 1).
— in his view, the Mishnah distinguishes between the two lists only for one who fixes his meal there. On the seif, the Mishnah Berurah refers to seif ה in the same sense: « ומבואר לקמן בס״ה דאם אוכל שם אע״פ שאינו ישן ושוכב שם מקרי דירה דמקום פיתא גורם » (משנה ברורה ש״ע ס״ק ה).
נפקא מינה — seif א and seif ב. The Biur Halachah specifies which straw-house the seif speaks of: « מיירי שבית התבן ובית העצים שייך לו ואי מיירי שהיה שאול או שכור מאחר בעינן עכ״פ שלא יהא לבעה״ב שם עצים וכדומה דבר שאין ניטל בשבת » (ביאור הלכה ש״ע) — otherwise the householder has tefisas yad, and we are in seif ב.
The Shulchan Aruch of the Alter Rebbe writes, for the gatehouse, « אֵין עָלָיו תּוֹרַת בַּיִת אֶלָּא תּוֹרַת חָצֵר » (שו״ע הרב ש״ע:א) ; and for the straw-house and the like, « לְפִי שֶׁרְאוּיִים לָדוּר בָּהֶם וַחֲשׁוּבִים דִּירָה, אַף עַל פִּי שֶׁעֲשׂוּיִים מִקָּנִים וְכַיּוֹצֵא בָהֶם » (שו״ע הרב ש״ע:א). The comparison of his text with the Mechaber's is at level 4.
3. Seif ב — the householder's tefisas yad
What tefisas yad is
The Mishnah (section 1): according to Rabbi Yehudah, if the householder has tefisas yad there, the one who lives in the shed does not forbid. Rashi, as the Beis Yosef cites him, adds the reason: « דכל רשותא דחצר דידיה היא כאילו דר עמו בבית » (בית יוסף או״ח ש״ע). The Beis Yosef establishes that the halachah follows Rabbi Yehudah: « ומדמפרשי אמוראי מילתיה דרבי יהודה אלמא הלכתא כוותיה » (בית יוסף או״ח ש״ע) ; and further: « ואפילו אי אתא לאיפלוגי הא קי״ל כדברי המיקל בעירוב » (בית יוסף או״ח ש״ע).
חקירה — what makes tefisas yad: an object that will in fact not be moved — so that weight suffices — or an object that halachah forbids moving?
- The source. Rashi explains the object that may be taken: « אינו תפיסת יד ואוסר דאי בעי שקיל ושדי ליה לבראי » (רש״י עירובין פ״ו ע״א) ; and the עששית: « של ברזל חתיכות גדולות » (רש״י עירובין פ״ו ע״א).
- The Rambam names only the prohibition: « בַּמֶּה דְּבָרִים אֲמוּרִים בְּשֶׁהִנִּיחַ שָׁם דָּבָר שֶׁאָסוּר לְטַלְטְלוֹ בְּשַׁבָּת כְּגוֹן טֶבֶל וַעֲשָׁשִׁיּוֹת » (רמב״ם הלכות עירובין פ״ד הי״ד) ; « אֲבָל אִם נִשְׁאַר לוֹ בְּכָל בַּיִת מֵהֶן כֵּלִים שֶׁמֻּתָּר לְטַלְטְלָן הוֹאִיל וְאֶפְשָׁר שֶׁיּוֹצִיאֵם הַיּוֹם וְלֹא יִשָּׁאֵר לוֹ שָׁם תְּפִיסַת יָד הֲרֵי אֵלּוּ אוֹסְרִין עָלָיו עַד שֶׁיְּעָרְבוּ » (רמב״ם הלכות עירובין פ״ד הי״ד).
- The Tur also names weight: « אם אינן ניטלין בשבת מחמת איסור או מחמת כובדן אין הדרין בהם אוסרין עליו שחשובין כולם כאילו דרין עמו ואם ניטלין בשבת אוסרין כיון שיכול להוציא משם » (טור או״ח ש״ע). The Beis Yosef explains his reading: « וסובר רבינו דנקט טבל ועששיות ללמד דכל שאינו ניטל מחמת איסורו או מחמת כובדו חשיב יש לו תפיסת יד » (בית יוסף או״ח ש״ע) — on this reading, the טבל for the prohibition, the עששיות for the weight. And he cites the Maggid Mishneh: « וכתב ה״ה בפ״ד שנ״ל שכל דבר שראוי לטלטלו לצורך מקומו בכלל דבר שניטל הוא ולזה ביארו טבל ועששיות שאין להם תורת כלים » (בית יוסף או״ח ש״ע).
נפקא מינה — a heavy object that may be moved. The reading the Beis Yosef gives of the Tur counts it as tefisas yad; the Maggid Mishneh writes that it seems to him that whatever may be moved for the sake of its place is an object that is taken, and thus explains that the Baraisa names the טבל and the עששיות, which do not have the status of utensils. The seif names weight and prohibition side by side. The Magen Avraham, on weight: « צ״ע דמה גבול יש לכובד זה דמשוי שקשה לא׳ נוח לב׳ ומ״מ כ׳ דוקא דברים המוקצים ע״ש ויש להחמיר » (מגן אברהם ש״ע ס״ק ג) — he leaves the question open and concludes that one should be stringent. The Mishnah Berurah explains the weight: « אף שאין נעשה מוקצה ע״י הכובד מ״מ כיון שיש טורח לפנותן אין דרך ליטלן בשבת » (משנה ברורה ש״ע ס״ק ח) ; and the prohibition, on the seif's words אפי׳ לצורך מקומו (even for the sake of its place): « דאם היה מותר לטלטלן לצורך גופן ומקומן אפשר שיצטרך בעה״ב להשתמש בהם בשבת או להוציאן מביתו מחמת איזה סיבה ולא ישאר לו שם תפיסת יד » (משנה ברורה ש״ע ס״ק ט).
The Shulchan Aruch of the Alter Rebbe brings weight as one opinion: « וְיֵשׁ אוֹמְרִים שֶׁאִם אֵינָן נִטָּלִין מֵחֲמַת כָּבְדָּן, חֲשׁוּבִין תְּפִיסַת יָד אַף עַל פִּי שֶׁמֻּתָּרִים בְּטִלְטוּל » (שו״ע הרב ש״ע:ב) , followed, in parentheses, by וְיֵשׁ לְהַחֲמִיר בְּזֶה (level 4).
May the residents too carry out into the courtyard?
- The Rambam gives the reason: « הוֹאִיל וְיֵשׁ לוֹ תְּפִיסַת יָד בְּכָל בַּיִת מֵהֶן נַעֲשׂוּ הַכּל כְּאוֹרְחִין אֶצְלוֹ » (רמב״ם הלכות עירובין פ״ד הי״ד) ; the Beis Yosef infers: « ולפ״ז גם הם מותרים להוציא מבית התבן לחצר אף על פי שלא נתנו עירוב כיון דאורחים נינהו » (בית יוסף או״ח ש״ע).
- The Beis Yosef cites the Mordechai: « וכ״כ שם המרדכי שהוא דעת רש״י להתיר ודלא כריב״א שפירש דיש לו תפיסה מהניא כדי שלא יאסור הדר בבית התבן על בע״ה אבל הדר בבית התבן אסור להוציא ולהכניס מביתו לחצר » (בית יוסף או״ח ש״ע) — according to Rashi, they are permitted; according to the Riva, tefisas yad only serves so that the one living in the shed does not forbid the householder, but he himself does not carry out from his house into the courtyard.
- The seif: «
4. The Rema's glosses on seif ב — other residents, and the bira rented from a non-Jew
The first gloss: « ויש אומרים דכל זה כשאין דיורים בחצר אלא הם אבל כשיש דיורים אחרים ומוליכים ערובן אצלן צריכים כל אחד לערב » (שו״ע או״ח ש״ע:ב). The Beis Yosef cites what Rabbi Yehonasan writes in the name of יש מן הרבנים (some of the rabbis): « יש מן הרבנים שאומרים כי מה שאמרנו שאינו אוסר ה״מ כגון חצר שהיה כולה שלו ומשכיר הבתים שבה לאחרים והוא שוכן באחד מהם ויש לו תפיסת יד בכולן שאינם אוסרי׳ עליו משום דדמי לאחין השותפין שאוכלין על שלחן אביהם וישינים בבתיהם שאין צריכין עירוב כל אחד ואחד » (בית יוסף או״ח ש״ע) ; « וה״מ בזמן שאין עמהם דיורין בחצר אבל אם יש שם דיורין בחצר ומוליכין עירובן אצל אחרים צריכין עירוב כל אחד ואחד מגו דאסרי הני הני נמי אסרי » (בית יוסף או״ח ש״ע).
This view thus compares tefisas yad to the brothers of the Mishnah, who eat at their father's table and sleep in their houses — Rabbi Yehonasan quotes its wording; the Gemara reads it as speaking of those who receive a portion (« בִּמְקַבְּלֵי פְרָס שָׁנוּ » (עירובין ע״ב ע״ב), section 9), and so seif ה places it: brothers who receive a portion and eat it at home. When other residents forbid, these forbid too — the reason the Taz writes on the gloss: « דמגו דאסרי הני אחרים אסרי נמי הנך שדרים שם בבית שיש לו לבע״ה בו תפיסת יד » (ט״ז או״ח ש״ע ס״ק א). The Magen Avraham specifies what the gloss refers to and what it means: « קאי אסעיף זה ולא אסעיף א׳ » (מגן אברהם ש״ע ס״ק ד) ; « פי׳ שהם מוליכין עירובן אצל אחרים כמ״ש ס״ה » (מגן אברהם ש״ע ס״ק ה). The Shulchan Aruch of the Alter Rebbe also writes the comparison with the brothers: « וַהֲרֵי דִינוֹ עִמָּהֶם כְּדִין אַחִים הַמְקַבְּלִים פְּרָס מֵאֲבִיהֶם שֶׁיִּתְבָּאֵר » (שו״ע הרב ש״ע:ג).
5. Seif ג — the five groups: the two innermost, and the gatehouse of the gloss
The Mishnah: Beis Shammai require an eruv for each group, Beis Hillel one for all; and all agree that those in rooms or upper rooms each give one (section 1).
Why does the seif single out the case where all pass through one another? Tosafos: « דאם לא היה לכל אחד פתח לחצר הוה אמרינן פנימי נותן עירובו ודיו או שני הפנימיים לר׳ יוחנן » (תוספות עירובין ע״ב ע״א) — the Mishnah speaks of groups that each have their own opening to the courtyard; otherwise the rule of the ten houses would apply (seif ז, section 10).
The two innermost: under what conditions, and how many eruvin?
- The Taz cites the view of his father-in-law and rejects it: « וכ׳ מו״ח ז״ל דאין פנימי׳ אלו חייבים אלא אם חולקים במחיצות המגיעות לתקר׳ ולע״ד ל״נ כן דכאן אין חילוק בין מגיעות לתקר׳ או לא » (ט״ז או״ח ש״ע ס״ק ב). He also explains: « פירוש הם ביחד נותנים עירוב אחד לאותו שנותני׳ בני חצר כמ״ש בסיפא » (ט״ז או״ח ש״ע ס״ק ב).
The Shulchan Aruch of the Alter Rebbe writes of the two innermost, even if they are real rooms: « שֶׁהֵם בִּלְבַדָּם חֲשׁוּבִים דִּירוֹת וְאוֹסְרִים בֶּחָצֵר זֶה עַל זֶה וְכֵן לְטַלְטֵל מִזֶּה לְזֶה, אֲבָל כָּל הָאֲחֵרִים חֲשׁוּבִים כְּבֵית שַׁעַר לָהֶם » (שו״ע הרב ש״ע:ה).
The gloss: each opens to a gatehouse
The gloss bears, in parentheses, a reference to the Beis Yosef. There the Beis Yosef examines the question the Smak raises on the Sar of Coucy: « וצ״ע אי מצריך אפילו בפתחא לר״ה דהא משמע דלא מהני פתח אחד כי אם לאחשוביה החיצונה בית שער » (בית יוסף או״ח ש״ע) ; and he reads it thus: « ונ״ל דכשאין הבתים פתוחים זה לזה מיירי כגון שכל הבתים פתוחים לבית שער אחד ואותו בית שער פתוח לחצר » (בית יוסף או״ח ש״ע) ; « אבל כה״ג שאינם פתוחים זה לזה אף על פי שאין להם אלא פתח אחד צריכים לערב זה עם זה » (בית יוסף או״ח ש״ע).
נפקא מינה — the Magen Avraham draws a consequence for the houses of his time: « ומה״ט בבתים שלנו אם נתקלקל העירוב אסור לטלטל מחדר לחדר אם אין לבע״ה תפיסת יד וגם מחדר לבית אסור אם דרים שם שנים » (מגן אברהם ש״ע ס״ק ז). The Biur Halachah infers from his words: « ומוכח מדבריו דכשם שחכמים אסרו לטלטל מבית לחצר בלי עירוב כמו כן אסרו להוציא מבית לבית » (ביאור הלכה ש״ע) ; he cites Acharonim who hesitated over this, and concludes: « מ״מ לדינא העיקר כמ״א ושארי אחרונים שהסכימו לאיסור » (ביאור הלכה ש״ע).
6. Seif ג, continued — the partitions of the hall, and the eruv that comes to them
On this Mishnah, the Gemara raises a Baraisa of Rabbi Yehudah HaSabbar against one of the Amoraic views: « לֹא נֶחְלְקוּ בֵּית שַׁמַּאי וּבֵית הִלֵּל עַל מְחִיצוֹת הַמַּגִּיעוֹת לַתִּקְרָה שֶׁצְּרִיכִין עֵירוּב לְכׇל חֲבוּרָה וַחֲבוּרָה. עַל מָה נֶחְלְקוּ — עַל מְחִיצוֹת שֶׁאֵין מַגִּיעוֹת לַתִּקְרָה » (עירובין ע״ב ע״ב) ; and Rav Nachman, in the name of Rav, rules: « אָמַר רַב נַחְמָן אָמַר רַב: הֲלָכָה כְּרַבִּי יְהוּדָה הַסַּבָּר » (עירובין ע״ב ע״ב). Rav Nachman bar Yitzchak reads it in the Mishnah itself — the rooms and upper rooms of its end are not real rooms, which would be obvious: « אֶלָּא לָאו: כְּעֵין חֲדָרִים, כְּעֵין עֲלִיּוֹת.
On בתוך ג״ט (to within three tefachim), the Beis Yosef cites: « וכתב ה״ה בפ״ד בה״ע בשם הרשב״א שאם המחיצות מגיעות תוך ג׳ לתקרה חשיבי מגיעות דכל פחות מג׳ כלבוד דמי » (בית יוסף או״ח ש״ע). On curtains, he rejects the view the Mordechai brings from Rabbi Hillel: « ולא כמו שכתב המרדכי שנראה לר׳ הלל דמחיצות דיריעות גריעי » (בית יוסף או״ח ש״ע) ; the Mishnah Berurah sets a condition for them, in the name of the Acharonim: « אכן באופן שקשורות היטב מלמטה שלא ינידם הרוח » (משנה ברורה ש״ע ס״ק כ״ג).
When the eruv comes to them
The Gemara brings two versions of a Baraisa: « תָּנָא: בַּמֶּה דְּבָרִים אֲמוּרִים, כְּשֶׁמּוֹלִיכִין אֶת עֵירוּבָן לְמָקוֹם אַחֵר.
Partitions that reach the ceiling, and the eruv placed in the hall —
The Beis Yosef adds: « וכ״כ הרא״ש ג״כ ורבינו כתב כשיטתם » (בית יוסף או״ח ש״ע).
- The seif writes, like the Tur, that the eruv placed in this hall exempts them.
יסוד — the Mishnah Berurah limits this case of the seif: « ומיירי במחיצות עראי כעין מחיצות של יריעות דאלו חלקוהו במחיצות גמורות כגון של נסרים וכדומה בוודאי אין נ״מ בין עירוב בא אצלן וכו׳ ובין יש דיורין אחרים בחצר או אין דיורין דבכולהו צריכין ליתן חלק בעירוב » (משנה ברורה ש״ע ס״ק כ״ה) — with real partitions, of boards for example, each group gives its share in every case; and, for temporary partitions, it explains why the eruv placed in one of the rooms counts for all: « דהתקרה מחברן לבית אחד כיון שתחתיו הם מחיצות גרועות » (משנה ברורה ש״ע ס״ק כ״ו). The Shulchan Aruch of the Alter Rebbe writes, for the eruv placed in one of the rooms: « אֵין בְּכָךְ כְּלוּם, הוֹאִיל וְאֵינָן אֶלָּא מְחִצּוֹת עֲרַאי » (שו״ע הרב ש״ע:ה).
On the end of the passage, « ואם היו דיורין בעליות ממש » (שו״ע או״ח ש״ע:ג) — the Mishnah Berurah includes fixed partitions that reach the ceiling (ס״ק ל״א) —, the Shulchan Aruch of the Alter Rebbe writes: « וְכָל זֶה כְּשֶׁעָשׂוּ מְחִצּוֹת עֲרַאי לְפִי שָׁעָה.
7. Seif ג, end — the teacher, the scribe and the students
Tosafos (on the Mishnah of the five groups) write that the scribe, the teacher and the students lodged each in his room do not forbid, and give two reasons: « כיון שכולם משתמשין בתוך הבית בכל עיסקי תשמישתיה באפייה ובבישול ובכל דבר חשיבי כולהו כאילו אוכלים וישנים במקום אחד » (תוספות עירובין ע״ב ע״א) ; « ועוד דאין משאיל להם רשותו לאסור עליו ולא זה על זה ומצי לסלוקינהו » (תוספות עירובין ע״ב ע״א).
חקירה — do these residents not forbid because they live off the house of the householder — they bake and cook there, and הכל נקראים על שם בעל הבית (תוספות עירובין ע״ב ע״א) (all are called by the householder's name) — or because he did not lend them his domain to forbid him, and can send them away?
- The Beis Yosef, as the Taz cites him: « וכתב ב״י שעיקר ההיתר בצירוף טעם השני דוק׳ ואין לסמוך להתיר משום טעם הראשון במקום שאין שם שייכות טעם השני » (ט״ז או״ח ש״ע ס״ק ו).
- The Biur Halachah traces the Mishnah Berurah to the Taz and the Magen Avraham; the Magen Avraham too, as the commentators explain him, requires both reasons, « עיין מ״ב ס״ק ל״ג והוא מט״ז ומ״א וכפי שפירשו המפרשים כדברי המגן אברהם דגם הוא ס״ל דתרתי בעינן דוקא » (ביאור הלכה ש״ע); and it writes that this appears to it to be the main view for the halachah: « וכן נראה עיקר לדינא שהרי הרשב״א בעבוה״ק ובחידושיו וריטב״א פליגי אעיקר דינא דמחבר » (ביאור הלכה ש״ע) ; then it limits this requirement: « ונראה דעד כאן לא הצריכו תרתי אלא במקום דמשאיל לו לזמן דלא מצי לסלוקינהו בכל שעה » (ביאור הלכה ש״ע) ; a little further on, a sentence opens « וכן מבואר בח״א דהיכי דאיכא תרתי טעמים אפילו השאילו לזמן ארוך שרי » (ביאור הלכה ש״ע) and continues: « אבל היכי דמצי לסלוקינהו בכל שעה כגון שלא השאילו לזמן מיוחד לא יכול לאסור עליו אפילו אופה ומבשל בפני עצמו » (ביאור הלכה ש״ע).
The Biur Halachah names the Shulchan Aruch of the Alter Rebbe (הגר״ז) in this discussion, and identifies his position with that of the Rashba and the Ritva, of whom he wrote above that they « פליגי אעיקר דינא דמחבר » (ביאור הלכה ש״ע): « ודע דדעת הגר״ז דתלוי רק במצי לסלוקינהו והיכי דלא מצי לסלוקינהו משמע מיניה דצריך עירוב אפילו אופין ומבשלין ביחד והוא ממש כשיטת הרשב״א והריטב״א » (ביאור הלכה ש״ע). The comparison of his text with the Mechaber's is at level 4.
8. Seif ד — one table, and the curtain
The seif closely follows the Rambam's words, who gives the reason: « וּכְשֵׁם שֶׁאֵין אִשְׁתּוֹ שֶׁל אָדָם וּבְנֵי בֵּיתוֹ וַעֲבָדָיו אוֹסְרִין עָלָיו וְאֵינוֹ צָרִיךְ לְעָרֵב עִמָּהֶן כָּךְ אֵלּוּ כְּאַנְשֵׁי בַּיִת אֶחָד הֵן מִפְּנֵי שֶׁהֵן כֻּלָּן סוֹמְכִין עַל שֻׁלְחָן אֶחָד » (רמב״ם הלכות עירובין פ״ד ה״א). The Beis Yosef specifies: « ונ״ל שאפילו אם הם חלוקין בעיסתן קאמר שאינם אוסרין זה על זה » (בית יוסף או״ח ש״ע) — and cites: « וכ״כ ר׳ ירוחם בחט״ו בשם התוספות כמה אנשים שדרים בבית אחד אפילו הבית שלהם אינם אוסרים זה על זה » (בית יוסף או״ח ש״ע).
The curtain — the gloss writes that it is not a partition, since it is not there permanently. The Beis Yosef, regarding neighbours in Egypt who in his time lived each in a portico of one house, writes among other things: « ואפילו אם מגיע לתקרה נראה דלא חשיב מחיצה כיון שאינו פרוס תדיר » (בית יוסף או״ח ש״ע) ; « ועוד שאין הוילון קבוע מלמטה והרוח מוליכו ומביאו » (בית יוסף או״ח ש״ע). He writes further that even if each eats in his own room, they count as one house, since they bake and cook together and all go out through one opening; and that if each had his own opening to the public domain, there would be room to consider being lenient, but: « אלא שאיני סומך להתיר בזה משום דאיכא למימר שלא סמכו הפוסקים על טעם זה לבדו אלא משום שלא השאיל להם רשותו כדי שיאסרו עליו » (בית יוסף או״ח ש״ע).
The Shulchan Aruch of the Alter Rebbe writes of the curtain: « אֲפִלּוּ אִם מַגִּיעַ לַתִּקְרָה, הוֹאִיל וְאֵינוֹ פָּרוּס שָׁם תָּמִיד כָּל זְמַן שֶׁהֵם בַּבַּיִת, אֶלָּא כְּשֶׁרוֹצִין לַעֲשׂוֹת שָׁם דְּבַר צְנִיעוּת פּוֹרְסִין אוֹתוֹ וְאַחַר כָּךְ מְסַלְּקִין אוֹתוֹ.
9. Seifim ה and ו — the place of the meal and the portion
The Gemara first infers that the place of sleep decides; Rav Yehudah answers in the name of Rav: « שְׁמַע מִינַּהּ מְקוֹם לִינָה גּוֹרֵם. And why they forbid when other residents are there: « הָכָא בְּמַאי עָסְקִינַן — כְּגוֹן דְּאִיכָּא דָּיוֹרִין בַּהֲדַיְיהוּ.
What is receiving a portion?
- Rashi: provision from the father's house, without actually eating at his table (above).
- The Rambam speaks of those « שֶׁאֵינָן סוֹמְכִין עַל שֻׁלְחַן בַּעֲלֵיהֶן אוֹ רַבָּן תָּמִיד אֲבָל אוֹכְלִין הֵם עַל שֻׁלְחָנוֹ בִּשְׂכַר מְלָאכָה שֶׁעוֹשִׂין לוֹ אוֹ בְּטוֹבָה יָמִים יְדוּעִין כְּמִי שֶׁסּוֹעֵד אֵצֶל חֲבֵרוֹ שָׁבוּעַ אוֹ חֹדֶשׁ » (רמב״ם הלכות עירובין פ״ד ה״ו).
- Bread or money — the Beis Yosef: « ואע״פ שהתוספות והרא״ש רצו לחלק ביניהם בפרק חלון כבר כתבתי בסימן שס״ו דהיינו למאי דס״ד אבל לפי המסקנא אין חילוק ביניהם » (בית יוסף או״ח ש״ע) ; the Mishnah Berurah writes that there is no difference (ס״ק מ״ד).
יסוד — why does the portion exempt them when there are no other residents? The Mishnah Berurah: « דהואיל שמקבלין עכ״פ פרס מאביהן האב מחברן ומצרפן להיות כאיש אחד » (משנה ברורה ש״ע ס״ק מ״ו). The Gemara objects to Rav from shepherds who sleep in the fields, and answers: « הָתָם אֲנַן סָהֲדִי דְּאִי מַמְטוּ לְהוּ רִיפְתָּא הָתָם, טְפֵי נִיחָא לְהוּ » (עירובין ע״ג ע״א) ; the Magen Avraham applies it to the seif, and refers, leaving the question open, to siman ת״ט: « משמע בגמ׳ דרועים הלנין בשדה אף על פי שאוכלי׳ בעיר אין אוסרין דאנן סהדי אלו ממטי להו ריפתא התם לאכול הוי ניחא להו וצ״ע עסי׳ ת״ט ס״ז » (מגן אברהם ש״ע ס״ק י).
Seif ו — the wives, the slaves and the student
The Baraisa is a dispute: « רַבִּי יְהוּדָה בֶּן בְּתִירָה מַתִּיר בַּנָּשִׁים, וְאוֹסֵר בָּעֲבָדִים » (עירובין ע״ג ע״א) ; « רַבִּי יְהוּדָה בֶּן בָּבָא מַתִּיר בָּעֲבָדִים, וְאוֹסֵר בַּנָּשִׁים » (עירובין ע״ג ע״א). The Beis Yosef cites: « וכתב הרא״ש שר״מ פסק כדברי שניהם להקל » (בית יוסף או״ח ש״ע) ; « וכתב שם ה״ה שהרשב״א פסק כר״י בן בבא וכ״כ הרא״ש בשם הרז״ה ובעירוב נקטינן כדברי המיקל » (בית יוסף או״ח ש״ע). The seif writes the wives and the slaves together, without dispute.
For the student, the Gemara asks and resolves it from what Rav said at Rabbi Chiya's house: « דְּרַב בֵּי רַבִּי חִיָּיא אָמַר: אֵין אָנוּ צְרִיכִין לְעָרֵב, שֶׁהֲרֵי אָנוּ סוֹמְכִין עַל שׁוּלְחָנוֹ שֶׁל רַבִּי חִיָּיא » (עירובין ע״ג ע״א). The Rambam also writes: « הָאָב וּבְנוֹ וְהָרַב וְתַלְמִידוֹ שֶׁהֵן שְׁרוּיִין בְּחָצֵר אֵינָן צְרִיכִין לְעָרֵב מִפְּנֵי שֶׁהֵן כְּבַיִת אֶחָד » (רמב״ם הלכות עירובין פ״ד ה״ה). And the Mishnah Berurah limits the rule: « ודוקא בכל אלו מועיל פרס לפי שהן נמשכין אחריהן אבל באדם דעלמא המקבל פרס מחבירו אין מועיל כלל » (משנה ברורה ש״ע ס״ק נ). The Shulchan Aruch of the Alter Rebbe writes, after the law of the brothers: « וְכֵן בְּנָשִׁים הַמְקַבְּלוֹת פְּרָס מִבַּעֲלֵיהֶן, וּבַעֲבָדִים הַמְקַבְּלִים פְּרָס מֵאֲדוֹנֵיהֶם, וּבְתַלְמִידִים הַמְקַבְּלִים פְּרָס מֵרַבָּן » (שו״ע הרב ש״ע:ז).
10. Seif ז — ten houses one inside the other
Rashi explains חִיצוֹן שֶׁל פְּנִימִי (the outer one of the innermost): « בית התשיעי לחצר » (רש״י עירובין ע״ה ע״ב).
In the chapter Keitzad mishtatfin, Rav Yehudah son of Rav Shmuel bar Shilas says: « כׇּל מָקוֹם שֶׁאָמְרוּ הַדָּר שָׁם אֵינוֹ אוֹסֵר — הַנּוֹתֵן אֶת עֵירוּבוֹ אֵינוֹ עֵירוּב, חוּץ מִבֵּית שַׁעַר דְּיָחִיד » (עירובין פ״ה ע״ב) — which the Rosh explains: in a gatehouse of one individual, the one who lives there does not forbid, and an eruv placed there is valid. How does this fit Rabbi Yochanan? The Beis Yosef reports that the Rosh first sees two opposing views here, or else: « א״נ התם בבית שער חצר דיחיד דלא עביד לדירה אבל הכא דעביד בית לדירה אמרי׳ בית שער דיחיד לא שמיה בית שער » (בית יוסף או״ח ש״ע). The Magen Avraham writes it on the seif: « דאע״ג דהשני הוי בית שער לפנימי מ״מ הוי בית שער דיחיד ואוסר כיון דעביד לדירה אבל בית שער חצר דיחיד אינו אוסר כיון דלא עביד לדירה » (מגן אברהם ש״ע ס״ק י״א).
The Shulchan Aruch of the Alter Rebbe ends the seif with: « וּבֵית שַׁעַר שֶׁל בַּיִת אֶחָד אֵינוֹ מִתְבַּטֵּל מִתּוֹרַת בַּיִת » (שו״ע הרב ש״ע:ח).
11. Seif ח — the guest
The Rambam, after the dying man and the minor who forbid: « אֲבָל הָאוֹרֵחַ אֵינוֹ אוֹסֵר לְעוֹלָם כְּמוֹ שֶׁבֵּאַרְנוּ » (רמב״ם הלכות עירובין פ״ד הי״ב). The seif, which the Beis Yosef bases on the Terumas HaDeshen (section 1), speaks of the guest who does not stay in a fixed way, for thirty days or less. The Rema's gloss: « ודוקא בדאיכא בעל הבית א׳ קבוע דאז האורחים בטלים לגביה אבל אורחים ביחד אוסרים זע״ז מיד » (שו״ע או״ח ש״ע:ח).
Thirty days, or more than thirty?
- The Taz: «
- The Biur Halachah: « ובב״י גופא יש בזה סתירה דבתחלה כתב יותר מל׳ ואח״כ כתב דדוקא פחות מל׳ יום חשוב אורח אבל שלשים מקרי קבע » (ביאור הלכה ש״ע) ; « ובאמת לא מצינו בשום מקום שיעורא דיותר מל׳ ואדרבא בכל מקום אמרינן דבשלשים מיקרי תושב » (ביאור הלכה ש״ע) — and he leaves the halachah in question (וצ״ע לדינא).
- The Mishnah Berurah: « וביותר משלשים אפילו אם היה רק בשאילה לבד תו מקרי קבע ויצא מכלל אורח ואוסר » (משנה ברורה ש״ע ס״ק נ״ה) ; and: « ומסתברא דאם קבע עצמו לכתחלה יותר משלשים אוסר מיד » (משנה ברורה ש״ע ס״ק נ״ה).
- The Shulchan Aruch of the Alter Rebbe: «
For one who from the outset settles for more than thirty days, the Mishnah Berurah and the Shulchan Aruch of the Alter Rebbe therefore do not write the same thing.
One who is accustomed to come and settle — the Magen Avraham reads in the gloss: « משמע דס״ל לרמ״א דבישראל אפי׳ רגיל אין אוסר » (מגן אברהם ש״ע ס״ק י״ב). The Mishnah Berurah: « י״א שאפילו רגיל לבוא שם כמה פעמים להתארח ויש מי שמחמיר בזה » (משנה ברורה ש״ע ס״ק נ״ו). The Shulchan Aruch of the Alter Rebbe: « וְיֵשׁ אוֹמְרִים שֶׁגַּם יִשְׂרָאֵל הָרָגִיל לִקְבּוֹעַ אוֹסֵר מִיָּד.
Do the residents forbid the guest? The seif writes that he and they are permitted. The Biur Halachah reports that the Magen Avraham, in siman The Shulchan Aruch of the Alter Rebbe brings, as one opinion, for a guest who has a house of his own, basing it on the renting of that house for a time: « אֲבָל לְטַלְטֵל מִבֵּית הָאוֹרֵחַ לֶחָצֵר — אָסוּר בֵּין לוֹ בֵּין לְבַעַל הַבַּיִת, שֶׁכֵּיוָן שֶׁהִשְׂכִּירוֹ לוֹ בַּיִת זֶה לְאֵיזֶה זְמַן, שְׂכִירוּת לְיוֹמוֹ מִמְכָּר הוּא וַהֲרֵי זֶה בַּיִת שֶׁלּוֹ » (שו״ע הרב ש״ע:ט) ; and he adds in parentheses: « וְהוּא הַדִּין אִם הִשְׁאִילוּהוּ לוֹ בְּעִנְיָן שֶׁאֵינָם יְכוֹלִים לְסַלְּקוֹ תּוֹךְ מֶשֶׁךְ זְמַן שְׁאֵלָתוֹ » (שו״ע הרב ש״ע:ט).
12. Summary of the shitos and halachic conclusion
The foundation — the Mishnayos and Baraisos of Eruvin, which the Rishonim and Acharonim read thus:
- the passages from which the seifim come, according to the Beis Yosef — section 1;
- the dwelling: the Mishnah sorts by place, the Baraisa of Rabbi Yehudah and Rav look to the place of the meal; the Rambam and the Beis Yosef write both conditions; the Mishnah Berurah refers to seif ה — section 2;
- tefisas yad: the prohibition (the Rambam) or also weight (the Tur, according to the Beis Yosef); the Magen Avraham leaves weight in question and concludes that one should be stringent; the residents too may carry out into the courtyard (Rashi according to the Mordechai, the Beis Yosef from the Rambam's reason, the seif), against the Riva; only in houses that are his — section 3;
- the Rema's gloss: when other residents forbid, these forbid too (Rabbi Yehonasan, the Taz); the bira rented with the intention of living together (the Mahari Kolon) — section 4;
- the two innermost: the Taz, the Biur Halachah and the Mishnah Berurah do not write the same thing; the gatehouse gloss, and the consequence the Magen Avraham draws from it for the houses of his time — section 5;
- the divided hall: the halachah follows Rabbi Yehudah HaSabbar; the eruv placed in the hall suffices for them according to Tosafos (one eruv for all), the Rosh and the Tur, who follows their view according to the Beis Yosef (« ורבינו כתב כשיטתם », בית יוסף או״ח ש״ע), and according to the seif, which writes that they need not give at all; not according to the Beis Yosef's reading of the Rambam; the Mishnah Berurah limits it to temporary partitions — section 6;
- the teacher, the scribe and the students: the two reasons of Tosafos; the Beis Yosef, cited by the Taz, does not rely on the first without the second, and the Mishnah Berurah requires both together; the Biur Halachah distinguishes whether the householder can send them away or not — section 7;
- one table: the Rambam; the curtain that is not permanently drawn (the Beis Yosef) — section 8;
- the place of the meal and the portion: Rav and Shmuel, and the seif, which writes that the place of the meal is the essential one; Rashi and the Rambam on the portion; the wives and the slaves, a dispute in the Baraisa — section 9;
- ten houses: Rabbi Yochanan and Shmuel; the Rosh and the Rambam rule like Rabbi Yochanan (the Beis Yosef) — section 10;
- the guest: thirty days, or more than thirty (the Taz, the Biur Halachah, the Mishnah Berurah, the Shulchan Aruch of the Alter Rebbe); one who is accustomed to come; the fixed householder — section 11.
