Why a Level 4 dedicated to the Alter Rebbe? The Shulchan Aruch HaRav is not a commentary on the Mechaber: it is a Shulchan Aruch in its own right, written by the Alter Rebbe, with its own division and its own numbering of the seifim. Here the Shulchan Aruch HaRav has 10 seifim, where the Mechaber's Shulchan Aruch has 8; the references on this page follow the Rav's numbering, except where the Mechaber's Shulchan Aruch is named.
This page gathers, for Siman 370, the full text of the Rav with its translation, where his text differs from the Mechaber's and the Rema's, and the practical conduct that follows from it.

Laws of participation (shittuf) in the eruv; it contains 10 seifim:
One who lives in a gatehouse (beis sha'ar), even though it has four walls, since many pass through there to their houses — it does not have the status (toras) of a house but that of a courtyard, and he need not make an eruv with the other houses. Likewise, one who lives in a portico (achsadra) or a gallery (mirpeses) of the courtyard does not forbid [carrying] to the residents of the courtyard, for they are not considered a dwelling (dirah). Likewise, the festival sukkah, during the festival, is not considered a dwelling so as to forbid. But one who lives in the straw-house, the cattle-house, the storehouse (beis ha'otzar) or the wood-house forbids until he makes an eruv, because they are fit to be lived in and are considered a dwelling, even though they are made of reeds and the like.

A householder (ba'al habayis) who has many houses in his courtyard, and rented them out to others or lent them (for a period, in such a way that he cannot remove them against their will within that period) — they forbid him [to carry] in the courtyard as if they were their own houses, until they make an eruv; and likewise it is forbidden to carry from his house to their houses until they make an eruv.
And if he has in each of them things that are not handled on Shabbos because of a prohibition, which it is forbidden to move even for their use or for their place — since he has not entirely withdrawn from these houses but has a hold (tefisas yad) in them, it is as if he lived in them, and those who live there do not forbid him, for they have all become like guests in his home. Therefore they too are permitted to take [things] out of their houses into the courtyard, although they did not give an eruv, just as guests staying in his house are permitted to take [things] out of his house into the courtyard without making an eruv with him. But if he has there only things that may be moved for their use or for their place, this does not count as a hold, since he can take them out of there when he needs them (or their place). And some say that if they are not handled because of their weight, they count as a hold even though it is permitted to move them (and one should be stringent in this).
And a hold is effective only in houses that are his, whether they are bought by him or rented or lent to him and he in turn rented or lent them to others. But one who has a hold in a house that is neither bought, nor rented, nor lent [to him] — it is of no use at all, and [the occupant] forbids him in the courtyard, and likewise to carry from his house to theirs.

Some say that a hold is effective only when there are no other residents with them in the courtyard — and then there is no need at all to make an eruv among them —, or even if there are residents in the courtyard, but those residents bring their eruv and place it in the house of this householder who has the hold, or in one of these houses in which he has a hold: then none of these houses needs to give bread for the eruv at all, for all these houses are like one house, and the house in which the eruv is placed need not give the bread. But if the eruv is placed in one of the houses of the [other] residents, all these houses must each give bread for the eruv: since these houses became bound to an eruv, in any case, on account of the house in which the householder lives, they too must give for their houses, even though the householder has a hold in them. And his law with them is like the law of brothers who receive a portion (peras) from their father, which will be explained.

One who rented a residence (birah) from a non-Jew and lives in it with his fellow, this one in one room and that one in another, and the renter has a hold in his fellow's room: if from the beginning of the rental, when he rented it from the non-Jew, they had agreed to live together and he rented it from the non-Jew with this in mind — even though he alone rented it from the non-Jew, his fellow is his partner in it and he cannot remove him for the whole length of the rental from the non-Jew; for since he rented it from the non-Jew with this in mind, so that they would live together, he became his fellow's agent (shaliach) to rent on his behalf from the non-Jew; therefore the hold does not help him in his fellow's [room], since it is not his. But if at the beginning of the rental he rented it for himself, and afterwards changed his mind and rented [a room] to his fellow — the hold helps him in his fellow's [room].

Five groups (chavuros) who stayed (shavsu) in a hall (traklin) and divided it with partitions into five rooms, each one opening onto the courtyard: if the partitions reach the ceiling, or [come] within three tefachim of the ceiling, each one is a room by itself, even if they are temporary partitions such as of curtains (yeri'os), and each of the groups must give its eruv.
When does this apply? When there are further residents in the courtyard and the eruv of the whole courtyard is placed with one of those residents, or in another courtyard that made an eruv with this one: since this hall became bound to the eruv because of the residents, each group must give an eruv. But if those residents placed their eruv in this hall, [the groups] need not give an eruv at all, for they all live in this house, and the house in which the eruv is placed need not give bread for the eruv. And although this hall is divided by partitions into five rooms and the eruv is in one of them, it makes no difference, since they are only temporary partitions. Likewise, if there are no other residents at all in the courtyard, there is no need of an eruv at all, for they do not forbid one another at all, since they are all in one house that is divided only by temporary partitions.
If they divided it with partitions that do not reach the ceiling, even if there are residents in the courtyard and the eruv of the whole courtyard is placed with one of those residents, all the groups need give only one eruv, as if there were no partitions between them at all. And if some of them made partitions reaching the ceiling and some did not, those who made them are separate, and those who did not are as partners.
And all this is when they made temporary partitions, for the time being. But if they stayed in actual rooms and upper chambers (aliyos) that open onto the courtyard, they forbid one another even if there are no other residents in the courtyard, and each group must give an eruv, even if the eruv is placed in this hall.
And all this is when they all open onto the courtyard. But if only the outer one opens onto the courtyard and they all pass through it, even if they are actual rooms, only the two inner ones need give an eruv, for they alone are considered dwellings and forbid one another in the courtyard, and likewise to carry from one to the other; but all the others are considered a gatehouse for them, as will be explained.
And all this is when they all have equal standing in this hall. But a householder who has a teacher (melamed) or a scribe (sofer) in his house, and likewise students who learn before the rav and live in his house, even though each one has a room of his own opening onto the courtyard and also onto the public domain (reshus harabim), and he eats and sleeps in his room — there is no need at all to make an eruv in the courtyard, because they do not forbid at all, neither in the courtyard nor to carry from their rooms to the house or from room to room, even if he has no hold in them, because he does not lend them his domain so as to forbid him, nor so as to forbid one another, and he can remove them at any time.
But if the rooms are bought by them or rented (or lent in such a way that he cannot remove them within the period of their loan — one cannot say that he does not lend them his domain so as to forbid him, since he has already lent it to them and it is not in his power to remove them, and they are there against his will), they forbid him, unless he has a hold in them. And even if they make use of the householder's large house for baking and cooking, it is of no use at all, since they eat in their rooms — unless they are students who receive a portion (peras) from their teacher, as will be explained.

A person's essential dwelling is the place where he eats bread, and not the place where he sleeps and spends the night. Therefore the people of a courtyard who all used to eat in one house on Shabbos, even though each one eats of his own at a separate table, and each one has a separate room in the courtyard where he stays all day and all night — they do not need an eruv, because they are like the people of one house and do not forbid one another.
And likewise, if they needed to make an eruv with another courtyard, one eruv for all of them, and only one bread, is brought to the place with which they make the eruv; whichever of them wishes gives the bread, and even the members of the householder's household may give the bread of their own. And if the eruv came to them, there is no need to give bread at all, like the house in which the eruv is placed, which need not give the bread: for all these houses are considered one house, since their owners eat in one house with no partition separating them.
And even if they sometimes spread a curtain (vilon) before them for modesty, it does not count as a partition dividing them, even if it reaches the ceiling, since it is not spread there permanently all the time they are in the house: when they wish to do something there that calls for modesty they spread it, and afterwards they remove it. This is not so with groups who stayed in a hall, where the curtains they spread between them remain spread there the whole time of their stay there.
And one who has two houses in two courtyards, who eats in one and lives in the second all day and all night — he forbids in the one where he eats, if he eats there on Shabbos, and must make an eruv with them; but in the second he does not forbid and need not make an eruv, and it is permitted to make use [of it] there on Shabbos, for he becomes there like a guest with them.

Brothers who have houses in their father's courtyard, who receive a portion (peras) from their father and eat in their houses — whether the portion is bread or money to buy bread with —: if there are further residents in the courtyard and the eruv of the whole courtyard is placed with one of those residents, the brothers together with their father must each give his eruv, for since these houses of the father and his sons became bound to an eruv, each one must give. But if there are no [other] residents with them in the courtyard, there is no need of an eruv at all, for they do not forbid one another: since they eat their father's portion, they have become like members of his household. Or even if there are residents with them, but the eruv is placed in one of these houses of the brothers or in their father's house, they need not make an eruv at all, for they are all like one house in which the eruv is placed, which need not give the bread.

But the other houses, in front of them, have the status of a courtyard, because each of them is a gatehouse for the one further inside it; thus the third house from the inside is a gatehouse for the two inner ones, and it is called a gatehouse of many (beis sha'ar shel rabbim), and it is not considered a dwelling since many pass through it. But the second house is a gatehouse only for one house, the one inside it, and the gatehouse of a single house does not lose the status of a house.

One who stays as a guest (misare'ach) in a courtyard, even if he stays in a separate house and eats and sleeps there in his house, if he does not stay in a fixed manner (derech keva) but for thirty days or less — he does not forbid the residents of the courtyard, and both he and they may carry in the courtyard, whether from his house or from their houses. And even if the guests are many and the householder is one, they are all subordinate (tefeilim) to him and become like members of his household, even if the houses in which they stay are not his but belong to non-Jews, or to Jews who do not live there.
And some say that a guest who stays in a separate house or room is not subordinate to the householder so as to be like members of his household; rather, as long as he does not stay in a fixed manner he has no share in the courtyard, and he does not forbid the householder to carry from his house to his courtyard. But carrying from the guest's house to the courtyard is forbidden, both to him and to the householder: since he rented him this house for some time — and renting for a day is a sale (sechirus l'yomo mimkar hu) — it is his house, and when he takes [something] out of there into the householder's courtyard, it is as one who takes out from one domain to another (and the same applies if they lent it to him in such a way that they cannot remove him for the length of his loan. And it is not like the people of a courtyard one of whom forgot and did not make the eruv, where, when he renounces (mevatel) to them the domain of his house, he too is permitted to take out from his house into the courtyard, because he becomes like a guest with them, as will be explained in Siman 380, for the one who renounces has withdrawn himself from the domain of his house and given it to them. This is not so with a guest who did not renounce and did not withdraw himself, and whom the people of the courtyard also cannot remove: the domain of his house is his own and the domain of the courtyard is theirs, and it is forbidden to take out from one of these domains to the other until they make an eruv).

But after thirty days he forbids the residents of the courtyard, if it is in such a way that they cannot remove him for the length of his rental or his loan.
And nevertheless, even if he settles for more than thirty days, he does not forbid until after thirty days, but not within the thirty, even if he is accustomed to come here and always to settle for more than thirty. When does this apply? To a Jewish guest; but a non-Jewish lodger (achsenai) who is accustomed to settle forbids immediately, as will be explained in Siman 384. And some say that even a Jew who is accustomed to settle forbids immediately. As for the halachah: in matters of rabbinic law (divrei soferim), follow the lenient view.
And all this is when there is a fixed householder in the courtyard: then the guests in the other houses of this courtyard are subordinate (bteilim) to him. But guests by themselves together forbid one another immediately, if each one has a room of his own for eating. And if a non-Jew lives in the courtyard, they must rent his domain from him, as will be explained in Siman 382.
And all this is in a place where there are no communal eruvei chatzeiros. But in a place where the community makes eruvei chatzeiros at the beginning of the year for the whole year, the guests who are added there do not forbid them nor one another, because the intention of the beis din (lev beis din) stipulates on their behalf that they have a share in the eruv, as was explained in Siman 366.

לשון הרב מול סעיף המחבר והרמ״א
Where the Rav's text differs from the Mechaber's seif and the Rema's
Each point sets side by side a seif of the Mechaber's Shulchan Aruch (its numbering, 8 seifim), with the Rema's gloss where there is one, and the corresponding seif of the Shulchan Aruch HaRav (its own numbering, 10 seifim), in the order of the Rav's seifim, and notes only what the comparison of the texts shows. In the main, the two divisions correspond as follows (the Rav's seif → the Mechaber's seif): 1 → 1; 2 → 2; 3 and 4 → the Rema's gloss on seif 2; 5 → 3; 6 → 4 and the beginning of 5; 7 → the rest of 5, and 6; 8 → 7; 9 and 10 → 8 and the Rema's gloss. What is missing from the Mechaber's text is not new for that reason: on this siman, several of the Rav's clarifications are already found in the Beis Yosef, the Magen Avraham or the Taz. Each point names where they are found, and level 2 quotes these passages at greater length; a clarification whose source we did not look for is not presented, for that reason, as the Rav's own.
נקודה א — בית שער, סוכת החג, ומה נחשב דירה (שו״ע הרב ש״ע:א)
Point א — The gatehouse, the festival sukkah, and what counts as a dwelling (Shulchan Aruch HaRav 370:1)
What counts as a dwelling
What the Mechaber writes: in seif 1 he writes « הדר בבי' שער אכסדרה ומרפס' שבחצר אינו אוסר על בני החצר שאינם חשובים דירה אבל הדר בבי' התבן בבי' העצים בבי' הבקר ובבי' האוצרו' אוסר » (שו״ע או״ח ש״ע:א), without giving a reason for the straw-house, the wood-house, the cattle-house and the storehouses.
What the Rav writes: for the gatehouse he writes « הַדָּר בְּבֵית שַׁעַר, אַף עַל פִּי שֶׁיֵּשׁ לוֹ ד' מְחִצּוֹת, כֵּיוָן שֶׁרַבִּים עוֹבְרִים דֶּרֶךְ שָׁם לְבָתֵּיהֶם — אֵין עָלָיו תּוֹרַת בַּיִת אֶלָּא תּוֹרַת חָצֵר » (שו״ע הרב ש״ע:א); he adds « וְכֵן סֻכַּת הֶחָג בֶּחָג אֵינָהּ חֲשׁוּבָה דִירָה לֶאֱסוֹר » (שו״ע הרב ש״ע:א); and for the straw-house and its like he gives the reason: « לְפִי שֶׁרְאוּיִים לָדוּר בָּהֶם וַחֲשׁוּבִים דִּירָה, אַף עַל פִּי שֶׁעֲשׂוּיִים מִקָּנִים וְכַיּוֹצֵא בָהֶם » (שו״ע הרב ש״ע:א).
What is already found before him: the Beis Yosef reports what Rabbi Yehonasan writes, on the gatehouse and then on the house made for straw, « בית שער אע״פ שיש לו ד׳ מחיצות כיון דרבים עוברי׳ לבתיהם דרך שם אין עליה תורת בית אלא תורת חצר אבל אם הניח עירובי חצירות בבית שבחצר שהוא מיוחד לאצור שם תבן ובהמותיו הרי זה עירוב שהרי ראוי לדירה הוא ובית מיקרי והדר שם בבית העשוי לתבן והוא עשוי מענפי אילנות ומקנים כלומר שאינה בית של קבע אפ״ה בית מיקרי לכל דבר » (בית יוסף או״ח ש״ע) (level 2, section 2); on the gatehouse of the seif, the Magen Avraham writes « אף על פי שיש לו ד' מחיצות כיון שעוברים דרך שם לא הוי דירה » (מגן אברהם ש״ע ס״ק א); on the seif's reason, that they are not considered a dwelling, he adds « וה״ה סוכת החג בחג » (מגן אברהם ש״ע ס״ק ב).
The difference: the Mechaber puts the gatehouse, the portico and the gallery under a single reason: they are not considered a dwelling. For the gatehouse, the Rav writes, in the words of Rabbi Yehonasan that the Beis Yosef reports, that many pass through it to their houses and that it has the status of a courtyard, not of a house; the Magen Avraham, in ס״ק א, writes that people pass through it, without saying many. He adds the festival sukkah, which the Magen Avraham adds in ס״ק ב; and he writes why the straw-house and its like forbid, even when made of reeds — which Rabbi Yehonasan also writes, and which the Mishnah Berurah repeats after him (ס״ק ה, level 1). On the gatehouse of an individual, which the Mishnah Berurah names alongside that of many, the Rav says nothing in seif 1, and this page does not decide: the Mishnah Berurah, writing after him, does not distinguish them, « לא שנא של רבים ולא שנא של יחיד » (משנה ברורה ש״ע ס״ק א); the Beis Yosef explains the Rambam's words on the gatehouse through which many pass by « שהרי בבית שער של יחיד ג״כ דורסין בו רבים כשבאים ליכנס לביתו » (בית יוסף או״ח ש״ע), reads the Tur in this way, « וזה נראה שתופס רבינו עיקר שכתב כאן הדר בבית שער אכסדרה ומרפסת אינו אוסר ולא חילק בין בית שער דרבים לבית שער דיחיד » (בית יוסף או״ח ש״ע), and concludes « וזהו כמו שכתבתי לדעת הרמב״ם והרי״ף והכי נקטינן » (בית יוסף או״ח ש״ע); the Magen Avraham, on the Mechaber's seif 7, writes « אבל בית שער חצר דיחיד אינו אוסר כיון דלא עביד לדירה » (מגן אברהם ש״ע ס״ק י״א); and the Rav, in seif 8, writes of the house through which one passes only to a single inner house « וּבֵית שַׁעַר שֶׁל בַּיִת אֶחָד אֵינוֹ מִתְבַּטֵּל מִתּוֹרַת בַּיִת » (שו״ע הרב ש״ע:ח).
Practical consequence: one who lives in a gatehouse through which many pass to their houses, even if it has four walls, in a portico or a gallery of the courtyard, or in the sukkah during the festival, does not forbid the residents of the courtyard; one who lives in the straw-house, the cattle-house, the storehouse or the wood-house forbids until he makes an eruv (370:1). נקודה ב — תפיסת יד בדברים שאינם ניטלים מחמת כבדן (שו״ע הרב ש״ע:ב)
Point ב — A hold (tefisas yad) through objects not handled because of their weight (Shulchan Aruch HaRav 370:2)
Weight and prohibition
What the Mechaber writes: in seif 2, for the houses the householder lent or rented out, he writes « ויש לו בכל א' מהם דברים שאינם ניטלים בשב' מחמ' כבדן או מחמ' איסור שהם דברים שאסור לטלטלם אפי' לצורך מקומו אין הדרים בהם אוסרים עליו » (שו״ע או״ח ש״ע:ב): weight and prohibition are set side by side.
What the Rav writes: he states the rule for prohibited things alone, « וְאִם יֵשׁ לוֹ בְּכָל אֶחָד מֵהֶם דְּבָרִים שֶׁאֵינָם נִטָּלִים בְּשַׁבָּת מֵחֲמַת אִסּוּר, שֶׁאָסוּר לְטַלְטְלָם אֲפִלּוּ לְצֹרֶךְ גּוּפָם אוֹ מְקוֹמָם » (שו״ע הרב ש״ע:ב); he writes that things which may be moved for their use or for their place do not count, « אֲבָל אִם אֵין לוֹ בָּהֶם אֶלָּא דְּבָרִים שֶׁמֻּתָּר לְטַלְטֵל לְצֹרֶךְ גּוּפָם אוֹ מְקוֹמָם — אֵין זוֹ חֲשׁוּבָה תְּפִיסַת יָד » (שו״ע הרב ש״ע:ב); and he brings weight as an opinion, « וְיֵשׁ אוֹמְרִים שֶׁאִם אֵינָן נִטָּלִין מֵחֲמַת כָּבְדָּן, חֲשׁוּבִין תְּפִיסַת יָד אַף עַל פִּי שֶׁמֻּתָּרִים בְּטִלְטוּל » (שו״ע הרב ש״ע:ב), adding in parentheses « וְיֵשׁ לְהַחֲמִיר בְּזֶה » (שו״ע הרב ש״ע:ב).
What is already found before him: the Mechaber himself sets the condition, « שהם דברים שאסור לטלטלם אפי' לצורך מקומו » (שו״ע או״ח ש״ע:ב); the Rambam names only prohibition, « בַּמֶּה דְּבָרִים אֲמוּרִים בְּשֶׁהִנִּיחַ שָׁם דָּבָר שֶׁאָסוּר לְטַלְטְלוֹ בְּשַׁבָּת כְּגוֹן טֶבֶל וַעֲשָׁשִׁיּוֹת » (רמב״ם הלכות עירובין פ״ד הי״ד), and continues « אֲבָל אִם נִשְׁאַר לוֹ בְּכָל בַּיִת מֵהֶן כֵּלִים שֶׁמֻּתָּר לְטַלְטְלָן הוֹאִיל וְאֶפְשָׁר שֶׁיּוֹצִיאֵם הַיּוֹם וְלֹא יִשָּׁאֵר לוֹ שָׁם תְּפִיסַת יָד הֲרֵי אֵלּוּ אוֹסְרִין עָלָיו » (רמב״ם הלכות עירובין פ״ד הי״ד); the Beis Yosef reports from the Maggid Mishneh « וכתב ה״ה בפ״ד שנ״ל שכל דבר שראוי לטלטלו לצורך מקומו בכלל דבר שניטל הוא » (בית יוסף או״ח ש״ע); on the words « מחמ' כבדן » (שו״ע או״ח ש״ע:ב), the Magen Avraham writes « צ״ע דמה גבול יש לכובד זה דמשוי שקשה לא' נוח לב' ומ״מ כ' דוקא דברים המוקצים ע״ש ויש להחמיר » (מגן אברהם ש״ע ס״ק ג) (level 2, section 3). On the loan, the Rashba's Avodas HaKodesh, which the Mishnah Berurah quotes: « ודוקא כשהשאילן לזמן מרובה אבל אם השאילן לפי שעה אין אוסר עליו בכל ענין » (משנה ברורה ש״ע ס״ק ז) (level 1, section 3).
The difference: the Mechaber's seif names weight and prohibition side by side, « מחמ' כבדן או מחמ' איסור שהם דברים שאסור לטלטלם אפי' לצורך מקומו » (שו״ע או״ח ש״ע:ב); that what may be moved for its use or for its place does not count, the Rambam and the Maggid Mishneh had already written, and the Mishnah Berurah, writing after him, reads it in these last words: « דאם היה מותר לטלטלן לצורך גופן ומקומן אפשר שיצטרך בעה״ב להשתמש בהם בשבת או להוציאן מביתו מחמת איזה סיבה ולא ישאר לו שם תפיסת יד » (משנה ברורה ש״ע ס״ק ט). On weight, the commentators do not read the seif alike: the Mishnah Berurah writes of the heavy object « אף שאין נעשה מוקצה ע״י הכובד » (משנה ברורה ש״ע ס״ק ח), and that it is not taken on Shabbos because of the effort of moving it; the Magen Avraham asks what limit there is to such a weight, then writes « ומ״מ כ' דוקא דברים המוקצים ע״ש ויש להחמיר » (מגן אברהם ש״ע ס״ק ג). In the Rav's text, the main rule is stated for prohibition alone; that an object its weight prevents from being taken counts even though it may be moved, he reports as a view, and he writes in parentheses that one should be stringent in this. The Rav also specifies, in parentheses, that the loan is meant « לִזְמַן, בְּעִנְיָן שֶׁאֵינוֹ יָכוֹל לְסַלְּקָם תּוֹךְ הַזְּמַן בְּעַל כָּרְחָם » (שו״ע הרב ש״ע:ב); the Avodas HaKodesh, which the Mishnah Berurah quotes, limits the loan that forbids to a loan for a long time (ס״ק ז); the Rav, to a loan he cannot take back before the term.
Practical consequence: if the householder keeps, in each of the houses he rented out or lent, things that may not be moved even for their use or for their place, those who live there do not forbid him; things that may be moved for their use or for their place are not enough; for things not handled because of their weight, the Rav writes « וְיֵשׁ לְהַחֲמִיר בְּזֶה » (שו״ע הרב ש״ע:ב). A hold helps only in a house bought, rented or borrowed by him (370:2).
נקודה ג — מלמד, סופר ותלמידים הדרים בבית בעל הבית (שו״ע הרב ש״ע:ה)
Point ג — The teacher, the scribe and the students who live in the householder's house (Shulchan Aruch HaRav 370:5)
Why they do not forbid
What the Mechaber writes: at the end of seif 3 he writes « אבל מי שיש לו מלמד או סופר בביתו וכן תלמידים הלומדים בפני הרב ודרים בביתו כל א' בחדרו אפילו יש לכל א' פתח פתוח לחצר ואוכל וישן בחדרו אינם אוסרים » (שו״ע או״ח ש״ע:ג), without giving the reason.
What the Rav writes: he gives a reason for it, « לְפִי שֶׁאֵינוֹ מַשְׁאִיל לָהֶם רְשׁוּתוֹ לֶאֱסוֹר עָלָיו וְלֹא לֶאֱסוֹר זֶה עַל זֶה, וַהֲרֵי יָכוֹל לְסַלְּקָם בְּכָל עֵת » (שו״ע הרב ש״ע:ה); then, for rooms that are theirs or rented to them, or lent so that he cannot remove them, he writes that they « אוֹסְרִים עָלָיו, אֶלָּא אִם כֵּן יֵשׁ לוֹ בָּהֶם תְּפִיסַת יָד » (שו״ע הרב ש״ע:ה), and adds « וַאֲפִלּוּ הֵם מִשְׁתַּמְּשִׁים בַּאֲפִיָּה וּבִשּׁוּל בְּבַיִת גָּדוֹל שֶׁל בַּעַל הַבַּיִת — אֵין זֶה מוֹעִיל כְּלוּם, כֵּיוָן שֶׁאוֹכְלִים בְּחַדְרֵיהֶם, אֶלָּא אִם כֵּן תַּלְמִידִים הַמְקַבְּלִים פְּרָס מֵרַבָּן » (שו״ע הרב ש״ע:ה).
What is already found before him: Tosafos give two reasons, the second being « ועוד דאין משאיל להם רשותו לאסור עליו ולא זה על זה ומצי לסלוקינהו » (תוספות עירובין ע״ב ע״א), and the Beis Yosef reports them (level 2, section 7). The Taz gives two reasons on this seif, « הטעם כיון שכולם משתמשים בשל בע״ה באפייה ובישול ובכל דבר חשיבי כולהו כאלו אוכלים וישני' במקו' א' ואע״פ שיש להם פתח לצד ר״ה נקראים ע״ש בע״ה » (ט״ז או״ח ש״ע ס״ק ו), and « ועוד דאין משאיל להם רשותו לאסור עליו כ״כ התוספות » (ט״ז או״ח ש״ע ס״ק ו); then he reports « וכתב ב״י שעיקר ההיתר בצירוף טעם השני דוק' ואין לסמוך להתיר משום טעם הראשון במקום שאין שם שייכות טעם השני » (ט״ז או״ח ש״ע ס״ק ו). The Magen Avraham gives the same two reasons in ס״ק ח, and writes of rooms that are theirs « ואם מקום חדרים קנוי להם או מושכר להם ומשתמשין כל א' בפ״ע אוסרין כמ״ש ס״ב » (מגן אברהם ש״ע ס״ק ח). The Beis Yosef already writes that these reasons are needed only to permit where the householder has no hold in the place he lent them: « ודבר פשוט הוא דלא איצטריכינן להני טעמי אלא כדי להתיר כשאין לב״ה תפיסת יד במקום שהשאיל להם שאם היה לו שם תפיסת יד בלאו הני טעמא הוה שרי » (בית יוסף או״ח ש״ע) (level 2, section 7).
The difference: the Mechaber states the permission without its reason. The Taz and the Magen Avraham write the second reason without Tosafos' closing words, « ומצי לסלוקינהו » (תוספות עירובין ע״ב ע״א), as the Biur Halachah notes: « ולכאורה יפלא על הט״ז ומ״א שלא הזכירו בטעם השני רק משום דאין משאיל רשותו כדי לאסור עליו ולא סיימו משום דמצי לסלוקינהו » (ביאור הלכה ש״ע); the Rav gives as a reason only this second one, and with these words: « וַהֲרֵי יָכוֹל לְסַלְּקָם בְּכָל עֵת » (שו״ע הרב ש״ע:ה). Of the first reason, the use of the large house for baking and cooking, he writes that it is of no use when the rooms are theirs, rented to them, or lent so that he cannot remove them, since they eat in their rooms. The Biur Halachah reads his position thus, and identifies it with that of the Rashba and the Ritva: « ודע דדעת הגר״ז דתלוי רק במצי לסלוקינהו והיכי דלא מצי לסלוקינהו משמע מיניה דצריך עירוב אפילו אופין ומבשלין ביחד והוא ממש כשיטת הרשב״א והריטב״א » (ביאור הלכה ש״ע); for his own part, he writes that the two reasons are required only for a loan for a period, « ונראה דעד כאן לא הצריכו תרתי אלא במקום דמשאיל לו לזמן דלא מצי לסלוקינהו בכל שעה » (ביאור הלכה ש״ע), then « וכן מבואר בח״א דהיכי דאיכא תרתי טעמים אפילו השאילו לזמן ארוך שרי אבל היכי דמצי לסלוקינהו בכל שעה כגון שלא השאילו לזמן מיוחד לא יכול לאסור עליו אפילו אופה ומבשל בפני עצמו » (ביאור הלכה ש״ע): according to the Chayei Adam, even a long loan is permitted when the two reasons are combined; and where the householder can remove them at any time, the same sentence continues (after the mention of the Chayei Adam), they do not forbid even if each cooks separately. The Mishnah Berurah writes, without this distinction, « או אפילו בשאול רק שמשתמשין כל אחד בפ״ע בחדרו אוסרין דדוקא בצירוף שני הטעמים ביחד מקילינן. וכ״ז בשלא היה לבעה״ב אצלם תפיסת יד דאל״ה מותר בכל גווני » (משנה ברורה ש״ע ס״ק ל״ג). Two cases show the gap with the Mishnah Berurah as it is written: a lent room that the householder can take back at any time, where each makes his own use — the Rav's seif 5 does not mention cooking in this case, and it is on the Biur Halachah's reading (« וכן משמע מהגר״ז », ביאור הלכה ש״ע) that he does not make them forbid, while the Mishnah Berurah makes them forbid (the Biur Halachah itself limits this requirement to a loan for a period); a room lent for a period, where all bake and cook in the large house — the Rav writes that it is of no use, and the Biur Halachah reports from the Chayei Adam that the two reasons together permit. For rooms that are theirs or rented to them, the Magen Avraham writes that they forbid when each makes his own use (ס״ק ח, which refers to the Mechaber's seif 2); the Rav writes it even when they cook in the large house, as the Beis Yosef had already written: « ואם שנים או ג' אנשים דרים כל אחד בביתו המושכר או הקנוי לו אע״פ שכל הבתים פתוחים לטרקלין ומקום אפיית' ובישולם ותשמישם ביחד נראה דלכ״ע אוסרים זה ע״ז » (בית יוסף או״ח ש״ע) (level 2, section 7). The Rav names the exception of a hold, which the Beis Yosef had already stated and the Mishnah Berurah also writes (see above); he ranks with these rooms the loan he cannot take back before the term — according to the Biur Halachah, this is the very position of the Rashba and the Ritva (see above); and he excepts students who receive a portion from their teacher, as he will explain in seif 7: when there are no other residents in the courtyard or the courtyard's eruv is placed with them or in their teacher's house. On the opening of the rooms, the Mechaber writes « אפילו יש לכל א' פתח פתוח לחצר » (שו״ע או״ח ש״ע:ג), and the Rav « אַף עַל פִּי שֶׁיֵּשׁ לְכָל אֶחָד חֶדֶר מְיֻחָד פָּתוּחַ לֶחָצֵר וְגַם לִרְשׁוּת הָרַבִּים » (שו״ע הרב ש״ע:ה); the Beis Yosef reports that the texts differ on this point, « אלא שבתוס' ושאר הספרים כתבו בין יש להם פתח לרשות הרבים בין אין להם פתח לרשות הרבים ובפסקי הרא״ש כתב לחצר במקום לר״ה ורבינו כתב כלשון הרא״ש » (בית יוסף או״ח ש״ע), and writes that according to the Rosh too it is permitted even if each has an opening to the public domain: « ונ״ל דלהרא״ש נמי אפי' יש לכל אחד פתח פתוח לר״ה שרי » (בית יוסף או״ח ש״ע).
Practical consequence: the teacher, the scribe or the students who live in the householder's house do not forbid, even if each eats and sleeps in his own room, and even if he has no hold in them, since he does not lend them his domain so that they forbid him, and he can remove them at any time; but if their rooms are theirs, rented to them, or lent to them so that he cannot remove them before the term, they forbid him unless he has a hold there, and this even if they bake and cook in his large house — unless they are students who receive a portion from their teacher, when there are no other residents in the courtyard or the courtyard's eruv is placed with them or in their teacher's house (370:5, 7). On the lent room, the Mishnah Berurah (ס״ק ל״ג) does not make this distinction, and the Biur Halachah limits its requirement to a loan for a fixed term (see above): consult your Rav.
נקודה ד — האורח: שלשים יום, הרגיל לקבוע, ואורחים לבדם (שו״ע הרב ש״ע:י)
Point ד — The guest: thirty days, one accustomed to settle, and guests by themselves (Shulchan Aruch HaRav 370:10)
The guest
What the Mechaber writes: in seif 8 he writes « אם לא נתארח דרך קבע אלא לשלשים יום או פחות אינו אוסר על בני החצר » (שו״ע או״ח ש״ע:ח); the Rema adds « ודוקא בדאיכא בעל הבית א' קבוע דאז האורחים בטלים לגביה אבל אורחים ביחד אוסרים זע״ז מיד » (רמ״א או״ח ש״ע:ח); the gloss refers to the end of Siman 391, and then, in square brackets in the edition printed on Sefaria (Maginei Eretz), comes a reference to Siman 384 for a non-Jew who stays.
What the Rav writes: in seif 10 he specifies « וּמִכָּל מָקוֹם אֲפִלּוּ אִם קוֹבֵעַ לְיוֹתֵר מִשְּׁלֹשִׁים יוֹם, אֵינוֹ אוֹסֵר עַד לְאַחַר שְׁלֹשִׁים יוֹם, אֲבָל לֹא תּוֹךְ שְׁלֹשִׁים, אֲפִלּוּ אִם רָגִיל לָבֹא לְכַאן וְלִקְבּוֹעַ לְעוֹלָם לְיוֹתֵר מִשְּׁלֹשִׁים » (שו״ע הרב ש״ע:י); he brings an opinion and then writes the halachah: « וְיֵשׁ אוֹמְרִים שֶׁגַּם יִשְׂרָאֵל הָרָגִיל לִקְבּוֹעַ אוֹסֵר מִיָּד. וּלְעִנְיַן הֲלָכָה, בְּדִבְרֵי סוֹפְרִים הַלֵּךְ אַחַר הַמֵּקֵל » (שו״ע הרב ש״ע:י); for guests by themselves he writes « אֲבָל אוֹרְחִים לְבַדָּם בְּיַחַד אוֹסְרִים זֶה עַל זֶה מִיָּד אִם יֵשׁ לְכָל אֶחָד חֶדֶר מְיֻחָד לַאֲכִילָה » (שו״ע הרב ש״ע:י); and, where the community makes eruvei chatzeiros at the beginning of the year for the whole year, he writes « אֵין הָאוֹרְחִים הַמִּתּוֹסְפִים שָׁם אוֹסְרִים עֲלֵיהֶם וְלֹא זֶה עַל זֶה, מִפְּנֵי שֶׁלֵּב בֵּית דִּין מַתְנֶה עֲלֵיהֶם שֶׁיְּהֵא לָהֶם חֵלֶק בָּעֵרוּב » (שו״ע הרב ש״ע:י).
What is already found before him: the Magen Avraham writes on guests by themselves « ודוקא שיש לכל א' חדר מיוחד לאכילה כמ״ש ס״ג » (מגן אברהם ש״ע ס״ק י״ב), and reads in the Rema « משמע דס״ל לרמ״א דבישראל אפי' רגיל אין אוסר עססי' שצ״א » (מגן אברהם ש״ע ס״ק י״ב) — the reference to the end of Siman 391, where Jews passing through who lodge in another courtyard do not forbid, « דאורח אינו אוסר » (שו״ע או״ח שצ״א:ב); the Taz infers from the seif « משמע ביותר מל' יום אוסר » (ט״ז או״ח ש״ע ס״ק י), and writes « במקום שיש קהל ועשו עירובי חצירות בע״פ כדרכינו אז פטור גם בזה כיון שלב ב״ד מתנה על כל שיתוספו דיורים » (ט״ז או״ח ש״ע ס״ק י).
The difference: here is, among other things, what the Rav's text writes and what the Mechaber's seif and the Rema's gloss do not write at this place (the gloss also refers to the end of Siman 391, which deals with Jews passing through who lodge in another courtyard and do not forbid because a guest does not forbid, and says nothing of the length of stay or of the community's eruv; it is to this reference that the Magen Avraham ties his reading of the Rema on the accustomed Jew): that a guest who settles for more than thirty days forbids only after the thirty days — the Taz infers from the seif that more than thirty days forbids, and the Rav writes from when; the Mishnah Berurah, writing after him, writes « ומסתברא דאם קבע עצמו לכתחלה יותר משלשים אוסר מיד » (משנה ברורה ש״ע ס״ק נ״ה): on a guest who settles from the outset for more than thirty days, the two texts do not agree; that after thirty days he forbids « אִם הוּא בְּעִנְיָן שֶׁאֵינָם יְכוֹלִים לְסַלְּקוֹ תּוֹךְ מֶשֶׁךְ זְמַן שְׂכִירוּתוֹ אוֹ שְׁאֵלָתוֹ » (שו״ע הרב ש״ע:י) — the Mishnah Berurah says that beyond thirty days he forbids « אפילו אם היה רק בשאילה לבד » (משנה ברורה ש״ע ס״ק נ״ה), without this condition, and we have not looked for a source before the Rav for it; the opinion that a Jew accustomed to settle forbids at once, and the rule of following the lenient view in rabbinic matters — the Magen Avraham already read in the Rema that a Jew, even an accustomed one, does not forbid; the condition of a room of one's own for eating, when the guests are by themselves, which is the Magen Avraham's; and the exemption where the community makes the eruv at the beginning of the year for the whole year, which the Taz writes for the eruv made on Erev Pesach, as was the practice in his time (« בע״פ כדרכינו », ט״ז או״ח ש״ע ס״ק י).
Practical consequence: a guest staying thirty days or less does not forbid; after thirty days he forbids if he cannot be removed for the length of his rental or loan, and even if he settled for longer, he does not forbid before then (the Mishnah Berurah considers it reasonable, « ומסתברא » (משנה ברורה ש״ע ס״ק נ״ה), that one who settles from the outset for more than thirty days forbids at once: consult your Rav); for a Jew accustomed to settle, the lenient view is followed; a non-Jewish lodger accustomed to settle forbids at once (Siman 384); guests by themselves, each with his own room for eating, forbid one another at once; where the community makes the eruv at the beginning of the year for the whole year, guests who are added do not forbid (370:10).

The practical Chabad conduct
Points of halachic conduct that flow directly from the Shulchan Aruch HaRav Siman 370, in the Chabad sensibility, in the order of its seifim. The seif numbers are the Rav's.
For the Chabad Chassid — Siman 370
- ① What counts as a dwelling: one who lives in a gatehouse through which many pass to their houses, in a portico or a gallery of the courtyard, or in the sukkah during the festival, does not forbid the residents of the courtyard; one who lives in the straw-house, the cattle-house, the storehouse or the wood-house forbids until he makes an eruv, even if they are made of reeds. See section 2; for the gatehouse of an individual, which the Rav does not address in seif 1, consult your Rav. Reference: Shulchan Aruch HaRav 370:1.
- ② Rented or lent houses, and a hold: houses the householder rented out, or lent for a period without being able to remove their occupants before the term, forbid him until an eruv is made, unless he keeps in each of them things that may not be moved even for their use or for their place; for things not handled because of their weight, the Rav writes « וְיֵשׁ לְהַחֲמִיר בְּזֶה » (שו״ע הרב ש״ע:ב); a hold helps only in a house bought, rented or borrowed by him (370:2). The Rav then brings an opinion that a hold helps only if there are no other residents in the courtyard, or if their eruv is placed in his house or in one of those in which he has a hold (370:3); and for a residence rented from a non-Jew and shared with a fellow, the hold helps the renter only if he first rented it for himself (370:4). Reference: Shulchan Aruch HaRav 370:2-4.
- ③ A hall divided by partitions: partitions that reach the ceiling or come within three tefachim of it, even temporary ones, make each part a room, and each group gives its eruv when the courtyard's eruv is placed with other residents, or in another courtyard that made an eruv with this one; if it is placed in the hall, or there are no other residents, none is needed, since they are only temporary partitions; partitions that do not reach the ceiling: one eruv for all; all this, the Rav writes, « וְכָל זֶה כְּשֶׁעָשׂוּ מְחִצּוֹת עֲרַאי לְפִי שָׁעָה » (שו״ע הרב ש״ע:ה): actual rooms opening onto the courtyard forbid one another even without other residents, and each group gives an eruv even if the eruv is placed in the hall; if only the outer one opens onto the courtyard and all pass through it, only the two inner ones give an eruv; for the teacher, the scribe and the students, see section 2. Reference: Shulchan Aruch HaRav 370:5.
- ④ The place of the meal: the people of a courtyard who all eat in one house on Shabbos, even each of his own and at his own table, do not need an eruv; with another courtyard, they bring one bread, which any of them may give, even members of the householder's household, of their own; a curtain spread at times for modesty is not a partition, even if it reaches the ceiling; one who eats in one courtyard and lives in another forbids where he eats, if he eats there on Shabbos. Reference: Shulchan Aruch HaRav 370:6.
- ⑤ The portion (peras): brothers who have houses in their father's courtyard and receive a portion from their father — bread, or money to buy it — and eat at home each give his eruv, their father included, when the courtyard's eruv is placed with one of the other residents; if there are no other residents, or the eruv is placed with one of the brothers or with their father, none is needed; likewise wives, slaves and students who receive a portion. Reference: Shulchan Aruch HaRav 370:7.
- ⑥ Houses one inside the other: ten houses one inside the other, of which only the outer one opens onto the courtyard: only the two inner ones give an eruv. Reference: Shulchan Aruch HaRav 370:8.
- ⑦ The guest: a guest staying thirty days or less does not forbid, even in a separate house where he eats and sleeps, and many guests are subordinate to a single householder; the Rav also brings the opinion that a guest lodged in a house or room by himself is not subordinate to the householder, and according to which « אֲבָל לְטַלְטֵל מִבֵּית הָאוֹרֵחַ לֶחָצֵר — אָסוּר בֵּין לוֹ בֵּין לְבַעַל הַבַּיִת, שֶׁכֵּיוָן שֶׁהִשְׂכִּירוֹ לוֹ בַּיִת זֶה לְאֵיזֶה זְמַן, שְׂכִירוּת לְיוֹמוֹ מִמְכָּר הוּא וַהֲרֵי זֶה בַּיִת שֶׁלּוֹ » (שו״ע הרב ש״ע:ט); he adds in parentheses « וְהוּא הַדִּין אִם הִשְׁאִילוּהוּ לוֹ בְּעִנְיָן שֶׁאֵינָם יְכוֹלִים לְסַלְּקוֹ תּוֹךְ מֶשֶׁךְ זְמַן שְׁאֵלָתוֹ » (שו״ע הרב ש״ע:ט) (370:9). For the rest — after thirty days, one accustomed to settle, guests by themselves, the eruv made for the whole year — see section 2 (370:10). Reference: Shulchan Aruch HaRav 370:9-10.
