📜 The text of the Shulchan Aruch — 1 seif
summary: the heading of the siman, then the seif. A coin given to the baker with “acquire for me” does not make an eruv, even if he made the eruv for all the others and included this man. It does if he said “make the eruv for me”; or if, having said “acquire for me”, he handed over an article as a kinyan; or if the baker had him acquire through another, or bought him bread at the market with the coin. Given to a private householder with “acquire for me”, the coin makes an eruv. The Rema adds no gloss.
1. The sugya — the Mishnah and Shmuel's three distinctions in Eruvin 81
The source in the Gemara
The source of the siman is the Mishnah of Eruvin 81a-b and the Gemara that follows it. The Mishnah sets Rabbi Eliezer against the Sages: « נוֹתֵן אָדָם מָעָה לַחֶנְוָנִי וְלַנַּחְתּוֹם כְּדֵי שֶׁיְּזַכֶּה לוֹ עֵירוּב, דִּבְרֵי רַבִּי אֱלִיעֶזֶר. וַחֲכָמִים אוֹמְרִים: לֹא זָכוּ לוֹ מְעוֹתָיו » (עירובין פ״א ע״א) — according to Rabbi Eliezer, one who gives a coin (ma'ah) to the shopkeeper or the baker so that he acquire the eruv for him has acquired; according to the Sages, his coin has acquired nothing for him. It continues: « וּמוֹדִים בִּשְׁאָר כׇּל הָאָדָם, שֶׁזָּכוּ לוֹ מְעוֹתָיו. שֶׁאֵין מְעָרְבִין לָאָדָם אֶלָּא מִדַּעְתּוֹ » (עירובין פ״א ע״ב) — the Sages concede that, given to any other person, the coin acquires for him. And: one makes an eruv for a person only with his consent. Rashi attaches this clause to the shopkeeper's case (רש״י עירובין פ״א ע״ב); the Rosh reads it as a separate rule, which does not bear on the coin given to the shopkeeper (רא״ש עירובין פרק ז׳ סימן י״ג); see section 3. And Rabbi Yehudah qualifies: « אָמַר רַבִּי יְהוּדָה: בַּמֶּה דְּבָרִים אֲמוּרִים בְּעֵירוּבֵי תְחוּמִין, אֲבָל בְּעֵירוּבֵי חֲצֵירוֹת — מְעָרְבִין לְדַעְתּוֹ וְשֶׁלֹּא לְדַעְתּוֹ, לְפִי שֶׁזָּכִין לָאָדָם שֶׁלֹּא בְּפָנָיו, וְאֵין חָבִין לָאָדָם שֶׁלֹּא בְּפָנָיו » (עירובין פ״א ע״ב) — for eruvei techumin his consent is needed; for eruvei chatzeros one makes the eruv for him with or without his consent, because one may confer a benefit on a person in his absence, but one may not act to his detriment in his absence.
The Gemara identifies “any other person”: « מַאן שְׁאָר כׇּל אָדָם? אָמַר רַב: בַּעַל הַבַּיִת. וְכֵן אָמַר שְׁמוּאֵל: בַּעַל הַבַּיִת » (עירובין פ״א ע״ב) — it is the private householder (ba'al habayis). It then brings three distinctions of Shmuel, each opening with “lo shanu”: « לֹא שָׁנוּ אֶלָּא נַחְתּוֹם, אֲבָל בַּעַל הַבַּיִת — קוֹנֶה » (עירובין פ״א ע״ב) ; « לֹא שָׁנוּ אֶלָּא מָעָה, אֲבָל כְּלִי — קוֹנֶה » (עירובין פ״א ע״ב) ; « לֹא שָׁנוּ אֶלָּא דְּאָמַר לוֹ ״זְכֵה לִי״, אֲבָל אָמַר ״עָרֵב לִי״, שָׁלִיחַ שַׁוְּיֵהּ, וְקָנֵי » (עירובין פ״א ע״ב) — he has made him his agent, and he acquires. Rav Yehudah reports Shmuel's ruling: « אָמַר רַב יְהוּדָה אָמַר שְׁמוּאֵל: הֲלָכָה כְּרַבִּי יְהוּדָה, וְלֹא עוֹד אֶלָּא כׇּל מָקוֹם שֶׁשָּׁנָה רַבִּי יְהוּדָה בְּעֵירוּבִין הֲלָכָה כְּמוֹתוֹ » (עירובין פ״א ע״ב) and when Rav Chana of Baghdad asks him whether Shmuel said so even of an alley whose beams or side-posts (lechis) were removed, Rav Yehudah specifies: « בְּעֵירוּבִין אָמַרְתִּי לְךָ, וְלֹא בִּמְחִיצוֹת » (עירובין פ״א ע״ב) — which Rashi explains: « בעירובין - כל היכא דאיירי בהלכות קניית עירוב » (רש״י עירובין פ״א ע״ב).
The seif writes Shmuel's three distinctions, but not in the order of the Gemara: first “make the eruv for me”, then the article, and the private householder last — which is also the order of the Tur. Between the article and the householder it places the acquisition through another and the bread bought at the market, which the Beis Yosef, on the Tur, traces to the Rosh (section 8). The Rosh on Eruvin (chapter 7) reports Shmuel's words in yet another order: the private householder first, as in the Gemara, then “make the eruv for me” before the article, as in the seif and the Tur.
2. The framework — courtyard eruv or techum eruv?
The seif speaks of a courtyard: « אם יבואו בני חצר לקנו׳ ממך ככר לעירוב » (שו״ע או״ח שס״ט:א) — and the Tur writes the same: « הנותן מעה לנחתום ואמר לו אם יבואו בני החצר לקנות ממך ככר לעירוב » (טור או״ח שס״ט).
The Rambam and the Maggid Mishneh — the Rambam writes this law under eruvei techumin: « נוֹתֵן אָדָם מָעָה לְבַעַל הַבַּיִת כְּדֵי שֶׁיִּקַּח לוֹ פַּת וִיעָרֵב לוֹ בָּהּ עֵרוּבֵי תְּחוּמִין » (רמב״ם הלכות עירובין פ״ו ה״כ) ; « אֲבָל אִם נָתַן לְחֶנְוָנִי אוֹ לְנַחְתּוֹם וְאָמַר לוֹ זְכֵה לִי בְּמָעָה זוֹ אֵינוֹ עֵרוּב » (רמב״ם הלכות עירובין פ״ו ה״כ). The Beis Yosef cites the remark of the Maggid Mishneh (ה״ה): « ופירשה רבינו בעירובי תחומין ויש מפרשים אותה בעירובי חצירות ודברי רבינו עיקר » (בית יוסף או״ח שס״ט) — the Rambam explained it of eruvei techumin; others explain it of eruvei chatzeros; and the main view is that of the Rambam.
The Rambam thus places the law where the Mishnah, according to Rabbi Yehudah, requires consent (section 1); the Tur and the Shulchan Aruch write it for the courtyard.
3. The underlying hakira — the acquisition or the intention?
חקירה — when the coin is given to the baker with “acquire for me”, what is missing: the acquisition — the coin does not acquire the bread without pulling (meshichah) —, or the intention — the payer meant to acquire only from the baker, in exchange for his coin, so that whatever else is done for him is done without his consent?
- First side — the acquisition. The Beis Yosef cites the Maggid Mishneh: « וטעם החנוני שאינו מזכה כשנתן לו מעה ואמר לו זכה לי לפי שהחנוני מוכר הפת ואין בעל המעה קונה אותה עד שימשוך » (בית יוסף או״ח שס״ט) — the shopkeeper sells the bread, and the one who gives the coin does not acquire it until he pulls it; and he continues: « וכיון שלא אמר לו ערב לי נראה שמשלו הוא רוצה לקנות תחת המעה ואינו קונה » (בית יוסף או״ח שס״ט) — since he did not say “make the eruv for me”, he meant to buy from the shopkeeper in exchange for the coin, and he does not acquire. This second sentence already concerns the payer's intention, the second side. The Rosh on Eruvin (chapter 7) objects to Rashi from the side of the acquisition. summary: why tie the failure to consent? Even made with his consent, an eruv acquired by a coin is no eruv, since money does not acquire.
- Second side — the intention. Tosafos write: « דאפילו מתכוין לו להקנות לו בחנם ואפילו זיכה לו ע״י אחר או לקח המעה וקנה לו מן השוק אינו עירוב כיון שהנותן מתכוין לקנות לו מן החנוני ואין המעה קונה לו » (תוספות עירובין פ״א ע״א) ; « וכל הזכיות שעושה החנוני של מדעת בעל הבית קא עביד ואין מערבין אלא לדעתו » (תוספות עירובין פ״א ע״א) — even if the shopkeeper means to give him the share for free, even if he has him acquire through another or buys him bread at the market with the coin, it is no eruv: the payer meant to buy from the shopkeeper, and whatever the shopkeeper does otherwise is done without the consent of the payer — it is he whom Tosafos here call the ba'al habayis, not the private householder of section 9. The text served by Sefaria reads של מדעת here; the Beis Yosef, who cites these words (section 8), writes שלא מדעת.
The Maggid Mishneh thus writes the acquisition, then the intention; Rashi too holds both. He opens with the acquisition: « שאין מעות קונות עד שימשוך » (רש״י עירובין פ״א ע״א) — then turns to an intention: not to give a gift, but to acquire against the coin. Whose intention is it? Tosafos, who reject this explanation, set against it the case where the shopkeeper means to give it to him for free: « ובחנם פירש כן דאפילו מתכוין לו להקנות לו בחנם » (תוספות עירובין פ״א ע״א) ; the Rosh, who copies this Rashi, writes (§13 of chapter 7 on Sefaria) « אלא לקנות במעה והרי אינה קונה » (רא״ש עירובין פרק ז׳ סימן י״ג) , where the text of Rashi served by Sefaria reads « אלא לקנות המעה » (רש״י עירובין פ״א ע״א) . This page does not decide between these readings; consult your Rav.
נפקא מינה — the baker has this man acquire his share through another, or buys him bread at the market with his coin. If what is missing is the payer's intention, these routes do not help: that is the conclusion of Tosafos. If what is missing is only the acquisition by the coin, they supply it. The seif writes that he has acquired the eruv (section 8).
4. Rabbi Eliezer — the four times of the year
For Rabbi Eliezer the coin acquires. The Gemara asks why: « מַאי טַעְמָא דְּרַבִּי אֱלִיעֶזֶר? הָא לֹא מָשַׁךְ! אָמַר רַב נַחְמָן אָמַר רַבָּה בַּר אֲבָהוּ: עֲשָׂאוֹ רַבִּי אֱלִיעֶזֶר כְּאַרְבָּעָה פְּרָקִים בַּשָּׁנָה » (עירובין פ״א ע״ב) — Rabbi Eliezer treated it like the four times of the year when the butcher is compelled to slaughter. At those times, if the ox dies, it dies for the buyer; the Gemara objects that he has not pulled it, and the first answer, Rav Huna's, « מֵת לַלּוֹקֵחַ? הָא לֹא מָשַׁךְ! אָמַר רַב הוּנָא: בְּשֶׁמָּשַׁךְ » (עירובין פ״א ע״ב) — is refuted from the end of the Mishnah on the four times. בִּשְׁאָר יְמוֹת הַשָּׁנָה, דְּחוֹב הוּא לוֹ — אֵין חָבִין לוֹ אֶלָּא בְּפָנָיו » (עירובין פ״א ע״ב) — he takes it as an acquisition made through another person: at those times it is a benefit for the buyer, and one may acquire on a person's behalf in his absence. This is the notion the Mishnah Berurah invokes for the clause « וכן אם זיכה לו הנחתום ע״י אחר » (שו״ע או״ח שס״ט:א): « מטעם דזכין לו לאדם שלא בפניו » (משנה ברורה שס״ט ס״ק ה). Then comes Rav Ila's, in the name of Rabbi Yochanan: « בְּאַרְבָּעָה פְּרָקִים אֵלּוּ הֶעֱמִידוּ חֲכָמִים דִּבְרֵיהֶן עַל דִּבְרֵי תוֹרָה. דְּאָמַר רַבִּי יוֹחָנָן: דְּבַר תּוֹרָה, מָעוֹת קוֹנוֹת » (עירובין פ״א ע״ב) — and Rashi applies it here: « דהעמידו בהן חכמים דבריהם על דין תורה דמעות קונות אף כאן מפני תיקון שבת העמידו דבריהם על דין תורה » (רש״י עירובין פ״א ע״ב) — for the sake of Shabbos, Rabbi Eliezer holds that the Sages kept to Torah law, under which money acquires.
The halachah does not follow Rabbi Eliezer; the Maggid Mishneh, cited by the Beis Yosef, gives the reason: « ודלא כרבי אליעזר לפי שהוא יחיד במקום רבים » (בית יוסף או״ח שס״ט).
The Magen Avraham on this seif: « וק״ק דבח״מ סי׳ קצ״ט ס״ג כתב דהקונה יין לקידוש קנה במעות כיון דצורך מצוה הוא העמידו דבריהם על דין תורה דומיא דד׳ פרקי׳ והא עירוב נמי מצוה הוא כמ״ש סי׳ שס״ו סי״ג ואפ״ה אין קונ׳ מעות ולא הוי דומיא דד׳ פרקים כדאמרי׳ בגמ׳ וצ״ע » (מגן אברהם שס״ט ס״ק א) — in Choshen Mishpat (siman 199, seif 3), one who buys wine for kiddush acquires it with money: since it is a mitzvah need, they kept to Torah law, as in the four times; yet the eruv too is a mitzvah (siman 366, seif 13 of the Shulchan Aruch, the Mechaber's), and still money does not acquire there, and it is not like the four times, as the Gemara says. The Magen Avraham leaves the question open (וצ״ע).
5. “Even if he made the eruv for everyone” — the reading, and what sets this case apart from the end of the seif
The seif: « זכה לי בעירוב שיהא לי חלק עמהם בשביל מעה זו אינו עירוב » (שו״ע או״ח שס״ט:א) ; « אפילו עירב החנוני [לכל האחרים] וזכה גם לזה עמהם » (שו״ע או״ח שס״ט:א) — even if the shopkeeper made the eruv for all the others and acquired on behalf of this one too along with them. The Tur had written: « אפילו אם זיכה החנוני לכולם וזיכה גם לזה עמהם אינו עירוב לזה שלא כיון לזכות לו במתנת חנם אלא בשביל מעה שנתן לו ומעות אינן קונות נמצא שאין לו חלק בעירו׳ » (טור או״ח שס״ט) — with the reason: he did not mean to give it to him as a free gift but in exchange for the coin, and money does not acquire. The Magen Avraham repeats this reason: « לפי שלא נתכוין ליתן לו מתנת חנם אלא בשביל מעות שנתן לו » (מגן אברהם שס״ט ס״ק א) ; and so does the Mishnah Berurah: « ר״ל בכלל כל בני החצר ולא פרט שמו בהדיא והטעם דמסתמא לא כוון ליתן לו במתנת חנם כמו לאחרים אלא בשביל מעות שנתן לו ומעות אינן קונות נמצא שאין לו חלק בעירוב » (משנה ברורה שס״ט ס״ק ב).
Where does the line fall? At the beginning of the seif, the eruv made for everyone does not help him; at the end, « וכן אם זיכה לו הנחתום ע״י אחר » (שו״ע או״ח שס״ט:א) — he has acquired. The commentators do not read the first case the same way: the Taz sees in it the baker conferring the share himself, the Mishnah Berurah a conferral through others, without naming him:
- The Taz: « פי׳ הוא עצמו מזכה להם ולו אבל לא ע״י אחר דהא ע״י אחר מהני כמ״ש אח״כ » (ט״ז או״ח שס״ט ס״ק א) — at the beginning, the baker himself confers the share, on the others and on him; not through another.
- The Mishnah Berurah — at the beginning too the acquisition was made through others: « ר״ל ע״י זיכוי שזיכה להן ע״י אחרים » (משנה ברורה שס״ט ס״ק א) ; what distinguishes the end is that he named him: « ר״ל שפרט שמו בהדיא ולא בסתמא עם אחרים וע״כ אף דמעות אינן קונות מ״מ הרי יש לו חלק בעירוב מטעם דזכין לו לאדם שלא בפניו » (משנה ברורה שס״ט ס״ק ה) ; and it concludes: « ובזה מיושב דלא יסתור למה שכתב בראש הסעיף דזיכוי לא מהני » (משנה ברורה שס״ט ס״ק ה).
- The Biur Halachah refers to the Mishnah Berurah: « עיין במ״ב והוא כמסקנת אחרונים בביאור דברי הטור ודלא כמ״ש בט״ז בשם הב״י » (ביאור הלכה שס״ט) ; he grants that this is the Tur's view, following the method of his father the Rosh: « אלא דבאמת אע״ג דכן דעת הטור בשיטת אביו הרא״ש דהוא סובר דהרא״ש לא פליג במש״כ ותמוהים הדברים בעיני וכו׳ אלא אדברי התוספות ולא על דברי רש״י שזכרו מתחלה דמיירי שזיכה לכל בני החצר וזיכה גם לזה » (ביאור הלכה שס״ט) — for the Tur, the Rosh's second objection (which the Biur Halachah designates by ותמוהים הדברים בעיני) is aimed only at Tosafos; it does not bear on Rashi's case, cited first, where he conferred a share on all the residents of the courtyard, this man included (the objection the Rosh addresses to Rashi, section 3, bears on the reason Rashi gives, consent). But, were it not for the words of the Tur, he would have read this objection of the Rosh as bearing on everything that precedes: « אבל באמת לולי דברי הטור הייתי אומר דתמיהת הרא״ש קאי על כל מה שזכר מקודם » (ביאור הלכה שס״ט) ; on that reading: « אבל אם החנוני זיכהו אף אם זיכהו בסתם בכלל שארי בני חצר נמי מהני » (ביאור הלכה שס״ט) — if the shopkeeper had him acquire, even without naming him, as one of the residents of the courtyard, it is effective. And he concludes: « ובאמת כן הוא דעת הב״י והט״ז לדינא אלא דהם פירשו כן בדברי הטור ובדברי הטור א״א לפרש כן וכמו שהוכיחו האחרונים וע״כ צ״ע לדינא » (ביאור הלכה שס״ט) — this is the view, in practice, of the Beis Yosef and the Taz, who read it into the Tur; the Acharonim showed that the Tur cannot be read so; the halachah remains in question.
The Shulchan Aruch of the Alter Rebbe writes this first case through another: « וַאֲפִלּוּ אִם זִכָּה הַנַּחְתּוֹם הַכִּכָּר לְכָל בְּנֵי הֶחָצֵר כֻּלָּם בִּכְלָל עַל יְדֵי אַחֵר בְּמַתְּנַת חִנָּם » (שו״ע הרב שס״ט:א) ; he gives the reason from the baker's intention: « אֶלָּא דַּעַת הַנַּחְתּוֹם הוּא שֶׁזֶּה יֵשׁ לוֹ כְּבָר זְכוּת בְּכִכָּר זֶה בִּשְׁבִיל הַמָּעָה שֶׁנָּתַן לוֹ » (שו״ע הרב שס״ט:א) ; then he writes, in parentheses: « אֲבָל אִם יֵשׁ בְּדַעְתּוֹ שֶׁיִּהְיֶה הַזּוֹכֶה שָׁלִיחַ לְזֶה כְּמוֹ לִשְׁאָר בְּנֵי הֶחָצֵר — קָנָה עֵרוּב » (שו״ע הרב שס״ט:א). The comparison of his text with that of the Mechaber is at Level 4.
6. “Make the eruv for me” — the agent
Shmuel's third distinction (section 1): “make the eruv for me” — he has made him his agent, and he acquires. Rashi: « אבל אם אמר ערב לי שליחא שוויה וסמכא דעתיה דקיימא לן חזקה שליח עושה שליחותו » (רש״י עירובין פ״א ע״ב) — he relied on him, for it is established that an agent carries out his mission. The seif: « אבל אם אמר לו ערב לי קנה עירוב » (שו״ע או״ח שס״ט:א).
The Rambam and the Tur do not write in the same way what the agent does. In the Rambam, he buys bread or some food with the coin; the Maggid Mishneh specifies: from another, not his own; in the Tur, it is as if the baker had been asked to confer a share on this man as on the other residents — and the Mishnah Berurah reads the seif as the case where the baker included him with the others.
The Taz (ס״ק ב) compares this case to a ruling of the Rosh in the first chapter of Kiddushin, which he says he cited in siman 14: one who lends a ring to his friend to betroth a woman is presumed to give it in whatever form will be effective. Hence his question: « ה״נ נימא אם אמר זכה לי הוא סבר בעד מעות מ״מ כיון דמן הדין לא מהני במעות נימא דנתכוין בל׳ דמהני כגון ערב לי » (ט״ז או״ח שס״ט ס״ק ב) — here too, one who said “acquire for me” thought he was paying; since the coin does not suffice, why not presume he meant the effective form, “make the eruv for me”?
His answer: « וי״ל דהכא שאני שאדם רוצה לעשות מצוה דוקא בשלו לא בשל חבירו » (ט״ז או״ח שס״ט ס״ק ב) — a person wants to do a mitzvah with what is his, not with what is his friend's; so he may have insisted, and not made the baker his agent to acquire for free. But the Taz does not stop there: « אלא דבסמוך יתבאר דהרא״ש לא ס״ל האי סברא ע״כ צ״ע » (ט״ז או״ח שס״ט ס״ק ב) — the Rosh does not share this reasoning (section 8), and the question stays open.
7. The article handed over — kinyan sudar
The seif: « ואפילו אם אמר זכה לי אם נתן לו כלי בתור׳ קנין שיקנה לו בו קנה עירוב » (שו״ע או״ח שס״ט:א). On Shmuel's statement Rashi writes: « אבל כלי - קנין סודר » (רש״י עירובין פ״א ע״ב) ; the Beis Yosef: « וטעמא משום דנקנית לו הפת בכלי בתורת קנין סודר » (בית יוסף או״ח שס״ט) ; and the Shulchan Aruch of the Alter Rebbe writes the word in the body of the law: « אִם נָתַן לוֹ כְּלִי שֶׁיַּקְנֶה לוֹ בְּתוֹרַת קִנְיַן סוּדָר, קָנָה עֵרוּב » (שו״ע הרב שס״ט:א).
יסוד — the Mishnah Berurah: « דדוקא מעות אינן קונות עד שימשוך החפץ אבל אם מקנה לו כלי הוי חליפין וכיון שזכה זה בכלי זכה זה בפת ששייך להעירוב » (משנה ברורה שס״ט ס״ק ד) — only money does not acquire before pulling; the article makes an exchange (chalifin), and once the baker has acquired the article, the other has acquired the bread that belongs to the eruv. The Taz (ס״ק ג) writes it in the same terms: « דדוקא מעות אינן קונות עד שימשוך החפץ אבל אם מקנה לו כלי הוה חליפין » (ט״ז או״ח שס״ט ס״ק ג).
8. Through another, or from the market — Tosafos and the Rosh
The seif, which here repeats the words of the Tur: « וכן אם זיכה לו הנחתום ע״י אחר או שקנה במעה שנתן לו לחם מן השוק קנה עירוב » (שו״ע או״ח שס״ט:א). On this sentence of the Tur, the Beis Yosef gives the source: « גז״ש מדברי הרא״ש ושלא כדברי התוס׳ שכתבו דאפילו זיכה לו ע״י אחר או קנה לו לחם מן השוק באותה מעה אינו עירוב » (בית יוסף או״ח שס״ט) ; « וכתב עליהם הרא״ש דדברים תמוהים הם » (בית יוסף או״ח שס״ט).
Tosafos and the Rosh —
- Tosafos: even through another, even from the market, it is no eruv, because the payer meant to buy from the shopkeeper (section 3).
- The Rosh, as the Taz reports him: « והרא״ש תמה ע״ז דכיון שזה גילה דעתו שחפץ בעירוב שנותן שהרי נתן מעה לחנוני ומאחר שאין קונה המעה וזוכה לו החנוני אמאי לא זכה ומ״ה פסק דזיכה לו ע״י אחר מהני וכ״כ הטור וש״ע » (ט״ז או״ח שס״ט ס״ק ד) — this man showed that he wants the eruv, since he gave the coin; if the coin does not acquire and the shopkeeper confers the share on him, why should he not acquire? So the Rosh rules that acquisition through another is effective, and so write the Tur and the Shulchan Aruch.
The Taz defends Tosafos: « וק״ל דאמאי דחה סברת התוספות דהא ודאי יש לו לומר לא ניחא לי שיתן לי אדם א׳ מתנה אלא איעבד מצוה בממוני » (ט״ז או״ח שס״ט ס״ק ד) — he can say: I do not want a person to make me a gift, I want to do the mitzvah with my own money; and he concludes: « כנלע״ד דברי התו׳ שאין בהם תמוה בזה » (ט״ז או״ח שס״ט ס״ק ד).
9. The private householder — the ba'al habayis
The Mishnah: the Sages concede that, given to any other person, the coin acquires; the Gemara: that is the private householder (section 1). Rashi gives the reason: « דהואיל ואין בעל הבית רגיל למכור ככרות לא נתכוון זה אלא לעשותו שליח ונעשה כאומר לו ערב לי » (רש״י עירובין פ״א ע״ב) — a private householder does not usually sell loaves; the one who gives him the coin meant only to make him his agent, and it is as if he had said “make the eruv for me”. The seif: « ואם נתן מעה לבעל הבי׳ ואמר לו זכה לי בעירוב קנה עירוב » (שו״ע או״ח שס״ט:א).
The presumption that an agent carries out his mission is found in Rashi for “make the eruv for me” (section 6), and in the Tur and the Taz for the private householder; the text of the Mechaber does not name it. The Shulchan Aruch of the Alter Rebbe writes it in both cases (Level 4).
10. Summary of the shitos and halachic conclusion
The foundation — the Mishnah of Eruvin 81a-b and Shmuel's three distinctions, which the Rishonim and Acharonim read as follows:
- baker or private householder, coin or article, “acquire for me” or “make the eruv for me”: Shmuel's distinctions, which the seif writes in the order of the Tur — section 1;
- the Rambam writes the law under eruvei techumin, the Tur and the seif for the courtyard (the Maggid Mishneh, cited by the Beis Yosef) — section 2;
- what the coin given to the baker lacks: the acquisition (the Rosh) or the intention (Tosafos); the Maggid Mishneh and Rashi write both — section 3;
- Rabbi Eliezer and the four times; the Magen Avraham's question from wine for kiddush, left open — section 4;
- the eruv made for everyone: the Beis Yosef's emendation; the Taz places the first case in an acquisition made by the baker himself, the Mishnah Berurah and the Shulchan Aruch of the Alter Rebbe in an acquisition made through another; the Biur Halachah leaves the halachah in question — section 5;
- “make the eruv for me”: an agent (Shmuel; Rashi; the Tur); the Taz's question, left open — section 6;
- the article: kinyan sudar (Rashi; the Beis Yosef), exchange (the Mishnah Berurah; the Taz) — section 7;
- through another or from the market: the Beis Yosef traces the Tur's sentence, which the seif repeats, to the Rosh and not to Tosafos; the Taz writes that the Rosh ruled so, and so did the Tur and the Shulchan Aruch; the Taz defends Tosafos; the Mishnah Berurah reports Acharonim who disagree (ס״ק ו) — section 8;
- the private householder: he does not usually sell, and it is as if he had said “make the eruv for me” (Rashi; the Tur; the Mishnah Berurah, ס״ק ח) — section 9.
