summary: heading of the siman, then seif א. A Jew who went to spend Shabbos in another courtyard, even an adjacent one, if he has put [his dwelling] out of his mind and does not intend to return home on Shabbos, does not forbid. A non-Jew, even if he went to spend Shabbos in another town, forbids until they rent his place from him, if it is near, within a day's walk, since he may come on Shabbos; if it is farther, he does not forbid. Some say that even a non-Jew who went to another courtyard does not forbid. In small type, in brackets: [and this appears to be the main view] [and if the non-Jew came on Shabbos, see below, siman 383].

summary: a Jew who went to spend Shabbos in another courtyard with no intention of returning on Shabbos, and then changed his mind on Shabbos and returned, does not forbid.

summary: one from the marketplace who had a house in the courtyard died and left it to one of the residents of the courtyard. If he died while it was still day, the one who acquires it does not forbid, since the eruv he makes for his own house also permits what he inherited; if he died after nightfall, he forbids: although he made the eruv with them, it does not help for what he inherited afterwards, on Shabbos.

summary: the resident who died on Shabbos. If he had made the eruv, even if one from the marketplace inherits him, he does not forbid. Without an eruv: the heir from the marketplace does not forbid as long as he does not come to live with them, and forbids if he comes on Shabbos to live in the house of the one he inherits; the heir from the courtyard who had made the eruv and lived with the deceased in his house does not forbid, although the deceased did not make the eruv; if he lived in another house in the courtyard, he forbids, although he made the eruv, since the deceased did not. If he died by day, the heir from the marketplace forbids — provided he came on Shabbos into the house of the one he inherits.

summary: a Jew and a convert lived in a courtyard; the convert dies by day and another Jew takes possession of his property: even if he does so only after nightfall, he forbids until he renounces his domain, like any other heir. If he died after nightfall, the one who takes possession does not forbid, since [the courtyard] remains in its original permission.

summary: the dying man forbids, although he cannot survive that day, until they transfer to him bread and make the eruv for him; likewise the minor, although he cannot eat a kezayis; but the guest does not forbid, as explained in siman 370.

1. The Mishnah and the Gemara — one who leaves his house (seif א)

The Beis Yosef opens his commentary on the siman with its source: « משנה בפרק כיצד משתתפין » (בית יוסף או״ח שע״א). Four Tannaim there discuss one who leaves his house to spend Shabbos elsewhere. Rabbi Yehudah: « רַבִּי יְהוּדָה אוֹמֵר: אֵינוֹ אוֹסֵר » (עירובין פ״ו ע״א). Rabbi Yosei: « רַבִּי יוֹסֵי אוֹמֵר: נׇכְרִי — אוֹסֵר, יִשְׂרָאֵל — אֵינוֹ אוֹסֵר, שֶׁאֵין דֶּרֶךְ יִשְׂרָאֵל לָבֹא בַּשַּׁבָּת » (עירובין פ״ו ע״א).

The Gemara brings Rav's ruling, and immediately limits it: « אָמַר רַב: הֲלָכָה כְּרַבִּי שִׁמְעוֹן. It justifies this with a saying: « דְּאָמְרִי אִינָשֵׁי: נְבַח בָּךְ כַּלְבָּא — עוּל, נְבַח בָּךְ גּוּרַיְיתָא — פּוֹק » (עירובין פ״ו ע״א).

Rashi, quoted by the Beis Yosef — on the first two opinions of the Mishnah: « ופירש״י ה״ז אוסר דדירה בלא בעלים שמה דירה. For Rabbi Meir, a dwelling without its owner is still a dwelling; for Rabbi Yehudah, it is not. And on Rabbi Shimon's word

יסוד — the Tur opens the siman with the rule, and applies it at once to Rabbi Shimon's case: « דירה בלא בעלים אינה אוסרת הלכך מי שיש לו בית בחצר והולך מבע״י לשבות אצל בתו אפילו באות׳ העיר אינו אוסר אפילו חזר בשבת » (טור או״ח שע״א). The Mishnah Berurah gives the same reason on seif

According to Rashi, the Mishnah thus brings in the absence of the dwelling's owner, on which Rabbi Meir and Rabbi Yehudah disagree, and, with Rabbi Shimon, intention: he speaks of one who has already put [his dwelling] out of his mind. Seif א writes « אם הסיח מלבו » (שו״ע או״ח שע״א:א) — the word by which Rashi explains Rabbi Shimon's הסיע —, and the rule applies even to an adjacent courtyard.

2. At his daughter's, not at his son's — the intention of the one who leaves (seif א)

Rashi, quoted by the Beis Yosef, explains the limit the Gemara sets to Rabbi Shimon's rule: « ופירש״י ודוקא בתו. דעביד איניש דדייר אצל חתנו אבל בנו אין אדם מסיח דעתו מביתו לדור אצל כלתו שמא תתקוטט ויצא » (בית יוסף או״ח שע״א) — it is usual for a man to stay with his son-in-law, but one does not put one's house out of mind to go and live with one's daughter-in-law, lest she quarrel with him and he have to leave. The Tur gives the reason in its own words: « ודווקא אצל בתו שהסיח דעתו מדירת ביתו שאפשר לו לדור אצל חתנו אבל אצל בנו לא שלא הסיח דעתו מדירת ביתו שמא לא יכול לדור אצל כלתו » (טור או״ח שע״א).

Daughter or son: the letter of the Gemara, or the intention. Seif א names neither the daughter nor the son. The Beis Yosef writes: « ורבינו כתב כפשט הגמרא דדוקא בתו אבל אצל בנו לא אבל הרמב״ם בפ״ד מה״ע לא חילק בין בתו לבנו » (בית יוסף או״ח שע״א). Seif א takes over the Rambam almost word for word: « אֶחָד מִבְּנֵי חָצֵר שֶׁהִנִּיחַ בֵּיתוֹ וְהָלַךְ וְשָׁבַת בְּחָצֵר אַחֶרֶת אֲפִלּוּ הָיְתָה סְמוּכָה לַחֲצֵרוֹ.

The Beis Yosef brings the Maggid Mishneh's explanation: « וכתב ה״ה דס״ל שלא אמרו כן אלא לדבר בהווה ומצוי שדרך בני אדם לשבות אצל בתו מאצל בנו ולעולם אם הסיח לבו אפילו הלך אצל בנו אינו אוסר ובשלא הסיח אפילו אצל בתו הרי זה אוסר » (בית יוסף או״ח שע״א). According to him, the Gemara speaks of the common case, and everything depends on the actual intention.

The Biur Halachah reads the sugya as dealing with the ordinary case: « אף דבסוגיא שם איתא דוקא בתו אבל בנו לא וכ״ש אחר הסוגיא מיירי בסתמא » (ביאור הלכה שע״א); and if the intention was stated: « אבל אם הסיח דעתו בהדיא מדירתו לאותו שבת כגון ששאלוהו ואמר שאין דעתו לחזור לדירתו לשבת זו אינו אוסר אפילו הלך לשבות אצל בנו וה״ה אחר ואם לא הסיח דעתו כגון ששמעו ממנו שדעתו לחזור בשבת אפילו בשהלך אצל בתו אוסר » (ביאור הלכה שע״א). He adds, on the Rambam: « ומסתברא דגם הרמב״ם מודה דבבתו אפילו בסתמא אמרינן דהסיח דעתו » (ביאור הלכה שע״א). He writes that the Rishonim copy the Gemara's distinction between daughter and son, among them Rabbeinu Chananel, the Rif, the Semag, the Rosh and the Rashba.

One who goes to spend Shabbos at his son's without saying anything of his intention. According to the Tur, who follows the letter of the Gemara, he has not put his dwelling out of mind. According to the Maggid Mishneh's explanation brought by the Beis Yosef, everything depends on his actual intention. According to the Biur Halachah, the ordinary case at the son's is not a putting-out-of-mind of the dwelling, and a stated intention counts at the son's as at anyone else's.

3. Left by day, or on Shabbos (seif א)

Seif א does not say when the resident left; the Tur, quoted in section 1, writes that he left מבע״י, while it was still day. The Magen Avraham on these words: « נ״ל דנקט כן לאשמועי׳ דאפי׳ חזר אין אוסר » (מגן אברהם שע״א ס״ק א). He proposes another explanation, connected with the non-Jew (siman 383), and then writes: « אבל באמת אפי׳ הי׳ כאן ולא עירב והלך בשבת אינו אוסר כמ״ש גבי מת בשבת ולא עירב » (מגן אברהם שע״א ס״ק א).

חקירה — what removes the dwelling: intention alone, or the intention already present when Shabbos begins? The Magen Avraham brings his proof from seif ד, where the house of a deceased who had not made the eruv does not forbid as long as the heir does not come into it. The Biur Halachah rejects the proof; he cites the Beis Meir, and the Gaon Yaakov, who distinguishes: « דהכא שהוא חי וקנה בו שביתה לאחר שקידש היום לא נעקרה דירתו מכאן במה שהלך במקצת היום הנשאר לשבות במקום אחר » (ביאור הלכה שע״א). One who was at home when the day was sanctified acquired his shevisah there, and leaving during the rest of the day does not uproot his dwelling.

He adds that Rashi says so explicitly: « וכ״כ רש״י בדף מ״ז בהדיא דמיירי מבע״י » (ביאור הלכה שע״א), and so do the Rashba and the Ritva. He concludes: « וע״כ נראה פשוט דאין להקל כשהלך בשבת אם לא בשעת הדחק אפשר דיש לסמוך על דעת המגן אברהם כשהסיח דעתו בהדיא » (ביאור הלכה שע״א).

The Shulchan Aruch HaRav writes the condition מבעוד יום for one who returns: « בַּמֶּה דְּבָרִים אֲמוּרִים? אֲבָל אִם הָלַךְ מִשֶּׁחָשֵׁכָה — אוֹסֵר כְּשֶׁחוֹזֵר » (שו״ע הרב שע״א:א); what it holds for the time during which one who left on Shabbos is away, its seif 1 does not say (Level 4, point ב).

4. The non-Jew — Rabbi Yehudah and Rabbi Yosei (seif א)

For the non-Jew, the Mishnah opposes Rabbi Yehudah, for whom one who leaves his house does not forbid, to Rabbi Yosei, for whom the non-Jew forbids (section 1). The Beis Yosef brings both rulings: « ובפלוגתא דרבי יהודה ורבי יוסי פסק הרא״ש כרבי יהודה משום דהלכה כדברי המיקל בעירוב » (בית יוסף או״ח שע״א); he then names, in the same sense, among others the Mordechai, the Semag, a responsum of the Ramban and a responsum of the Rashba.

A non-Jew who left by day does not forbid; if he comes on Shabbos, he forbids; and the Tur brings the Rambam's view.
His words set no distance.

The Beis Yosef brings the Maggid Mishneh: « וכתב עוד שנראה מדברי הרמב״ם שאין עכו״ם אוסר אא״כ הוא במקום קרוב דהיינו מהלך יום אחד שיכול לבא בשבת אבל אם היה רחוק יותר אינו אוסר » (בית יוסף או״ח שע״א). The Beis Yosef adds on his own that this is obvious, from the Gemara at the beginning of chapter הדר — the words that follow are not in the Maggid Mishneh: « אוקימנא לאוסר דר״מ דוקא לדאתי ביומיה כלומר אבל אם הוא במקום רחוק שא״א לו לבא ביומו לא אסר וממילא נשמע לרבי יוסי דלא בא להחמיר על ר״מ בעכו״ם דא״כ הו״ל לפרושי » (בית יוסף או״ח שע״א). Rabbi Meir thus forbids only when the one who left can come the same day, and Rabbi Yosei, according to the Beis Yosef, does not come to be stricter than him regarding the non-Jew. In the Gemara, the question and the answer: « וְכִי לֵיתֵיהּ, לָא אָסַר?

Seif א writes the stam ruling in the Rambam's words, with this distance: « אם היא קרוב מהלך יום א׳ שהרי אפשר שיבא בשב׳ » (שו״ע או״ח שע״א:א). On the town farther away, the Magen Avraham: « ואף על גב דברחוק נמי איכא למיחש שהלך בחול עד סמוך לכאן ויבא בשב׳ מ״מ לא חיישי׳ להכי » (מגן אברהם שע״א ס״ק ב) — even though one might fear that he walked during the week to somewhere nearby and will come on Shabbos, this fear is not taken into account.

5. The opinion introduced by וי״א, the brackets and the Taz's reading (seif א)

Then, in small type, in brackets and without the word The text does not name the author of these notes.

Another town, or even another courtyard? The opinion brought speaks of another courtyard. The Biur Halachah on these words: « עיין בב״ח שהביא דהתוס׳ חולקים ע״ז וכן משמע מהטור דדוקא אם הלך לעיר אחרת מקילינן גם גבי עכו״ם ולא בחצר אחרת ובפסקי הרא״ש כתב הכי בהדיא » (ביאור הלכה שע״א). He finds the opposite view in the Riaz: « אכן בריא״ז המובא בשלטי הגבורים דעתו הכי דאפילו בחצר אחרת מותר » (ביאור הלכה שע״א), and concludes: « אבל עכ״פ הוא דעת יחידאה דהתוס׳ והרשב״א והטור חולקים ע״ז ובפרט לדעה קמייתא בעכו״ם בכל גווני אסור » (ביאור הלכה שע״א). The Mishnah Berurah refers to this Biur Halachah (see Level 1, seif א).

The Taz's question. A non-Jew who comes on Shabbos forbids (the Tur, section 4); yet seif ב writes that a Jew who changed his mind and returned does not forbid: « ומ״ש מהא דאי׳ אחר זה בישראל שנמלך ובא בשב׳ דמותר » (ט״ז או״ח שע״א ס״ק א).

His answer: « וע״כ נרא׳ דבאמת אין חילוק בין עכו״ם לישראל אלא בספק לנו בע״ש אם יבא בשב׳ » (ט״ז או״ח שע״א ס״ק א). It is on this doubt, according to him, that the Tannaim of the Mishnah disagree, and he writes: « והכריע רמ״א להקל בעכום בספק ובזה פסק דאם בא בשבת העכו״ם אוסר ולא אמרינן בזה שבת שהותרה כו׳ כיון שלא הותר אלא מכח ספק » (ט״ז או״ח שע״א ס״ק א). But if, on Erev Shabbos, it was clear that the non-Jew would not come: « אבל באם היה נרא׳ בבירור בע״ש שלא יבא בשבת והסיח מלבו אלא שאח״כ נמלך ובא בשבת אפי׳ בעכו״ם י״ל שבת שהותרה הותרה דמ״ש משראל » (ט״ז או״ח שע״א ס״ק א).

The Taz relies on the Rosh (section 6), and ends with a reservation about the reading he proposes of the Tur: «

6. One who changes his mind and returns — the Shabbos that has been permitted (seif ב)

The Taz copies the Rosh, who first brings the opposing view and its two proofs: « אם חזר לביתו בשבת י״א שאוסר ומביאים ראיה מעכו״ם דכי ליתיה לא אוסר וכי איתיה אוסר. Then the Rosh answers: « ול״נ כיון דר״ש לא שרי אלא משום דמסיח מלבו ובודאי לא יחזור ה״ל שבת שהותר׳ ושוב לא תאסר ול״ד לעכו״ם שהי׳ עתיד לבוא בשבת » (ט״ז או״ח שע״א ס״ק א). Continuing, in the Beis Yosef: « וכן מצאתי משם הראב״ד וכן דעת ה״ה בפ״ד מה״ע » (בית יוסף או״ח שע״א).

The principle he uses has a general form in a baraisa that the Gemara raises against Rav Nachman, about an heir who renounces his domain; its examples include an eruv made through a doorway or a window that was then blocked; none speaks of one who changes his mind — the connection with seif ב is this page's: « זֶה הַכְּלָל, כׇּל שֶׁמּוּתָּר לְמִקְצָת שַׁבָּת — הוּתַּר לְכׇל הַשַּׁבָּת, וְכׇל שֶׁנֶּאְסַר לְמִקְצָת שַׁבָּת — נֶאְסַר לְכׇל הַשַּׁבָּת חוּץ מִמְּבַטֵּל רְשׁוּת » (עירובין ע׳ ע״ב).

The Mishnah Berurah explains why the same reason does not apply to the non-Jew: « דלא שייך גבי עכו״ם לומר שכבר הסיח דעתו שזה אינו אלא בישראל שבמקום ששובת בכניסת שבת שהוא לו יום מנוחה מסתמא דעתו אז שלא לעקור ומה שבא אח״כ רוח אחרת היתה לו משא״כ גבי עכו״ם כשבא הוכיח סופו על תחלתו ואמרינן שכבר בבין השמשות היה דעתו לבוא ואף אם יאמר שהסיח דעתו מתחלה לא מפיו אנו חיין » (משנה ברורה שע״א ס״ק ח).

The reservations. The Taz remarks on the wording of the seif: « וגם כאן בש״ע צ״ע למה נקט ישראל » (ט״ז או״ח שע״א ס״ק ב). The Biur Halachah, on the words « ואח״כ נמלך בשבת וחזר אינו אוסר » (ביאור הלכה שע״א): « עיין בב״י שהביא דעות המחמירין בזה אך הוא נטה להקל והגר״א בביאורו משמע דדעתו לפסוק כדעת המחמירים » (ביאור הלכה שע״א). And he concludes: « וע״כ יש להחמיר אם לא בשעת הדחק » (ביאור הלכה שע״א). On seif ג, he reports that the Gra inferred from a question of the Bach (section 7): « ומחמת קושיא זו הכריח הגר״א דלא כס״ב » (ביאור הלכה שע״א).

The Shulchan Aruch HaRav writes, as the Mechaber does: « וַאֲפִלּוּ אִם אַחַר כָּךְ נִמְלַךְ וְחָזַר לְבֵיתוֹ בְּשַׁבָּת, אֵינוֹ אוֹסֵר » (שו״ע הרב שע״א:א); see Level 4, point ב.

7. The house of one from the marketplace, inherited by day or after nightfall (seif ג)

Seif ג comes from a baraisa whose first part is also that of seif ד (section 8); the Beis Yosef says so: « ברייתא בפרק הדר » (בית יוסף או״ח שע״א).

The Beis Yosef infers from this that the two figures of the baraisa are only markers: « וא״כ אחד מבני החצר ואחד מן השוק לסימנא בעלמא נקטינהו דסתם אחד מבני חצר הוא מערב עם שכיניו וסתם אחד מן השוק אינו מערב עמהם » (בית יוסף או״ח שע״א). The Mishnah Berurah, on seif

יסוד — the moment that counts is twilight. Died by day: « שהעיקר קניית העירוב בין השמשות ואז כבר היה הבית שלו » (משנה ברורה שע״א ס״ק י״א). Died after nightfall: « כיון דבעת ביה״ש שהוא אז זמן קניית העירוב לא היה הבית שלו אין חל העירוב על בית זה » (משנה ברורה שע״א ס״ק י״ד).

The Bach's question. The Biur Halachah sums it up: at twilight the house had no owner and did not forbid; why not say that the Shabbos, permitted at that moment, remains permitted? The Magen Avraham brings the question in the name of the Bach: « וא״ת נימא שבת הואיל והותרה הותרה » (מגן אברהם שע״א ס״ק ד). The Taz, who calls him his father-in-law, answers: « ומו״ח ז״ל הקשה כאן נימא כיון דהותר׳ שבת הותרה ולא דק דכאן לא הותר בכניסת שבת שהרי לא היה שם עירוב » (ט״ז או״ח שע״א ס״ק ג).

And on seif ד, of the heir who came from the marketplace: « דבדידיה לא אמרי׳ שהסיח מלבו דדוקא כשהי׳ כאן והלך לו אמרי׳ כן » (מגן אברהם שע״א ס״ק ה).

The Biur Halachah: « אכן לפי מה שכתב המגן אברהם בסק״ה מתורץ קושית הב״ח ואין אנו צריכין כלל לתירוצו שתירץ בסק״ד » (ביאור הלכה שע״א). The Shulchan Aruch HaRav formulates the rule in its seif 2: « לְפִי שֶׁאֵין אוֹמְרִים כֵּן אֶלָּא כְּשֶׁבְּשָׁעָה שֶׁהֻתְּרָה הָיָה הַדָּבָר בָּרוּר שֶׁלֹּא תַחֲזוֹר וְתֵאָסֵר » (שו״ע הרב שע״א:ב); see Level 4, point ד.

חקירה — may the heir renounce his domain? Where one could have made the eruv the day before, one can also renounce; but this one could not do so the day before — can he therefore not renounce? Or is the heir the leg of his father? Rav Nachman answers that he renounces, and adds that the school of Shmuel teaches the opposite.

The Gemara objects to him from our baraisa, and answers: « אַמַּאי אוֹסֵר? The Rambam writes it: « וְאֶחָד מִן הַשּׁוּק שֶׁמֵּת וְהֵנִיחַ רְשׁוּתוֹ לְאֶחָד מִבְּנֵי הֶחָצֵר. The Beis Yosef brings, from the Maggid Mishneh in the name of the Rashba: « ויראה דאפילו לא היה היורש דר באותו שבת עמהם אוסר עד שיבטל שכל שנאסר למקצת שבת נאסר לכל השבת עד שיבטל » (בית יוסף או״ח שע״א).

8. The resident who died on Shabbos (seif ד)

Seif ד deals with the first part of the baraisa (section 7), which it details according to the heir. The Beis Yosef, on the Tur: « ומעתה כל דברי רבינו בבבא זו מבוארים במה שכתבתי מהגמרא ודברי הרא״ש » (בית יוסף או״ח שע״א). He notes what the Tur left out: « ולא השמיט רבינו מהם זולת הא דתניא גבי אחד מבני חצר שמת וכו׳ מבע״י אוסר והטעם שהשמיטו הוא משום דלא איצטריכא ליה דבכלל לא עירב המוריש הוא דכל שמת מבע״י אע״פ שעירב כלא עירב דמי דהא פסק עירובו קודם השבת » (בית יוסף או״ח שע״א). Seif ד, for its part, writes it at its end: « ואם מבעוד יום מת ויורשו אחד מן השוק הרי זה אוסר והוא שבא היורש בבי׳ מורישו בשב׳ » (שו״ע או״ח שע״א:ד).

This condition is written by the Rosh, whom the Beis Yosef brings: « וכתב הרא״ש אחד מבני החצר שמת וכו׳ מבע״י אוסר היינו דוקא כשבא היורש בבית אביו בשבת דאי לא בא לא הוה אסר דקי״ל כר״ש דאמר אם הניח את ביתו והלך אצל בתו אינו אוסר » (בית יוסף או״ח שע״א). The Mishnah Berurah, on death by day: « כאן לא חילק בין עירב ללא עירב דאפילו עירב כיון שמת מבע״י בטל עירובו והוי כלא עירב » (משנה ברורה שע״א ס״ק כ״ג).

The heir from the marketplace who does not come to live there. The deceased had not made the eruv; his heir does not come into the house. Seif ד writes that he does not forbid.

The Taz explains the position of the Tur and the Rosh: « דאז אמרי׳ הואיל והותר שבת הותר ובלא עירב דלא אסר היורש אלא א״כ בא בשבת א״ל הואיל ונאסר בכניסת שבת נאסר לכל השבת דהא כאן לא היו לו בעלים ביום השבת כל זמן שהיורש לא בא אחר מיתת אביו דירה בלא בעלים אינה אוסרת אבל כשבא היורש שם בשבת הרי יש לדירה בעלים ואז אסור מכח מה שלא עירב תחלה אביו ועירוב של יורש לא מועיל למה שיורש בשבת כ״ה דעת הטור ע״פ הרא״ש » (ט״ז או״ח שע״א ס״ק ד). The Mishnah Berurah: « אף דנאסר בתחלת השבת מחמת המוריש שלא עירב עם בני החצר מ״מ כשמת ונשאר הבית בלא דיורין לא חשיבא לאסור » (משנה ברורה שע״א ס״ק י״ח).

The Biur Halachah ends: «

The heir from the courtyard who had made the eruv and lived with the deceased does not forbid, although the deceased did not make the eruv; the Mishnah Berurah gives the reason: « שבני ביתו של אדם מערבין לו שלא מדעתו » (משנה ברורה שע״א ס״ק כ׳).

The condition that the heir came into the house. The Biur Halachah, on this condition: « הקשו האחרונים הא כיון דמתחלת שבת היה דירה בלא בעלים ולא היה אוסר דירה על בני החצר אמאי לא נימא כיון שהותרה הותרה וכההיא דסעיף ב׳ וי״ל דדוקא בס״ב שהיה כאן והלך לו מבע״י אמרינן שהסיח מלבו לחזור בו ביום ולכן אמרינן ביה אף שאירע שחזר ובא כיון שהותרה הותרה משא״כ בזה לא אמרינן כלל שהיורש הסיח דעתו בעת תחלת כניסת השבת שלא לבוא כלל בשבת לדור בבית » (ביאור הלכה שע״א).

9. The Jew and the convert (seif ה)

Another baraisa, on the same page of Gemara, begins thus: « יִשְׂרָאֵל וְגֵר שְׁרוּיִין בִּמְגוּרָה אַחַת, וּמֵת גֵּר מִבְּעוֹד יוֹם » (עירובין ע׳ ע״ב). The Gemara is puzzled by its wording, and Rav Pappa emends the reading: « אָמַר רַב פָּפָּא: אֵימָא: אַף עַל פִּי שֶׁלֹּא הֶחְזִיק » (עירובין ע״א ע״א); to the objection that the baraisa states the opposite, the Gemara gives its meaning, for each of the two clauses, which Rav Pappa emends in the same way: « הָכִי קָאָמַר: אַף עַל פִּי שֶׁלֹּא הֶחְזִיק מִבְּעוֹד יוֹם אֶלָּא מִשֶּׁחָשֵׁיכָה, כֵּיוָן דַּהֲוָה לֵיהּ לְהַחְזִיק מִבְּעוֹד יוֹם — אוֹסֵר » (עירובין ע״א ע״א); « הָכִי קָאָמַר: אַף עַל פִּי שֶׁהֶחְזִיק מִשֶּׁחָשֵׁיכָה, כֵּיוָן דְּלָא הֲוָה לֵיהּ לְהַחְזִיק מִבְּעוֹד יוֹם — אֵינוֹ אוֹסֵר » (עירובין ע״א ע״א).

יסוד — on this reading, the Gemara looks not at the moment when the other Jew took possession, but at whether he could have done so while it was still day. Rashi, quoted by the Beis Yosef: « נמצאת רשות זו תלויה ועומדת ולא הוה הותר למקצת שבת » (בית יוסף או״ח שע״א). The Magen Avraham: « כיון דראוי להחזיק מבע״י ה״ל רשות זו תלוי׳ ועומדת ולא הותר למקצת שבת » (מגן אברהם שע״א ס״ק ז).

Another Jew — the Beis Yosef: « ומאי דנקט בברייתא החזיק ישראל אחר הוא משום דאי הוי מחזיק בנכסים ישראל עצמו השרוי עמו בחצר לא הוה מצי למיתני אוסר ואינו אוסר דהא ליכא מאן דאסר עליה כיון דיחיד הוא » (בית יוסף או״ח שע״א). In the text of the Tur served by Sefaria: « ישראל וגר שהיו דרין בחצר ומת הגר מבע״י והחזיק ישראל בנכסיו » (טור או״ח שע״א), and the Beis Yosef writes: « וא״כ צריך להגיה בלשון רבינו והחזיק ישראל אחר בנכסיו » (בית יוסף או״ח שע״א). The Mishnah Berurah: « דאלו החזיק אותו ישראל הדר שם בכל גווני מותר דהרי הוא נשאר יחיד בחצרו » (משנה ברורה שע״א ס״ק כ״ז).

On taking possession only after nightfall, the Mishnah Berurah: « ר״ל ונכנס ג״כ לדור בה » (משנה ברורה שע״א ס״ק כ״ט). On like any other heir, the Mishnah Berurah: « דחשבינן הזוכה בנכסי הגר כיורש בנכסי אביו דמהני כשמבטל רשות » (משנה ברורה שע״א ס״ק ל׳); see Rava's question about the heir, section 7.

10. The dying man, the minor and the guest (seif ו)

Seif ו takes over, almost word for word, the Rambam: « אֶחָד מִבְּנֵי הֶחָצֵר שֶׁהָיָה גּוֹסֵס אַף עַל פִּי שֶׁאֵינוֹ יָכוֹל לִחְיוֹת בּוֹ בַּיּוֹם הֲרֵי זֶה אוֹסֵר עַל בְּנֵי הֶחָצֵר עַד שֶׁיְּזַכּוּ לוֹ בְּפַת וִיעָרְבוּ עָלָיו. The Tur quotes him as well. The Beis Yosef brings the source the Maggid Mishneh gives for it: « וכתב ה״ה שהיא תוספתא » (בית יוסף או״ח שע״א). The Mishnah Berurah, on the dying man: « וסד״א דנחשב כאלו מת והו״ל דירה בלא בעלים קמ״ל דכל זמן שהוא חי הרי הוא כחי לכל דבריו » (משנה ברורה שע״א ס״ק ל״ב).

If he dies on Shabbos. The Magen Avraham: « ואם מת בשבת אוסר כיון שאין העירוב ראוי להתקיים כל השבת דרוב גוססין למיתה » (מגן אברהם שע״א ס״ק ח). The Mishnah Berurah defines its scope: « והנה אם היה דר עמו אחד באותו בית פשיטא דאינו מתבטל העירוב » (משנה ברורה שע״א ס״ק ל״ג); and adds: « אכן אם העירוב הונח בשבת העבר וא״כ חל העירוב פ״א אף שבשבת זו כשנעשה גוסס היה עומד להתבטל אעפ״כ שייך בזה לומר כיון שהותרה הותרה » (משנה ברורה שע״א ס״ק ל״ג).

The Biur Halachah, on seif He concludes: « ובשעת הדחק נראה דיש לסמוך ע״ז » (ביאור הלכה שע״א).

The Shulchan Aruch HaRav writes, as the Magen Avraham does: « כֵּיוָן שֶׁאֵין הָעֵרוּב רָאוּי לְהִתְקַיֵּם כָּל הַשַּׁבָּת, שֶׁרֹב גּוֹסְסִין לְמִיתָה » (שו״ע הרב שע״א:ה); see Level 4, point ה.

The minor forbids, although he cannot eat a kezayis, until the eruv is made for him (Mishnah Berurah, ס״ק ל״ד, in the name of the Rambam); the guest does not forbid — seif ו refers to siman 370.

11. Summary of the shitos and halachic conclusion

The foundation — a dwelling without its owner does not forbid (Tur; Mishnah Berurah, ס״ק א), and the twilight at the start of Shabbos, the time when the eruv is acquired (Mishnah Berurah, ס״ק י״ד), recurs notably in seifim ג, ד and ה:
